We needed an attorney to help us with termination of parental rights and step-parent adoption. Shelby Sims Harper knew it was a dangerous situation from the beginning and it never stopped her from trying to help us. We started the process in September of 2022 and finalized in May of 2023. Our family will never be able to thank her enough for all that she did for us!

He spoke down to me. He did absolutely NOTHING for my custody case, He prolonged me seeing my children for seven months before I finally got a real lawyer who does their job. In five weeks after hiring another attorney I was reunited with my kids AND under the terms I wanted. Rian literally laughed in my face and told me that wouldnt happen. FIRED AND NEVER RECOMMEND HIM TO ANYBODY THAT I ACTUALLY CARE ABOUT. Smug and arrogant jerk

I hired Than to represent me in my divorce case. He seemed knowledgeable, available and willing to go to bat for me at first. Then after receiving my retainer, it would take him a week to respond to emails. He became interested in taking the path of least resistance and even after communicating serious concerns about my former spouse, he acted nonplussed. It came to the point where I felt as if I had to convince him to stand up for my rights, rather than him looking for ways to represent me. Unfortunately, I had to fire him when it became clear he had a previous working relationship with another attorney who was representing my ex spouse, which caused a conflict of interest. Even after I fired him and he filed the papers to withdraw representation on my case, he still was in contact with the attorneys representing my ex spouse. Rian, on two separate occasions, attempted to reinsert himself into my case and handled my personal and financial information with other parties. This lead me to have to reach out to the Missouri and Kansas State Bar associations. I cannot in good conscious, recommend Rian as an attorney.

There are three recordings of this guy on Reddit and apparently more to come. One is him encouraging his client to lie about the level of activity they could do. The other is the hearing where he asked the judge two questions and made fun of his client in front of the judge. Last is him not taking the appeals council appeal even though his client had literally almost died. This guy only wants your Social Security money with minimal effort. Lots of people who hear these recordings are reporting him to the Bar association

I just listened to the recording of the trial with the administrative disability judge. This lawyer is a joke. He must just think that putting the name of a lawyer on the disability case makes it win. Because he did nothing. He asked two questions and even put my buddy down in front of the judge. That recording is on Reddit. I should’ve represented my friend. The only thing this lawyer did was get records which anybody can do with one phone call to any medical facility. I have reported this guy to the Bar association on my friends behalf. Just do your case yourself or just a random friend instead of this guy.

I managed to talk to Chris two times in a year that I had him hired. His pretrial preparation was worthless. His pretrial briefing was garbage. The briefing I wrote to him to take my trial was better. He asked two questions during the hearing, neither of which the judge cared about or used in his decision. I lost my case because I hired Chris instead of doing it myself. Don’t make your illness or disability worse by hiring this guy and giving him any of your money.

This gentleman and his office made major mistakes in my case. They neglected to file important paperwork in a timely fashion. This caused me additional unnecessary damages and financial hardship. We had several doctors complain that he would not call them back after numerous attempts to get in contact with him. Corey’s office would ask me to do many things that his office should have done. For example, he asked me to get a letter from a doctor. The doctor was not sure what exactly was needed. The doctor asked Corey to contact him. After several weeks, the doctor said Corey still hadn’t contacted him, even though we provided the doctor’s contact information several times to Corey and kept reminding him. He made me do a great deal of extra work and made me spin my wheels. We also didn’t get to speak with him until after we hired him. Before that, we had to interview with several assistants, Briana and April. These representatives gave us conflicting information and then I was treated poorly for following their instructions. Then we were transferred to a paralegal in another state. Hiring this firm was the worst decision of my life and I can’t in good conscience recommend Corey to anyone. I’m embarrassed to bring this up, but his hands were shaking with nerves in the courtroom.

Avoid these attorneys at all costs. I was a customer for 10 years, my original attorney left and we decided to stay. The new attorney makes me extremely uncomfortable. We asked him to help with a simple lease assignment. He ended up bringing on an additional attorney, charged us almost $10,000 for a very common/simple review. We did not ask for 2 attorney's to review this. When communicating with the attorneys they go out of their way to drag out conversations, they act like they don't comprehend what you say and then draw out the conversations to make it look like they actually were getting work done. Most recently, we were potentially acquiring another unit in our franchise. I specifically told them NOT to file paperwork or work on this. Today, we received a bill where they want to charge us for the work I specifically told them not to do. And to top it off, they are claiming that both attorney's put work in on this when they were told not to. I would not trust this company, it seems like have lost their principles, lack transparency, and are deceitful in their practices.

Hired Mr Pekas in 2008 disability claim, I had all my doctors submitted forms/records all supported me, hereditary connective tissue disorder, brain stem compression and more isssues. It is NOT normal to be stuck in the disability application system for 8 YEARS!! I did NOT know that, as I had trusted the Fiduciary/attorney I hired!BIG mistake! Do you know that az arizona has a Rule that Attorney can NOT take more than $6000 fee for disability case? I did NOT know! Well NOW it makes sense WHY i was stuck for 8 years. MONEY!! $6000 fee versus 25% of hundreds of thousands of $$ fee. SHAMEFUL! behavior. My Geneticist I saw in 2015 asked me WHY i had not been approved for disability(as her other 3000 patients with this rare disorder ALL had been approved within 6 to 12 months of their applcation. SHE told me it is fishy and NOT right and to CONTACT my Senator. Bless her! I DID just that. and Bless Senator Mc, who assited me by contacting the Administrative Law judge in dissability division, I was approved shortly after that. Seems, a LOT of my medical records, Doctor forms etc had NOT been submitted, so that is why I kept getting denied( on my final 3rd? appeal/8 years in system!!) of course Mr pekas(with Caldwell Ober in 2008 when I hired him) tried to get 25% of the aprx $150k award(back from 2008 to date approved) even though small monthly $ add up over 8 years!) With Senator help Judge saw what was going on GREED and denied Mr pekas attempt to get the aproximate 30k. These are the facts. ALL medical records gathered by a claimant should be submitted in order to get approved, No attorney should leave any of them out , when asked to submit by a client/claimant.

After getting a denial of my claim from Social Security, I called Mr. Pekas after reading his reviews. I spoke to his assistant on the telephone. She scheduled an appointment for a telephone interview - not to see Mr. Pekas in person. On the appointed date and time, I got the call. It was from the same assistant who asked me a series of questions and subsequently declined to represent me, siting that I was one quarter short and my last day insured was too early. She suggested I could go back to work an additional quarter and maybe I would qualify after my last day insured is updated. I checked with Social Security and confirmed their information was outdated. I got corrected information and Called Mr. Pekas' assistant back, leaving her a detailed message. She never returned my call. I then found another attorney who brought into his office for a consultation, reviewed the same information. This other attorney said he was confident he could help. I hired him instead of Mr. Pekas. Lesson - Attorney should be involved in intake review.

After having a bad experience with my personal injury lawyer and without any referral, I didn't expect much when I called the office of Ober & Pekas, PLLC. However, Jeremy Pekas put me at ease from the very beginning when we first met. He was very reassuring, honest and professional. He explained all my options and laid out a timeline for the entire process. Jeremy handled my case very caring and professionally. He was also very prompt with his replies to my questions. My SSDI case was settled much sooner than I expected. I couldn't be happier & am so thankful to Jeremy for taking my case. I would highly recommend Ober & Pekas, PLLC to anybody looking for Social Security benefits. When you are unable to work due to your illness & physical conditions, the last thing you need is having more disappointments & frustrations. Jeremy Pekas is an attorney you need who is experienced, ethical, caring, and passionate. I wish there're more lawyers like Jeremy.

Now I just lost ANOTHER $5,000 because he petitioned for more money which I find absolutely ridiculous! Don't hire him unless you want $12,000 of your own money given to him instead of you. I tried for years to get SSI for my adult daughter who has a disability. No attorney would help me. Every attorney I went to would turn me down. One day, a friend referred me to Attorney Justen E Grech. She said, “He will help you.” I told her, “No he will not. He will be like all the other attorneys that would not give me a moment of their time.” To make a long story short, to my surprise, when I called him via telephone, he listened to me and scheduled an appointment to meet me and my daughter at his office. Nevertheless, I still had the belief that he will not help us. On the contrary, he did! My first meeting with him was very professional and courteous. He treated me and my daughter with great respect. He listened to my despair and anguish; and at the conclusion, he said, “I will help you…I never lost a case.” I wanted to cry with joy. Finally, there is a person who cares. It took years to find him, but I am so glad that journey is over. He did not abandon us; he represented us to the very end. If I had any questions, he made himself available to answer. Attorney Justen Grech was true to his words, that he never lost a case…he WON ours!!! If you are looking for Attorney that will sincerely help you, Justen E. Grech is that person. Thank you Attorney Justen E. Grech for your time and effort. – From: Raven and Crystal

Patrick McGraw was literally heaven sent! I had been battling a nasty custody fight with my child's father for 10 years! After 5 lawyers, 4 guardian ad items and $6,000+ later...NOTHING ever got ruled in my favor. I'm a single mother with limited financial resources. I needed a 'NO NON SENSE" type of lawyer who would not only listen to me but take me and my dollar seriously! Patrick is also organized, knowledgeable of the law and has experience! He did not waste anytime on my case! He filed subpoenas and other court documents ON TIME! He kept it real with me at all times regarding the details of my case. Regardless of how ugly it was, he was HONEST! He worked with me when it came time to pay him. He didn't try to 'price gouge' me or make it about money. When I first hired Patrick, by the time I explained to him what was all done to me and how my son was suffering as a result, Mr. McGraw already could see through what was happening and how I got 'railroaded'. This Lawyer has the discernment and experience to see through foolishness! Again, this is what makes him a 'no-nonsense' lawyer. As a result of his assertiveness and doing his due diligence, I FINALLY WON A LONG AWAITED CUSTODY BATTLE! It was a breeze!!! I wish I would've known about him years ago, because I know that I wouldn't have had to go through so many horrible lawyers. If you want a lawyer who will stand up for what is RIGHT & FOR YOU?? CALL PATRICK MCGRAW!!! He represents what a TRUE LAWYER IS!

They charge you ,tell you what you wanna hear. Then when it comes time to hold them to what they said , they backtrack and change what was originally stated, they build you up to think you have a case, and that you just need to wait for this 1 or 2 things to happen/not happen and when those events come ,he turns around and tells you sorry I can't do anything now good luck, even though its what he initially told you to wait for, for your case . This law firm will tell you just about anything to get you off the phone. I was told different answers by more than one representative and none of them ended up being correct. After speaking with the owner, my understanding of what had transpired improved but I still was not satisfied with how I was treated. Another point is if you schedule a phone appointment with them, you are required to call in and wait until they are ready. You are paying for the services his staff should call you, since you are the paying client when they are ready to speak. This makes you feel unimportant and like you have nothing else better to do than to wait for them. I wouldn't recommend this firm and I hate writing this but it is important for everyone to get all sides of their performance. Maybe I was not an important enough client but I thought the lawyer should be treating each case with the same effort and energy.

GET THERE BEFORE 3:45pm OR GET A DOOR SLAMMED IN YOUR FACE. I just had a terrible interaction with one of the clerks that works there that shut the door in my face, literally, I could have stuck my hand out to stop it, but I didn’t. So I knocked. I was informed they close at 3:45. “I don’t get paid after 4” is what she told me. Their website says nothing about closing at 3:45pm. The person I talked to on the phone this morning said they’re open 8am - 4pm. This has been a negative experience made especially awful thanks to an incredibly rude worker. I hope you can find better staff in the future.

What a Social Security & Disability Lawyer Can Do for You

A Social Security and Disability lawyer specializes in helping individuals navigate the complex process of applying for and securing Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI) benefits. These lawyers assist clients in filing applications, gathering necessary medical evidence, appealing denied claims, and representing them in hearings before administrative law judges. A lawyer can help maximize the chances of approval by ensuring that the paperwork is accurate, deadlines are met, and legal standards are addressed.

If you are disabled and unable to work, or if your Social Security Disability claim has been denied, a Social Security and Disability lawyer can guide you through the legal process to obtain the benefits you’re entitled to.

When Should I Hire a Social Security & Disability Lawyer?

You should consider hiring a Social Security and Disability lawyer in the following situations:

  • Applying for SSDI or SSI benefits: The application process for disability benefits can be complex, with strict requirements and documentation. A lawyer can assist in completing the application correctly and submitting the required medical evidence to improve your chances of approval.
  • Denied disability claim: If your initial claim for SSDI or SSI benefits has been denied, a lawyer can help file an appeal and represent you in hearings. Many claims are denied initially, and having legal representation during the appeal process significantly increases the chances of success.
  • Requesting reconsideration: After an initial denial, you have the right to request reconsideration of your claim. A lawyer can help present new medical evidence or correct any errors in your original application.
  • Hearing before an administrative law judge (ALJ): If your reconsideration request is denied, you may request a hearing before an ALJ. A lawyer can represent you during the hearing, preparing you to answer questions and presenting a strong case based on your medical and work history.
  • Proving medical conditions: If your disability involves complex medical conditions, a lawyer can help gather expert medical testimony or additional evidence to demonstrate that your condition meets the legal criteria for disability.
  • Overpayments and cessation of benefits: If the Social Security Administration (SSA) claims you were overpaid or attempts to terminate your benefits, a lawyer can assist in challenging the decision and protect your right to continue receiving benefits.
  • SSI for low-income individuals: If you are applying for SSI, which is based on financial need in addition to disability, a lawyer can help ensure that your financial records are correctly submitted to meet SSA’s strict income and asset limits.

Hiring a lawyer early in the process can help you avoid mistakes that could delay or jeopardize your claim.

What Does a Social Security & Disability Lawyer Do?

A Social Security and Disability lawyer provides a range of services to help individuals navigate the application and appeals process for SSDI or SSI benefits. Their responsibilities often include:

  • Filing initial applications: A lawyer can help prepare and file your SSDI or SSI application, ensuring that all necessary forms are completed accurately and medical evidence is included.
  • Gathering medical evidence: A lawyer works with your doctors and healthcare providers to collect medical records, treatment histories, and expert opinions to support your disability claim.
  • Filing appeals: If your initial application is denied, a lawyer can file an appeal and guide you through the reconsideration process, ensuring that any additional documentation or evidence is provided.
  • Representing you in hearings: A lawyer will represent you in front of an administrative law judge, helping you prepare for the hearing and arguing your case to demonstrate that your disability prevents you from working.
  • Handling deadlines and paperwork: A lawyer will ensure that all deadlines are met, and that any requests for additional information from the SSA are responded to promptly.
  • Negotiating settlements (for private disability insurance claims): If your disability benefits claim involves private disability insurance (in addition to or instead of SSDI/SSI), a lawyer can help negotiate a fair settlement with the insurance company.
  • Fighting benefit terminations or overpayment claims: If the SSA attempts to terminate your benefits or claims you were overpaid, a lawyer can defend you in administrative proceedings or file for a waiver or reconsideration.

How Are Social Security & Disability Lawyers Paid?

Social Security and Disability lawyers are typically paid on a contingency fee basis, meaning they only get paid if your case is successful, either through the approval of your disability benefits or winning an appeal. Here's how it generally works:

  • Contingency fee: The fee is usually 25% of your past-due (backpay) benefits, but no more than $7,200. This fee structure is set by the SSA, and lawyers cannot charge more than this amount for SSDI or SSI cases.
  • No cost for future benefits: Lawyers are not entitled to any portion of your future monthly disability benefits. Their fee is strictly limited to a percentage of your backpay.
  • Additional costs: In some cases, you may need to pay for additional expenses, such as obtaining medical records or expert witness testimony. These costs are usually minimal, but it’s essential to ask your lawyer about any additional expenses upfront.

It’s essential to confirm fee arrangements with your lawyer during the initial consultation to avoid misunderstandings.

How Much Does a Social Security & Disability Lawyer Cost?

The cost of hiring a Social Security and Disability lawyer is typically structured around the contingency fee system outlined by the SSA. General cost information includes:

  • Contingency fee: The lawyer’s fee is capped at 25% of your backpay, with a maximum of $7,200. For example, if you are awarded $10,000 in backpay, the lawyer will receive $2,500 (25%), and you will receive the remaining $7,500.

Overall, there is no financial risk in hiring a Social Security and Disability lawyer, as they only get paid if your case is successful.

Top Questions to Ask a Social Security & Disability Lawyer

Before hiring a Social Security and Disability lawyer, it’s important to ask the right questions to ensure they have the experience and expertise to handle your case effectively. Key questions to ask include:

  1. What experience do you have with Social Security Disability cases?
Ensure the lawyer has experience handling SSDI and SSI cases similar to yours, particularly if you have a complex medical condition.
  2. How do you charge for your services?
Confirm that the lawyer charges a contingency fee and that you won’t owe any fees unless your claim is successful. Ask if there are any additional costs for medical records or other expenses.
  3. What is the likelihood of success in my case?
Ask the lawyer for an honest assessment of your case and the potential challenges you may face.
  4. How long will the process take?
Disability claims can take time, especially if you’re appealing a denial. Ask the lawyer how long they expect the process to last and what the typical timeline is for cases like yours.
  5. How will you help me prepare for my hearing?
If your case is going to a hearing before an administrative law judge, ask the lawyer how they will help you prepare for testimony and present your medical evidence effectively.
  6. What happens if I’m denied again?
Ask about the next steps if your reconsideration or appeal is denied, including the possibility of further appeals to federal court.

How to Check the Credibility of a Social Security & Disability Lawyer

To ensure you are hiring a reputable Social Security and Disability lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice law and has no history of disciplinary actions.
  • Look for Social Security experience: Review the lawyer’s website or profile to ensure they specialize in Social Security and Disability law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on Social Security Disability matters.
  • Check for memberships in relevant organizations: Membership in organizations like the National Organization of Social Security Claimants' Representatives (NOSSCR) can indicate that the lawyer is committed to representing disability claimants.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a Social Security and Disability lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Medical records: Bring copies of your medical records, including doctor’s notes, test results, treatment histories, and any disability-related diagnoses.
  • List of medications and treatments: Provide a detailed list of any medications you are taking, treatments you have received, and ongoing medical care related to your disability.
  • Denial letters (if applicable): If your disability claim has been denied, bring a copy of the denial letter from the SSA, along with any documentation related to your appeal.
  • Work history: Provide information about your previous jobs and work history, including details about how your disability has impacted your ability to work.
  • Social Security application (if already filed): If you’ve already submitted an application, bring a copy of the application and any correspondence you’ve had with the SSA.
  • List of questions: Prepare a list of questions you have about the legal process, the lawyer’s fees, and what to expect in terms of timelines and outcomes.

By preparing thoroughly for your consultation, you can help the lawyer assess your case more effectively and provide the best possible legal advice tailored to your situation.
