My boyfriend and i wanted to put me on one of his deeds with a mortgage. I am already on the deed where we currently live. Ken kept stating what a generous gift my boyfriend was giving me and he had dealt with plenty of divorces. We flat out told him i was divorced and my boyfriend has no children it is what we want considering we aren't getting married but have been together for 25 years. Ken had me leave the room to talk to my boyfriend privately for 20 minutes. When my boyfriend came out he said Ken says for us to do a life lease. WHAT A JOKE. Ok so apparently he sees me as a gold digger. If thats the case then i would just be happy with my boyfriend's three 401ks that i am 100 beneficiary including the other deed i am already on. We wanted just a simple quick claim deed done and he just didn't want to do it. This guy was a jerk and rude. Also, floor was not vacummed and his secretary was walking around with no shoes. Very unprofessional!

this attorney was part of a bankruptcy firm I went to after I was divorced in 2012. One of my main concerns was what I was court ordered to pay my ex. I asked this attorney if I declared chapter 7 if it would discharge all debt and she assured me it would. However I found out now that it never discharged debts owed during dissolution, so ironically it discharged a debt I had been paying on but not the ex and so now I am facing even more financial and dissolution hurdles.

I RETAINED HELEN TO REPRESENT ME ON A CHAPTER 13 BANKRUPTCY. SHE MADE PROMISES OF DEBTS THAT WOULD BE INCLUDED THAT WERE NOT AND ULTIMATELY COST ME MORE TIME AND MONEY TO ATTORNEYS TO ASSURE MY FINANCIAL FUTURE WAS ACCOMPLISHED WITH THE SET PURPOSE OF FILING BANKRUPTCY. I SENT DOCUMENTS MULTIPLE TIMES THAT WERE LOST, HAD TO RESEND THOUGH I HAD CONFIRMATION. WE WERE IN COURT AND SHE WAS TOLD OF SEVERAL MISTAKES IN HER PETITION THAT NEEDED TO BE CORRECTED BEFORE MY CASE COULD MOVE FORWARD. MOST DISTURBING IS SHE DID NOT ADVOCATE FOR WHAT SHE PROMISED. AND THEN UP AND LEFT THE LAW FIRM SHE WAS WORKING AT WITHOUT NOTICE.

She has been my husband's attorney for years and we have had no results. She does not ever contact us unless we get very upset and rude and then she only contacts him to smooth it over. If you require an attorney for VA benefits do not use Mrs. Welch. It has been 4 or 5 years and she has done absolutely nothing. She does not respond to calls, text, messenger or emails. She does to give any updates unless we force the issue. Run in a different direction if you see her. Our opinion is that we should have never hired her. She will not give a letter of release if she is fired according to her website. So if you hire her you are stuck with her and her ineffective business practices.

I was recommended Shellana Welch by a fellow veteran. She was very pleasant for the first month. Once she solidified her position as my VA attorney, I never heard from her again. I've emailed and called her multiple times with no response. I had not heard from her in a year. Despite her lack of assistance, I reached 100% on my own. Unfortunately, she still gets a portion of my backpay because she refused to remove herself from my case. I feel awful because I trusted her to help me and in the end, she scammed me.

Cullen was hired based on a referral from Tessa. I had been assaulted by my spouse, who was a former special forces operative and had tried to strangled me to death with our kids in the house. I had very little experience with attorneys. I was in shock and had no family to support me. Leading up to my permanent protection order hearing, I offered over and over if we needed witnesses or documents submitted. There was the woman who had met me at the hospital. The officer who made the arrest and others who had been involved. Cullen was dismissive and said it wasn't needed. She also never informed me of my rights as a victim of a violent crime. My assailant mocked me as I shakily gathered my belongings after going through security. When Cullen arrived for my hearing, she failed to even bring my file. She was disheveled and had nothing prepared. She asked if she could borrow my personal file. She told me to call my 19 year old daughter, who was watching her younger siblings and ask her to come testify. She scrambled to find a sitter and get there asap. A DV advocate who had worked with me was there for another hearing and on the spot, Cullen asked her to testify. It was completely haphazard. The judge even commented that Cullen was unprepared and offered to extend the protection order but stated that there had not been enough evidence presented by Cullen to justify a permanent order. I paid this woman a substantial amount and she failed to even show up with my file. It was an awful experience.

The very first conversation I had with this lady not just showed me a flicker of hope but also that I'm not as invisible as I feel. She has shown me that someone will listen and someone will hear you. I have no doubts in my mind that this lady will represent me to the capitol letter of her name as long as I show that I am worth fighting for. That 1 star review I read comes from anonymous... Seems like you were a coward afraid to fight for yourself or even let your name be known. I hope you learn and grow from this and make better decisions in the future.

Horrible representation used her for my divorce and she had her own agenda did not listen when I explained safety concerns regarding my ex and our child. My family had to go through probate and we were unjustly price gouged. I would never recommend this firm for setting up a will or having them go through probate for your family. Truly sad, as this person was originally thought to be close to a past relative. They will complicate everything and you are forced to do the majority of the work while they rake in the money. A very despicable firm.

I wasted 7 months of waiting for Elizebeth to do anything. I contacted Elizabeth back on October 2023 in reference to having her take my case so I could apply for TDIU. During that she recommended that I should apply for a multitude of claims in what appeared to be shot gunning in hopes that something will hit instead of carefully calculating my claim. During my time I could hardly get in touch with her and much of her communication was sparce at best. When attempting to contact her, I could never call, and I had to leave messages with her voice answering service. When I did leave these messages, she would never return them. There was one time she even forgot who I was. If I asked questions, she would give me only generic answers to questions that I already knew not answering the actual questions that I had asked. When I would email her, it would take days for her to respond, and I would sometimes have to send follow up emails for her to respond. When my claims were filed, she applied for an increase in two claims that I had reservation about in that I knew it was almost a certainty that they would be denied. When asked why they were applied for, she stated that this was necessary to be applied for my TDIU. I asked would the VA reduced my already current rating to which she said it would be very very unlikely. Well, I got my letter today and guess what? My rating was reduced! In something that she stated wouldn't be a problem. Along with this, I asked her about a claim that was approved through her and the compensation that would come with it and she stated that would take the VA a little for it to process and then I would receive it. However, when the payment never came, I contacted the VA to ask why, and they stated that my claim never went over my current rating to begin with. SOMETHING THAT SHE SHOULD HAVE KNOWN! Lastly, I began looking at many of the documents that had been sent to the VA via evidence and began noticing that much of the evidence that the VA had asked for had been submitted by me and not her. Many of the evidence records to support my claim had only been submitted by me and not her, and I had noticed that she only submitted paperwork to begin the claim. No other documents had been submitted by her unless I confronted her about it. When I confronted her about all these issues, and demanded her to give me periodic updates, she withdrew as my attorney and stated she was not the attorney for me but still demanded the VA pay her for the " work" she did. In closing, it appears that Miss Lunn is not the attorney for anyone. She talks a good game, but when it comes to the complete dynamics of the VA, she knows nothing, If you noticed that many of these reviews on here are from 2016 and 2017 and not up to date. She will take your money and she will do barely any work to accomplish it. You will have to do it. I literally could have done this myself with no jeopardy of having my rating reduced. Now I have to deal with that issue because of her. Save yourself some time, DO NOT HIRE HER!

We have called more times than I can count. It’s always the same thing...we will let him know. He is never in his office and never returns called. I had troubles finding a disability lawyer to take my case not because of my conditions, but because of my age. She prepared me by letting me know that it will take some time because of my age but my conditions qualified me and was very confident that I would win my case. She was prepared every corner in my fight and worked around that I lived in a rural area not easily accessible of making trips to her office for hearings, paperwork and any other issues that may have arised. I really am grateful for all her support and hard work. I recommend her highly for fighting for disability.

I had a very bad experience with Mr Edmonson, I found him to be very lazy, unprepared for my workerscomp case, exaggerates on value of case, unprofessional and a hot head. Here's what happen with my case, he didn't correct my end of employment date for social security knowing the date was incorrect (this resulted in delay of my SS benefit for over 5 months) he closed my case out on his end for social security for months(result- no-one knew what was going on with my case, i only learned when i called and asked for a update) I never Knew where my case standing, when i called he simple said I don't know. Now for workers comp case. He was so unprepared did not fight for me at all. He simply went with whatever the opposite attorney said, if he uses the phrase ( IF i did my math right) be ready to be greatly disappointed. It was a complete joke . let's address the hot head issues. When i questioned him why my case was closed without receiving SSB or notification of any kind from social security that it was closed he became outraged. what he did was quiet then decided that wasn't a good idea. I kept him only because i was close to two years with him other wise i would have fired him on the spot. I would also ask John if he has the resources to hire professional medical wittnisses for your worker's Comp case. You may find out he doesn't. I could keep going but it would take to much of my time. Conclusion: If your looking for a lazy, unprepared for your case, exaggerates, a hot head and never follows up on anything kinda of attorney this would be a good one to hire.

There was a depth of comfort upon meeting John Edmonson for the first time; immediately followed by him illustrating his knowledge of my circumstances and needs and how the law applied to it. I never felt pressured; rather, understood. Made all the difference in signing up with John. John kept in touch and kept me abreast of what was unfolding and was very comprehensive in his explanations and aiding in my understanding. I have enjoyed working with Cliff Weisberg since back in the early 1990's. During that time, his commitment and passion for children with disabilities. His effort to organize a law practice focusing upon helping the underserved who have disabilities has been so important to the families I serve: Families having children with severe inherited bleeding disorders. These disorders often prevent parents from holding jobs because their children are hospitalized so often. Working with Clif to help parents obtain SSI coverage has made it possible for these parents to have financial resources, albeit small in amounts, that make it possible to take care of their children without being totally financially devasted. I totally endorse Clif Wisberg for being an attorney who has and still does go above and beyond. I am very thankful for him!

My ex-wife did not have to do anything she was supposed to do because of the way he wrote the divorce decree. I’m still suffering 5 years after the divorce from the things he didn’t do. The primary complaint I have with Sharon Meyers specifically is the fact that she knew in advance of taking on my case--one month and a half before my review/hearing date--that I had prior legal representation. My transparency when I initially contacted Ms. Meyers and disclosed the name of my prior legal counsel as well as the fact that I was briefly represented by Legal Aid, was not reciprocated with transparency from the Myers firm about how the prior representation would impact the timing and overall fee petition decision of the Judge in my case. Because of prior representatives who did not waive their fees, the Judge did not approve the fee petition as part of the Notice of Award in September 2018. After contacting prior representatives, who previously provided me with a letter saying they were no longer representing me, I was advised they don't waive fees even when they opt to no longer represent a client. Aware there was specified time period for the representatives to respond, I contacted the Myers firm on January 2, 2019: They had NOT filed the fee petition, claiming they were not aware of my awarded SSD benefits. No one from the Meyers firm contacted me, but they stated they were awaiting a reply to their request for my award notice to file the fee petition. Only after I reached out to the Myers firm on January 2, 2019 again did they ask me to provide them with a copy of my award notice. As of March 2, 2019, I have received no updates from Judge’s office nor Myers about the fee petition. As professionals, it would have been appropriate for the Myers law office to provide me with realistic expectations for this process. Based my experience, I would not recommend.

She was not truthful. She seems like a nice person but will take advantage if given the chance. She took a case regarding child support and garnishing wages. She convinced a single mother that she could garnish the wages of someone on VA disability. She informed her that she has had experience doing that which is clearly not the case. Now the single mother is out a large amount of time and money and still is getting no child support from the dead beat father. Very upsetting that she would take this case and charge the victim when she is not able to deliver on her word. This was clear cut and up front from the beginning and she convinced the defendant that she would win. Not even a chance. I recommend a more informed Lawyer who wont take your case just to make money off of someone.

Forces clients to sign legal documents with "threats" that the judge will be angry if you "don't sign". She "takes credit" for others legal work, and looks the other way when asked about it. Either answers questions with questions, or walks away with her partner claiming they can't deal with their clients. Set's up her clients to "teach them a lesson" when the clients disagree with the way cases are handled. Routinely covers for "bad acts by her partner" so the firm won't be exposed. Refused to answer grievance claim after she "witnessed" opposing counsel threaten her clients. Bad apple all around. Should be investigated and have her law license pulled.

I hired Donna Simpson for my disability claim and she didn't reprevent me in a professional manner. She questioned every diagnosis I have and basically made me feel less than human, basically calling me a liar. She was late to my ALJ hearing and didn't even argue my case. I had 1 face to face meeting with her and could never talk with her on the phone. I was only able to speak with her daughter, Carrie. I had her file my appeal to the appeals council and was told that Donna Simpson didn't issue any written paperwork as to why she was appealing the ALJ decision, that she normally leaves it blank a day just files the appeal. If you want to be represented in a professional manner, with a competent attorney, I would advise you to hire anyone other than Donna. I was told after my ALJ hearing, I had a favorable decision, but later found out, I was denied. It's all lies!

I have had the honor of employing Donna Simpson, Attorney at Law, as well as personally experiencing her ability, courage, and most of all her integrity. Attorney Simpson filed my divorce suit in Putnam County. My ex-husband’s attorney was very obstinate and tried to delay the case at every turn. In her professional, thorough, and determined way, after many delays and motions filed by my ex-husband – including filing for palimony -Attorney Simpson obtained my divorce and the judge ordered what I requested. My ex-husband appealed the case to the Tennessee Court of Appeals and the results of the trial court were upheld. Attorney Simpson remained in control of my case and justice was served. I feel that many attorneys would have given up my case after the lengthy delays and injurious arguments of the opposition. But her perseverance and attention to every detail of my case brought my divorce to a just conclusion. I heartily recommend Attorney Donna Simpson to anyone who wishes to employ a thorough and equitable divorce attorney.

Wendy was amazing! We had a case against the Poway school district because of the way our handicapped son was treated by his teacher. She was incredible at advising us of our rights and assisting us in filing all of the complaints. She wrote the complaints for us using our information. She was so patient and so compassionate with all of our questions. More attorneys need to be like Wendy and remember why they got into law in the first place....to help people! Thank you Wendy, our son is now in his new school because of your help and is doing amazing!

The Doctors, office showed me the confirmation, that they had given him all my, Medical records , and that I was discharged from the Doctors office. Now he is saying, that i need to be working, before we can go to trail. We were suppose to start trial, 6 months ago, but more dishonest tactics. Good luck with this team!

I needed an attorney to help me when my husband passed away. Ms. Gallo, listened intently and took control of my case which was a very complex family situation. She went above and beyond to help keep peace, and was available. I appreciated her strong ethics, yet she was not intimidated to stand up to the other attorney, and was well prepared with facts, not just talk. I will definitely call on her again.

She was suppose to represent me in my disability case and I didnt feel like she could get the job done if she didnt believe in me. And she just blew me off one to many times. And insinuated to me that I was faking! I didnt appreciate this attitude at all. I have enough problems without having an attorney that treats me badly.

Attorney Martin prepared wills, financial powers of attorney and healthcare powers of attorney for both me and my husband. Our initial consultation took approximately 30 minutes. The documents were prepared within the next week, and my husband and I reviewed them and signed them at a second meeting. The entire process was effortless and took about an hour to complete, from the initial consultation to signing the wills. Laskoff & Associates kept the originals in their safe, so we don't have to worry about losing them. Attorney Martin was very professional, listened to our questions and was able to answer all of our questions in layman’s terms.

This is not the kind of attorney you want representing your intrests for ANYTHING Trust me . Put it this way , it was so unprofessional I had to write to the OVERSEER's OF THE MAINE BAR ASSOCIATION in which the incident is still being investigated. I wish I had never retained him, and I still regret it. He was retained , and not only was he rude and unprofessional , but his assistant - ( not sure what else she is to him ) was rude and disrecpectful on the telephone . As a result I would NEVER use this attorney again. The firm he works for has been my firm for 20 plus years .. but for bankruptcy hes the lawyer that handles most of these cases so I was refered to him . BIG mistake !! Its enough to have to file Chapter (7) in my case .. but to be treated with such disrespect and ouright bad behavior in unthinkable . PLENTY of capable bankruptcy attornies in the Lewiston-Auburn area ...Lloyd is not one of them

Attorney Harris represented me with my ssd case. We took the appeal to the Federal level. Thanks to the incredible argument she prepared and submitted to the Court as well as her professional, no nonsense approach she took at my hearing, I was awarded full benefits and all of my back pay. I asked her to represent me with my VA appeal because “if it ain’t broke don’t fix it!” She was successful in getting my current service connected pension @ 10% increased to 40% and is currently working on my appeal for a new claim that was previously denied.

This woman lost my disability case, then quit when I criticized her poor effort and multiple acts of negligence in my case. Not only that, but she's stealing money set aside for lawyers by Social Security which is preventing me from hiring competent legal representation to help me win my case; it's proving an uphill battle trying to do it alone from my bed. Even while she was in an ongoing Bar Association complaint from me, she lied to Social Security about which day she quit, milking even more money from my potential backpay. I have no idea how this evil, heartless woman still has a license. I can't say anything about her associate Peter Helwig, but if this firm is your only option, PLEASE DON'T CHOOSE HER, YOU'LL REGRET IT!

I retained The Velez Law Firm after being subjected to a hostile, discriminative, and retaliatory work environment. I was treated unfairly, demoted, and eventually fired after 27 years of employment for speaking out against these matters. I left the job feeling hopeless, depressed, and financially deprived. The situation affected me physically and emotionally. I selected Mark Velez and his team to represent me based on recommendations from my lawyer contacts, and by his proven track record of winning and successfully settling employment discrimination cases. From the moment I began working with Mark Velez and his colleague Natalya Grunwald, they were responsive and professional. Mark helped me weigh all my options and potential course of action, and he set realistic expectations from day one. He listened to all the facts and gave insightful explanations as to what to expect during every phase of my case. Mark worked diligently in getting this matter resolved and getting me compensation for the wrong that was done to me by my former employer. The outcome was more than fair and favorable. My experience with The Velez Law Firm was highly positive, and I strongly recommend Mark and his team to anyone that has experienced employment discrimination and retaliation.

Mark Velez took on my Employment discrimination case. I was written up and fired for not completing my job in a timely manner after returning back to work for medical leave. I was out of work for 8 weeks on mental disability leave. I spoke to Mr. Velez for a consultation and he immediately reassured me that being fired was not my fault. Mr. Velez and his team worked tirelessly on my case. Kept me informed at all times and finally won my case. I couldn't have found a better lawyer. Mark Velez is truly a Bulldog in the industry. Highly recommended!

I only spoke with Mark one time before the initial settlement conference. He was obviously unfamiliar with my case. The judge told him that the statue of limitations was up on an important aspect of my case. He was an embarrassment to me. He was the rudest person that I know. He later tried to tell me my case was over when it wasn't. I came away with a small settlement, no job and an IRS bill for $7000. His wife also an attorney said it wasn't taxable.

We don't know how this attorney is still practicing law. Client has been the subject of potential stalking; being disallowed from communicating or asking questions. Allegedly, this attorney has breached "The implied covenant of good faith and fair dealings--breaching the contract of attorney-client representation; has attempted to coerce client to to sign a substitution of attorney to show that client terminated the contract when it was the attorney who communicated that he was withdrawing from the case, because the client called him outside of unreasonable time parameters that attorney had recently enacted within much less than 30 days. Attorney has committed so much more maleficence, committing harm to client's conscience with evil intentions and hate, but client will defer. Any fees that this Guy would try to collect from client, if the court deem proper, would be "Unconscionable Fees".

I couldnt find a lawyer who would talk to me but Guy met me right away and explained in detail why I wouldnt win my case. I didnt think I would but my other lawyer told me to try. He looked over all my med info and explained why I didnt have a case yet but after I turn 55 to get back with him. He gave me papers to have my Dr fill out and talked to me and answered all my questions. He didnt rush and didnt charge me anything. It might not sound like he helped me but other lawyers had me wasting my time! He didnt.

Years ago my husband and I went to Gary Smith regarding filing for my husband's Soc.Sec. Disability due to Parkinson's. Not only did Mr. Smith handle the case with expedience, but refunded almost the entire retainer paid because he said it did not require the time and effort he thought it would. When do hear of an attorney refunding you payment??? Since that time, we trusted Gary to do our Wills, POA papers and other matters. When we went to Gary regarding an investigation of an accident and death of a family member, he was very supportive and helped us find closure in a difficult case. If you are looking for a flashy high powered attorney that throws around jargon to purposely intimidate you ,then Gary Smith is not the lawyer you want. On the other hand , if you are in need of an attorney that explains and represents you openly and honestly, then I highly recommend Gary L. Smith.

Don't waste your money with this guy. You might think I'm writing this referral because I didn't get the verdict I was looking for but Mr. Gary Smith did not even make it to the final hearing date. I gave Gary Smith $2,500 to help me with an case that involved the safety and well being of my Six year old daughter. Her Mother's new boyfriend was domestically violent and my daughter had witnessed it. The day before the first hearing Gary Smith demanded (pretty much held me ransom) and said if you don't deliver me $2,500 more before the hearing I cannot help you. My wife and I got together the last $2,500 dollars we had and delivered it to Gary Smith in time. During the hearing he was completely useless, my Judge even saying one time, "I was waiting for you to jump in Mr. Smith." after he failed to object to multiple lines of questioning that were in violation of court rules. So after his complete failure at our first hearing, showing that he did absolutely zero home work and was extremely ill prepared for the hearing that day, we began to question his ability to assist us. Meanwhile the case was extended and nothing was done on that day. I wrote an E-mail to Mr. Gary Smith explaining that I was upset with how he was handling the case. I was not offensive, rude, or ignorant. I kept the E-mail's tone very professional focusing on the fact that my daughters safety was at risk. Gary Smith replied by dropping me as a client, not submitting a bill to me, and keeping all of my money. I got an E-mail response from him stating he could not handle my case anymore and then filed to be removed as my counsel. So months later I was left unprepared, unrepresented, and missing $5,000 from our saving. Do Not waste your money with the laziest and most unprofessional lawyer I have ever met.

Mr. Bateski represented me back in 2008 before I knew of this website. It was a serious matter. My dad had a friend who recommended Mr. Bateski We had a few meetings discussing the case and law. My situation was explained to me. I was left to make my own choices. He stated that he had to be prepared to go to trial regardless of what happens during the hearings. He was competent in court. He represented me and protected my rights in court and phone calls with the judge and DA. Ultimately, my case was not prosecuted so we never started a trial and I cannot comment on his work in trial. This other reviewer talking about anxiety is not like what I remember. I would not call him the worst lawyer as that reviewer did. Since we didn't go to trial he refunded most of his retainer. His retainer was very reasonable in the first place. I think he charged much less than other lawyers would've charged.

I received a speeding citation 2 years ago in GA while driving from FL back home to NC. Without knowing all my rights I paid the fine because I was out of state. About 3 months later I was sent a second fine for the same ticket (super speeder fine). Again, I was out of state and unfortunately just paid the ticket. Then GA finally got around to notifying my home state about the citation almost two years after the fact and they sent me a notice that my drivers license was being revoked for 6 mths. Mr. Bateski advised me very well and worked with the court in GA on my behalf. Ultimately, Mr. Bateski got the original citation vacated in GA, which saved my license in NC. I am so grateful for his dedication, speed with handling my case and responsiveness. I hope to never need an attorney again, but if I do he will be the one!

MR. BATESKI IS THE WORST LAWYER TO GET. ALTHOUGH HE IS CHEAP, HE HAS ANXIETY ISSUES AND GETS VERY NERVOUS WHEN IN COURT. I HAD A SIMPLE CITY ORDINANCE AND BEFORE I COULD EVEN SAY ANYTHING HE HAD ALREADY AGREED TO TAKE A PLEA THAT WOULD HAVE RUINED MY CAREER. HE THEN WENT ON TO GIVE ME BACK MY MONEY BEFORE I HAD TO GET STERN AND ALMOST MOTIVATE HIM TO DO HIS JOB! I EVEN HAD TO TELL HIM TO SAY WHEN TALKING WITH THE JUDGE...PATHETIC!

What a Social Security & Disability Lawyer Can Do for You

A Social Security and Disability lawyer specializes in helping individuals navigate the complex process of applying for and securing Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI) benefits. These lawyers assist clients in filing applications, gathering necessary medical evidence, appealing denied claims, and representing them in hearings before administrative law judges. A lawyer can help maximize the chances of approval by ensuring that the paperwork is accurate, deadlines are met, and legal standards are addressed.

If you are disabled and unable to work, or if your Social Security Disability claim has been denied, a Social Security and Disability lawyer can guide you through the legal process to obtain the benefits you’re entitled to.

When Should I Hire a Social Security & Disability Lawyer?

You should consider hiring a Social Security and Disability lawyer in the following situations:

  • Applying for SSDI or SSI benefits: The application process for disability benefits can be complex, with strict requirements and documentation. A lawyer can assist in completing the application correctly and submitting the required medical evidence to improve your chances of approval.
  • Denied disability claim: If your initial claim for SSDI or SSI benefits has been denied, a lawyer can help file an appeal and represent you in hearings. Many claims are denied initially, and having legal representation during the appeal process significantly increases the chances of success.
  • Requesting reconsideration: After an initial denial, you have the right to request reconsideration of your claim. A lawyer can help present new medical evidence or correct any errors in your original application.
  • Hearing before an administrative law judge (ALJ): If your reconsideration request is denied, you may request a hearing before an ALJ. A lawyer can represent you during the hearing, preparing you to answer questions and presenting a strong case based on your medical and work history.
  • Proving medical conditions: If your disability involves complex medical conditions, a lawyer can help gather expert medical testimony or additional evidence to demonstrate that your condition meets the legal criteria for disability.
  • Overpayments and cessation of benefits: If the Social Security Administration (SSA) claims you were overpaid or attempts to terminate your benefits, a lawyer can assist in challenging the decision and protect your right to continue receiving benefits.
  • SSI for low-income individuals: If you are applying for SSI, which is based on financial need in addition to disability, a lawyer can help ensure that your financial records are correctly submitted to meet SSA’s strict income and asset limits.

Hiring a lawyer early in the process can help you avoid mistakes that could delay or jeopardize your claim.

What Does a Social Security & Disability Lawyer Do?

A Social Security and Disability lawyer provides a range of services to help individuals navigate the application and appeals process for SSDI or SSI benefits. Their responsibilities often include:

  • Filing initial applications: A lawyer can help prepare and file your SSDI or SSI application, ensuring that all necessary forms are completed accurately and medical evidence is included.
  • Gathering medical evidence: A lawyer works with your doctors and healthcare providers to collect medical records, treatment histories, and expert opinions to support your disability claim.
  • Filing appeals: If your initial application is denied, a lawyer can file an appeal and guide you through the reconsideration process, ensuring that any additional documentation or evidence is provided.
  • Representing you in hearings: A lawyer will represent you in front of an administrative law judge, helping you prepare for the hearing and arguing your case to demonstrate that your disability prevents you from working.
  • Handling deadlines and paperwork: A lawyer will ensure that all deadlines are met, and that any requests for additional information from the SSA are responded to promptly.
  • Negotiating settlements (for private disability insurance claims): If your disability benefits claim involves private disability insurance (in addition to or instead of SSDI/SSI), a lawyer can help negotiate a fair settlement with the insurance company.
  • Fighting benefit terminations or overpayment claims: If the SSA attempts to terminate your benefits or claims you were overpaid, a lawyer can defend you in administrative proceedings or file for a waiver or reconsideration.

How Are Social Security & Disability Lawyers Paid?

Social Security and Disability lawyers are typically paid on a contingency fee basis, meaning they only get paid if your case is successful, either through the approval of your disability benefits or winning an appeal. Here's how it generally works:

  • Contingency fee: The fee is usually 25% of your past-due (backpay) benefits, but no more than $7,200. This fee structure is set by the SSA, and lawyers cannot charge more than this amount for SSDI or SSI cases.
  • No cost for future benefits: Lawyers are not entitled to any portion of your future monthly disability benefits. Their fee is strictly limited to a percentage of your backpay.
  • Additional costs: In some cases, you may need to pay for additional expenses, such as obtaining medical records or expert witness testimony. These costs are usually minimal, but it’s essential to ask your lawyer about any additional expenses upfront.

It’s essential to confirm fee arrangements with your lawyer during the initial consultation to avoid misunderstandings.

How Much Does a Social Security & Disability Lawyer Cost?

The cost of hiring a Social Security and Disability lawyer is typically structured around the contingency fee system outlined by the SSA. General cost information includes:

  • Contingency fee: The lawyer’s fee is capped at 25% of your backpay, with a maximum of $7,200. For example, if you are awarded $10,000 in backpay, the lawyer will receive $2,500 (25%), and you will receive the remaining $7,500.

Overall, there is no financial risk in hiring a Social Security and Disability lawyer, as they only get paid if your case is successful.

Top Questions to Ask a Social Security & Disability Lawyer

Before hiring a Social Security and Disability lawyer, it’s important to ask the right questions to ensure they have the experience and expertise to handle your case effectively. Key questions to ask include:

  1. What experience do you have with Social Security Disability cases?
Ensure the lawyer has experience handling SSDI and SSI cases similar to yours, particularly if you have a complex medical condition.
  2. How do you charge for your services?
Confirm that the lawyer charges a contingency fee and that you won’t owe any fees unless your claim is successful. Ask if there are any additional costs for medical records or other expenses.
  3. What is the likelihood of success in my case?
Ask the lawyer for an honest assessment of your case and the potential challenges you may face.
  4. How long will the process take?
Disability claims can take time, especially if you’re appealing a denial. Ask the lawyer how long they expect the process to last and what the typical timeline is for cases like yours.
  5. How will you help me prepare for my hearing?
If your case is going to a hearing before an administrative law judge, ask the lawyer how they will help you prepare for testimony and present your medical evidence effectively.
  6. What happens if I’m denied again?
Ask about the next steps if your reconsideration or appeal is denied, including the possibility of further appeals to federal court.

How to Check the Credibility of a Social Security & Disability Lawyer

To ensure you are hiring a reputable Social Security and Disability lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice law and has no history of disciplinary actions.
  • Look for Social Security experience: Review the lawyer’s website or profile to ensure they specialize in Social Security and Disability law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on Social Security Disability matters.
  • Check for memberships in relevant organizations: Membership in organizations like the National Organization of Social Security Claimants' Representatives (NOSSCR) can indicate that the lawyer is committed to representing disability claimants.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a Social Security and Disability lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Medical records: Bring copies of your medical records, including doctor’s notes, test results, treatment histories, and any disability-related diagnoses.
  • List of medications and treatments: Provide a detailed list of any medications you are taking, treatments you have received, and ongoing medical care related to your disability.
  • Denial letters (if applicable): If your disability claim has been denied, bring a copy of the denial letter from the SSA, along with any documentation related to your appeal.
  • Work history: Provide information about your previous jobs and work history, including details about how your disability has impacted your ability to work.
  • Social Security application (if already filed): If you’ve already submitted an application, bring a copy of the application and any correspondence you’ve had with the SSA.
  • List of questions: Prepare a list of questions you have about the legal process, the lawyer’s fees, and what to expect in terms of timelines and outcomes.

By preparing thoroughly for your consultation, you can help the lawyer assess your case more effectively and provide the best possible legal advice tailored to your situation.
