I hired Jeannie Tupper upon exit from the military. I had a 100% disability rating from the VA medicines and what I felt was a solid case. First I never met the woman. She sent someone to my hearing who waited until 5 minutes before the hearing to explain that she would not be speaking but I would have to do all the talking. They did not properly request paperwork. I provided them with all needed paperwork. She fumbled up a good case. They would not file an appeal and I could not see Tupper to get any real answers. Time passed to the point now where I would have to start all over again. It's not fair but as a lawyer there was nothing she did except try to be in place to capitalize on what they may have thought to be an easy win. As a law office I would strongly ward off any suitable cases looking for help at that office.

Our experience with Sean and SSDI was great! Sean walked us through the entire process. He always kept us informed of what was going on with the case. This case was complicated with years worth of documentation to sort through. But in the end, the judge approved the SSDI. I would highly recommend Sean McCormack for anyone seeking a Disabilty attorney

Jeannette did what SHE wanted to with the claim, and did not tell us until the last moment that she had no intention of including most of the information that we provided her. We're paying the price for this now in our dealings with the SSA. She was really, really rude and hostile at several junctures. I would try to find someone else.

Nothing a big fat nothing. He talks to much knows everything won't allow you to ask questions . I don't know where the writing of a 100% best disability attorney comes from. Because he didn't fight for me, he took me in front of the judge not once but twice in a 10 year period I still kept Faith in him even though he was a complete jerk to me talk to me like a Dog absolutely would give no Stars if it were possible. I suggest that no one contact this attorney for help. Because he will only waste your time. So that way he can make more money. That's all he is out for he does not care about people or their situation. He does not stay in communication. He demands you to do all the work hes supposed to be doing. I absolutely am disgraced and angry. That I wasted my time on this loser. Good luck.

I consulted and hired this firm to handle my ssi/ssd denial appeal. On the day of my hearing, my "attorney" informed me that we had about a 25% chance of winning and she, Marilyn Macy, was not wanting to actually go before the judge! I asked why the firm accepted a case that was thought to lose with no answer. I requested that we still try this case, as i have waited almost 3 years. I have since waited almost 6 months without any info. I have called the firm several times only to get a voicemail. This is exhausting.

I was recommended to Barbara Loevy from another attorney. I am 41 years old and have worked all of my adult life. In the past two years i've been in and out of ambulances and Memphis emergency rooms over a dozen times. Due to grand-mal seizures and sholder dislocations due to the seizures. My most recent seizure resulted in my siezing while driving, flipping my car and waking up in a hospital. Although I am still young, my body and emotional state feels defeated. I cant pay any bills (Hospital, MLGW, Food, Child support, ect).. and every day I fall furthur behind. Now, to make matters worse, my best friend.."my mother" just passed and I'm lost and falling fast. Pulling myself together, I called the office of Barbara R. Loevy to ask for assistance in fighting for my social security. I was greeted with extremly rude individuals who said "I dont think Barbara wants your case, I suggest you flip trough the yellow pages and find another lawyer" I then asked is there any way I can speak to Ms. Loevy myself. The individual told me no. I then asked the individual for her name so because I always document who I speak with. She told me no! Then hung up the phone. I'm sure, or I hope Attorney Loevy is not aware of the lack of customer service and sensetivity her employees show. This is an example of kicking a person when there down from a firm that is suppose to help. I plan to continue to try to contact this attorney, not to help with my case, but to inform her of exactly how I was treated when I asked her office for help

Joan is very professional, caring, detail oriented, and has no problem explaining exactly what you can expect as things progress. In my particular case, Joan has helped me with workers' compensation, guardianship, estate, financial, medical, tax, social security, and family issues. Joan is committed to making sure everything is handled to your satisfaction, so you can lessen your stress. She answers all questions, or will help guide you to find out what you need to know. In my case, Joan has accompanied me to family conference updates on medical progress of a brain injured family member for whom I am now guardian, and he is well cared for in a proper facility. Joan continues to stay in touch throughout the year and checks on how I am and how my ward is progressing. If I had had to accomplish on my own all that Joan has assisted me with, I would be lost and buried in red tape. Joan answers questions promptly, and when she is tied up, will let you know when to expect her attention. She asks specific questions and has been immeasurably helpful in a complicated situation. I highly recommend Joan Durkin.

Patrice Denman handled my complicated divorce and child support case. A contested divorce can be very complicated and confusing when both sides disagree on multiple levels and children are involved. Patrice Denman wisely guided me through the legal divorce process step by step and provided a well-executed plan with clarity and direction. Throughout the case and afterwards, she kept me abreast of case activities and status. Her legal, communication and problem solving skills gave me confidence that I was well represented and she was the right attorney for my case. In court, Patrice Denman’s sharp, strong legal arguments were backed with well supported facts. Her passion to pursue a just and equitable resolution laid the foundation for well-defined objectives that were reasonable and unwavering. She productively used information and time to manage volumes of legal and case related documents. She accurately calculated and clearly explained the child support. The separation agreement Patrice Denman wrote for me clearly defined many details regarding children’s activities and visitation that will transcend time. Her compassion and attentiveness to details, my children and my needs was encouraging and supportive and more than I expected. She understands family life and exercised flexibility in scheduling to accommodate my work and children’s schedules. I saw that Patrice Denman is well respected in the Lake County court system and amongst her legal peers. Based on my recommendation, my friends have engaged her for legal services and were extremely pleased her with legal services. Patrice Denman is a smart, supportive and fully-engaged attorney that uses time, information and money wisely. She will continue to be my attorney. If you need a family law attorney, call Patrice Denman and ask for a free consultation.

My overall experience with Attorney Mark Didrickson has been horrendous. If giving no stars for a rating was an option that is what I would give. I hired Mark over a year ago to take care of ONE very simple matter; Mark took my money but did absolutely nothing. Mark would constantly come up with some really preposterous excuse(s) not to work on my case, not to return my emails and phone calls. If by some miracle Mark did set up an appointment with me--Absolutely nothing ever got. accomplished at any of my appointments. Mark also constantly gave me court hearing dates that never ever happened; as he would always come up with some completely absurd excuse/reason that had absolutely positively nothing to do with my case and would cancel whatever upcoming court hearing date I thought we had. Mark is a complete waste of money and time.

She always answered my calls personally, kept me informed and was always aware of the details of my cases. In both divorces things moved right along and I never felt like I was stalled or put on the back burner. It was like my case was the only one she had. I cannot say enough about her respect, integrity and knowledge. I am going back to her now for real estate purposes and didn't even consider anyone else. Amy is currently helping me litigate against A large retailer and has helped my wife in the past with litigation against a pizza delivery worker who t-boned us years ago. I know of no other lawyer who would go through what she's been through with me. She is so responsive, generous, caring and trustworthy. She has helped me tremendously and has been a true friend throughout this ordeal. While she is still learning about Workers Comp cases she is not afraid of the big boys or to ask colleagues for advice or to school herself on the issues. What a tremendous job se has done for me and my family. She helped me get my job back, to win compensability in what seemed like a hopeless case, and we're still fighting. She is tenacious, doesn't give up and her background outside of Workers Comp in other areas of practice proved invaluable in my situation. I have recommended her to several friends and co-workers and she has successfully litigated on their behalf, winning two that I have sent her way and working on two others beside mine. Through my case and others she has become a local expert in dealing with Wal-Mart and standing up to their tactics. I highly recommend her services should you need to stand up to this Goliath. Thank you Amy for all you have done and are still doing. Whatever happens I will be eternally grateful for you! Pastor Joe Senior Pastor, Mile High Bible Institute

Just as I'm getting ready to load myself and my wheelchair into my vehicle to go into his office for my initial consultation, Phil Reitan calls and asks if we can do the consult over the phone. When I explain that I have documents that I'd like him to see that would better explain my situation, he immediately dismissed me, said he didn't have time to deal with my matter, said it was too much work without a $4000 retainer. Frustrated, I end the call. About 25 minutes later as Im in the process of contacting another attorney, I receive a call from Phil Reitan's secretary telling me that I'm late for my appointment with Phil and why am I not there yet. My whole experience with his office left me feeling frustrated and Phil himself seemed rather abrasive.

He didn't go over the fine details with me for my original award. He didn't fight for me to cover all of my injuries. He only focused on the part of my injury that would make him money. Now, I'm still out of work, not getting any wages, and fighting for approval for my meds, procedures, etc. on my own. She was my last chance and hope before my time had run out to find a lawyer being granted the right to sue by the EEOC. She also missed out on a chance to add an impressive victory to her resume. I had a court appointed laywer. He failed to file the writ of certiorari which stopped the appeal. The Tennessee Court of Appeals contacted the lawyer, they found problems in my transctript. It was only 43 years later that I found this out.The state had no proof,no weapon,no money, and no witness's.The Tennessee Appeals set aside my verdict and reinstated it to give the lawyer more time to file the writ of certiorari. If he had done so my sentence would probably have been over turned and I would have been freed. He still never filed and the court agreed that I had ineffective assistance of counsel. I am only asking to have this expunged from my record.I served the time all those years ago. You are that Lawyer. The Tennessee board of parole will not help unless you will send me a letter stating why you did not file the writ of cert. I spent four and a half years in prison for a crime I did not do. And 48 years later I am still being punished. I just want my record cleared. The Tennessee court of appeals set aside my conviction so you would have more time to file. They said in their judgement that they contacted you, But you still never filed. Please you can help and make a big different in my life Thank you in advance for your time and trouble. BILLY

What a Social Security & Disability Lawyer Can Do for You

A Social Security and Disability lawyer specializes in helping individuals navigate the complex process of applying for and securing Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI) benefits. These lawyers assist clients in filing applications, gathering necessary medical evidence, appealing denied claims, and representing them in hearings before administrative law judges. A lawyer can help maximize the chances of approval by ensuring that the paperwork is accurate, deadlines are met, and legal standards are addressed.

If you are disabled and unable to work, or if your Social Security Disability claim has been denied, a Social Security and Disability lawyer can guide you through the legal process to obtain the benefits you’re entitled to.

When Should I Hire a Social Security & Disability Lawyer?

You should consider hiring a Social Security and Disability lawyer in the following situations:

  • Applying for SSDI or SSI benefits: The application process for disability benefits can be complex, with strict requirements and documentation. A lawyer can assist in completing the application correctly and submitting the required medical evidence to improve your chances of approval.
  • Denied disability claim: If your initial claim for SSDI or SSI benefits has been denied, a lawyer can help file an appeal and represent you in hearings. Many claims are denied initially, and having legal representation during the appeal process significantly increases the chances of success.
  • Requesting reconsideration: After an initial denial, you have the right to request reconsideration of your claim. A lawyer can help present new medical evidence or correct any errors in your original application.
  • Hearing before an administrative law judge (ALJ): If your reconsideration request is denied, you may request a hearing before an ALJ. A lawyer can represent you during the hearing, preparing you to answer questions and presenting a strong case based on your medical and work history.
  • Proving medical conditions: If your disability involves complex medical conditions, a lawyer can help gather expert medical testimony or additional evidence to demonstrate that your condition meets the legal criteria for disability.
  • Overpayments and cessation of benefits: If the Social Security Administration (SSA) claims you were overpaid or attempts to terminate your benefits, a lawyer can assist in challenging the decision and protect your right to continue receiving benefits.
  • SSI for low-income individuals: If you are applying for SSI, which is based on financial need in addition to disability, a lawyer can help ensure that your financial records are correctly submitted to meet SSA’s strict income and asset limits.

Hiring a lawyer early in the process can help you avoid mistakes that could delay or jeopardize your claim.

What Does a Social Security & Disability Lawyer Do?

A Social Security and Disability lawyer provides a range of services to help individuals navigate the application and appeals process for SSDI or SSI benefits. Their responsibilities often include:

  • Filing initial applications: A lawyer can help prepare and file your SSDI or SSI application, ensuring that all necessary forms are completed accurately and medical evidence is included.
  • Gathering medical evidence: A lawyer works with your doctors and healthcare providers to collect medical records, treatment histories, and expert opinions to support your disability claim.
  • Filing appeals: If your initial application is denied, a lawyer can file an appeal and guide you through the reconsideration process, ensuring that any additional documentation or evidence is provided.
  • Representing you in hearings: A lawyer will represent you in front of an administrative law judge, helping you prepare for the hearing and arguing your case to demonstrate that your disability prevents you from working.
  • Handling deadlines and paperwork: A lawyer will ensure that all deadlines are met, and that any requests for additional information from the SSA are responded to promptly.
  • Negotiating settlements (for private disability insurance claims): If your disability benefits claim involves private disability insurance (in addition to or instead of SSDI/SSI), a lawyer can help negotiate a fair settlement with the insurance company.
  • Fighting benefit terminations or overpayment claims: If the SSA attempts to terminate your benefits or claims you were overpaid, a lawyer can defend you in administrative proceedings or file for a waiver or reconsideration.

How Are Social Security & Disability Lawyers Paid?

Social Security and Disability lawyers are typically paid on a contingency fee basis, meaning they only get paid if your case is successful, either through the approval of your disability benefits or winning an appeal. Here's how it generally works:

  • Contingency fee: The fee is usually 25% of your past-due (backpay) benefits, but no more than $7,200. This fee structure is set by the SSA, and lawyers cannot charge more than this amount for SSDI or SSI cases.
  • No cost for future benefits: Lawyers are not entitled to any portion of your future monthly disability benefits. Their fee is strictly limited to a percentage of your backpay.
  • Additional costs: In some cases, you may need to pay for additional expenses, such as obtaining medical records or expert witness testimony. These costs are usually minimal, but it’s essential to ask your lawyer about any additional expenses upfront.

It’s essential to confirm fee arrangements with your lawyer during the initial consultation to avoid misunderstandings.

How Much Does a Social Security & Disability Lawyer Cost?

The cost of hiring a Social Security and Disability lawyer is typically structured around the contingency fee system outlined by the SSA. General cost information includes:

  • Contingency fee: The lawyer’s fee is capped at 25% of your backpay, with a maximum of $7,200. For example, if you are awarded $10,000 in backpay, the lawyer will receive $2,500 (25%), and you will receive the remaining $7,500.

Overall, there is no financial risk in hiring a Social Security and Disability lawyer, as they only get paid if your case is successful.

Top Questions to Ask a Social Security & Disability Lawyer

Before hiring a Social Security and Disability lawyer, it’s important to ask the right questions to ensure they have the experience and expertise to handle your case effectively. Key questions to ask include:

  1. What experience do you have with Social Security Disability cases?
Ensure the lawyer has experience handling SSDI and SSI cases similar to yours, particularly if you have a complex medical condition.
  2. How do you charge for your services?
Confirm that the lawyer charges a contingency fee and that you won’t owe any fees unless your claim is successful. Ask if there are any additional costs for medical records or other expenses.
  3. What is the likelihood of success in my case?
Ask the lawyer for an honest assessment of your case and the potential challenges you may face.
  4. How long will the process take?
Disability claims can take time, especially if you’re appealing a denial. Ask the lawyer how long they expect the process to last and what the typical timeline is for cases like yours.
  5. How will you help me prepare for my hearing?
If your case is going to a hearing before an administrative law judge, ask the lawyer how they will help you prepare for testimony and present your medical evidence effectively.
  6. What happens if I’m denied again?
Ask about the next steps if your reconsideration or appeal is denied, including the possibility of further appeals to federal court.

How to Check the Credibility of a Social Security & Disability Lawyer

To ensure you are hiring a reputable Social Security and Disability lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice law and has no history of disciplinary actions.
  • Look for Social Security experience: Review the lawyer’s website or profile to ensure they specialize in Social Security and Disability law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on Social Security Disability matters.
  • Check for memberships in relevant organizations: Membership in organizations like the National Organization of Social Security Claimants' Representatives (NOSSCR) can indicate that the lawyer is committed to representing disability claimants.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a Social Security and Disability lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Medical records: Bring copies of your medical records, including doctor’s notes, test results, treatment histories, and any disability-related diagnoses.
  • List of medications and treatments: Provide a detailed list of any medications you are taking, treatments you have received, and ongoing medical care related to your disability.
  • Denial letters (if applicable): If your disability claim has been denied, bring a copy of the denial letter from the SSA, along with any documentation related to your appeal.
  • Work history: Provide information about your previous jobs and work history, including details about how your disability has impacted your ability to work.
  • Social Security application (if already filed): If you’ve already submitted an application, bring a copy of the application and any correspondence you’ve had with the SSA.
  • List of questions: Prepare a list of questions you have about the legal process, the lawyer’s fees, and what to expect in terms of timelines and outcomes.
