They are seriously understaffed and won't take any case that requires even a little bit of work. They only take cut and dry type of cases. The type of case they can give to a first year law student and still win. For instance if a facility doesn't have a handicap access or something like that. Any kind of other dispute they blow off. Tell you to call a 'Real' Attorney. I need a lawyer because I was incarcerated in two different jails because I was too poor to pay a traffic fine and I told the judge and the judge didn't care. It was out of Addison and Farmers Branch, TX. I had never been arrested before and now I have an arrest record. Both courts mislead me and in the case of Farmers Branch the judge LIED. Sat right there on the bench and LIED. Said the "State" mandated that poor indigents get jailed when the state has done no such thing. Well I found out that this is illegal. The U.S. Supreme Court ruled on a case out of Texas in 1971 that if a person is indigent a state cannot first give a fine and then convert that fine to jail time for indigents. It violates the 14th Amendment to Equal Protection of the laws. The case is: TATE v. SHORT, 401 U.S. 395 (1971) 401 U.S. 395 TATE v. SHORT CERTIORARI TO THE COURT OF CRIMINAL APPEALS OF TEXAS No. 324. Argued January 14, 1971 Decided March 2, 1971 The court ruled that if the court first lets a 'wealthier person' pay their way out of the fine, they are not allowed to 'jail' a poorer defendent because of their inability to pay saying - "the same constitutional defect condemned in Williams also inheres in jailing an indigent for failing to make immediate payment of any fine, whether or not the fine is accompanied by a jail term and whether or not the jail term of the indigent extends beyond the maximum term that may be imposed on a person willing and able to pay a fine. In each case, the Constitution prohibits the State from imposing a fine as a sentence and then automatically converting it into a jail term solely because the defendant is indigent and cannot forthwith pay the fine in full." This case is currently being used to restructure court procedures involving the jailing of indigents around the country. However, the Legal Aid won't touch this. Pro Bono attorneys in Mo are taking up this cause but there are no pro bono lawyers in Texas that will do this. They are all lazy. They only want super easy cases. This is a travesty because the jails across Texas, especially in Dallas and surrounding counties are busting at the seems with POOR PEOPLE on MINOR TRAFFIC FINES. When I went to jail I heard one cop tell another "Oh well, she's in because of "FINES". I pleaded with the courts to work with me but they REFUSED. Also, this legal aid interrogate you to no end about if you own property or a home (why I don't know) and they get all up into your finances. I can understand asking about the finances but if a person is a homeowner who has lost their job what do they expect? To sell the home and take the proceeds to pay for legal expenses? Where will the person then live? I think it was a Texas Supreme court justice that said the Texas Legal Aid foundation is so underfunded that for every eight people that apply, only one is able to be assisted and even then the assistance they receive is minimal. I feel sorry for Texans.
