Hello, My name is Michele Calp. I am the Power of Attorney for my sister who is in a nursing home. My niece and I were in the terrible position of having to find a nursing home for my sister who has dementia. We were not in the position to pay privately for her nursing care, which meant we we would have to apply for Medicaid. We attended a seminar on Elder Care Planning that Bellomo was holding. We set up a meeting and from that point decided to have them work with us. And we are glad we did. The work that is involved in getting the paper work together to apply is daunting. They took so much pressure off of our shoulders. The people there are so easy to work with and make you feel that they will do all they can to help you. Thank you.

Had the privilege of meeting Debbie Pico and was so impressed with the person she is, my Wife and retained her most professional service. Meeting Debbie provided a most secure and supportive environment. We asked Debbie to evaluate our Family Trust. Once Debbie explained certain aspects that needed to be addressed, we retained her services immediately. Debbie is the attorney that makes you feel safe & secure. We had Debbie do an entire Estate Planning Review on our behalf and she pointed out several items that needed to be altered that could have created issues later on. We would recommend the services of Debbie Pico to anyone that wants the most understanding individual that provides the most professional and caring services. Jaimi & Allan Yallof

Deborah is a wonderful attorney. It was my second time asking for her help with the documents when selling the house. She is the best in the industry and go extra mile explaining everything in details. She responds immediately, no email or question ever left unanswered. I felt heard, important and protected. It’s so rare nowadays. I would be happy to use her service again when I decide to buy a house and when my family will be back to Jersey.

I contacted Justin Plumer in 2014. He helped with an estate for my stepmother which was complicated. Justin and the team at Cheryl David and Associates got all the research I needed without me having to do anything. At the time I was living 200 + miles away and working full time. This was a huge help for me. I recently needed some receipts from their office and they dug through old files to once again save me time and effort. I would recommend this office to anyone who needs legal advise and estate planning and someone who truly cares. Kristina Hobgood Smith

The idea of “Counselor at Law” is sometimes a forgotten or back burner concept when it comes to attorneys, with their role as legal advocates taking precedent in most people’s minds. However, from my very first experience with Mr. Harvell, I was quickly reminded of the notion of “Counselor at Law”. I reached out to him for emergency advice regarding my mother and he quickly returned my call and gave me excellent advice. He continued to assist me with regard to my mother throughout the remainder of her life, not only explaining the pertinent legal issues but also providing excellent guidance. He was a shoulder I could rely on during a very stressful months long situation. I would greatly recommend him to others seeking elder law advice and guidance.

With the legal work completed, Jeff informed me that I have access to the case file at the courthouse as well as access to electronic copies of the case files through his client portal. When we needed to learn how to manage our sister's anticipated inheritance, it didn't take long to settle on the Farr Law Firm for advice. Their reputation as the experts in elder law and estate planning preceded them. After a thorough review of our situation, they revised my mother's revocable living trust and prepared a Special Needs Trust for my sister. There was some urgency as my mother was nearing 100 years of age. Thanks to their knowledge and depth of experience they were able to complete the work in a matter of days. Trusts are complicated and in the course of administering them, I've had numerous questions for Mr. Farr or a member of his staff. Without fail, responses are clear, comprehensive and delivered without delay. Working with Farr, I know I can count on things being done correctly and to our best advantage - and that adds up to great peace of mind.

Originally we chose Evan Farr and his law firm based on his clients' reviews. Our initial appointment with Evan only confirmed all the excellent reviews we have read. Three specific qualities set Evan apart from other attorneys practicing Elder Law: his vast knowledge, excellent listening skills and offering of continuous education for his many clients. We much appreciated Evan's help in navigating the complex and stressful process of setting up our legal documents. We also appreciate Sara Entis' efforts to finalize this colossal task and to make the important signing appointment totally flawless. In addition, we want to mention Sierra Kolasa's willingness to help every time we needed assistance. Our entire experience only proved that choosing Evan and his firm was the right decision. We highly recommend Evan and his firm to everyone.

First and foremost, my wife and I are extremely appreciative of the Roy Law Group. They are now family to us and we could not have dealt with the insurance company alone. The people that work for Roy Law Group took us on and walked us through every step of the long process. I wish we could recommend them higher than this review. Our story of "why" we recommend Roy Law Group. My wife suffers from Traumatic Brain Injury (TBI) as a result of a horrific automobile accident and epilepsy. At first, her short term employment disability kicked in without any issues. We noticed a change in the disability insurance as my wife's treatments continued past the six month mark. We were told by the insurance company she was not going to receive long-term disability. The insurance company lied stating long-term disability was not selected for her at time of employment. Being she has TBI it was very difficult for her to understand what was happening. I had to do the work to find her original employment signing paperwork showing she had signed up, checked the box, and paid for this service. This was the first time we realized the insurance company was not here to "help" my wife. During this stage we received many complicated paperwork assignments from the insurance company and threats she was going to be dropped from coverage. You could feel the insurance company just wanted us to give up so they could save money. They do not care about your actual wellbeing. We did not give up like they wanted us to do. Months prior to the one year mark the threats became real as the insurance company randomly sent my wife a denial of coverage letter. They gave a ridiculous reason stating they felt she was fine now and was dropping her from long-term coverage again. Mind you, she had only been on long-term disability for a few months. Even though she was still receiving medical services and had multiple doctors stating the opposite. We did not accept the insurance games anymore and looked for help. Thankfully we talked with the Row Law Group. They are amazing people from the start and tell you up front what they will do. No false promises, as they walk you through realistically if they were able or not able to help and why. Luckily for us they saw what the insurance company was doing and had dealt with this same company many times. I love the fact they listen to your situation and you know they are in the fight with you. I have never seen complete strangers be an advocate for the truth and justice like the Row Law Group is. Over the process I could not imagine anyone else doing such an amazing tailored job to our situation as them. We have now had my wife's long term disabilities reinstated and now moving forward the insurance company has to still deal with our protectors the Row Law Group. If you are going through the ringer and fighting with an insurance company over short/long-term disability just stop the stress and fight alone. Don't delay like we did just CALL Row Law Group now. I wish we had called them earlier and my wife would not have had to cry or worry as much during the earliest stages of the fight. Our family is so grateful to the Row Law Group.

Attorney Palmer was referred to me by an attorney here in Connecticut that I work closely with. I needed an attorney familiar with Elder Care & Trust issues as well as someone who could be trusted to work with me from a distance since the action took place in Seattle & I live in CT. John went out of his way to keep me informed prior to our mediation hearing on an ongoing basis. He reviewed volumes of documents and was instrumental in helping me formulate an informed decision on what path I should follow during our mediation hearing. John worked diligently throughout the 14 hour process discussing options with the other 4 parties attorneys. I was involved in an auto/pedestrian accident in 2021. I was simply knocked down to the pavement in a parking lot. It didn't seem like a "big deal" until I started to have some debilitating back pain. I just wasn't able to stand for any length of time, which was negatively affecting my everyday life. I contacted Jorgensen, Brownell & Pepin, P.C. about my case. Matthew Crowther, Esq. and his team handled my case, first getting a settlement from the driver's insurance company and then actually filing against my personal insurance company. It took some time, actually about three years, but Matthew was able to negotiate a six figure settlement for me. The fact that I deposited a six figure check into my bank account last week still hasn't actually sunk in. Matthew and his team did an amazing job for me and I would certainly give him my highest recommendation!

From day one, Ms. Foster was friendly, efficient, patient, organized, and focused on taking the right actions at the right time. Ms. Foster used her legal education along with years of paralegal expertise to keep all concerned moving forward on the right track so that we could reach our destination. KEY ADVANTAGES OF HIRING HOLLYN FOSTER: We worked with Hollyn Foster for nearly two years to distribute items and educate the heirs about the estate settlement process. About nine months after we met her, Global Pandemic spread across the U.S. Hollyn quickly adapted and handled the virtual courtroom and delayed hearings as if it were a natural ritual. Hollyn’s MASTERY OF TECHNOLOGY enabled us to move forward with the case at hand. We were working full-time, managing quarantine issues and still grieving. She worked hard to address the challenges of a large family whose members live in three different time zones. She almost seemed to be some sort of procedural wizard. She considered the best course to take, discussed the strategy with her clients. If approved, she prepared documents, handled filings and garnered the respect of other attorneys involved in the case. Hollyn HAS SKILLS AND WISDOM TO ASSESS CHANNGING SITUATIONS AND RESPOND AS NEEDED. She was a fearless guide for us and encouraged all concerned to proceed with decency. This may not seem important when you are involved with the legal system, but you definitely need THE RIGHT ADVOCATE WHEN YOU NEED LEGAL COUNSEL. When you are in the midst of the storm, you need an advocate who gained experience on the boat and then became a master at the wheel.

I cannot recommend Hollyn and her paralegal, McKenzie, enough! The service was OUTSTANDING! Hollyn met with us in person initially, and made what could have been SUPER complicated situation, with transferring my deceased sister’s trust almost effortless. And I really appreciated that the very reasonable expense to help us with all of the filings and papers was done as a flat fee. There were no surprises or hidden costs! Because of this, I was not stressed about the MANY emails I sent asking for help and clarification on how to do things, as this was the first time I was the executor for a trust. And there responses were so quick; I always got an answer immediately. I even called in a panic when I was at the bank (getting my Medallion Signature Guarantees) and they took my call and patiently talked me through everything. What amazing and caring client service to get in this day and age when other law firms bill for every ten minutes! And Hollyn explained EVERYTHING in plain terms that I could understand. She is SO knowledgeable about all of the details of estates. I am thankful that my sister chose Hollyn before she died so that we would have a trusted firm to help us take care of this. And I am grateful that even with a pandemic we had all of Hollyn’s expert advice and experience to help us resolve this estate. Do not hesitate to use her and her team to help you!

I am so grateful for Hollyn Foster. I went to Bowers and Associates, because my family had gotten help from them in 2015, when my Mom needed to admitted to a nursing home, and they provided excellent service to help set up a Qualified Income Trust. This past December (2019), I went to see Hollyn Foster for help with my sister-in-law's estate. Since that first meeting, and continuing now, she has provided me with advice and direction, solved problems, answered every email right away and kept me informed of the progress of the Estate. No matter what complicated matter arose, regarding the letters of administration, will, house, belongings, savings bonds, 401K, life insurance policy, unclaimed accounts, vehicle- she was able to help with it or direct me as to what my options were( Paralegal McKenzie Ford has also assisted on some of these issues). I strongly recommend Hollyn Foster's services to everyone - she is so smart, passionate, and compassionate, and knows how to get results.

I met Mr. Conte at a fundraiser years ago not knowing that I would be in need of his services. There were changes in my circumstances and I needed to update my will and prepare a trust. I remembered Mr. Conte who made everything easy for me to understand and cover my needs in the present and the future. He treated me like family and was attentive to my needs. Best of all he 'knows his stuff". I highly recommend him.

Though my husband refused to believe he was very ill, we both heard the doctors tell us he had a cancer he had probably gotten while serving in VietNam. We had nothing in place...no will, no trust, nothing even on paper! I looked on line for a nearby lawyer/estate planner and the God's were on my side that day! I phoned and made an appointment for us to visit with Leo McGrath. I believe we were there for about 2 hours, and by the time we left his office, we were in total agreement that we were on the right track to securing and entrusting our estate, and the investment and distrubution of our funds, to this firm. It is now 5 years later, my husband has passed, our money is secure in trust accounts, and I have invested my funds, with much success, thanks to the Leo McGrath Law Firm and Wealthcare LLC.

Mr. Kaune is an excellent lawyer. His knowledge of creating wills, POA for financial and medical needs and living wills is "right on". He explained every item in terms that made it easy for me to understand. There were many "ah ha" moments when my questions were answered. He made me feel very comfortable with what I was doing. Making a will is a stressing activity but Mr. Kaune friendly but professional and respectful manner certainly eased the stress. I have every confidence in him as well as his firm.

In August 2013 I attended an elder care luncheon presentation from one of Long Island's big estate planning firms. I had concerns that maybe the simple will my husband and I had was not enough. I called our general practice lawyer and he referred us to Ms. Cipriani in order to review our will and determine if we were in need of additional protections. We found Ms. Cipriani to be very knowledgeable and informative. She is an easy to work with professional. Ms. Cipriani is a pleasant and straight forward counselor. No question is "too stupid to ask." Time at each meeting allowed for our questions to be answered. The time frame between the initial consultation and review of our plan allowed us to digest all the information and gather the additional items she requested. Upon review of all our individual assets, which included a vacation home in another state; separate banking, retirement and investments accounts for each of us and; multiple desired beneficiaries in addition to our one child, Ms. Cipriani advised us as to what changes we should make as well as how to make them. She developed a comprehensive estate plan and thoroughly reviewed it with us before execution. Ms. Cipriani is available for follow-up questions and clarification. I wholeheartedly recommend Ms. Cipriani without reservation.

First and foremost, the Magnell Office is a cut above the rest. They were not only cordial and attentive but displayed a strong sense of trust, integrity, and reliability when taking on my case. Back in 2020, I got a speeding ticket for driving a 53 in a 30. As an out-of-state driver, I was unaware of New York's point system. Not to mention the fact that this was my first-time offense. Long story short, I would have gotten 6 pts; however, the Magnell Office brought it down to 0 pts and a fine for littering on the highway. I highly recommend this law firm. If I could, I would give them a 6 out of 5.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
