I hired Dan and his team to help determine the legal situation I was in with a business venture. Dan is easy to communicate with and efficiently gathered the necessary information to assess my predicament. He then explained the details of this complicated business situation in plain english allowing me time to think over my options. Dan also patiently answered all of my questions including hypothetical situations so I could better understand the law and have a greater understanding of the decisions I needed to make. Dan and his team are extremely professional, thorough and honest. He expects the best from himself and those around him. I have the utmost confidence they will do everything needed to succeed.

I am active in local politics. We have discovered inappropriate township recordkeeping activities. Attorney Dan Mead showed great patience while investigating the documentation I provided. Mr. Mead was hired to help us litigate against these inappropriate activities. Dan Mead, a man of superb character, successfully brought the inappropriate activates to the attention of the court. Mr. Mead is a gentleman who practices his profession ethically and always within the law.

We have been working with Gregory Hodge for 3 years now. My mother is on Medicaid and in a nursing home. Whenever I have questions, he responds quickly. Every year he completes the required government forms that are so cumbersome! All I have to do is collect the information and provide it to him Gregory spells out exactly what is needed. We couldn't be happier!

Patrick is an exceptional attorney and has served me extremely well in the 3 years he's been my attorney. He's highly professional, easy-going, articulate, diligent, and extremely knowledgeable in estate planning and real estate law. What impresses me most about Patrick is his approach to working with his clients. Most attorney's focus exclusively on the legal aspects of estate planning with some assistance in identifying tax planning strategies that will increase tax efficiencies. Patrick goes one step further by ensuring that his clients have / are receiving appropriate counseling from financial planning and tax experts to ensure they are best positioned to meet their retirement and estate planning objectives. He's also assisted various members of my family with real estate transactions, estate planning, traffic tickets, etc. My mother and 2 adult siblings also consider Patrick as our "family attorney". I've called Patrick on several occassions to get general legal advice on a broad range of other matters. In nearly every instance he was able to address my questions. Another one of Patrick's attributes that makes him a great attorney is that he knows his limitations - if he finds himself outside of his area of expertise, he'll say so and refer you to the appropriate subject matter expert. Patrick is an outstanding attorney and I highly recommend him to anyone considering his services.

He made sure to stay in contact with us on a regular basis and was always willing to take the time to explain things when they were unclear to us. Patrick provided us with varying alternatives and suggestions and it became clear early on that he has a very deep understanding of the law.

I had the opportunity to work with Teresa on estate planning. Teresa did an exceptional job leading me through the process and making everything understandable and straight forward. Where there were choices to be made, she made sure I understood the options and the implications of my choices. Teresa responded promptly to questions and met every deadline she set. I enjoyed working with her and have no hesitation recommending her to my friends and family.

Teresa breaks setting up a trust into discrete chunks of work which makes the process less daunting. and easier to complete without stretching out the amount of it takes to finalize your trust. More importantly, Teresa listened to me, learned how I live my life and, my distribution goals. In turn she made custom recommendations to create a trust which is personal to my life and memory. Teresa guides you through some difficult decisions. I always felt that she was working for my benefit rather than pushing to finish up. Another huge part of Teresa's service is to ensure that you understand how trusts work especially the changes that you can make to tweak it in the future. The real definition of a living trust. Teresa/Caplan Wilkinson provides simple to use tools to document your assets, your plans and final chapter care. I'm happy knowing that my trust is not fixed but will continue to age gracefully with me.

I highly recommend Teresa Wilkinson for any estate planning work like creating trusts and wills. She updated our family trust and will documents that were over 20 years old. There was a lot to update in the trust structure and wording and for me the new documents are much easier to understand. What stands about working with Teresa are her trustworthiness and thoroughness. We've known Teresa for many years and trust her implicitly. Knowing she's an expert in estate planning and elder law gave us complete confidence in choosing her as our lawyer. Teresa was extremely thorough during our interviews to cover all aspects like advanced medical directives and a number of topics I hadn't considered.

My wife Jennifer and I had a very warm, professional experience working with Kathryn and her staff. Jennifer has a terminal brain tumor and we needed help updating our wills and had several other questions that we needed answers for. Kathryn and her staff showed not only the answers we were looking for but brought up several key points that we hadn't even thought of. They all displayed a relaxing professionalism, compassion and we felt most comfortable that we had picked the right firm to help us. Kudos to all the staff and especially to Kathryn for making a very difficult situation much more tolerable. We will be using them again and would highly recommend them.

Shari has been my attorney since May 2020 and the probate case finally closed this March 2023! I don’t live in Colorado so having to handle this all on the phone or electronically isn’t the norm. She was instrumental in giving great advice on next steps and which way to handle all the legal roadblocks. She always explained the most cost effective way versus just trying to log billable hours. I couldn’t have asked for a better attorney and would recommend her as a probate/estate attorney.

My mother passed away on January 6, 2005, and I was appointed the Personal Representative of her Estate on January 31, 2005. On April 4, 2005, the State of Colorado Department of Health Care Policy and Financing filed a claim against my Mother’s Estate in the amount of $22,000.00 for Medicaid services rendered while she was alive. She also had a couple of debt collectors attempting to get paid twice by the estate. My attorney at the time couldn’t handle a case this size so he backed out. On September 8, 2005, I engaged Shari Caton as my attorney for my Mother’s Estate who helped me prove to the State of Colorado Department of Health Care Policy and Financing that I had received a disability on my back during active military service and that I was receiving disability compensation from the Veterans Administration. This was grounds for the State of Colorado to drop their claim against the estate and so they did. Thanks to Shari Caton and her high degree of legal professionalism, for blocking the State’s Claim against my Mother’s Estate and stopping a couple of money hungry thieves from getting paid twice. Shari Caton is an excellent attorney with a vast knowledge of the legal system, a high degree of legal professionalism and works diligently in helping her clients win their cases. Shari is a great person as well as a great attorney who is second to none. A real WINNER!!! I very highly recommend her to anyone needing legal help.

Ms. Schliem was a hard working attorney that really fought my battle for me in court. She went above an beyond her call of duty in order to get me a favorable decision. It made me confident that I would get benefits by the interviews she gave me before meeting at the hearing. Joan helped my brother with his estate planning and when that was completed he asked that she continue on helping him with other legal matters including a family lawsuit and property dispute. I had never hired a lawyer before, so I asked some friends about their lawyers. Two of them said that I should see Roberta, who lives in my town. I was nervous when I called, but her secretary, Jeanne, was very friendly. Jeanne asked me some questions, to make sure that Roberta could handle my case, and set up an appointment. She told me the first consultation was free. When I walked in, there was the cutest dog I have ever seen (he is Roberta's dog). His name is Sam. Jeanne asked me if I was ok with dogs. I was (I have three dogs), so I played with him until Roberta met with me. Roberta was very friendly and asked a lot of questions about me, my health, my children, and why I was meeting with her. It was very easy to talk to her. I told her I needed a Will. She explained that I should also have a Power of Attorney and Health Care Proxy. She asked me if I was concerned about protecting my house and savings if I had to go into a nursing home. I was glad she asked. I was worried about it, but didn't know how to ask about what I could do. I didn't want the State to take my housel. She told me about MassHealth, a program that pays for the nursing home. She asked if my husband (he died three years ago) was a veteran. When I said that he served in World War II, she said that I could apply for Veterans Aid and Attendance benefits if I needed money to pay home health aides to help me stay in my home. She also said that I should contact the local Elder Services Agency if I need help to stay in my home. She also explained that if I did no planning, all of my savings and my house could be lost if I had to go into a nursing home. She told me about deeding my house to my children with a life estate for me and setting up a trust that could not be changed. It was a lot of information. Roberta could tell I was confused, so she suggested that we have a second meeting, with my children there. She said that my children would be involved in my estate planning, and they should understand the ways I could protect my house and savings. We had a second meeting with my children at the meeting. After the meeting, we decided that the Trust (an irrevocable trust) was the best way to protect my home and savings. Roberta sent documents to me and my children with a letter explaining everything. I went over the documents with my children. I didn't understand some of the legal language, but my children did, so I felt good about signing the documents. We had a third meeting. Roberta explained everything again before we signed, to make sure that we understood and then we signed the documents. I am so glad I called her. I didn't think that an attorney would be that friendly. She did her best to make sure that I (and my children) understood the documents that we were signing. I admit I don't understand everything, but my children do. And I trust Roberta. I feel like that I did the right things to protect my home and my savings. Roberta is very smart and knows a lot about programs for older clients. My children also like her. My son is going to do his estate plan with her. I like everything about going to her office. There are bowls of candy and I really like her dog, Sam.

I called Attorney Schreiber because my mother has alheimers. She was living with me and my family, and we were all stressed out. I have a part time job, a husband and three children. Someone had to watch my mother all of the time. We had to figure out how to keep her from wandering away from the house or turning on the stove and leaving an empty pot on it. I was exhausted by the time I met with Roberta. The first thing that she did was help us get a Personal Care Attendant through MassHealth, at a very low cost to us. That really helped. When my mother got worse, Roberta helped us find a good nurinsg home nearby and she applied for MassHealth to pay for my mother's care. Roberta made things so much easier for me. She did all of the paperwork to get my mother benefits. She is a very caring person. She understood what I was going through (she told me that her father had been in a nursing home before he died). She always returned my calls. I am so grateful that I found her.

I consulted Attorney Schreiber because I was appointed as Executor of my mother's estate. The first attorney that I hired was not responsive and did not tell me what to do after I was appointed. My sisters were asking what was happening, and I was not able to tell them. A friend told me about Attorney Schreiber and I made an appointment to meet with her. She and her assistant were friendly, and I liked them right away. I was offered cofffe, tea, or water and there was a plate of cookies. Attorney Schreiber was right on time. From the first meeting, she told me exactly what to do. She also gave me a checklist to consult after I left the office. She helped me find a good real estate broker and my mother's house was sold three months later. She told me how to close out my mother's bank accounts and she filled out the paperwork to sell the stock. She wrote to my sisters to tell them what was going on. She worked with my mother's accountant to make sure that the correct tax returns were filed. Everything was settled about eight months after I met with her. My sisters and I got our distributions and the estate was done. My sisters and I are very happy with Attorney Schreiber. She even returned telephone calls on the same day.

I am the guardian of a mentally disabled family member. Some years ago I was embroiled in a long-standing, complex dispute with care providers that could have resulted in devastating and dangerous consequences for my ward. Lara entered my legal case at this point, and assisted in bringing the situation under control in just a few months. Her wisdom, knowledge, patience, calmness and exceptional skills as a negotiator and counselor helped to bring about a solution that was better than anything I had hoped for. Since then, I have continued to work with Lara as my attorney for all guardianship issues, which fortunately, have been relatively routine since that early crisis. Lara has such a passion for protecting and serving the disabled. Her compassion is boundless, yet she is like a rock when she takes a stand for what is needed, and she cannot be manipulated. Her knowledge is extensive, yet she is also guided by intuition. Her ability to be impartial, and to understand (and explain) the differing perspectives of difficult people is, and was so valuable in my personal situation. I learned much from her that still serves me well in my continuing relationships with my ward's present care providers. I would highly recommend Lara as an advocate and a resource to any disabled person, or to anyone who takes care of a disabled person.

I first met Jane in 2004. At that time she wrote a durable power of attorney that is as valuable today as it was the day she wrote it. When questions regarding the needs of someone who is incapacitated arise, people can become very tense and forget that their ultimate goal is the welfare of the incapacitated person. Jane has been able to help me and my family members to remember that we are all seeking the best interest of someone who needs special support. She responded very quickly. Mr. Neiburger first spent about 15 minutes on the phone with me (conferencing in my sister), listening to our situation and then letting us know that there were many things that could be done to keep our dad in his house when our mom had to go into a nursing home. We set up an appointment to go into his office, and were immediately made comfortable with drinks (and chocolate!) in a sunny conference room. Ben was very prompt, friendly and sensitive to our dad's discomfort about seeing a lawyer, and fears about money and our mom's progressing Alzheimer's. I felt so much better after the hour consultation!! I know what we can do, and I know the Ben is going to help us through it. At first I was a little surprised at how expensive Medicaid planning was... and then I saw how much it would SAVE us & our dad in the long run. So very worth it. I highly recommend Ben Neiburger.

I had gone through multiple lawyers in my custody dispute with my ex. No matter who the lawyer was, I always spent a fortune and never got more than every other weekend and extended 3 day weekends every other weekend in the summers. I even tried to do Court myself but the system chewed me up and spit me out. I had lost hope but a friend told me to call John. I figured this would be another lawyer upselling my chances or being so vague I wouldn't know realistically what I could expect. John wouldn't upsell me, but after taking a look at my documents and collecting information from me, he told me he couldn't understand how I had so little custody. He was 1/2 the price of my previous lawyer per hour. I figured I had done everything else, I may as well try with this guy. Fast forward to a year and four months (forever to get to trial) later and I have 50/50 custody of my daughters. My ex tried all of her usual tricks and tried to spend me out of my lawyer by filing every single ridiculous motion she could. John defended against every motion, got whole portions of her evidence tossed, you name it. When I last went to court in early 2019, I spent $36,000 on my lawyer only for him to basically threaten me to take a bad deal.. My total cost with John was just under $15,000. It may still sound high to some but considering what I had previously spent on a lawyer and the fact that I got what was right, I would gladly spend it again a thousand times to have my girls. If you need help with custody, look no further!

It was a fairly standard thing for most of us and only a few pages. John wrote up a will, power of attorney, living will, and HIPAA compliance documents. Everything was perfect. He listened to exactly what I wanted and covered every single thing I was concerned about, especially if I were to die while my kids are still kids. The documents are super-thorough and contain protections for everything, even social media. The fee was reasonable to begin with and he gave me a veterans discount on top of that. You can’t go wrong with this guy!

“John helped me and my family when my mom needed a medical power of attorney. My mother is a bit of hothead and didn’t want to get the power done. When I brought in John, she said she didn’t trust us and especially attorneys because they’re all liars. John pulled out his phone, dialed a number and gave the phone to Mom telling her that if she thought he was lying to her that she could call the Idaho bar and report him and his bar number. He told her if she didn’t want the power, he would leave and that would be that. We were shocked! She spoke with him alone, and then she agreed she needed it. He even spent (not billed) time with Mom talking to her about her days growing up in the Treasure Valley on our family’s dairy. She took a liking to him more than she did with most of her own kids! He got the document done, and Mom was happy. Can’t recommend John enough!”

Living in Miami-Dade county, I needed an attorney in Orange County to represent me as the Guardian Advocate for the ward living in Orlando. Immediately, I needed representation for a scheduled hearing before the Court. Time was of the essence. From the first telephone call to Ms. Zoebel’s law firm I received immediate and appropriate guidance, concisely explained and executed. Ms. Zoebel understood my issues and with the help of her legal assistant very efficiently resolved my issues and took an added step that had not occurred to me to improve future dealings as Guardian. She very clearly explained the steps and actions that resolved the situation very favorably and what would be necessary in the future. She demonstrated excellent legal knowledge, communication skills and responsiveness. I believe I am in good hands for any future needs in this area and highly recommend her.

I recently had the privilege of having my will drawn up by Attorney Zobel. I was recently divorced and had to have a custom will drawn up to meet the requirements of my specific divorce settlement. Attorney Zobel took the time to thoroughly review my case and drew up a will that met those needs. She took her time explaining every step of the process. At the time of signing, she went over everything, making sure I had no questions or concerns before leaving. I offer my highest recommendation of Attorney Zobel, as I will plan on continuing to work with her regarding my future needs for legal assistance in my Estate Planning .

Anne doesn't hesitate to push other parties involved to get things done. She did a great job for us.

Ms. McConnaughhay took care of my uncle's estate and trust planning in a timely and thorough fashion. She was very patient - there was a language barrier-- in listening to his needs. She also gave him honest advice and explained everything to not only him, but also to his selected family members upon his request. She took everyone's questions, but continued to protect his interests. Her staff is very helpful and discrete. I will continue to recommend her to anyone who has probate, wills, estate, trust or guardianship issues.

My wife and I were in need of having our existing trust reviewed. I researched a few attorneys and we decide on Ms. Campbell. We met with her and were impressed with her knowledge and professionalism.. She explained in detail what exactly she felt we needed to do. She also informed us about certain problems with our existing trust. We decided to retain Ms. Campbell. One of the things that most impressed me was Ms. Campbell would always respond to my emails in a timely manner usually within an hour. She answered all of my questions in a lay man's term which was greatly appreciated. My wife and I were also impressed with her knowledge of the problems that come with senior law. My wife and I are 69 and 70 and are at the age where we need someone with her knowledge. I would highly recommend Ms. Campbells services to anyone needing estate planning or senior law.

I was referred to Attorney Weatherby by a friend. I have no family but I wanted to leave a separate parcel of land with a garage to a neighbor and my home across the street to a friend. I was procrastinating and dreading the process. Attorney Weatherby was able to provide a draft of the plan as we spoke and shortly after receiving a few missing pieces of information. I worked with Hank Weatherby after a general practice attorney I hired had made substantial errors when advising me on a family member's Medicaid spenddown. The nursing home had threatened to take my home away at one point! Hank took over, unraveled the extremely tangled knot, and provided me with answers and peace of mind. Hank then worked with me on my estate plan to clearly explain all the options I had which were unique to me- there were no fill-in-the-blanks documents. Hank's comprehensive approach to planning and his innovative Lifebridge plan ensures that my estate documents are up to date and are relevant to my life circumstances.

My husband and I engaged Hank Weatherby's services last year to help us plan for our children and grandchildren. As this is my second marriage and the third for my husband, with children from each marriage, we had thought this would be a very stressful process. Hank immediately put us at ease. He provided helpful materials that helped us formulate our goals. He provided practical examples and explanations for legal concepts that would otherwise have been difficult to understand. We had been avoiding this task for several years. Hank guided us through every step of the process and made what had been an overwhelmingly complex matter seem straight-forward and understandable. He never imposed his personal views. Rather, he helped us understand our wishes (which we really hadn't thought through before) and then implemented them. We've been delighted with the outcome and the ongoing communications and support. Hank is proactive and always accessible to answer questions. Had we known how painless he would make the process, we would never have procrastinated. We highly recommend his services

I needed a new attorney to handle my estate planning. Although not ultra complex, I needed someone who could handle multiple trusts, carry out specific objectives, udate provisions, and correct some issues created by a former attorney. I was referred to Victoria Horvatich and Copenbarger and Cooenbarger. After an initial consultation I felt confident that she would be able to handle our families estate planning needs. Working with her was very easy. She was both responsive and attentive to detail. Setting up appointments and completing documents was easy. She took time to explain everything and helped develop a plan for the tasks I needed to do. Unfortunately, before we were able to complete all of the tasks, the COVID-19 shelter in place went into affect. Government offices were closed yet Victoria continued to work on my case. Estate planning is never fun, but Victoria was able to make the process manageable and helped me complete a process that I had too long postponed. I would highly recommend retaining Victoria Horvatich and will be using her in the future.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
