Our Dad was diagnosed dementia/Alzheimers; however, Dad was in complete denial of his condition. We initially had hired a family law atty who gladly took our money but was unable to assist us with straight answers or obtaining guardianship. By the grace of God, we found an elderly law care specialist - Atty Aaron Parks! Aaron is an expert in the field of elderly care law. Aaron listened patiently and compassionately as we explained our complex family situation and our concerns over Dad's safety/circumstances. He gave us concise counsel explaining the process, he pointed out potential problems that might be encountered and how we would address each hurdle that might be encountered. He knows the law and how to navigate complex family/legal issues for the best outcome for your loved one. We had emergency guardianship by the end of the day and full guardianship in 10 days. He is professional, honest, extremely knowledgable and full of integrity. We are so thankful we found him and highly recommend him.

Aaron Parks was referred to me by a friend. I had to drive over an hour to see him but I was assured that the service he provides, his knowledge of the Medicaid system and his professionalism was definitely worth the drive. My mom has dementia and had recently moved in with me. It was time for her Medicaid renewal for the next year. Upon the review, as Power of Attorney for my mother, I was faced with my mother not only being denied future services but to have to repay for services rendered due to an oversight of a small pension check that actually put her over the limit to qualify for Medicaid. This pension check was an oversight by DHS workers a year ago while not in my care. I entered Mr. Parks' office nervous, upset,embarrassed...all the emotions a caregiver can feel when the idea of failure and a move to a nursing home looms near. Upon the first hand shake and hello, Mr Parks' sincerity, caring personality and being a person with a real heart (often times hard to find in the Medicaid system) was instantly felt and put me at ease. He was very professional, spoke with words that i could understand and follow. He was patient and kind regarding all of my questions no matter how silly they probably sounded to him. He listened to all the events that brought us to him, looked at papers I brought with me and it was no time before he knew exactly what we were going through. I was expecting gloom and doom and for him to help pull us out of the deepest hole he had ever seen. Instead, it wasn't a big deal. He deals with these very issues on a daily basis. The solutions although simple, required some work and he was very willing to walk me through the various solutions, as I wrote them step by step so I could implement each one on my own to save money. Not only did he tell me all the steps to take but he told me the response each one would get us from DHS and what to expect. Saving money and doing the leg work on my own was perfectly fine with him but he told me at any time I felt overwhelmed by it all he was just a phone call away.It was all my decision with ZERO pressure! Now confident and knowing all the steps and how they should all play out, I was able to tell the DHS worker I was not jumping through any more hoops nor putting my mom in a nursing home for a few months to throw away what little money my mom had to MAYBE qualify for Medicaid and to leave her penniless for any unforeseen needs she will have. I confidently told the DHS worker to process the paperwork as is, so we could get the denial letter so I and the attorney could proceed on facts, not what ifs. By the look on her face I felt as if I was the first person who had ever spoke to her with confidence and as an equal and not as if she was above us dangling the golden carrot, forcing us to perform for her pleasure, all while services were being toyed with. Mr Parks helped me legally spend down my mom's money in ways that best cared for HER and HER needs, not DHS' best interest. Following "the steps" I paid off medical bills and debt, paid off her car, purchased a burial plan, set up a Medicaid Trust Account, and also paid family members to care for my mom, in my home, round the clock instead of putting her in a nursing home for a few months to spend down the money the DHS way. Per my request for further assistance, Mr Parks set my mom up with a Life Estate. NOW my mom qualified for Medicaid which provides my mom with assistance to help pay for Personal Care Providers while I go to work. Because the steps were so well laid out for me and no time was wasted my mom's care was not interrupted NOR did she have to reimburse the system for their clerical error! Without PCA's assisting us while I work, I am not sure where my mom would be right now. I feel truly indebted to Mr Parks. EVERY detail played out JUST AS HE SAID it would! No hidden punches and no crying or blaming Mr Parks for any surprises. He really knows the law! I recommend him to anyone dealing with THE System!

When I met with Mr. Parker, he took the time to ask questions and listen in order to determine how to arrange my estate with the best interests of myself and my loved ones in mind. He made me feel at ease with personal decisions and family matters and had a calm way of explaining difficult concepts so that everyone understood and could make the right decisions. By the time the process was complete, everyone in my family felt the documents were created with compassion, fairness and clarity for everyone concerned. And as a single parent, I was also pleasantly surprised at how his costs compared to those of other law firms in town. Mr. Parker is a sole proprietor who works out of his home, so he is able to provide a high level of professional services at great prices. After doing more research into typical estate planning costs, I've come to believe that Mr. Parker provides the best value of professional estate planning services in town, so he is my first recommendation when anyone asks if I know of a good attorney for estate planning services.

Alan listened very carefully to our needs and situation. He spent a good deal of time making sure our Special Needs Trust would be set up in a way to protect our children's needs. In the end, we decided to use only a revocable trust, but it was set up in a way to be able to set up a Special Needs Trust for our son in the end. It all was quite complicated (to us) but he was patient, responsive, and thorough. We are very pleased with our final products and would recommend Alan for estate planning.

After my husband's death, I needed legal advice. Chesley, Harvey & Carpenter, PLLP was recommended so I stopped in and was given a Client Estate Plan Information form to fill out. October 17, '16, I had a consultation with Lisa Chesley who made recommendations and filled out an Engagement Agreement. On November 7th, I met with Lisa to sign legal forms and she completed the legal work I requested. On December 20th, Lisa sent a final letter with original and copies I needed. Lisa Chesley was a godsend to me, very helpful, kind and considerate and patient, very professional. This was a good experience for me and I would definitely recommend Lisa and seek her counsel again as needed. NOTE: This involved both a consultation (no charge, which I appreciated) and I "hired" Lisa to execute the legal work.

Ms. Writer was very thorough, she first sent us a detailed questionnaire to fill out so that she could prepare our trust and wills. My wife and I don't have very much but it was important for us to have what we do have protected from probate for our four children. We had the questionnaire for a few weeks and Ms. Writer called to follow up with us to see if we needed any help with it. She answered all of our questions and was pleasant and patient. Once we got the questionnaire back to her office, she sent us a draft to review, there were only a few changes that we wanted to make but as soon as we sent them back to her within a day or two, we received a call from her office that it was ready. Unfortunately, we were not able to come into the office to have the documents signed, my wife had to have emergency surgery and so instead of us signing the documents in the office, we signed in the hospital right before her surgery. Her office set us up with a mobile notary that came and took care of us. That was a huge relief for us. I most definitely would recommend Ms. Writer to anyone without a doubt.

Mr. Sowerby was the one person who not only responded in detail by email, he also spent over 20 minutes on the phone with me. I hired him and I can tell you he not only positively resolved the issues I was having, he did it all under the estimated cost he provided. When you should be focused on grieving, the last thing you want to do in these circumstances is think you could be taken advantage of, Mr. Sowerby had my back, kept me informed, and quite frankly saved the other party a lot of difficulty by informing their attorney of incorrect filings! Fernando was referred to me by a friend because she said he did a good job creating her trusts and I wanted a trust to protect our assets in case we got sued. He also helped us design a will that 'poured over' into our trust so if my husband and I were to die, my son would get what he was entitled to without any hassles or legal costs. Fernando is an expert in wills, trusts, and estates as well as Elder Law. It is all he does! He does not dabble in other areas of law like so many lawyers around town do. I'm very happy with Fernando's legal services and advice. I recommend him to all my friends and clients because he is great at what he does and his prices are very reasonable. Don't make the mistake of going to an online service or "jack of all trades" lawyer to save a few hundred bucks and risk losing your child's inheritance or your assets if you're sued . Go see Fernando, you won't be sorry.

Ms. Schreiber has a thorough and accurate knowledge of the disabled. She answered specific questions regarding the guardianship of my very handicapped daughter. Ms. Schreiber became familiar with my daughter's case and did not generalize questions about her disability or her care. She made sure information was provided to me at my convenience, when I was available, and fought for my child not to have to attend a court appearance. This would have been tramatic due to her disabling condition. All questions were answered and I was at ease with the level of confidence she held and passed on to me throughout the guardianship process. I would recommend Ms. Schreiber to those seeking compassionate assistance.

I first met Annemarie about a year ago when I needed someone who I could trust & provide advice on matters of selling my parents place of residence due to illness, passing & the settling of estate matters. It was refreshing to finally have an attorney who took the stress & worry out of handling such matters during extremely difficult times. Once these items were completed, to which great care & attention were given, I then retained her services for my own personal family needs. Again everything went like clockwork; smoothly & without any stress associated with such issues & needs. Annemarie's experience, guidance & assistance on matters regarding estate planning as well as social security disability were/and are invaluable. This is the first time that I can say in all my years of working with attorneys, from a professional & personal standpoint, that someone actually responded back, put forth a plan, executed it, advised well, followed up, made sure "t's" were crossed, "i's" dotted and returned calls & emails in more than a timely fashion. She has two wonderful assistants, Sandra and Grace, who, together and individually, form a great team. Annemarie's values, experience and care for her clients definitely sets her apart from the rest. No one client is the same or has the same need to which Annemarie understands and pays great attention to. Without hesitation, I have already recommended Annemarie to others and will continue to do so.

Scott is very thorough and never makes the client feel rushed. He’s extremely thorough in answering all of your questions and makes sure you understand and are comfortable with everything. Sometimes lawyers can be condescending but I did not feel that at all with Scott. I've worked with a lot of large law firms but Scott brings a whole aura of a fresh breath to the industry.

After having a bad experience was another attorney, I was referred to Casey (Carl Jr.) by a senior care professional to assist me with the care of my parents. From the beginning, I found him to be understanding, knowledgeable, and a passionate advocate for persons in my position, the caregiver for my disabled elderly parents. He has given me a sense of relief with his supportive demeanor and comforting advice. I have and will continue to refer Casey to anyone who finds themselves in the one of the most difficult positions anyone can be in, the caregiver to your love ones.

My Grandmother means the world to me which is why when it was time to transition her to Assisted Living, I wanted to find an attorney that would protect her assets so that she would be comfortable in her declining years. The first moment I met Mr. Price, I knew he was the right man for the job. First, the office staff is very friendly and helpful making sure that you begin the estate process with the utmost ease. Next, when you have the actual appointment, he takes the time to get to know you and your family needs never overburdening you with things you don't need. He makes himself available to answer any questions and provides excellent and helpful advice without killing your wallet. I now have that peace of mind that my Grandmother's assets and best interests are in good hands so I can focus my attention on caring for her. If you are looking for an attorney to protect your loved one's assets, I can't think of anyone more experienced, kind, intelligent and caring attorney than Mr. Price. Words can never convey the amount of gratitude my family feels for having him in our lives. God Bless him for taking good care of the elderly.

I have been in a professional relationship with Mr. Price for approximately 15 years. My first contact with Mr. Price was regarding my aunt and uncle. My uncle had developed Alzheimer's Disease and my aunt asked me to help her with her financial obligations and my uncle's medical condition. I had no idea where to turn. I contacted the American Bar Association in my county and I was referred to Mr. Price's office as an Elder Care Attorney. I called his office and spoke with Mr. Price about my situation. I advised him that my uncle had Alzheimer's Disease and that my was in a wheel chair. Mr. Price advised that he would come to my aunt's home for a consultation. Mr. Price assisted me in all of the financial and legal aspects of my family's needs. He was always there to answer any questions I had on many subjects concerning my family's legal needs. I have since then had occasion to use Mr. Price's help with other family matters. Everyone in his office has always been courteous and efficient. Mr. Price goes out of his way to be available to answer any questions I may have. Mr. Price has even made appointments with me in evenings and on weekends. I have had nothing but courteous and kind service from Mr. Price and his staff.

Ms. Grayson made my legal experience easy. I was able to get an appointment quickly and she didn't waste time during my appointment having me fill out forms. She emailed them to me ahead of time so we were able to keep the meeting brief and to the point. She was so kind and explained everything to me so that it made sense. The whole process was very fast and there was little work on my end. I highly recommend Dennise.

Ms. Grayson was very helpful in explaining why I needed more than just a will for my children and why it was important to have a health care directive, power of attorney and the pros and cons of setting up a trust. She prepared my will and health care directive and I thought her fees were very reasonable. I also have a friend with a special needs child and she seemed very knowledgeable about Social Security and how to prepare to take care of such a child through wills and trusts. She really seemed to care about helping and not just running up her fees.

Chris did a great job representing my father as we applied for his veterans pension. As a result of Chris's work, my dad's application was approved and he was able to move into the assisted living facility he preferred. After my dad's death, Chris represented the estate in filing for probate and he and his staff did a very efficient job of filing and then completing probate. All of these activities were done under a very fair, fixed fee so we knew our costs right up front and there were no surprises. I recommend Chris wholeheartedly to anyone needing elder care legal services.

I interviewed a couple of Denver area attorneys before hiring Rose Mary Zapor to do my will. I learned about her after asking friends for a referral. Rose has had many years of experience with elder law and services for the elderly, including estate planning, and with how laws work in Colorado. She did my will for a reasonable flat fee, which made me feel at ease, not on the clock, while i asked numerous questions and she answered them patiently. Rose was meticulous and detail-oriented going through various options and scenarios, and gave me some good suggestions and warnings about what not to do. Her staff is efficient, too.

I was so confused as to how to proceed when 2 banks declined to accept my POA for my significant other who now has dementia and is in assisted living . He would probably not be considered able to sign another. (3 other financial institutions had accepted it). I saw Ms. Peterson, dreading the possibility of applying for guardianship. She found no flaw in my POA. Sent a letter to the Branch Manager at each bank, which resulted in their accepting my POA. Also, hearing questions I had about whether his care might be better in another facility, she recommended an agency familiar with over-all nursing home/assisted living environment in Bergen Co. That agency made an objective evaluation (as I was paying them), and made suggestions, which I also found helpful and reassuring. Ms. Peterson took the time to look, not only at the problem I presented, but at the wider picture. I will return if I need help in the future.

When my dad had to go into a nursing home last year, I tried to navigate the complicated process of handling his finances and getting his paperwork in order for the eventual Medicaid application. I finally decided to turn to a lawyer to guide me and I called the firm of Guston & Guston as I have had positive interactions with them in the past on other matters. Linda Peterson was their Eldercare/Estate planning lawyer and I immediately felt like I was in good hands when I met her. She told me exactly what I needed to do to make this process all run smoothly. She was kind, empathetic, knowledgeable, and professional. Any email or call I placed was swiftly answered, always making me feel like I was her only client! She relieved my anxieties and I was able to focus on my father's care knowing the legal matters we faced would be easily addressed. I highly recommend the firm and would confidently recommend Linda to my closest of friends. Thank you Linda.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
