I can't sing enough praises about this kind and knowledgeable man !! My sister is the executor of my mothers estate. I was already having issues with her taking advantage of her position. I was pretty disappointed that she would even do this ... but before I called out the Marines, Doug went thru some options that he wanted me to be aware of. Clear headed thinking is always the best.

Mr.Koenig was knowledgeable and professional as we reviewed policies on home ownership rights and problems. The need to possibly change or transfer the deed, the pros and cons associated with any change; the other possible options: refinancing or sale of the home. He provided specific facts and costs of each options, facts of NC law relative to each option, and positive and negative financial and/or personal consequences related to each of those options. We reviewed local housing levels of care options for seniors, from rentals to assisted living. Lastly we reviewed the NC law on tenancy; the right to rent out a room to either stranger or family; when and how one might evict if necessary. Mr. Koenig provided dates of upcoming appropriate information sessions. He explained a remedy to an incomplete Will and Power of Attorney. I surely will recommend him to others and will return to use his services as needed.

We found Doug to be respectful of our wishes, knowledgeable, thorough, careful and considerate. Beyond this, he offered suggestions that we had considered and were glad to accept to ease future estate settlement. He also made appropriate adjustments in our POA's and Directive. We highly recommend him.

Michelle came highly recommended and rightfully so. After our first meeting I was confident in Michelle's ability to handle my divorce case. Michelle was attentive to my needs and always kept me well informed. It was a contentious divorce from the start and Michelle did a tremendous job with the many "curve balls" throughout the case. In the end, I was satisfied with the result and would definitely hire Michelle in any of her specialties.

My wife and I were recommended to Kara to help us rewrite our wills and estate documents. By the end of our consultation, we knew Kara was the lawyer we wanted and hired her right then. Kara patiently listened to our wishes and desires and had great ideas on how to verbalize these wishes in a manner that made sense and kept things simple. She was extremely prompt with getting us copies to review and worked diligently with us to tweak and adjust where needed. At no time did we feel left out of the process. I highly recommend that anyone looking for a professional, friendly, and caring lawyer to give Kara an opportunity. You will not regret it.

I was very impressed by Ms. Gansmann’s legal knowledge of elder law and estate planning. She was at all times a very personable, pleasant and accommodating person to meet and work with. I was pleased that my existing revocable trust did not need to be completely redone and instead could be restated which did not require re-funding of accounts and assets. I would highly recommend her.

I've worked with Dan four times over the past ten years to create and adjust my estate plan. Each time, he's been attentive to my detailed requests, and always takes the time to explain my options and answer any questions I have about them. One of these adjustments happened just before my (unexpected to me) divorce, and Dan was especially helpful and accommodating in making additional changes to my estate plan that reflected my new circumstances. He really went above and beyond during that time and it meant a lot to me.

My husband and I needed a will and turned to Krause Donovan for their help after the firm had invited us to a "what is estate planning all" about dinner/meeting. Having a will was something we knew we needed, but kept putting it off. Krause Donovan was wonderful...they asked all the right questions, were patient with our back and forth, and everything was wrapped up successfully. We are relieved that there is a plan in place. That gives us peace of mind.

I got into a situation that was very serious if convicted would take many of my freedom rights away as a citizen as well as going to prison, for sure a attorney to get out of jail, and the help that was to come. I did as you would have looking for a attorney to help it was first time I was in trouble and had no idea what to do. I owned my home so there was no public defender for me. I contacted several attorneys most of them wanted around 30,000 plus expenses. I am over 75 years old an retired. One of the attorneys in longbeach i talked to did not do felony cases, and told me about Jon Quittner, what a blessing. Jon not only was willing to work with me on the cost, but was caring, and felt i was unjustly charged .He worked on my case over 3 months, and still is willing to answer questions that i have. He did get me out of my situation, still very supportive, and caring about me. Mr Quittner is a great lawyer, but more than that, but one of the nicest, caring person i have had the privilege to meet. I feel Jon is a true friend, i don't use that word very often. If you need help i truly telling you he is the best. Thank you Jon....roger

We hired Jon about 2.5 years ago to advise initially on what was a small chance of paternity. He was new to town but he clicked for us instantly. He advised late pregnancy on paternity giving us options. We chose from those and ultimately paternity was established.  This meant a need for a parenting plan, again Jon advised options well and guided through the mounds of paperwork. The decision on both sides was try co-parenting in the best interests of the child, to have the best of both sides. A plan was submitted, and the Judge ordered a GAL be attached. That wasn't what we expected but we were lucky to get a Gal that took her time, and carefully monitored. Co-parenting started out well but over time trust and co-operation degraded. Mom filed for primary first but both sides had come to the point where it was accepted it couldn't work as it was. We filed in return, and that is where Jon really came into play. That started with a hearing that established our side as temporary primary with a trial set if it wasn't worked out. A trial was imminent as the Mom wouldn't even talk about it. Again Jon and his team did well to advise and provide support throughout, insuring both sides were being fair. Trial ended in primary being permanently assigned to our side. Jon did a very good job making points while being as kind as he could be. We were lucky we had professionals across the board from medical, to development, and the GAL all looking at this situation as what was best for the child, and not gender. It was not an easy or a fast path, it was certainly not without a great deal of stress but, Jon was there the whole time. The child got what was best, that the greatest blessing of all. Needed stability, and healthy/safe situations were addressed and now is doing very well, playing catch-up, as a result.  We are pretty down to earth plain speaking people. We feel very fortunate to have gained Jon and his team not just as legal advisers, but confidants and even friends over the course of time. More than being a good Lawyer, Jon Quittner and his team are good people!

There are no words to express our appreciation for Lindsay. She helped at a time when we had issues going on with both our parents. Our Dad had dementia. It made it very difficult getting him to understand about the Medical POA, Living Will, etc...Lindsay was very patient going over everything until she knew he understood about all the documents. She also fit us in to take care of this without an appt. (what lawyer have you ever heard of would do that). Someone who has dementia you never know what the day will bring. If Lindsay hadn't been so understanding what happened next would have been unbearable. Our father broke his hip, had surgery, went into a home and died two days before Christmas. Just 2 weeks after everything had been completed. We were able to make the right medical decisions for him, pay his bills, etc... without any additional stress. In regards to our Mother. I had taken upon myself to get my mom on Medicaid in 2010. Not realizing that we would lose an additional 50,000. All because I wasn't informed about what documents I would need to protect my parents and future generations. I even used a regular lawyer to write my dad's will. All of which was a bad idea. Someone I knew mentioned using an Elder Lawyer and recommended Lindsay. Which I am forever grateful for. Lindsay takes care of making sure my mom stays on Medicaid every year. She made sure we had the right Will for my dad so that when he passed. My mom wouldn't be kicked off of Medicaid. She is also helping us take care of Probate, etc...for my dad. Taking a huge burden off my family. We tell everyone we know that is taking care of their parents. Don't make the mistakes we did. Go To Lindsay Graves and she will protect you and their parents.

I worked with Lindsay beginning three and a half years ago, when my mother was diagnosed first with cancer, through present when she suffered a debilitating stroke. None of my mother's legal affairs were in order, and I had no idea where to start on figuring things out. With Lindsay's help, we were able to retire my mother from her job, secure her insurance and property, and ultimately find a wonderful nursing home where she's receiving top-notch care. I can't say enough about how willing Lindsay was to take the time to answer all my questions, big and small...with a big dose of compassion too.

After moving from Michigan to Wisconsin in late 2019, one of my top priorities was to revisit my Estate Planning Documents that were completed in Michigan with my family attorney there. My goal was to ensure that my documents complied with Wisconsin law. This project was a special priority for me since my wife had passed away in March of 2019, and my intent was to locate a competent attorney who specialized in Estate Planning. So I started making telephone calls to numerous attorneys in this area listed in the Yellow Pages. I had many questions for them. Finally, I found the Frozena Law Firm. After asking the receptionist several questions, I made an appointment. After my first appointment and having a very informative and productive meeting with Angela Frozena, who was very congenial and very knowledgeable. She briefed me regarding what additional information I must provide her, so we setup a future appointment for after I returned from vacation in Europe in three weeks. Upon returning from Europe, I returned to Frozena Law Firm for my second appointment. At this appointment, Angela had already received the documents from my former attorney in Michigan, and had the draft of my new estate plan prepared, and sent the documents via encrypted email to my home in Racine. After reviewing the draft documents, I returned them to the firm for finalization. At my final appointment, everything was organized and Angela had already made arrangements for the witnesses to be present. Everything went so smoothly, and I was impressed with Angela's knowledge, efficiency, sincerity and her positive attitude. Her professionalism is second to none. And along the way, Angela and I communicated via telephone and email. I was so impressed with the courtesy and respect shown to me, that I am happy to share my experiences with Angela, and to highly recommend the Frozena Law Firm to anyone in need of competent, efficient estate planning services.

When our mom relocated to Florida, we contacted a Florida attorney to have the appropriate legal documents in place. However, over the years her health met with assorted challenges. A bout of protracted health issues transpired and the decision was made to return her to New York. We soon realized that Florida estate planning documents may not be easily utilized in New York State. It became abundantly clear that New York documents were necessary. Through an excellent referral, we met with Aaron Futterman, Esq of Futterman, Lanza and Pasculli. The firm being dually admitted in New York and Florida was more than capable to bridge the two states and assist our mom and family. A short time frame for completion was evident to get the documents finalized. Mr. Futterman was professional, knowledgeable, approachable and accessible to answer all our concerns and questions. His years of experience and ability to dissect, analyze and find resolution to complex matters proved to be an added benefit. At one time, our mom was unable to visit him at his office and he actually met her at her residence. Mr. Futterman’s calming, assuring demeanor with a splash of humor was comforting to my elderly mom. Having dealt with other attorneys, we can absolutely state that Mr. Futterman is an exemplary attorney. The staff at Futterman, Lanza and Pasculli were all equally accommodating. We are so glad to have met and worked with him and will absolutely continue to do so as the need arises.

My husband and I sold our home without an agent so Mr. Emmi went above an beyond when there were hiccups along the way to closing on our house. On top of that, my husband and I were two states apart from each other during the process and he was very patient with all that was involved in talking to both of us and getting things signed. He is a man of integrity and takes his job very seriously. Never once did I feel like he didn't have time for either of us to answer our questions (sometimes twice) or move forward towards the next step. He was very organized, professional and very pleasant to do business with. I would highly recommend his services to anyone.

I had great experience with Anthony as an attorney, I was very stressed about a legal situation I was in but as soon as I retained him he drafted and filed the proper papers right away and kept me in the loop regarding the progress of my situation. Certain times I thought I knew the right action to take but Anthony would advise me to take a different route and I am very glad I listened to him.

My wife and I finally decided to create Wills, Powers of Attorney, and Advanced Directives. Of course we hoped to get them completed ASAP, as we were embarking on a trip and wanted things in place, “just in case.” Attorney Bohorad met with us, gave us very effective counsel, and met our self-imposed tome frame. This was our first experience with a law firm since we bought our home over thirty years ago, and it was a good one. We would recommend this practice to anyone.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
