Our non-profit was in tax trouble and suspended by the Secretary of State. We also had a patron that wanted their donation back. This attorney resolved all of it and returned the balance of our initial retainer. She resolved the issue with the patron over dinner and got us a compromise offer for our tax troubles. She was tough and gave us great advice about letting go of our Executive Director which was better for us in the long run. We are healthier today as an organization and even though she will not join our Board of Directors, we admire her and would recommend her if your having compliance issues.

My husband and i used Michele Dobson Wilson for the preparation of our Living Trust that that was somewhat complicated. Michele was very professional, extremely knowledgeable on these types of legal documents, answered all of our questions, and made recommendations. In addition I also have first hand knowledge of Michele's legal expertise and professionalism as I am on the board for a non profit and Michele represented our non profit in a wrongful termination suit brought forth by an ex-employee. She was excellent in reviewing all of our documentation and confirming to the court our non profit did not wrongfully terminate this employee.

I met Matt when both of my parents were going downhill physically and mentally. My mom had been sick for years and my dad had just suffered a massive stroke. Both of my parents were under age 70. I have 3 siblings and we all agreed we needed guidance. I don't know how we could have done it without him. With his guidance and knowledge we were able to actually retain some of my parents assets that otherwise would have gone straight to the nursing home. Matt's knowledge of the Medicaid system can only be described as PRICELESS! Many people cringe when you tell them you had to hire an attorney and the first thing they ask is "Is he expensive?" Our experience with Matt left us with more than we would have had if we had not hired him. I feel like he took so much stress out of the Medicaid nightmare and let us focus on being there for our parents. I have referred many friends to Matt and have received many thanks from them. I have actually referred to him as " my guardian angel"!! He is easy to work with and his assistant, Lisa is always available for questions and has become a true friend.

I have been working with Matt Darpel since 2010 on my parents’ Estate and Medicaid planning. His knowledge and guidance allowed the family to focus on the most important part of the process which was taking care of my parents. With his experience, and unparalleled knowledge of Medicaid, Matt was able to maneuver through the obstacles to secure the Medicaid benefits. His patience and expertise was truly demonstrated throughout the entire process. The staff was extremely kind and attended to the family in a personal manner. The stress placed upon families making the difficult placement decision, the burden of financial decisions, and emotional support for the remaining parent and/or family members can be overwhelming, but the assurance and trust of Matt and his team allowed us to have peace and no regrets with our decisions. Our family has been truly blessed working with this professional team!

Matt's services were recommended to me by a friend when I realized I would have to file for Medicaid for my Mom. Having never done this, I reached out to Matt and hired him to handle my case. Matt met with me several times and explained the entire process, handled all the paperwork, and handled all meetings with case workers to successfully get my Mom approved for Medicaid. I truly could not have gotten through this event without his expertise and guidance. He and his team continue to help me when anything arises involving Medicaid for my Mom. I have been asked by two others for a lawyer recommendation regarding the Medicaid process and have given them Matt's name. I truly trust him, his knowledge and expertise to handle these types of life changing events for yourself or a loved one.

Attorney Kilkenny represented me in a landlord/tenant dispute. He was recommended by another attorney. At first I was a bit apprehensive about hiring such a young attorney but Attorney Kilkenny has proven that honesty, intelligence, and a strong work ethic can provide excellent results. I was originally planning to spend $4,000 on attorney fees but he was able to negotiate a deal with the landlord and reduce it to about $1,000. He's willing to do what is in the client's best interest rather than what is more profitable for himself. His hourly rate is also very low for the caliber of his skills. I've used attorneys at large law firms in the past and have found that they sometimes don't have enough time to dedicate to my case. Attorney Kilkenny, however, promptly responded to all my calls and emails and I can't recommend him enough.

Contacted Attorney Fitzgerald to take care of a short suspense need for a trust, lady bird deed, and miscellaneous legal advice on issues of elder law with a Mother unexpectedly facing a life change and entry into a nursing home with challenges of end of life along with the discovery of little previous planning. Chris shifted, accepted the task and responded with excellent help. A calm, sage, skilled and personable Attorney that is also complimented by an outstanding team of professionals in the office. Forty plus years of Federal service behind me around the globe - I’ve had General Counsel in my staff and have been supported by some great Attorneys. Attorney Fitzgerald’s performance has clearly been superior to that I previously thought was great - he has reset the bar. Chris’s and his team’s work is superb and they deliver - words matter but deeds done and done well matter more. Chris’s legal skill set is without peer and he and his select team, delivers. You can trust these good people to do the right things and to do the right things, right.

We hired Tom Minetree to handle a Medicaid benefits application for a family member. Despite the intertwined finances of the applicant and his wife, Tom's office ably prepared the application and determined precisely when it should be submitted. The state Medicaid agency challenged a property transfer that had occurred prior to the submission of the application. We would up litigating the issue before an administrative law judge who, thanks to Tom's capable representation, determined that we had, in fact, complied with the strict requirements of the law. Furthermore, the state Medicaid agency affirmed the decision and confirmed benefits as of the date of the application.

Being single with no children, I decided it was time to get my affairs in order and sought the advice of Tom Minetree who specializes in elder law and estate planning. During my estate planning it became very evident that Tom knows his speciality and provided some very helpful legal insight into my affairs. After my first consultation, I thought my mother should look at her estate planning. My brother and I first met with Tom and came away again with the feeling Tom really knows what he is talking about. During the establishment of our mother's estate and that of mine, I can truly say it was a pleasant experience, unlike others I have had, to deal with Tom and his staff. Tom sees the big picture and looks down the road to the future. I called several times and asked numerous questions and not one time was I talked down to nor felt my questions were unwarranted. I trust Tom to tell me like it is and to have my and my family's best interest in mind. If you need legal advice in elder law and estate planning, I highly recommend that you give Tom a call. When we had to move Dad from Hospital to Nursing Home with an expectation of long term Medicaid needs, I needed good advice fast. Somehow I came across Bill’s first blog, where he said he saw himself as an elder advocate. Sounded like a nice guy, so I moved on to his main website and left a contact request over the weekend. When he returned my inquiry early on Monday morning he didn’t disappoint. So kind and helpful! Our situation was so simple it could really be handled by downloaded documents without an attorney. He offered an overview of the Medicaid process with really helpful insights that were not among the info I had unearthed in hours and hours of search and reading. I feel I can handle the Medicare and Medicaid application process with more confidence now. I am so grateful for his willingness to take 20 minutes to answer my questions. His answers really changed everything. If I had a more complex case I would certainly ask Bill to handle it.

He always kept us informed, and was always honest with us even if it hurt. He promptly returned phone calls and responded to e-mails. His style was to get to the point quickly, and not waste time. Within just a few short months, we were able to get the matter resolved and got the squatter out of the house. We had to pay the squatter a little money in order to get him out, but we were okay with that because it would have cost us a lot more if we had to go to trial. I first consulted Scott Hartley in October 2010. My wife and I wanted to review and revise our Wills, and also a Family Trust that we had established many years previously. Also, we needed to do a Durable Power of Attorney, and Advance Health Care Directive. It was apparent immediately that Scott Hartley had broad expertise in all these areas. He listened carefully to what we said, and asked critical questions in order to understand our wishes and needs. He did a first rate job in setting up all the documents for us and taking us through them so that we understood what they meant. We have recently needed to meet with Scott again to re-visit the documents drawn up in 2010, and seek his advice regarding some changes that we had in mind. Again, the whole experience has been very positive. He listened, and asked the right questions to make sure he understood what our concerns were. then, he told us in clear language what the options were, and the consequences of each option from a legal standpoint. Scott is thoughtful, and clearly an expert in his profession. I have a great deal of confidence in him, and I am delighted that he is our lawyer.

Ted Hoppe is exactly what you want in a family law attorney. He is fair and honest and has no fear about telling his clients the truth, even if it's not what they want to hear. His staff is friendly, sympathetic and caring. I've been working with Ted in my divorce and custody case for over two years. He has treated us like we are part of his family, been available at all hours for emergencies and has kept my child's interests as a priority. He hasn't forgotten a single detail about my case and has been there when we needed him. His focus, legal expertise and knowledge of the judges and courts makes him invaluable. One thing I really like about Ted Hoppe, versus other attorneys, is he truly listens. Not just to his clients, but to the judges, to the other attorneys, and has this uncanny ability to cut through everything down to the issues at hand.

We now have valuable peace of mind due to Steve's top-notch wisdom. We can live our lives with assurance that we are taken care of no-matter what circumstances life throws our way. Also, Steve assisted us with locating an Elder Attorney for our Mom in another state to execute a trust for her. Hi Kathleen, I wanted to sincerely apologise for the fraudulent review this account left. This email account is meant to be registered to my old (defunct) photography business in Australia. I have no idea how they managed to create this account to leave a fraudulent review. I have changed the password and enabled 2 factor authentication, so this shouldn't happen again. Sorry again!

Kathleen was the only attorney that we could find all over Western NC to handle mine and my husband situation. She was very helpful and quick to respond via email. We never had any problem with the firm. I highly recommend contacting Kathleen for any guardianship, estate, and medicaid law.

This lawyer was very generous in responding to my question posted on avvo.com and was even more helpful in responding to a follow up question I sent her. The result has been that I now have confidence that I can handle the matter in an intelligent manner. Without her answers, I was just guessing.

He was very thorough and helpful with putting together my trust. My husband had just passed away at age 36 and I was in no way able to plan for the worst in case something happened to me. Tyler walked me through it and made all the arrangements to get my trust finalized. He even assisted with some checks that came in my husband's name that I was unable to deposit since his name was no longer on my account. I would highly recommend him and if I EVER need legal services again I will definitely use him. He even helped answer some contractual law questions I had for my son. For which he never charged me for. He is great.

I contacted Tyler last year to do a living trust, to me it seemed very complex because I am a business owner, property owner and have various other assets like cars and equipment. Tyler to all the time needed to explain how the trust works and and options that I should consider, the end result is what I consider a highly professional family trust that puts my mind at ease knowing this was done by a lawyer who not only specializes in wills and trusts but truly cares that it is done properly. Tyler is very "hands on", no dealing with a paralegal here.

My brother and I hired Mrs.Barriga to set up a guardianship for our father a few months ago. She helped prepare the guardianship application, helped us find an appropriate nursing home and aided us in completing the Medicaid application for state benefits. She was very clear with and knowledgeable in the entire process and left us with peace of mind.

What a very pleasant experience we had with Ms. Barriga. We, like most people, put off having Wills or Living Wills done because we don't know what all it intails. A lot of people tend to think it is too hard to go through the process. We were no different in feeling that way. Ms Barriga made us feel relaxed and comfortable when exposing our personal needs and requests. She certainly made the right choice in choosing her field and we certainly made the right choice in choosing her. We have recommended her to our employees and to our families.

Glenn has been a godsend for our family, starting with setting up a Living Trust for my father and a Special Needs Trust for my brother. Every time I've had a question, whether it was financial, tax issues, or difficulties in dealing with assets to be placed inside the Special Needs Trust, and dealing with Social Security and Medicare, Glenn was always a phone call away to provide guidance and a sure hand. Many nights that could have been sleepless, weren't because of the help I got from Glenn. I highly recommend him.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
