After four and a half long years our daughters are where they belong with their mothers. Todd did an excellent job answering our insane questions, quelling our fears, and letting us know when things didn't look good. Court date after court date he doggedly wrote motions, filed petitions, requested files. Even more fact gathering and pursuing leads, very thorough work. My wife and I are very happy with Mr. Sivia's work. If services are needed again I will definitely call him first.

I found Todd to be a man of great personal and professional integrity. He was able to organize and coordinate a great number of tasks and responsibilities and establish appropriate priorities in handling them. He was efficient, conscientious and refused to accept less than high quality work from himself. He was professional, took the appropriate time to address my needs and questions and was quick and efficient in resolving my needs. He is a pleasant, sincere and approachable person. I would and have referred him to both my colleagues, clients and family.

Matthew Perkins was the lawyer I chose to handle the settling of my daughter's estate, and I am certainly glad I did. I had plenty of questions, and he always had an answer for me. When I contacted him or his office, I always received a timely response. He is young, energetic, intelligent, professional, and very knowledgeable. One of the things I admire most about him is that he is willing to take on new challenges. Hiring Matthew Perkins to handle this legal matter was a very wise choice. I would recommend him if you are looking for a lawyer who will take the time to sit down and explain things to you. He never left me in the dark as we went through the necessary steps to set up and then close the estate. I could not be more pleased with the professionalism that I received from Matthew Perkins. If you are in need of the services of an attorney, at least set up a consultation with him. I believe that you will be very impressed with his can-do attitude. If I need legal services in the future, Matthew Perkins is definitely the attorney that I plan to hire.

Went to Bradley a couple of years ago for a consultation regarding an elder parent. We were impressed with his knowledge and advice. When a more complicated matter came up with another parent, Bradley was the first person we thought of and he didn't let us down. We never could have pulled off what he did in such a short amount of time. Many thanks to him for his expertise, humor, empathy, and work ethic.

Estate planning is a difficult topic, as an Accountant, I knew what my Mom should have to protect her assets but getting my Mom to agree was a totally different thing. Ben took the time to listen to what I thought my Mom needed and to my Mom and was able to come up with an estate plan where all of my concerns were addressed. He has so much compassion for his clients, my Mom felt comfortable with him within a few minutes of our initial meeting.

I hired Ben in the summer of 2017 to prepare two important documents: a Durable Power of Attorney, and a Health Care Proxy/Living Will. I also used him as a consultant on my will, which was prepared by an attorney in New York City. Ben's expertise and professionalism were clearly evident throughout the processes. He answered all my questions thoroughly, without pretense or condescension, and made it plain that these important documents were as much of a priority for him as they were for me. Ben's friendly, unassuming manner, coupled with his admirable habit of responding to phone calls and e-mails promptly made all my dealings with him a pleasure. I have dealt with some pretty hotshot attorneys in my time, and Ben ranks up there with the best of them; he's the real deal.

Everyone in the office is wonderful--friendly and accommodating. Neel explained everything that I needed to know, gave me choices, guided me and let me make up my own mind. When decisions had been made, Neel and the staff swiftly put together everything that I needed into one complete package. She guided me through some of the difficult decisions that had to be made and did so with a high degree of empathy and professionalism. What began as the fulfillment of a goal to secure my financial matters has morphed into a solid and ongoing relationship. I now proudly say 'my attorney.' I had a very, very tricky Personal Injury ("slip and fall") case that my own attorney eventually rejected. It's got a lot of risk, it involves attorney-expense, time, etc. It's against a Major Bank who vigorously defends such claims, etc. For so many reasons it's WRONG for the top attorneys in this field. Many or most who either hung-up on me or didn't call back, write back, acknowledge receipt of previous attorney's Demand Letter, etc. Even my own attorney was very lukewarm and unable to give this much time. I understood and understand it all. The fact that an attorney showed interest at all buoyed my surgery and necessary physical rehab, which took a good six months just to again walk. So either way I won, either way this turned out well because I'm walking again, in the gym, exercising, etc. Attorney Katz was just awesome in that he spent some time on the phone (despite being busy and involved in at LEAST one other trial). Returned all calls. If he said and says he'll call he does and did. I was just amazed at the Class-Level given the fact this Slip-and-Fall case is not an attractive proposition. I knew when my first attorney said he's bailing that it was a one-shot thing, a Demand Letter then everyone go home. People have to make a living, pay the rent, it has to make sense for these top guys. From what I understand, Attorney Katz is about as "Tops" as it gets. My first attorney was SURPRISED to hear Attorney Katz expressed ANY interest. (thought maybe I misunderstood or had wax in my ears). He said REALLY, Richard M. KATZ returned a call on this - wow - did Attorney Katz SEE the Demand Letter?! Which just shows how other attorneys in this field regard Attorney Katz - as the top of the top. I'm writing this because I just got off the phone with Attorney Katz. He AGAIN called back (each time I'm shocked), this is THIRD time even though he senses/knows there's nothing very strong - or unusual - or favorable about my position. Which is okay, as written I recovered, I'm well, I'm exercising again - as written the THOUGHT there might be compensation for a difficult year BUOYED my rehab, at least gave me some hope. So Attorney Katz, just wanted to come here, reflect on what a class guy you are - and how anyone needing a top Los Angeles-Pasadena-Glendale-based attorney should first consult you. I'm really in awe in light of the response from the others - and my respect for you knows no bounds. Thanks very much again for your time and attention: Joseph K

Our Asset Protection and Medicaid application started with an attorney in Leesburg, VA. The trusts they wrote and the strategies they used to protect the assets made our case unnecessarily complex almost to the point of failure. It later surfaced that they were not qualified to file a Medicaid application in the state of Florida. This attorney said we would have to find a qualified Florida attorney at our own expense. We learned what a bad attorney is. We chose Jason Penrod of Family Elder Law for the Medicaid application. Family Elder Law reviewed the trusts from our Leesburg attorney and explained clearly to us how the battery of trusts the Virginia attorney had created were inadequate and could jeopardize the process and require going through probate; something even a basic trust can avoid. Family Elder Law took control after seeing the substandard work from the Leesburg attorney and drafted a Qualified Income Trust (QIT) to replace a poorly written Living Trust and corrected other Trusts. Their revised Trusts contained the proper language required for the States of Florida, Maryland, and Virginia where the assets were located. We now know what a good attorney is. We also worked with the staff of Family Elder Law and they earned our trust and confidence with their in-depth knowledge, clearly stating the direction we would proceed, and why this was a better strategy than what the Virginia attorney had started. Everyone, including Jason, were willing to clearly answer our numerous questions. When we emailed or sent a text, they responded within minutes not days. They knew how the different Trusts were essential to achieving a successful outcome. They clearly guided us in the roles and responsibilities for managing these Trusts and how to avoid possible costly errors. Several years have passed since we placed our faith in Jason and my mother-in-law sadly has since passed. I can say that fulfilling her final wishes were positive.

I met Jason a few years ago when he helped my father with my elderly aunt's transition from Texas to a Florida ALF. Now several years later Jason and his associates have helped me navigate the uncharted waters with my mother and father and all of their needs. You never know how quickly life can change. My mother suffered an injury that rendered her unable to care for herself and my father. We were totally unprepared for everything that had to be taken care of in a short amount of time. Jason and his staff have been an invaluable help to me. Not only with the legal aspects but they were there for me emotionally. I had no idea where to start. Jason and his associates knew exactly what needed to be done and when. I was able to concentrate on my parents and not worry about the legal details. My father has since passed away which brought other changes to our situation. I am currently working with Samantha Carter. There are no words to express my gratitude for everything she has helped me with. She is always there to answer my questions. I never dreamed how complicated life can be. When my father and I came to see Samantha, we were struggling with what seemed like an insurmountable challenge: applying for and obtaining MassHealth benefits for my 86-year old mother, who has late-stage Alzheimer’s and who was in desperate need of round-the-clock care. The MassHealth approval process has innumerable requirements. It is tricky, and it is one of those applications where it would be easy to make a mistake and end up creating delays if I had attempted to navigate it myself. Samantha, however, stepped in with her considerable knowledge, her sharp attention to detail, and her diligence, and made this overwhelming task completely manageable. She would check in with me, or I with her, and her guidance and *patience* during this time was invaluable. She was always available to answer questions, not only mine, but anyone who was providing us with essential documentation for the application, and who might need an explanation of what was required. She called in for three-way conferences, and wrote emails on our behalf requesting information. We always knew where we stood, and she anticipated and prepared us for any potential problems, which she would then help us to resolve. She is utterly honest and straightforward. Several months on now, my parents’ lives have improved immeasurably: my mother is securely cared for, in her own home, with all the attention and guidance we could ever hope for—and all owing to Samantha’s considerable efforts on our behalf. I cannot recommend her highly enough.

My sister and I wanted to take a moment and thank your firm for the outstanding service and support we have received regarding estate planning for our parents. Helen Mesoloras, Melissa LaPointe and Erin Vogt have provided guidance and their expertise while also displaying genuine care, concern and compassion. When my father suffered a massive stroke in October '15, we were left overwhelmed and lost as to what to do next regarding his care. After being referred to your firm by in NY (where I live) I spoke to Erin who listened and right away assured us your firm could help not only in estate planning but with the medicaid process as well. From our first meeting with Helen and Melissa, we felt confident and secure we were not alone, and that we would have someone helping us advocate for my dad in the nursing home he was at. As for the medicaid process, being that I do not live in town, the idea of my mom and sister having to do the medicaid application alone was not an option. Had it not been for your team organizing everything and informing us when items were still needed I honestly think we would still be knee deep in paperwork today. Another turning point happened in December when I was talking to Erin regarding my dad's overall health. He was extremely depressed and not eating at the time. She suggested that maybe palliative care could help us. While initially on palliative care, since February he had been on hospice care. But had it not been for Erin we never would have known about these services. While unfortunately our father passed away recently, we continue to work with your team regarding my mother's estate planning. We feel great solace in knowing that dad would want us to make sure mom is taken care of and protected in every way. Thank you again for all your support.

Julianna is both insightful and empathetic with her broad understanding of all legal issues dealing with elder care. She has gone above and beyond in all areas. I feel like Julianna is part of the family; fighting for my mom’s welfare, looking out for the best aspects of care for my mom, and making sure both her and her family are protected during these difficult times.

Julianna was recommended to us. In our initial consultation my husband and I felt very secure in moving forward with a restatement of our trust. Everything was explained thoroughly, conversation was easy, questions were answered clearly, and when we came in to sign the documents were were astonished that this new document was by far a more thorough and better organized document than our former trust document. Julianna'a knowledge, and her friendly, assuring demeanor made us feel like we were her only clients. I have recommended Julianna's qualities and capabilities to many others who I knew could benefit from her thoroughness in carrying out the services she offers. My husband and I look forward to a long relationship with Anacapa Law.

Michael helped our community group fight a large development. Our cause would not have achieved the level of recognition and attention that it did without Michael's wisdom, forethought, and execution. I cannot thank him enough for his help.

Michael Molland represented me in preparation for trial in a consumer law case opposing a large corporation. He inherited a complicated case and was quick to understand the intricacies involved. From the beginning, he was able to accurately pinpoint areas of strength and weakness in my case. He intelligently used this to define multiple legal strategies and as a result opposing counsel had to rethink their success at trial. In preparation for trial, the combination of his knowledge, extensive legal background, and skill as a litigator was clearly evident. At all times I felt a confidence in his legal representation. He is an excellent attorney who I would highly recommend to clients with cases both small and large.

Michael Molland has represented Citizens Advocating for Roblar Rural Quality (CARRQ) for several years in our fight to prevent the development of a gravel mine in rural west Petaluma. As an all-volunteer neighborhood group, CARRQ took on the uphill battle against the project developer and the County of Sonoma to stop the project, but it was not until Michael stepped in to help us that we were able to achieve any success at all. Michael took our case because he believed in our cause and wanted to help us make a difference in our community. He helped us craft strategies to oppose the project and guided us through years of legal actions. He (and his team) devoted hundreds of hours to our case and skillfully and tenaciously represented us before public agencies and in court. Of most importance to me though, has been Michael’s integrity; his ability to listen and put clients at ease, and his passion for doing what is right. I will be forever grateful to him for his counsel and I highly recommend him.

He is very knowledgeable in the process of qualifying for disability and made things much easier on me so that I could concentrate on my health. He didn't talk down to me and explained things to me so that I could understand them. I would recommend him to anyone as he is very professional in his business.

Ashley Scarpetta was consulted to learn if our aging father's will needed fine-tuning to accurately reflect and ultimately fulfill Dad's longstanding wishes for his family. Ashley welcomed our concerns by answering our many questions, educating us in a manner that was easy to grasp. Most importantly, Dad had some highly personal, sensitive matters that had to be considered. Ashley instantly responded in a manner that revealed both her extensive knowledge and her own depth of character. Hiring Ashley to convert Dad's outdated will to a trust brought immediate peace of mind to our father and will infinitely simplify matters in the future. Additionally, we now have the added benefit of an updated health directive that we know reflects my father's wishes, were he ever to become incapacitated. We had not even considered this as Dad had previously prepared a living will 20 years prior -and was now out-dated, as we soon learned. Ashley included this in her services with no additional fee, "because it's that important!" I would highly recommend Ashley Scarpetta for estate planning.

My concern for my grandchildren to have a secure and stable home was the reason I stepped up to become their legal guardian, since they were in the system from early on in their young lives. However, issues which placed their safety in jeopardy was the reason I decided to adopt them. I knew the adoption would be bitterly contested, nevertheless, I placed the best interest of the children ahead of any concern I had about any objections, and proceeded to look for an attorney who could help me. I do most things online, but this time I went to the yellow pages of the phone book, and as I thumbed through the pages of attorneys one firm stood out to me. I contacted their office and was met with a friendly greeting and very helpful person who relayed my concerns to the attorneys. They set up a free consultation with me that was very timely, and during that consultation the attorneys listened closely to my story. They were honest with me and explained that there was a chance that I would not win my case, and they explained clearly why this was. They also told me that with all the information we had, there was a very good chance that I would win. I was encouraged by the attention and professionalism displayed by this firm and by Attorney Chad Rayle who took my case. Chad was prompt with supplying me with information and asked questions whenever he need to via phone, email, or by face to face meetings. He gave me the impression that he cared about my case and especially about my grandchildren, and I felt comfortable that he had a good grasp on the tasks at hand. He also had the advantage of the advice and experience of two very knowledgeable senior attorneys who seemed always available, although they are also very busy. This gave me the impression that they were very good at what they do, because many people come to them for legal help. The fee was very reasonable, and I was kept affront of the financial aspect so that I had control, and they also worked with me considerably to help keep it affordable and I appreciated that. From my perspective Attorney Chad Rayle picked up my case with authority and confidence. He researched, information which helped us strengthen the case and kept me informed and included. Chad always contacted me with information so that I could make informed decisions whenever it was necessary and then allowed me to make them. I felt that he always let me have control especially when it came to decision making, by the way he gave me information, explained what it meant and whenever I was unsure of what to do he explained what choices I had in a way that made it much easier. He also made me feel welcome to contact him whenever necessary. I was struck by Attorney Rayle's positive attitude, focus, professionalism, and assertiveness. These are important qualities that I look for in a professional and because of these qualities, I felt that I could relax and allow Attorney Chad Rayle to handle my case, which was contested and a very difficult one I might add. When I needed assurance, Chad gave me that assurance and I knew that I could trust him. I felt that Chad, as well as the entire staff at the firm handled me with dignity and respect from start to finish which was very valuable to me. This case was truly "one for the books" because of it's delicate aspects, and when it was all said and done, the court ruled in my favor; Attorney Chad Rayle had won my case for me. Because of my experience I have nothing but the deepest trust, admiration, and respect for Attorney Rayle because of how he handled me and my case, and because of his intelligence, knowledge of legal matters, and professionalism. If I were ever to need an attorney again I will most certainly go to Attorney Chad Rayle, and I highly recommend him to anyone needing his services. I am exceptionally satisfied with Attorney Rayle's services, and because of him my confidence in the legal system has been strengthened.

We went to her for estate planning and Eileen held our hand through it all. We had no idea where to start or even if we should do it. But you really have no idea how much there is to consider, even if everyone is healthy and you don't have "that much." There's stuff you don't even think about! She explained everything to us very clearly. We were very comfortable and happy that we did it. I've recommended her to some of my closest friends and I'm pushing them to now get their affairs in order. It really does make you sleep better at night. There's so much I didn't know, you really do need a pro to keep an eye on that part of your life for you. She's very sharp, personable, and easy to work with. We moved to FL and needed an attorney. We attended an estate planning seminar given by Ms. Maastricht, checked out her credentials, and went for a consultation. We hired her to do our estate planning and couldn't be more pleased. She is even better than the attorneys we had up north. She listens; she advises; she responds appropriately. Great attorney -- and, like Farmers Insurance, we should know a thing or two about attorneys since we have seen quite a few.

Kathryn was spot-on with everything, her compassion and knowledge of elder care law is second to none. Our entire family highly recommends Kathryn!

Kathryn was recommended for her elder law expertise. She helped create a customized 'family contract' for our unique situation, which required her partnering with a NY lawyer, as well. In parallel, we used her for our own estate planning, and are to return this month to update the original documents she provided in a timely manner. The occasion of reviewing the documents to prep for the upcoming meeting reminded us of how thorough and thoughtful she was in completing our wills, trusts et al. We highly recommend her services.

One of the most professional, honest, direct, sincere, and skilled individuals I have ever met in life. During/following our first visit, I questioned myself, and wondered why I was there, and thought Annemarie was a bit "gruff." She was at times; however my situation was painful, & she made me a stronger individual as I opted to go forward and have her handle my case. She is extremely smart, very direct, instructs, guides, and tells you just what's going to be, how she's going to get there, and what the expected outcome might be. I could not have resolved my issue, without Annemarie's extensive background and experience. She knows her "stuff!" She will get the job, done, and she will do her very best for you. I strongly urge you to consider her for our individual needs. I will be back for future guidance involving Wills, Trusts, etc, and I have no doubt in my mind, I will "all set" at the end of it all, with Annemarie at the helm.

After my father passed away, I had Jen look over his trusts, which were basically a foreign language to me. It is clearly written and was organized and explained very well. Jen and Brad (her law partner) made it easy to understand and presented us with an organized binder and clear directions for us to take. They were both available instantly when I had a few questions. What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
