Deb represented my startup in business negotiations with partners and investors, and worked miracles! In setting up deals with worldwide companies, we thought we were on the ropes and she repeatedly worked out terms that fully protected our intellectual property without a negative impact to us. I once asked her about her talent, and she explained that she viewed negotiation as a way for both parties to get what they want, rather than a winner take all proposition. That, and her track record, earned a lot of respect from me. I occasionally keep in touch, and she is now at her own firm: www.djlcorplaw.com.

Rob Leach is knowledgeable and very well-versed in intellectual property law. I asked him to help me create a win-win situation in a complex IP case and he did exactly that. I believe all parties were satisfied. I know I certainly was! I highly recommend him and also think you will find him to be more accessible and personally interested than large firms that handle IP matters.

Michael was the lead associate on our class action and I was a class representative. His hard work made sure that all of my friends and former co-workers never had to settle for less than we should have gotten and we were overjoyed with the success we all had on the case. He always kept us in the loop and never made us feel like second class citizens. while all lot of older lawyers talk down to you, Michael truly related to what we had been through and even used to do exactly the work we did when he was in school. I am most thankful for how well he prepared all of us for our depositions. I had been in one before and it was a nightmare, but with Michael's help and advice it went by so much easier.

We can see why Melissa is head of her own firm! She is a genuine person who cares about her clients (a la "small town lawyer"), but has a wealth of legal knowledge and expertise (a la "big city attorney"). She doesn't bill for every second of every conversation like our previous attorneys at another firm. She only bills us for when we talk business as it should be. Her firm's rates are pretty good. Honestly, I would pay more given the highly personal service and amazing attention to detail but no rate increases since we moved our matters to BLF. Her firm is very modern with email billing and going paperless wherever possible, but like us she can be old school too and certain things are on paper and as she says, "Always will be. Lawyers like paper." BLF is in a building in downtown SLO with free parking and a nice conference room. She does intellectual property for us and advises us on our business matters and writes our contracts. She's got a great perspective from her experience at big firms and owning her own business too. We think she is a diamond in the rough because she was in the paper for winning awards, is the President of the SLO Bar group, and despite all of these things, she is always the one who handles our work and communicates with us. When we dealt with our previous lawyers, they said the head attorney would handle everything and we were paying for that experience, but it was obvious that wasn't the case. With BLF however, Melissa talks to us directly and even on weekends if there is a time sensitive matter. She has gotten two trademarks for us on the first attempt that the previous attorneys couldn't get despite wasting our time and money. Can't say enough about how pleased we are with Melissa and BLF. That's why we decided to write a review. Saw the AVVO commercials on TV, looked her up because I was curious, and was surprised she wasn't ranked higher! Hope this helps you because we we know we could have saved a lot of time, money and stress if we had found her sooner!

Michelle and Kathleen helped us update our living will and worked attentively, and patiently, with us to ensure that all of our questions and concerns were addressed within our legal document. We had a lot of back and forth conversation in which they were incredibly helpful in allowing us to fully understand the legal ramifications of each choice we were making with the structuring of our will. At the same time, they are incredibly professional and I would highly recommend them to anyone.

I was wrongly accused by the CHP for DUI, and I hired a large cookie cutter attorney to begin with (I won't mention their name). While they only charged me $1000 to defend me, I learned quickly that you get what you pay for, as they were just going to basically do the same thing a public defender would have done or less, which is help the state win their case against me. Then I hired Kapsack and Bair to defend me. It cost a lot more, but for a year and half as the court dragged their feet towards a trial, they were always there to represent me as needed. Although the Solano County DA's office is extremely incompetent and has no clue what they're doing, take nothing away from Kapsack and Bair, they did a great job. I would definitely recommend them to anyone who needs legal representation anywhere in the SF Bay Area.

Sometimes the most unexpected can happen and all of a sudden you need an experienced and qualified attorney. The unexpected event for me was being hit by a speeding automobile when I was in the crosswalk while out for my daily run on a sunny day. It happened in a nightmarish flash, and my life changed that day. However, Nick Carlin and Phillips, Erlewine, Given & Carlin LLP were able to help me and my recovery. If you need an attorney or law firm that knows how to handle a complex personal injury case, knows how insurance companies operate, and most importantly knows how to look after the interest of their client, you need to give Nick Carlin at Phillips, Erlewine, Given & Carlin LLP a call. When you have a complex personal injury case, you need an attorney and a law firm that have trial and litigation experience and are willing to take your case to trial. I was expecting to go to trial and felt that a trial would maximize my recovery. However, just prior to setting a trial date, my wife encouraged me to settle the case, so I could continue my recovery. By this time, the case was ongoing for over one year and was taking an emotional toll on me and my family. The injuries, pain, trauma, suffering, and emotional impact of the traumatic accident was taking a toll on my life, my wife and family, and my career. I’m still suffering from the effects of being hit by an automobile; however, with love from my family, an understanding workplace and therapy have helped in my recovery. Nick and Phillips, Erlewine, Given & Carlin LLP also provided invaluable legal and practical advice over the entire process, while treating me with respect. Nick has an experienced and companionate staff that also helped and were always available. Nick was also able to get the experts for this complex personal injury case. There were at least ten special medical and non-medical experts involved in the case, and the defendant was represented by two national insurance companies. The settlement that Nick was able secure for me was in the seven-figure range. If you, a family member, or loved one is involved in a personal injury case, and you need an attorney who will put your interests first, you need to give Nick Carlin a call.

Top Questions to Ask a Lawyer

When meeting with a lawyer for the first time, it's important to ask the right questions to understand their expertise and determine if they're the right fit for your legal needs. Here are some top questions to consider:

  1. What experience do you have with cases similar to mine?
Ensure the lawyer has relevant experience in the specific area of law pertaining to your case.
  2. How do you charge for your services, and what are the estimated costs?
Understand the fee structure, including hourly rates, flat fees, retainer fees, and any additional expenses.
  3. What potential outcomes can I expect from my case?
While no lawyer can guarantee results, they can provide an assessment of possible scenarios based on their experience.
  4. What is your approach to handling cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.
  5. Who will be working on my case?
Find out if the lawyer will handle your case personally or delegate tasks to other attorneys or paralegals.
  6. How will you communicate with me throughout the process?
Establish expectations for updates, preferred communication methods, and response times.
  7. What is the likely timeline for resolving my case?
Get an estimate of how long the process may take from start to finish.
  8. Do you have references from past clients?
Testimonials or references can provide insight into the lawyer's professionalism and effectiveness.
  9. What are the strengths and weaknesses of my case?
Understanding potential challenges helps you prepare and sets realistic expectations.
  10. Are there alternative ways to solve my legal problem?
Discuss options like mediation, arbitration, or settlement to resolve the issue efficiently.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  1. Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing.
  2. Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case.
  3. Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association.
  4. Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, or Google to gauge client satisfaction.
  5. Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field.
  6. Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation.
  7. Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  8. Ask for References:
A credible lawyer should be willing to provide references from past clients.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  1. Relevant Documents:
Bring all documents related to your case, such as contracts, correspondence, legal notices, court papers, or evidence.
  2. Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and involved parties.
  3. List of Questions:
Write down any questions you have about your case, the legal process, or the lawyer's experience.
  4. Financial Information:
If applicable, bring financial documents like pay stubs, tax returns, or bank statements.
  5. Contact Information:
Provide details of any witnesses or other parties relevant to your case.
  6. Personal Identification:
Bring a valid ID for verification purposes.
  7. Pen and Notebook:
Take notes during the consultation to remember important points.
  8. Budget Constraints:
Be ready to discuss your budget and any financial limitations.

How Much Does a Lawyer Cost?

The cost of hiring a lawyer varies widely based on several factors:

  • Fee Structures:
    • Hourly Rate:
Lawyers may charge anywhere from $150 to $500 or more per hour, depending on experience and location.
    • Flat Fee:
For routine legal services like drafting a will or handling an uncontested divorce, lawyers might offer a flat fee.
    • Retainer Fee:
An upfront payment against which the lawyer bills hourly fees.
    • Contingency Fee:
Common in personal injury cases; the lawyer receives a percentage (typically 25% to 40%) of any settlement or award.
    • Monthly Retainer:
For ongoing services, businesses might pay a monthly fee for a set number of hours or services.
  • Factors Affecting Cost:
    • Complexity of the Case:
More complex cases require more time and resources, increasing costs.
    • Lawyer's Experience:
Highly experienced lawyers may charge higher fees.
    • Geographic Location:
Legal fees can vary significantly by region or city.
    • Additional Expenses:
Court filing fees, expert witness fees, travel expenses, and administrative costs may be extra.
  • Estimating Total Costs:
Request a detailed fee agreement outlining all potential costs.
Discuss any additional expenses that may arise during the case.
  • Negotiating Fees:
Some lawyers may be willing to negotiate fees or offer payment plans, especially for clients with financial constraints.
  • Pro Bono Services:
For those who cannot afford legal services, some lawyers or legal aid organizations offer services at reduced rates or for free.
