Derek was recommended to me after I received my first ever DWI charge. I was very nervous about the journey ahead and all that it would entail. Derek was there every step of the way. He helped explain everything so that I understood what was happening at each court hearing and what would be expected as follow up. I could count on him for my many fears and questions and he helped give me peace of mind along the way. Derek is extremely knowledgeable and he always has a bigger picture plan in mind. Gabriella was so amazing! From the initial consultation she was friendly, understanding and honest. She explained the process, addressed the what-ifs and discussed options. Have an established Worker's Comp Case., Carrier had Classified my case due to post op complications. Medical addressed, however never received SLU/ Award for injury. Refered to Dan by co-worker, sent letter of inquiry to Law Firm Bronk & Somers, attn:

Adam Militello was instrumental in getting my DWI reduced to a DWAI. Thanks to Adam, I have no criminal record. (DWAI is a traffic violation in NY state.) I have been able to move past this experience - and now have a new job in a highly regulated industry. Background check for the new job came back completely clear. What a relief that my terrible mistake doesn’t ruin my career. Adam also advised me every step of the way on what I needed to do to position my case in the best light before I went to court. When I picked up my 3rd drinking and driving offense I knew I messed up. I reached out to a few different attorneys and determined Tom was the best fit for me and I wasn't wrong. Mr. Splain knew I messed up pretty big as well, but never made me feel worse than I already felt. Tom was able to get this DWI reduced to a DWAI with all the minimum sanctions. Tom's presence in the court room is second to no one and he is clearly very well connected with the players in the judicial system in the greater Rochester area. My biggest hurdle was the DMV hearing. Tom, was able to get the refusal dismissed. Which to my understanding, is like finding a needle in a haystack!
Tom Splain is one of the premier, top notch, defense attorneys around and I highly recommend him when your backs against the wall!

The day following my son’s arrest, we were in a state of shock and immediately hired a different attorney affiliated with one of those DWI firms that you see heavily advertised on billboards. Over the next couple of months, as details of the case emerged, it became increasingly clear that there were issues with the initial stop and inconsistencies with the evidence, but the attorney did not seem to be fully engaged or have mastery of the facts of the case. Often, I would reach out to him when I found an issue and would get no response or a response at the last minute, as if he only looked at the material the morning before the court appearance. Each court date it seemed like he was “going through the motions” with a foregone conclusion that the case would simply be pled down. When I brought up issues with discovery, or the police report, or frustration that no one was reviewing the full facts of the case, I was most often met with a shrug and some comment along the lines of “that’s just how it is in the criminal justice system.” He advised my son to request and accept a plea deal and had us nearly convinced that if we tried to push forward with motions, etc., we were just risking a worse outcome. But this was my kid, and accepting a sentence without anyone really considering the facts of the case just didn’t feel right, so we reached out to an experienced friend for advice and she said, “Fire that guy. You need to hire Ed Fiandach.”
At our initial consultation with Ed, he immediately identified that there were issues with the traffic stop and cited the relevant case law. He said the right next step was to file motions to suppress the stop. “You should never skip the steps,” he said. When I shared that the other attorney told us that filing motions could result in a worse sentence and maybe the plea is the best we can do, Ed said something that put everything in to focus. He said, “Your son hasn’t even had a defense yet.” He gave us confidence that my son shouldn’t just accept the plea deal. Ed and his team filed the motions, and when the hearing happened, Ed knew exactly what to say and do to show that the prosecution had not established probable cause for the traffic stop. To follow-up, he wrote a memorandum of law that was thorough, detailed, and fact-based that clearly supported his motion to suppress the evidence. Ed knows the law inside and out and through his efforts, my son’s case was dismissed.
Throughout the entire process, Ed was responsive when we had questions, patient, and most importantly, kind to both me and my son. I am forever grateful to Ed and his team for helping my family through this difficult situation.

I had a bit of anxiety over filing bankruptcy like many people probably do. I also felt embarrassed to be in this situation. Ken, however, always treated me with respect and honesty, and never made me feel worse about the situation. Ken helped me in so many ways , first was chapter 13 and feeling confident that he would win our case. And we did . When Covid-19 came about , it was a different sort of story for me and my family . I worked with Segar and Sciortino a couple of times over the last ten years. I needed their help again when I had a bad fall at work that changed my life forever. It was a very serious injury and I needed help with Workers comp and SSDI. I had met with Stephen Segar for a consultation. He was very professional and very kind. He made me feel comfortable from the first moment I met with him. He is extremely knowledgeable and helped guide me to all of the answers that I needed. I worked with Stephen for a few months until the doctors determined that my injuries were too severe to return to work.
That’s when Stephen assigned Mark Hayden to start working on an SSDI case for me. He was very knowledgeable about the DWI process and explained everything that would happen in the justice system and the DMV. Facing charges in the #1 county for DWI convictions and a strong case against me, Richard was able to reduce my sentencing to the minimum sentence allowed by law. Peter and the staff in his office helped us with a motor vehicle accident claim. He was always available when needed for questions. He was thorough and on top of everything throughout the process. There was 3 of us involved in the accident and when it was time to file the suit, he coordinated 2 other attorneys from outside his office so we were all represented without conflict of interest. This is a long process but Peter kept us informed throughout the entire process. While it does not help to get rid of the injuries and the pain endured on a daily basis we were able to reach an agreement for settlement with the insurance company. I would highly recommend Ken for any bankruptcy proceedings. Let's be honest, bankruptcy is not fun and it is not a procedure you want to be involved in. But if after your free consultation with Ken, he feels it is your best solution, you can't find a better lawyer to handle the case for you. He treated me with respect; he laid out exactly what was required from me; he maintained constant communication with me; and his experience of being a Trustee ensured that my I was completely prepared for our meeting with the appointed Trustee. In late 2017 I filed chapter 13 bankruptcy. Ms. Nobile was awesome, because I followed all her instructions to the letter. Because I did it saved me time, additional fees and a possible court postponement.
I witnessed another person in my first hearing with the same situation I had, their lawyer did not informed them correctly subsequently causing the person to face a postponement and extra fees - I am soooo thankful I listened to Ms. Nobile. She knew exactly what she was doing. Now mind you I challenged her on some things but shut my mouth and did as I was told and the proceeding went without a hitch.
