He answers your case questions once when you hire him. But then wouldn't notify / answers your calls and emails about progress on the case. Provided me with misleading info just to get rid off me till the hearing. And then when the hearing date come up , he told me completely different scenarios of outcome for which I sure was not prepared for based on what I heard from him previously. I wouldn't even hire him if he told me that before. What a waste.

Keith fights the good fight. If you are innocent and want to prove it, then look no further. Whether it is injustice at the hands of a peace officer, a misdemeanor or criminal charges, Keith delivers. He did so for me and got my case dismissed from court without a glitch. Now the plaintiffs have become the defendants and we are fighting the good fight together against injustice. Keith is trustworthy, responsive, knowledgeable and meticulous. I highly recommend him as an attorney.

Mr. Spencer was assigned counsel to me on appeal (at no cost). After not returning my calls for 3 weeks to discuss possible appellate issues I decided to represent myself. Mr. Spencer did file a Wende brief on my behalf -- though I wouldn't recommend doing that for any appeal.

After being referred by a friend, I came to Mr. Spencer during a conflict with a former landlord. My interactions with Mark were consistently positive. While I felt vulnerable and anxious about any outcomes- he remained even keeled with a unique ability to remain compassionate and non- judgmental. Mr. Spencer's ability to communicate in a clear and effective manner with the defendant and myself paved the way for a great outcome. As any lawsuit is stressful simply because of the ambiguity, he put me at ease that he can handle any curveballs with a solid knowledge base, timeliness and grounded responses.. I would, and do, recommend any friend of mine to contact Mr. Spencer for their legal needs.

Hired to help with my nasty divorce. I’m a professional business woman and my ex was attempting to steal our assets and my income by making false claims of abuse to simply increase his chances of getting large support orders. Mr. Rinaldelli and his office staff were very helpful in guiding me through the frustrations of the whole divorce process. He really made me feel like her cared about me and my situation and helping get me to a better new life beyond my failed marriage. Was very aggressive in court and very sharp and saw all the angles my ex and his lawyer were trying to employ. After a tough battle he was able to convince the court of my ex’s lies and I didn’t have to pay any support whatsoever. And he accomplished all of this in less than six months even though my ex was trying to drag the case on to force me to pay his lawyers fees and pressure me to settle. In the end I had to pay no support, no attorney fees, and was granted a restraining order against my ex. Mr. Rinaldelli and his office really helped me to move past my divorce and I’m very thankful. He was also very reasonable in his payment arrangements, discounts, and overall fees. I believe my ex paid his lawyer almost twice what I paid Mr. Rinaldelli and he lost almost everything he wanted. Thank you Daniel.

Hire Mr. Rinaldelli for a child custody modification. All paperwork was given to him within 2 days of retaining him, it took him over 7 months to file my paperwork. I had called, emailed, left message after message only to be ignored for months. Once I finally did speak to him he just gave excuse after excuse. He was highly recommended by a past client that is why I didn't just fire him. He agreed to two continuous' without even consulting me. Once we finally did go to court SIX months after the filing date due to continuous after continuous he was great. Very professional and does know the law very well. But it should not take over a year for a simple modification. An order after hearing was never filed by him although I did request one several times. If he only would be respectful of his clients time and money outside of the court room he would be great.

I hired him a few years ago. There was a lot of hidden assets he told me we would get in discovery . When we went to court he asked me if I minded waiting outside the courtroom because she my ex feared for her life. I thought it was odd but did it. When he came out he said for now I still had to pay 650 spousel support and if I sold the house I had to give her half and nothing would happen for a couple months to sign here. I didn't read what I signed I trusted him. A few days later he withdrew from being my attorney and I found out that was the final papers he had me sign. I got nothing after working fir 30 years

Mr. Montgomery is the best family law attorney in SB county. After a 10 year custody battle he was able to get me full custody of my 3 children. Absolutely amazing after two previous attorneys failed completely. He also cleared out my child support case with absolute precision. I was referred to him by my close friend who he also helped get full custody of his daughter. After being in court over 100 times (no exaggeration) I’ve seen pretty much every attorney in SB county family law. His rate is extremely fair and his ladies who run his office Leslie and Luvia are wonderful! I’ve sent him every person I know who has had issues after they hear my successful story. Give him a call if you’re a father struggling in this unfair court system! Edmund and his staff is A-1.

I wanted full custody and wanted to settle for 50/50 custody towards the end because I was tired of going to court . I ended up with 45% custody and I still have to pay child support when he promised to write something for me and said more than likely I wasn’t gonna pay anything. Mr. Montgomery had a chance to go against my ex without a layer and asked for an extension only because I had another case next door . Had we continued that day we would have won the case especially since my ex didn’t have the proper paper work and didn’t have a lawyer . He did however helped me beat a restraining order that my ex wanted permanently. Besides that I do not recommend this lawyer . Sorry Ed it’s been a few years now and I regret asking for your services .

Avoid at all costs. I had the misfortune of using an attorney from this firm. They over charge, and then proceeded to do the bare minimum. In court they are too passive letting the other side have their way resulting in my child suffering as a result. Do not let your family suffer. Update: my attorney from this firm contacted me about my review. They stated that their poor work was intended to save me money. I never asked for that.

Amanda was very well versed in the rights of cyclists, and made sure I received a fair settlement for my injury. Knickerbocker is a disgrace for legal profession!! I too would give Richard zero rating if it was available, took money and never did anything on the case and when i requested refund he quickly wrote several pages and claimed he earned the money I gave him. Very dishonest and tricky! When you get to him you have one problem when you hire him you will have one more!! AVOID! Also, not only is he rude, but his paralegal wife Saloy that answers his phone calls has a severe attitude. Knickerbocker is hands down a terrible lawyer who did not help me, which is why I would never recommend this man to any friends or family. I hope karma comes back to him after how he's treated my family and clearly many of his unfortunate clients.

When you have to explain to an attorney that two party consent doesn’t apply to public places because there’s no reasonable expectation of privacy and that the First Amendment, freedom of press, does apply—you suspect you aren’t dealing with the sharpest crayon in the box. But when the lawyer proceeds to be condescending about it, when you’re the one who has a chamber loaded with one star reviews, you realize that the dullest tool in the shed attempted to sharpen the dullest crayon in the box that’s been dressed by its mommy and is rolling around under the seats of the short bus. Lawyers should realize if they pick up the phone to consult that they’re running a business.

Donn Taketa successfully represented us in a fire case against Southern California Edison and Time Warner Cable. The case was tried before a jury for 8 weeks in Ventura County, California. On July 26, 2012, we obtained a judgment in excess of $2 million because of the tenacity of Donn Taketa and his firm's extensive knowledge of the utility industry. Mr. Taketa’s honesty and integrity were a beacon of light in this highly contested case. Each of the attorneys on the Sullivan Taketa team has impressive skills, talents and credentials. We prevailed in every aspect of our case because of Mr. Taketa's commitment to us and to our case. Not only did he fight for our rights, but his genuine concern for public safety motivated him to be deeply committed to seeking justice. I highly recommend Mr. Taketa.

I hired David Nick and during his time on my case he was sanctioned 3K dollars. He also appeared late to a hearing which was followed by a reprimand by the judge. I watched attorney Nick for the first time in court, and when the judge asked him a simple question, his response was nothing like his written legal brief, he seemed to forget what he had written. Mr. Nick was paid 20k dollars for a trial but when the case didn't allow for a trial and Mr. Nick refused to return the money. I am forced to file a complaint with the State Bar. When confronted about the problems Mr. Nick caused in my case, he arrogantly denied any and all of the facts. Mr. Nick claims to be a Navy veteran, I also am a veteran, who regrets ever hiring him.

If I can rate it zero stars I would. This is absolutely a clown show of lawyers that just pass on the case from lawyer to lawyer! Nobody seems to have any information of anything. They pressured us to get the money within an hour to have the case worked on immediately. Which stressed my family and me out getting the money! As soon as we got it they comfort us saying they will start, but no lawyer ever contacted us and the day of the court they didn’t even BOTHER TO SHOW UP! Which resulted in the court to be pushed back till next month. Absolutely disappointed, I trusted this firm because I was recommended by one of their own employees! I urge anyone that is looking for a good lawyer and actually do their job DO NOT COME HERE! They will take your money and not give a care about your case !! They prey on financially unstable people to pressure them and take their money! Unfortunately I was a victim of this false advertisement they show case. I urge anyone that is trying to get their loved one out please don’t come here! There is a reason why they have less than two stars on ratings Si puedo calificarlo con cero estrellas, lo haría.

What an Appeals Lawyer Can Do for You

An appeals lawyer specializes in representing clients in appellate courts, challenging or defending lower court decisions. If you believe that a legal error was made during your trial or that the court’s decision was unjust, an appeals lawyer can help you appeal the ruling to a higher court. They work to identify mistakes made during the trial, such as improper application of law, exclusion of key evidence, or jury misconduct. On the other hand, if you're defending a favorable judgment, an appeals lawyer can help protect the decision from being overturned.

Appeals lawyers don’t retry the case but instead focus on legal arguments and procedural issues to convince the appellate court to either overturn, modify, or uphold the lower court’s decision.

When Should I Hire an Appeals Lawyer?

Hiring an appeals lawyer is necessary when you are involved in a legal appeal, either as the appellant (the party appealing the case) or the appellee (the party defending the lower court’s ruling). Common situations in which you should hire an appeals lawyer include:

  • Appealing a conviction or ruling: If you’ve been convicted in a criminal case or lost a civil case and believe the decision was based on legal errors or improper procedures, an appeals lawyer can review the case and file an appeal on your behalf.
  • Challenging a sentence: In criminal cases, if you feel that the sentence is excessively harsh or not in line with legal standards, an appeals lawyer can work to reduce or modify the sentence.
  • Defending a lower court ruling: If the opposing party has filed an appeal to overturn a favorable ruling, an appeals lawyer can help defend the judgment and argue that the lower court’s decision should be upheld.
  • Complex legal issues: If your case involves complicated legal issues or interpretations of the law, an appeals lawyer can provide the necessary expertise to argue those points effectively before an appellate court.
  • Reviewing trial errors: Appeals lawyers can examine whether mistakes such as jury misconduct, improper exclusion or admission of evidence, or incorrect jury instructions occurred during the trial.

You should hire an appeals lawyer as soon as you decide to appeal or are informed that the other party is appealing the case, as appellate procedures are time-sensitive.

What Does an Appeals Lawyer Do?

An appeals lawyer provides specialized legal services to challenge or defend a lower court decision. Their role focuses on legal arguments, reviewing the trial record, and persuading the appellate court to either reverse or uphold the ruling. They can:

  • Review the trial record: Appeals lawyers meticulously review transcripts, evidence, and rulings from the original trial to identify any legal errors or procedural mistakes that could be grounds for appeal.
  • Prepare and file briefs: Appeals lawyers write legal briefs that present persuasive arguments to the appellate court. These briefs focus on the legal errors made during the trial and how they affected the outcome.
  • Present oral arguments: In many appeals, lawyers present oral arguments before a panel of judges, explaining why the lower court’s decision should be reversed or upheld based on legal principles.
  • Monitor case law developments: Appeals lawyers stay updated on changes in the law and precedents set by higher courts, which can be crucial in shaping the arguments they present during the appeal.
  • Provide legal advice on the likelihood of success: Appeals lawyers can offer a realistic assessment of your chances of winning the appeal based on the legal errors and evidence from the trial.

How Are Appeals Lawyers Paid?

Appeals lawyers typically charge for their services based on the complexity of the appeal and the amount of work required to prepare briefs and present arguments. Common payment structures include:

  • Hourly rate: Many appeals lawyers charge by the hour due to the significant amount of research, writing, and preparation involved in appeals. Hourly rates can range from $200 to $600 or more, depending on the lawyer’s experience and the case’s complexity.
  • Flat fee: For some straightforward appeals, a lawyer may charge a flat fee that covers all the work necessary to complete the appeal.
  • Retainer fee: In complex or high-stakes appeals, a lawyer may require a retainer, an upfront payment that covers the initial stages of the appeal. The lawyer then bills against this retainer for ongoing work.

It's important to discuss fees and costs upfront with your lawyer during the initial consultation to ensure you understand the financial commitment involved.

How Much Does an Appeals Lawyer Cost?

The cost of hiring an appeals lawyer varies depending on factors such as the complexity of the case, the lawyer’s experience, and the amount of work involved. General cost estimates include:

  • Straightforward appeals: For simpler appeals, such as those involving minor legal errors, fees can range from $5,000 to $15,000, depending on the scope of work.
  • Complex appeals: Appeals that involve complicated legal issues, multiple grounds for appeal, or high-stakes outcomes can cost anywhere from $20,000 to $100,000 or more, especially if the case requires extensive legal research, brief writing, and oral arguments.
  • Hourly rates: Many appeals lawyers charge hourly rates ranging from $200 to $600 per hour, with higher rates often associated with more experienced attorneys or particularly challenging cases.

Before proceeding with your appeal, it’s crucial to ask for a clear estimate of the costs involved so you can budget appropriately.

Top Questions to Ask an Appeals Lawyer

Before hiring an appeals lawyer, it’s essential to ask questions to ensure they are well-suited for your case and that you understand the appeals process. Important questions include:

  1. What experience do you have with appeals?
Ensure the lawyer has substantial experience handling appellate cases, particularly in the area of law relevant to your case (e.g., criminal, civil, family, etc.).
  2. How do you charge for appeals?
Ask whether the lawyer charges an hourly rate, a flat fee, or a retainer, and request an estimate of the total costs for handling your appeal.
  3. What is the likelihood of success for my appeal?
A good appeals lawyer should provide an honest assessment of your case’s strengths and weaknesses and the chances of winning the appeal.
  4. How long will the appeal process take?
Ask for an estimate of how long the appeal process might take, from filing the initial briefs to a final decision by the appellate court.
  5. Will you personally handle my appeal?
In larger law firms, junior attorneys or legal assistants may handle some of the research or drafting. Clarify who will be responsible for preparing and arguing your case.
  6. What is your approach to handling appeals?
Some lawyers may be more inclined to focus on procedural issues, while others emphasize broader legal arguments. Make sure the lawyer’s approach aligns with your goals.

How to Check the Credibility of an Appeals Lawyer

To ensure that you’re hiring a reputable appeals lawyer, take the following steps to verify their credentials and experience:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for appellate experience: Review the lawyer’s website or profile to ensure they specialize in appellate law and have successfully handled appeals similar to yours.
  • Check client reviews and testimonials: Look for client feedback on platforms like Avvo, Martindale-Hubbell, or Google to get insight into the lawyer’s track record and client satisfaction.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their expertise and success in handling appeals.
  • Look for recognition in appellate law: Membership in organizations like the American Academy of Appellate Lawyers (AAAL) or awards and recognition in appellate law can indicate a lawyer’s expertise in this specialized area.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with an appeals lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Trial transcripts and court records: The lawyer will need a complete record of the original trial, including transcripts, motions, exhibits, and the final judgment or order.
  • Legal briefs from the trial: If any briefs or motions were filed during the trial, bring copies so the appeals lawyer can review the legal arguments that were presented.
  • Written decision or verdict: Bring the court’s written ruling, verdict, or decision so the lawyer can identify any potential errors or issues to raise on appeal.
  • Questions about the appeal process: Write down any questions you have about the appeal’s timeline, costs, and potential outcomes.
  • List of potential legal errors: If you believe specific mistakes were made during the trial (e.g., improper evidence, legal misinterpretations), provide a list of those issues.

Being well-prepared for your consultation allows the lawyer to assess your case more effectively and provide the best guidance on how to proceed with your appeal.
