He is very good when handling Small Business type of cases. Has guided me on setting up my small business and has also been able to assist in collecting past due items. I highly recommend him, he does not try to take advantage of your pocket book and keeps your best interest in mind.

I’m a car dealer in New Jersey and I was having issues with a company located in Texas. I needed an attorney to represent me in Texas and after doing a lot of digging around I came across SMG. They explained to me everything I needed to know about my case and what the possible outcomes might be. They communicated with me the whole way through and we were able to get everything resolved. The pricing was more than fair and I couldn’t be happier. If I ever need an attorney down in Texas Allen Landon will be the first attorney I reach out to.

Horrible!!!!!! Horrible!!!! Horrible!!!!! My ex and I are divorced and we shared a property together in which I was glad to leave and give him in a divorce because I didn’t want him to know where I went since he was so abusive in the marriage. I’ve went through the courts and my divorce doesn’t even list my present address because I don’t want to be bothered or contacted by this man and this law firm basically exposed the information to him directly. They represent Camden park association who is sueing him for Assessments owed to them and when they couldn’t find him, they used their research to locate me, and even though I’m divorced and have nothing to do with that property, they located my new property and served me papers pertaining to that property because my name was still on it. IN returned, contacted them directly spoke with them emailed with them, letting them know that I was divorced, and had nothing to do with the property. I sent them a copy of my divorce papers months later, because they couldn’t get in touch with him. They continued to pursue me. legally, I had nothing to do with it. My attorney told me not to speak with them again that they had record in writing that they had been made aware of the fact that I was no longer at that property and had nothing to do with it I later get a letter the other day from that law firm telling me and my ex-husband, who they had his name listed with his property address and listed my name right next to his with my new property address, informing him of my whereabouts and when I called the law firm left a message with the receptionist because I scared, nervous and upset pertaining to this instead of them even offering an apology or trying to offer any assistance the woman that called me back was defensive and said so you’re calling to complain because we had to notify him and you but since you’re no longer on the law suit I can’t discuss details with you, I said I don’t want details I want to know why you couldn’t make him aware of this without giving him my address??? and she said she doesn’t have time for this, have a good day and she hung up on me…. Why would she be mad at me???? What did I do???? We live in a day and age where we have to do whatever necessary to keep ourselves safe and out of trouble, and this legal firm openly, threw me in front of domestic violence abusive narcissistic man who made my life horrible for no reason without even an apology, or concern Or offer any kind of assistance with what they had done so I intern after being hung up, I called back and left a message, letting them know that I will be talking to my attorney as well as the police about what I can do against their firm and getting some barriers of protection for what they did or what he might do going forward…. I feel so violated, scared, and open for whatever might come next but at least this firm won’t be affected by none of it!

I served as the secretary for the Harris Branch HOA when Chris Archambault was hired to mediate conflicts among board members and draft a Code of Ethics for our governing bylaws. The Code was intended to control the board’s professional behavior, with violations leading to removal. During the January meeting, Chris insisted that the entire board sign the contract, threatening to withdraw if this was not done. The initial meeting, lacking a quorum, included the VP, President, Property Manager, and Director of Goodwin and Company. In discussions with Chris, the President emphasized the need for an investigation into my harassment complaint against the Property Manager and his retaliatory complaint. Despite this, Goodwin Management failed to investigate, resulting in a "hostage" board environment where I faced harassment, slander, and bullying through emails and personal attacks by the board and Goodwin Management. Chris was tasked with investigating the December 8th incident between me and the Property Manager, involving harassment and insubordination. However, shortly after the January executive session, I resigned due to the hostile environment. During the meeting, Chris mistakenly called me by the wrong name multiple times, displayed rudeness, and made inappropriate jokes at my expense, which the board found amusing. These comments were both disrespectful and dismissive of my concerns. Additionally, Chris used offensive language during the recorded meeting, further demonstrating a lack of professionalism. The entire board failed to sign the Code of Ethics contract, yet Chris was instructed to remove me from the board, although I had already resigned. His alignment with the board’s power group and failure to conduct an unbiased investigation showed his bias. The VP posted a podcast slandering the President and me, with no action taken. Chris refused to address the community's concerns regarding these violations and allowed the VP to alter the bylaws to prevent restrictions on his social media activities. Chris breached his contract with Harris Branch HOA by failing to enforce the Code of Ethics and charging for legal fees related to an unenforceable document. He pursued legal actions against my complaints, despite a clear conflict of interest as he represented me as a board member. He also instructed the property manager to refer all my questions to him, including routine inquiries about community amenities, unnecessarily escalating the situation. I communicated my experience to Porter Law, highlighting Chris's unprofessional conduct, including his inappropriate language and failure to investigate harassment charges, which forced me to resign for my family’s and my own well-being. I would not recommend Porter Law Firm if this behavior is representative of their standards.

They made sure that I got the appropriate medical treatment required for my pain and they took care of me in the most fair way possible. They keep me abreast on my case throughout the process. I was recommended Carlos by a close friend who set up an appointment for me at the firm. Upon meeting Carlos I felt extremely welcomed, even before payments we fleshed out my case and every possible scenario and route we could take. Carlos and team were all extremely patient and thorough with my case, it took close to 2 years to finally get a resolution but ultimately I left the courtroom happy. We were able to get my charges severely reduced and I was given my life back thanks to Carlos and the team, I can't begin to explain how relieved and happy I was when I was given my final paperwork and saw what they were able to do for me.

Carlos and team did for me in ONE court date what 4 other attorneys in almost 3 years could NOT do! I had 3 Felony / 3 Misdemeanors (2 A / 1 B) which combined could have resulted in a max of 32-33 years. Because of my situation with an ex-spouse known to be Spiteful and Manipulative of the system I was not going to give up. 4 of the 6 Charges were violations of a "settled" Protective Order whereby the courts found that there was no violence in the past, present or none feared in the future. The Ex knew how to manipulate the system as I was the 3rd husband that tried has to "kill her" or brutally abused her. Obviously a pattern here BUT in the State of Texas - Women are the Kings and if a female makes the same statements and claims as mine then you are Guilty until proven Innocent regardless of HER past and previous allegations against those poor souls before me. In short - no one wants to harm the Ex but only get as far away as possible from her and her illicit double life and thanks to Carlos 5 of the 6 charges were dismissed. After all of the facts were presented to the ADA by Carlos I walked out of the courtroom with deferred adjudication for 2 Years for one Class B Misdemeanor of "ATTEMPTED Violation of Protective Order" with no fines or penalties either. I am eligible in 8 months to have the case dismissed altogether and keep my clean record which is important as a corporate executive with global travel. He works at a busy law firm with difficult cases and that is what you want from an attorney - it's analogous to walking into a restaurant that is packed with people - the food is good as opposed to a restaurant that never has any people (always a Red Flag)! Please note that this website is a revenue site and a lot of attorneys on here with 5+ Stars have an upgraded membership and routinely manipulate the reviews in their favor. Do NOT be fooled by that as was I... Last - IF you are not happy with an attorney then you have the Legal Right to change - Carlos was my FIFTH attorney. Don't accept a judgement then "blast" the attorney online in a poor review!!

My Aunt who has now passed away was extremely happy at the time she asked The Díaz Law Firm, to assist her in filing legal documents for her own Last Will and Testament and was very determined . He explained everything carefully and she strongly agreed that he execute her every wish! I’m sure All Law Firms have to deal with family members that try to fight and Lose!!! So sad. Thank you so much for your kindness and encouragement to us , that HER Will was the Last and Final Testament Thanks Be To God…

My late aunt whom was in her 90's hired him as her attorney for her will. My aunt wanted to revoke her will and asked me to contact Mr. Diaz, I called 3 times In which his wife answered everytime and always had an excuse as to why he could not come to the phone, I told her my aunt wanted to talk to him about cancelling the will, Mrs Diaz said each time Mr. Diaz would call us back. We never got a return phone call back from him. Which resulted in many problems with the will after my Aunt passed away.

If you want to give away your money and have them do nothing for you, do not hire the service of this buffet of incompetent people. 9 years ago I made an immigration request and to this day they have not given me a response to my case. His license should be revoked for malpractice. I contacted State Bar of Texas a few times. Money is the root of all evil, and I pray people like this God will handle. To many times he avoided me, over the years, a case by default judgement and he said he never collected. There was a Lien placed on the property so they wouldn't sell unless we got paid, but guess what ? I did my own research and someone got paid because the apt. Complex was sold, and the Harris Cnty records ,show that my case was paid, but never received a penny. Don't waste your time.

I contracted directly and personally with Mr. Tompkins in 2006 for a dispute with the subdivision homeowners association. Immediately after I paid the retainer, I can't never speak with or contacted with Mr. Tompkins. The excuses always " he is in the meeting." Or, " he is out of town on business." etc. My questions and concerns were never answered or take care of with Ms. Karalynn Cromeens, with whom, I was told is taking care of my case for Mr. Tompkins. After many complaints regarding Ms. Cromeens' irresponsiveness and lack of professionalism in service, I formally cancelled the contract with Mr. Tompkins law firm. However, as of today ( 1/10/2010) I can't get the un-used retainer refunded. Mr. Tompkins personally signed the last and final billing statement, on which, it charged all the charges on reviewing and handling the complaint I filed against Ms. Cromeens on her non-service to me concerning the actual origional law suit. It is rather pittful if an attorney and the law firm have to make money in such a disrespect, un-professional, and urgly way. Even though, the Texas Bar Association find "no mis-conduct" on Mr. Tompkins and his law firm in handling the law suit case. But, they do agree that it is not right to "rob" the retainer which was paid for other reason. However, it seems doesn't bother Ms. Cromeens and Mr. Tompkins. If any one can help me with getting this refund back (we are talking about almost US$1.000), it is greatly appreciated.

Mr. Jaworski handled a case for a close friend of mine, with excellent results. My friend insisted that I get in touch with Mr. Jaworski. At this point, I have worked with him on a limited basis, but have researched his advise and find him to be knowledgeable and on target. I have worked with several attorneys in the past and have found Mr. Jaworski to be personable, respectful and knowledgeable. He answers questions with patience as he tries to educate the client. He does not condescend or make the client feel rushed. After my previous experiences, he has quickly commanded (notice I did not say "demanded") my respect.

This attorney handled a custody case for me. He had no idea what he was doing and custody case went on for over a year. He did not know that mediation was required and had no knowledge of custody cases in general. The case dragged on while Mr. Jaworski collected money and did nothing. With 30+ years of experience in law, I thought I was getting an experienced, knowledgeable attorney. I was disappointed. After 1 year and no progress in the case, I hired another attorney and he got the job done in two weeks. I could not believe how quickly the process could have been. I would definitely not recommend Jaworkski. He might be a good criminal lawyer, but DEFINITELY avoid him for family law.

What a Debt Collection Lawyer Can Do for You

A debt collection lawyer helps individuals and businesses navigate legal matters related to debt collection. Whether you’re a creditor seeking to recover unpaid debts or a debtor facing aggressive collection actions, a debt collection lawyer can provide valuable assistance. These lawyers help creditors pursue legal action to collect overdue debts and ensure compliance with debt collection laws. On the debtor’s side, they help defend against unlawful collection practices, negotiate repayment plans, or file for bankruptcy if necessary.

If you’re dealing with a debt collection issue, a lawyer can ensure your rights are protected and work toward a resolution that aligns with your financial or business needs.

When Should I Hire a Debt Collection Lawyer?

You should consider hiring a debt collection lawyer if you are facing any of the following situations:

  • For Creditors:
    • Unpaid debts: If you’re a creditor (such as a business or individual) with unpaid invoices, loans, or accounts receivable, a lawyer can help you pursue legal action to recover the debt.
    • Debtor refuses to pay: When a debtor is unwilling or unable to make payments, a lawyer can assist with filing lawsuits, securing judgments, and enforcing those judgments to collect the debt.
    • Negotiating repayment plans: If you’re willing to work with a debtor to arrange a payment plan, a lawyer can negotiate and draft a legally enforceable agreement.
    • Legal representation in court: If a debtor disputes the debt or countersues, a lawyer can represent you in court and ensure your legal interests are protected.
    • Securing liens or garnishments: A lawyer can help you secure liens on a debtor’s property or garnishments on their wages to recover the owed debt.
  • For Debtors:
    • Facing debt collection lawsuits: If you’ve been sued by a creditor or collection agency, a lawyer can represent you in court and help you defend against the claim or negotiate a settlement.
    • Debt collection harassment: If creditors or debt collection agencies are harassing you or violating your rights under the Fair Debt Collection Practices Act (FDCPA), a lawyer can help stop the harassment and potentially sue for damages.
    • Negotiating debt settlements: If you owe a significant amount of money but want to avoid bankruptcy, a lawyer can negotiate with creditors to reduce the total amount owed or set up a payment plan.
    • Disputing a debt: If you believe a debt is incorrect or have been wrongfully targeted by debt collectors, a lawyer can help you dispute the claim and provide evidence to resolve the matter.
    • Bankruptcy options: If your debts are overwhelming and you’re unable to repay them, a debt collection lawyer can help you explore bankruptcy as an option for debt relief.

Hiring a lawyer early in the process can help you protect your financial interests and avoid escalating legal issues.

What Does a Debt Collection Lawyer Do?

A debt collection lawyer provides a variety of services depending on whether they are representing the creditor or the debtor. Their responsibilities often include:

  • For Creditors:
    • Filing lawsuits: A lawyer can file a lawsuit against a debtor who has failed to pay what they owe. This includes preparing and submitting legal documents, representing you in court, and pursuing judgments.
    • Negotiating settlements: If the debtor is willing to settle, the lawyer can negotiate a payment arrangement or reduced settlement that ensures you recover some or all of the debt.
    • Securing judgments and enforcement: After obtaining a court judgment, a lawyer can help enforce it through methods like wage garnishment, bank levies, or property liens.
    • Reviewing contracts and agreements: A lawyer can review your contracts and lending agreements to ensure that they comply with the law and are enforceable if a debtor defaults.
  • For Debtors:
    • Defending against debt collection lawsuits: If you’re being sued by a creditor, a lawyer can challenge the lawsuit, dispute the debt’s validity, or negotiate a more favorable settlement.
    • Stopping harassment: If debt collectors are using unlawful practices to collect a debt (such as threatening you or contacting you excessively), a lawyer can intervene and protect your rights.
    • Negotiating debt relief: A lawyer can negotiate with creditors to reduce the total amount of debt you owe or develop a manageable payment plan that suits your financial situation.
    • Disputing inaccurate debts: If a debt is not valid, a lawyer can help you gather evidence to dispute the claim and prevent further collection actions.
    • Filing for bankruptcy: If your debts are overwhelming, a lawyer can advise you on whether filing for bankruptcy is the best option and help you through the process.

How Are Debt Collection Lawyers Paid?

Debt collection lawyers typically charge for their services in different ways depending on the complexity of the case and whether they represent a creditor or debtor. Common payment structures include:

  • Hourly rate: Many debt collection lawyers charge by the hour, with rates typically ranging from $150 to $500 or more, depending on the lawyer’s experience and the case’s complexity. Hourly fees are common when the lawyer is representing either party in litigation or negotiation.
  • Contingency fee: For creditors, some lawyers work on a contingency fee basis, meaning they only get paid if they successfully recover the debt. Their fee is typically a percentage of the recovered amount, usually ranging from 20% to 40%.
  • Flat fee: For specific services, such as reviewing a contract, drafting a demand letter, or defending a straightforward debt collection lawsuit, a lawyer may charge a flat fee.
  • Retainer: For larger or ongoing cases, a lawyer may require a retainer fee ranging from $2,000 to $10,000, depending on the complexity of the case and the expected duration.

It’s important to discuss fees with your lawyer during the initial consultation and understand the total cost of their services before proceeding with your case.

How Much Does a Debt Collection Lawyer Cost?

The cost of hiring a debt collection lawyer depends on whether you are a creditor or debtor, the complexity of the case, and the lawyer’s experience. General cost estimates include:

  • Hourly rates: Most debt collection lawyers charge between $150 and $500 per hour. Complex cases involving litigation or large amounts of money may result in higher legal fees.
  • Contingency fees: If the lawyer works on a contingency basis, they typically charge between 20% and 40% of the recovered amount. For example, if you recover $10,000 and the contingency fee is 30%, the lawyer would take $3,000.
  • Flat fees: For simpler services like drafting a demand letter or responding to a debt collection lawsuit, flat fees may range from $500 to $2,500, depending on the work required.
  • Retainers: For larger or ongoing cases, a lawyer may require a retainer fee ranging from $2,000 to $10,000, depending on the complexity of the case and the expected duration.

Always ask for a detailed cost estimate during your consultation to avoid surprises and ensure that the services fit your budget.

Top Questions to Ask a Debt Collection Lawyer

Before hiring a debt collection lawyer, it’s important to ask the right questions to ensure they have the experience and expertise to handle your case. Key questions to ask include:

  1. What experience do you have with debt collection cases?
Make sure the lawyer has experience handling cases similar to yours, whether you’re a creditor or debtor.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, on a contingency fee basis, or a flat fee, and ask for a detailed estimate of the total cost.
  3. What is the likelihood of success in my case?
Ask the lawyer for an honest assessment of your case and the potential outcomes.
  4. How long will the process take?
Debt collection cases can take time, so ask the lawyer how long they expect the process to last, from filing the claim to recovering the debt or resolving the dispute.
  5. What are my legal rights?
Ask the lawyer to explain your rights as a creditor or debtor, including protections under laws like the Fair Debt Collection Practices Act (FDCPA).
  6. Will you personally handle my case?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be managing your case.

How to Check the Credibility of a Debt Collection Lawyer

To ensure you are hiring a reputable debt collection lawyer, take the following steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice law and has no history of disciplinary actions.
  • Look for debt collection experience: Review the lawyer’s website or professional profile to ensure they specialize in debt collection law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and ability to handle debt collection cases.
  • Ask for references: A reputable lawyer should be able to provide references from past clients who have worked with them on debt collection matters.
  • Check for certifications or memberships: Look for certifications or memberships in organizations like the National Creditors Bar Association (NCBA) or other relevant associations that focus on debt collection law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a debt collection lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • For Creditors:
    • List of outstanding debts: Bring a detailed list of the debts owed to you or your business, including invoices, contracts, or other supporting documentation.
    • Previous communication with the debtor: Provide copies of any emails, letters, or phone call logs showing attempts to collect the debt.
    • Contracts or agreements: Bring any contracts or agreements related to the debt, as they may be critical in proving your case.
    • Judgment information (if applicable): If you’ve already obtained a court judgment against the debtor, bring the judgment documents and any enforcement attempts.
  • For Debtors:
    • Debt collection letters or notices: Bring any correspondence from creditors or collection agencies, including demand letters and collection notices.
    • Payment records: Provide proof of any payments made toward the debt, including receipts, canceled checks, or bank statements.
    • Debt validation or dispute documentation: If you’ve disputed the debt or requested validation, bring copies of the dispute letters and the creditor’s response.
