Pat’s large corporation background and post-graduate business education makes her an astute counselor for complex business transactions. She understands the 'why' as well as the 'how' of getting things done. She is also tireless in her attention to details and engagement follow-up. I would recommend her without reservation for corporate, contract, business and real estate matters.

We were involved in a construction contract dispute involving an unlicensed, underqualified, unresponsive and untrustworthy contractor who, among other things, filed a frivalous lien on our project. Fortunately for us, we retained Ms. Foster to handle this situation. She immediately communicated with the contractor's attorney and within weeks the lien was removed and the matter resolved in our favor. Ms. Foster was knowedgeable, aggressive, responsive and properly focused on our case. We would highly recommend her for her great work and results and would not hesitate to use her again if the need arises.

I own a small collection agency in Lynnwood, Washington. I have used Mr. Bernheim to handle a frivolous lawsuit, general legal counsel, and most currently a complaint response. I find myself amazed each and every time I speak with him or his staff. The guidance he offers coupled with his quick response time and his reasonable billable hours makes me feel like I am a priority. This may sound unbelievable but each time I have worked with him I have walked away feeling like the money was well spent. To get that feeling as a small business on a budget is pretty awesome. Gordon did an excellent job in our BK7 case; from the very beginning he walked us through all the specifics - there were no surprises at any time. He stayed on top of our case, always followed-up, and was always there to answer any questions that we had. If fact, he saved us money when it came time for us to do our pre-online debt counseling and post-debt counseling - a federal requirement.

He represented my wife in a minor injury case about twenty years ago, and he helped me through the probate process when my mother passed away. He has always done this work excellently, reasonably and with a great sense of humor. Highly recommended!

He explained my options in language I could understand, gave his professional advise which proved accurate, yet allowed me to make my own decision. He negotiated firmly on my behalf and resolved the matter to my satisfaction. Mr. Woldseth is professional and personable, easy to work with and has great communication skills. Even though I talked to this attorney on an initial phone consultation, I was impressed with his detailed oriented style, probing question and genuine caring to understand my situation and help. He was very knowledgeable and confident, yet was able to acknowledge areas that he was not specialized in, that came up during my case discussion. I know that if I decide to go through with a divorce, I will be contacting him to ask him to be my attorney. Impressive and much higher level of service than anticipated!

Jay goes above and beyond to help people. I worked with Jay in the past with a slip and fall at a major retailer where I was injured. He handled the case with ease and kept me informed every step. He won the case and made sure to explain every detail. Recently I was in a car accident out of state and Jay was a wealth of knowledge to help me again. It's hard to find legal help that cares. Jay falls into that rare breed. Look no further, give him a call.

I cannot say enough good things about working with Kathy Pauktert. She represented me in a State Farm car accident case, that went on for 6 years and was quite stressful. Every step of the way, I really felt that she was representing me fully, with no evidence of influence because it was a State Farm case, and she gave me excellent guidance but ensured that I made my own choices regarding next steps. She communicates very promptly, is kind, and gives an extremely persnalised experience. Her expertise was evident and I would recommend her (and do!) to folks going through similar cases. Knowing how competant she is, I would use this group for any case that they have expertise in.

Mr. Freeborn and his paralegal were not the first legal team we met with about our issues. The first lawyer we spoke with came highly recommended by a family member, but he was adamant we’d have to file for bankruptcy. We gave Freeborn Law Offices a try for a second opinion. His paralegal Ms. Messamore was refreshing in explaining things in plain language, being upfront, transparent, and very thorough. I walked away from our initial consultation with Mr. Freeborn very impressed at the depth of his experience. He laid out our options clearly and concisely. It was comforting to have confidence that our case was in such knowledgeable hands. After having a plan in place, I was further impressed that he took the time to dig through the weeds and figure out who to contact to resolve our issues as it wasn’t clear. Within four months, the lien on our house was removed, we had avoided bankruptcy, and we were finally able to move on with our lives. His rates were very reasonable and worth every penny.

Amsale Aberra law PLLC is one of the best law firm in Seattle . In 2019 I had a very tough immigration case and I hired another law firm and it didn’t go well, I spend more than 3k and finally my case got denied due to the lawyer’s irresponsible action. A few months later a friends of mine suggested to contact Amsale’s law firm. She was very kind, positive , thoughtful and a good listener. She listened the entire issue with the previous law firm, and what surprised me was her focus to resolve the problem instead of nailing down. After a brief discussion and consultation, I hired her to represent me the same case which I got denied previously. It took her shorter time comparing with the previous lawyer and successfully won my case. Not only that, through the entire process of my case with Amsale I was getting an update based on the information timeframe of each steps from immigration office. The best part of her consultation, if she thinks your case doesn’t worse to continue, she doesn’t wanna waste your money! This is how she does business ! I will always refer to Amsale law firm for friend and family because she is trustworthy!

What a huge compliment to the firm’s legal and life philosophy.

My case was complicated due to many missteps I took in a real estate/renter arrangement and I was threatened with a forced sale in a lawsuit filed by the tenant. When Fred received the inch thick packet from the tenant’s attorney he said in his calm understated way, and I paraphrase, in my years as an attorney I have never seen anything quite like this. He carefully read the five years worth of emails, asked many questions, and ultimately created a clear picture of what had taken place in this exchange. He identified the strengths of our argument and presented them to the tenant’s attorney precisely and forcefully, without confrontation or aggression. I was particularly impressed by his kindness and intelligence throughout the negotiations. Fred kept me informed and responded to any questions or concerns within hours of my inquiry. He listened and respected my point of view. While not offering false hope, Fred encouraged me to allow him to assume the anxiety so I could carry on with my normal daily living. We discussed settlement options to which the other side ultimately agreed and I was able to keep my house---I am exceptionally happy with Fred’s expertise and much relieved by the outcome. I strongly recommend him.

I had an unusual and very messy situation that several attorneys had declined to consider. Fred took the time to do an initial review of the situation and documents, then, meet in-person for further clarification and detail. Fred was patient and worked through all of the details during this meeting. He very clearly presented the obstacles I faced, and then offered an insightful, thoughtful, and a thinking-outside-of-box, strategy. He genuinely cared about getting the best outcome for my situation. Fred made a great first & lasting impression. I believe anyone would be happy with the counsel Fred provides.

I went to Tim Durkop when my ex-husband, an airline captain, filed a Ch 13 bankruptcy to avoid his court ordered debt obligations and a contempt charge. Tim took on a very complicated case that lasted over two years with more than 150 filings. The other side needed three attorney's to handle the case, and yet Tim's superior knowledge of the law came through in every instance, and in the end we won hands down. Tim is the exact opposite of what one hears about lawyers. He is respectful and kind, yet has a keen intellect that allows him to cleverly strategize a case and back it legally. He has an uncanny knowledge of the law and almost photographic memory. If you are lucky enough to get him on your team, you are in great hands....I can't recommend him enough.

John handled an international collection for me on behalf of a client. An international transaction and contract that never took place and I was owed substantial amounts in Italy, Germany and Austria. We collected 80% of the amount owed and in the process I learned a lot about the European Legal Process. This man is a true gentleman and a walking encyclopedia! Just a small item but it needs to be noted here, the amount of time he is an active lawyer is wrongly placed on your website, he has over 15 years experience.

His knowledge on European affairs and his way of protecting clients are second to none. He could have written a book about corporate set ups and the advantages/disadvantages to US citizens. Not a time watcher, and he makes you feel as if he's known you forever. I have no idea why he was not snatched by one of the top corporate firms in NY or London but he seems to enjoy being a lone ranger.

Brian Sommer is one of the most amazing attorneys that I've ever met. He's a world class negotiator and mediator. When I found myself in a very difficult landlord-tenant dispute late on a Friday, he made great personal sacrifices to attend to the situation that I was facing, and dedicated himself to working on it through the weekend. His approach to the complicated situation was calming and professional. He deescalated the emotional reactions and work with the parties involved to bring them to common ground over a matter of days. What could've been a very costly, lengthy and stressful litigation, was resolved equitably and quickly. Based on Brian's steadfast dedication to his clients as well as his skill in matters of law, mediation and humanity, Brian has my highest recommendation as an attorney.

After six years and tens of thousands of dollars spent, we finally changed lawyers, then our debtor declared bankruptcy. Referred to Mr. Hurley and couldn't be happier. He is fair, honest, realistic and kept us in the loop for the whole ordeal. A very reasonable and moral attorney, no dirty tricks or pumped up bills---hard to find. I wish he lived on our side of the mountains.

What a Debt Collection Lawyer Can Do for You

A debt collection lawyer helps individuals and businesses navigate legal matters related to debt collection. Whether you’re a creditor seeking to recover unpaid debts or a debtor facing aggressive collection actions, a debt collection lawyer can provide valuable assistance. These lawyers help creditors pursue legal action to collect overdue debts and ensure compliance with debt collection laws. On the debtor’s side, they help defend against unlawful collection practices, negotiate repayment plans, or file for bankruptcy if necessary.

If you’re dealing with a debt collection issue, a lawyer can ensure your rights are protected and work toward a resolution that aligns with your financial or business needs.

When Should I Hire a Debt Collection Lawyer?

You should consider hiring a debt collection lawyer if you are facing any of the following situations:

  • For Creditors:
    • Unpaid debts: If you’re a creditor (such as a business or individual) with unpaid invoices, loans, or accounts receivable, a lawyer can help you pursue legal action to recover the debt.
    • Debtor refuses to pay: When a debtor is unwilling or unable to make payments, a lawyer can assist with filing lawsuits, securing judgments, and enforcing those judgments to collect the debt.
    • Negotiating repayment plans: If you’re willing to work with a debtor to arrange a payment plan, a lawyer can negotiate and draft a legally enforceable agreement.
    • Legal representation in court: If a debtor disputes the debt or countersues, a lawyer can represent you in court and ensure your legal interests are protected.
    • Securing liens or garnishments: A lawyer can help you secure liens on a debtor’s property or garnishments on their wages to recover the owed debt.
  • For Debtors:
    • Facing debt collection lawsuits: If you’ve been sued by a creditor or collection agency, a lawyer can represent you in court and help you defend against the claim or negotiate a settlement.
    • Debt collection harassment: If creditors or debt collection agencies are harassing you or violating your rights under the Fair Debt Collection Practices Act (FDCPA), a lawyer can help stop the harassment and potentially sue for damages.
    • Negotiating debt settlements: If you owe a significant amount of money but want to avoid bankruptcy, a lawyer can negotiate with creditors to reduce the total amount owed or set up a payment plan.
    • Disputing a debt: If you believe a debt is incorrect or have been wrongfully targeted by debt collectors, a lawyer can help you dispute the claim and provide evidence to resolve the matter.
    • Bankruptcy options: If your debts are overwhelming and you’re unable to repay them, a debt collection lawyer can help you explore bankruptcy as an option for debt relief.

Hiring a lawyer early in the process can help you protect your financial interests and avoid escalating legal issues.

What Does a Debt Collection Lawyer Do?

A debt collection lawyer provides a variety of services depending on whether they are representing the creditor or the debtor. Their responsibilities often include:

  • For Creditors:
    • Filing lawsuits: A lawyer can file a lawsuit against a debtor who has failed to pay what they owe. This includes preparing and submitting legal documents, representing you in court, and pursuing judgments.
    • Negotiating settlements: If the debtor is willing to settle, the lawyer can negotiate a payment arrangement or reduced settlement that ensures you recover some or all of the debt.
    • Securing judgments and enforcement: After obtaining a court judgment, a lawyer can help enforce it through methods like wage garnishment, bank levies, or property liens.
    • Reviewing contracts and agreements: A lawyer can review your contracts and lending agreements to ensure that they comply with the law and are enforceable if a debtor defaults.
  • For Debtors:
    • Defending against debt collection lawsuits: If you’re being sued by a creditor, a lawyer can challenge the lawsuit, dispute the debt’s validity, or negotiate a more favorable settlement.
    • Stopping harassment: If debt collectors are using unlawful practices to collect a debt (such as threatening you or contacting you excessively), a lawyer can intervene and protect your rights.
    • Negotiating debt relief: A lawyer can negotiate with creditors to reduce the total amount of debt you owe or develop a manageable payment plan that suits your financial situation.
    • Disputing inaccurate debts: If a debt is not valid, a lawyer can help you gather evidence to dispute the claim and prevent further collection actions.
    • Filing for bankruptcy: If your debts are overwhelming, a lawyer can advise you on whether filing for bankruptcy is the best option and help you through the process.

How Are Debt Collection Lawyers Paid?

Debt collection lawyers typically charge for their services in different ways depending on the complexity of the case and whether they represent a creditor or debtor. Common payment structures include:

  • Hourly rate: Many debt collection lawyers charge by the hour, with rates typically ranging from $150 to $500 or more, depending on the lawyer’s experience and the case’s complexity. Hourly fees are common when the lawyer is representing either party in litigation or negotiation.
  • Contingency fee: For creditors, some lawyers work on a contingency fee basis, meaning they only get paid if they successfully recover the debt. Their fee is typically a percentage of the recovered amount, usually ranging from 20% to 40%.
  • Flat fee: For specific services, such as reviewing a contract, drafting a demand letter, or defending a straightforward debt collection lawsuit, a lawyer may charge a flat fee.
  • Retainer: For larger or ongoing cases, a lawyer may require a retainer fee ranging from $2,000 to $10,000, depending on the complexity of the case and the expected duration.

It’s important to discuss fees with your lawyer during the initial consultation and understand the total cost of their services before proceeding with your case.

How Much Does a Debt Collection Lawyer Cost?

The cost of hiring a debt collection lawyer depends on whether you are a creditor or debtor, the complexity of the case, and the lawyer’s experience. General cost estimates include:

  • Hourly rates: Most debt collection lawyers charge between $150 and $500 per hour. Complex cases involving litigation or large amounts of money may result in higher legal fees.
  • Contingency fees: If the lawyer works on a contingency basis, they typically charge between 20% and 40% of the recovered amount. For example, if you recover $10,000 and the contingency fee is 30%, the lawyer would take $3,000.
  • Flat fees: For simpler services like drafting a demand letter or responding to a debt collection lawsuit, flat fees may range from $500 to $2,500, depending on the work required.
  • Retainers: For larger or ongoing cases, a lawyer may require a retainer fee ranging from $2,000 to $10,000, depending on the complexity of the case and the expected duration.

Always ask for a detailed cost estimate during your consultation to avoid surprises and ensure that the services fit your budget.

Top Questions to Ask a Debt Collection Lawyer

Before hiring a debt collection lawyer, it’s important to ask the right questions to ensure they have the experience and expertise to handle your case. Key questions to ask include:

  1. What experience do you have with debt collection cases?
Make sure the lawyer has experience handling cases similar to yours, whether you’re a creditor or debtor.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, on a contingency fee basis, or a flat fee, and ask for a detailed estimate of the total cost.
  3. What is the likelihood of success in my case?
Ask the lawyer for an honest assessment of your case and the potential outcomes.
  4. How long will the process take?
Debt collection cases can take time, so ask the lawyer how long they expect the process to last, from filing the claim to recovering the debt or resolving the dispute.
  5. What are my legal rights?
Ask the lawyer to explain your rights as a creditor or debtor, including protections under laws like the Fair Debt Collection Practices Act (FDCPA).
  6. Will you personally handle my case?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be managing your case.

How to Check the Credibility of a Debt Collection Lawyer

To ensure you are hiring a reputable debt collection lawyer, take the following steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice law and has no history of disciplinary actions.
  • Look for debt collection experience: Review the lawyer’s website or professional profile to ensure they specialize in debt collection law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and ability to handle debt collection cases.
  • Ask for references: A reputable lawyer should be able to provide references from past clients who have worked with them on debt collection matters.
  • Check for certifications or memberships: Look for certifications or memberships in organizations like the National Creditors Bar Association (NCBA) or other relevant associations that focus on debt collection law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a debt collection lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • For Creditors:
    • List of outstanding debts: Bring a detailed list of the debts owed to you or your business, including invoices, contracts, or other supporting documentation.
    • Previous communication with the debtor: Provide copies of any emails, letters, or phone call logs showing attempts to collect the debt.
    • Contracts or agreements: Bring any contracts or agreements related to the debt, as they may be critical in proving your case.
    • Judgment information (if applicable): If you’ve already obtained a court judgment against the debtor, bring the judgment documents and any enforcement attempts.
  • For Debtors:
    • Debt collection letters or notices: Bring any correspondence from creditors or collection agencies, including demand letters and collection notices.
    • Payment records: Provide proof of any payments made toward the debt, including receipts, canceled checks, or bank statements.
    • Debt validation or dispute documentation: If you’ve disputed the debt or requested validation, bring copies of the dispute letters and the creditor’s response.
    • Legal summons or lawsuit documentation: If you’re facing a lawsuit, bring the court summons, complaint, and any legal documents related to the case.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and provide the best legal advice tailored to your needs.
