Gil might be a great lawyer. I had a mediation for legitimation case in Cobb and he where the state appointed him for our mediator and he was completely biased and stereotyped me. My child’s father couldn’t spell our child’s name correctly but he stereotyped me as someone who didn’t want my child to see their dad. He gave legal advice but claimed he wasn’t. He withheld information and made it clear he was advocating for my child’s father not what’s best for my daughter. Mediation felt like a boy’s club. He left many holes in our agreement, made many judgemental comments to me, and dismissed every one of my concerns. I would give my experience 0/10 but google makes me pick at least one star. He’s not the type of person who realizes these are real people’s lives we are talking about. It’s all a paycheck to him.

Gil Howard ,executed my and my husbands will 6 years ago. Recently my husband passed away on June 15th 2021. I assumed with them doing the process and the state of affairs left by my husband, I thought I may have been able to get a consultation . Instead they wanted the 1250.00 retainer fee plus 300.00 dollars an hour. I am getting over breast cancer and funds very limited. I was in a bind and had a question about probate. John was able to see me, I wasn’t even there an hour, and was charged 300.00 which I really could not afford. What has happened to old fashioned free consultation and just not in it strictly for the money very disappointed.

Whit Frost took over my divorce case and has been nothing short of AMAZING!!! Whit consistently won the day in court with a level headed focus on the evidence and on the story from a big picture perspective. He also has displayed a calm yet firm demeanor throughout the case and has been an excellent souce of good counsel throughout. He showed that he cares numerous times and also, has been very fair in his billing practices. If you need a lawyer for a domestic situation in Cherokee County, Whit should be the first and only call.

I am sharing a 5-star rating for Mr. Teiger to share that my complete experience from start to finish has been nothing less than perfect. Fortunately, I do not have any prior experience to compare with that of having Mr. Teiger represent me, but his communication, attentiveness, promptness, and brevity is everything of which I could have asked for in an attorney. It is important to know that I retained his services out-of-state client, but never felt anything other than a local client. I strongly encourage and recommend his representation to anyone - I am confident you will have the same experience. Thanks, Tracy!

Has been booted off Hyatt Legal Services due to client complaints. Did NOTHING in my case resulting in default judgment and garnishment. Never returned a call. Buyer beware. We hired this has been and he fumbled our case for 2 years. During the 2 years he had over 6 s-i-x locations locally. He’s forte is chasing people with property on 441 road expansion. He is far from honest and is the bottom of the barrel. He needs to return where he came from. If you see he has a prestigious address in Atlanta it’s not true. He was using another firm’s good name and address.

Ms. Litt is a knowledgeable and pleasant attorney to work with; however, she missed a critical deadline for a filing stating she was missing some information from our file. Upon meeting with Ms. Litt a third time, I provided the duplicate information and had the sense that my case was not a priority. Mr. Spetalnick was extremely combative, unsupportive and literally called me “very stubborn” during our brief consultation. Not only did I feel as if I was being legally mansplained regarding my case but he was actively interrupting and belittling me as I candidly and vulnerably explained my situation. I felt as if he has defended many men in family law cases and was projecting a perspective against mothers in legal cases. He will not be retaining my services, and my hope is with this review he analyzes the privilege and patriarchy that propagate his behavior and will eventually catch up with him.

when my x stopped paying child support, I knew I needed help so I hired Jon Spetalnick. Mr. Spetalnick provided an initial consultation at no charge and thoroughly explained the process and the next steps. Rather than charge me by the hour, he provided a flat fee for his work up until the court date and a 2nd fee if we went to court. My x on the other hand, hired an attorney with a large practice who charged him an hourly fee and billed him for every little thing. Ultimately, we did not end up in court because of Mr. Spetalnick's hard work and expertise. It was clear that Mr. Spetalnick spent a great deal of time on my case and thought through the best way to document and present the facts to my x's attorney and to a judge if we ended up in court. We settled out of court and everything was in my favor. I definitely made the right decision when I hired Mr. Spetalnick and I know the overall cost was much less than it would have been had I hired an attorney who had charged me an hourly rate. Mr Spetalnick can be very direct, blunt and somewhat harsh at times, but don't let that scare you away. He's passionate about his work and works tirelessly for his clients.

To be honest, this lawyer is really straight to the point, but she is rough around the edges. She recieved my case and she did minimal work to it. But, it really wasn't a case at all. I do feel like she pre-judge clients and think all are the same, but to be fair, I really wasn't honest with her in the beginning. So she had her reasons to doubt me. Anyway, she done her job and my case was dismissed.

John Welsh ll, Att at Law from Lawrenceville, Ga took thousands from us and did nothing. Have all kinds of proof but in Gwinnett County anything goes I guess. Always has, always will. He takes $2000 on 9/21/15 and runs to the bank right away for it. We got our background checks, paid for them, took them to his office. We try and call, leave messages and go to office to leave messages. Nothing. On 10/5/16 he wants another $2000 (I knew I should have went with my gut and left then, figured he blowing smoke up my ass and telling me lies for more funds) but I wrote another $2000 and he was at my bank again within minutes (as they called me). We had to re-do our background checks again, pay for them and take them to his office. Again he does not respond or do anything. Initially he told us this would only take 6-12 months. My husband checked around, it should only take that. So my husband sends an e-mail and he gives him some run around about how it takes a long time. We finally sent a certified letter on 4/11/17 for a statement and refund (signed for 2 days later) 2 months ago but of course we hear nothing. The normal with this attorney. Never hear from him. Today is 6/5/17, never heard a word again.

I have to say hands down Mr. John Welsh is the best attorney I have ever had. Mr. Welsh was my saving grace in helping me survive the process of handling my late husbands affairs. I was completely lost and was about ready to give up and somehow I found Mr. Welsh. Within one visit I had hope again that somehow things might be possible. He stepped right in and took charge and has been unbelievably amazing in every way. I was a happily married woman and stay at home mom of three "little" children when my worst nightmare happened, my husband of 10+ years hit a tree in the black ice of January 2015 and suffered a traumatic brain injury and remained in a coma for 8 months before he passed away. My case was far from simple, my husband was young and had no will plus he had a fairly new business that he had started, not to mention we had 3 young kids. My husband handled all the affairs outside of the household stuff and left me completely lost when he hit that tree. This all made my case become more and more complicated as time went on. Not to mention the mistakes I had made trying to apply for my husbands estate myself with the court. Mr. Welsh was able to take what I had done and completely turn it around for us. He became like family to my kids, myself and even my mother. His assistant Heather was always happy and welcoming, quick to respond to my needs or questions and even when the kids and I were there we always felt more like we were with family than at an attorneys office. They had toys for my kids to play with and were very accepting of having children around, making me much more comfortable and able to concentrate. He is a very kindhearted and thoughtful man and I could tell he had only our best interest at heart. Even to the point of being concerned that I needed to eat after a long day at the courthouse, and urging me to take care of myself. I wish there was a way to convey with words how grateful I am to Mr. Welsh and to Heather- for all their hard work on my case, but words are not adequate to how thankful I am to have had the help of such a kind and caring lawyer. I don't know what I would have done without Mr. Welsh!!!!! If you want an attorney who will treat you like his own family then Mr. John Welsh is it, he's absolutely wonderful in every way. And even my kids loved him... Wonderful attorney and I highly recommend him to everyone!

Although Mr. James is experienced, I felt that he did little to meet me half way with my case. In all honesty I felt that he was more on the side of the non-custodial parent, rather than on the side of his client (me). I say this because I did most of the leg work for him (providing financial records, employment records, etc), yet he did not subpeona the non-custodial parents records. He insisted that the non custodial parent gave a verbal record of his own records and that was sufficient in his eyes. I had proof the ex was lying, yet Mr. James swept that by the wayside. He insisted that because of the ex's occupation, the ex "would be easy to find if a child abduction occurred". Maybe he is close to retiring and that is why he had no passion or time for my case. I paid IN FULL, yet received 1/10 of the services.

Lynwood Johnson is a cruel and conceited man. He is currently the Forsyth County Probate Court judge. My mother has been struggling to take care of our family for years and has done a great job of it. He was extremely harsh and dismissive with our case, telling our family we needed to try other options. When I tried to tell him we had already tried these options, he got fed up with me and decided to not let me speak. He lost his temper with us, yelling at us about things he wouldn't let us explain as my mother cried powerlessly. If you are in Forsyth county, please voice any opinions you have about Lynwood Johnson at City Council meetings. No one should wield the power they've been granted so carelessly and mercifully, especially a man who claims to be a Christian.

When you hire an attorney, they'll tell you they're good for the job and unfortunately this attorney and his firm, bank rolled me while ruining my case for restitution & damages. It was also later discovered that he had absolutely zero experience in vehicle accident/personal injury claims, and yet he assured me that he was up for the job. I have to honestly blame myself for choosing such an inexperienced attorney, who works for a "probate" legal firm. Upon hire, I was seeking monetary damages that over the course of 3-1/2 yrs, cost me well over $35,500.00 and proposed just over 40% recovery in return for my damages due. One would think that the attorney knows the law and could give you a somewhat precise outcome, but instead of coming after the insurance company, he and his firm charged me upfront. Just so your aware, the defendant was founded to be 100% liable for the accident, which I paid both his legal expenses as well as my costs for repairs, and from my pocket. Mr. Stuckey however, benefited well over $14,678.00 and State Farm's legal team (opposing counsel) profited for their legal work, and of course everyone got paid accept me, and/or profited well more than me. Ask yourself, who's the victim here? Again, inexperienced attorney for my needs, but typical attorney, thus never turning down a means for potential monetary gain! If there was a negative 5 stars, that would better suit him.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
