My husband and I have had nothing but wonderful experiences with Kim Rife. My experience is a bit unusual, and different. However, Kim has been there for me from the beginning of my divorce. I went from filing for divorce, coming out as an openly gay man, to fighting for custody of my children after marrying my now husband. Not only did Kim help me accomplish all of these things; she’s also helped us with my husband petitioning the adoption, that adoption being approved and happening, to helping us with the process of changing our children’s last names to match ours. I don’t think it’s noticed but, attorneys (in situations like mine and many others), are the first and often times the final step in making families like mine happen. Thanks Kim. From the Richardson family

I have required legal assistance twice in my life for very difficult situations and thankfully I found Suzan Myers and her staff. Everyone treated me with incredible kindness and I received assistance that was way above and beyond what I believe is normal for a law office. I would never consider going anywhere else for legal assistance and would highly recommend them all!

I have had the unfortunate pleasure of working with Ms. Myers in relation to several matters with elderly relatives. I have found her to be mildly rude and condescending, and completely untrustworthy. I have caught her in a couple of lies while working through probate. During this time she also became increasingly evasive and difficult to work with. Fortunately, her services are no longer needed. In addition to my issues with Ms. Myers herself, her paralegal is well known around town (and the county) for having some very loose lips. Don't use these services unless you want your private life to be sacrificed. It is very apparent that Ms. Myers has a significant inability to maintain the confidentiality of her office. My recommendation: Do not use Ms. Myers simply because she is local and available. There are better, more trustworthy attorneys in the area.

I called the office and gave all my information to Veronica. She put me on hold to speak to Terry. She scheduled an appointment for me with a $200 consultation fee. I met with Terry for 10 minutes during which he informed me there was nothing I could do. I can't imagine why they wouldn't have told me that on the phone considering I told him the same thing I told the receptionist. I thought that was really a jerk move.

Be aware. This attorney will refuse your calls and refuse to let his assistant talk to you a paying client. He cares more about his duties as city attorney where he can walk all over people's rights on a grander scale. I had to fire him because a month went by and he would not talk to me. He does not care about what you are going through once he gets paid.

I was not and IF he would have taken a moment to hear what I was trying to say HE would have realized that myself and my siblings had not only lost our last surviving parent but that we had also been put through the ringer. !!!! So thank you kind Sir for your inability to listen and also for your rudeness of hanging up unjustly on me !!!!!! That's Hoosier hospitality at its worst not to mention extremely disrespectful !

I hired Rachel for a domestic violence case involving children. She failed to ever mention to me she specializes in elder law. She failed my children and myself and did nothing to help protect us. She handed my children back into the hands of their abuser, stating "It will look better to the judge" and insisted I bend over backwards to cater to my abuser and his every whim, revictimizing me and my children over and over. She may as well been my abusers lawyer, as she catered to him and had no interest in protecting my children, despite the mountain of evidence against my abuser. She has no backbone and was easily intimidated by my abusers lawyer. Lawyers like this one is part of the reason children continue to get abused(and worse) and ignored in the court system. If I could give her a negative star review, I would. Beware of this lawyer and avoid hiring her for anything important to you.

Wish I could give 0 stars. It's a debt collections place so, clearly, they won't get many positive reviews. My personal experience for this though, is I have been paying for the past couple years every month on time, even early (even went in person a couple times and paid a month in advance and talked with them about advancing it). I got a letter threatening my work pay, and them monitoring my job status. I have proof in receipts they give from the office and online payments of it all, and so should they (hopefully). I found the lawyers name and emailed him stating I was worried if there was an issue and was confused as to why I received this, because I have kept up with everything needed, even months early. I also stated there was proof in the receipts I was given and is in their records, and also on the website. He then only responded that I haven't been doing the agreed upon terms and they will continue to monitor my job; he clearly didn't care to look into it. I know I have nothing to worry about since I've been paying what was agreed and will continue to, and have proof of it all. It was just so uncomfortable, not professional at all, and made me gather every proof I had just in case and I shouldn't have to do that. Reading other reviews, it seems intimidation is a key method for them.

If I could leave a negative star review, I’d leave it a thousand times over. Sally was appointed as a guardian at litem, at my request for a GAL, due to the crystal clear parental alienation that was taking place in my custody case. Due to confidentiality, I will not get into the specifics of the case, but her performance in this case warrants a complaint with the Indiana Judicial Branch, which will be my next step, and hopefully an investigation into her performance as a GAL. Her lack of expertise in this field was overwhelming. She was so cocky, and arrogant, with nothing to back it up. The job of a Guardian at Litem is to be the voice of the children, and yet she didn’t even speak to the kids a couple of weeks before her report was due to the court. TWO WEEKS. Four months after she was appointed to our case. Every email I sent her, she never responded to. It wasn’t until my daughter, who I had been alienated from was having a medical surgery, and I was given one week notice, that she actually responded back to my email. Only to scold me in her response back because by reaching out her with my concern for this surgery, that apparently isn’t how things are done in a custody hearing??? And apparently it was my responsibility to email her again if she never responded back to my email…My daughter who I’ve been alienated from is having a difficult time with life right now and Sally had a DUTY, a RESPONSIBILITY to make sure she was doing her due diligence, and to see through the lies, but she did none of that. She made a judgement in her initial meetings with me and my husband and my ex and his wife, and once she picked a side, she did no further work to gain anymore information. I don’t know how this woman sleeps at night knowing how negligent she is in her job, and how that impacts CHILDREN and FAMILIES every single day.

Mr. Cioe does not care or listen to what you ask for. He tries to play both sides, drawing out your case racking up your bill. If you voice your opinion, or say one thing that he don’t like he is extremely rude and tries to con you into something that you don’t want to do. Mr. Cioe was extremely two-faced, and will act like he’s loyal to you, but he’s friending the other party to try to drag things on. Mr. Cioe assisted me through the process of administering my parent's estate. To keep the expense low, I wanted to do as much of the work that I could myself. To help in this matter, Mr. Cioe to applied to the court for the probating of the estate to be "unsupervised". This meant that Mr. Cioe took care of presenting items in court when needed, prepared required legal documents, and advised me on proper process as I handled everything else. The cost in doing it in this manner was much lower than any of the other lawyers had quoted. And this was accomplished from afar, as I live several states away. We made extensive use of fax, email and phone as well as the Post Office. Mr. Cioe was always very patient when I called with my numerous questions. I would recommend him to others and use him again myself if a similar situation arises.

She completely screwed my husband over while "representing" him in a custody battle for my stepson. She did NOTHING, failed to inform him of hearings, failed to respond to his inquiries in regards to ANYTHING through the whole process. She even said before the final hearing, "You should pray." We are great parents and she ruined his chance of the custody he deserves. We didn't even receive the final order from her until MONTHS after, and that was only because we both bothered her incessantly until she finally sent all of his paperwork. We will definitely be filing a complaint of negligence to the IN Bar Association. She's worthless.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
