As one who personally finds it painful to speak well of any attorney I must make an exception and speak of my great satisfaction with John Rains. I first dealt with John about twenty years ago as a young businessman. Since that first meeting until today I have been more than satisfied with John's ability as an attorney and character as a person. He is exceptionally well prepared for any meeting or hearing, he exudes professionalism and competence, and reduces stress by simply being in the same room. John is not a "pit bull attorney", he uses his skill and knowledge of the law to achieve results, not a loud mouth and threats. John provides reason and perspective to a case and is not afraid to be brutally honest with his clients about the nature of civil procedure and that your money and peace of mind is more important than "going to war" with your adversary. If you are looking for an attorney that you can respect and who sincerely places you before his desire to rack up a ton of billable hours, I know you will be happy with John Rains.

My eighteen year old daughter went from being a healthy college athlete to suffering a massive stroke, paralysis, brain damage and multiple heart surgeries as a result of malpractice. She was hospitalized for over two months and had an extremely lengthy rehabilitation and recovery period. We hired Charles Moore in 2013 on the recommendation of a relative who is an attorney. I wasn't even aware of the firm he worked for at the time. To be perfectly honest, I probably would not have contacted that firm because I was of the opinion that large firms provide less personal service and I needed to look the person who would represent us in the eye to get an idea of the type of person they were. My daughter had been through enough already and I needed to know that the attorney representing her would be someone she could relate to and someone who would be patient and understanding with her. Mr. Moore made himself available to us for all questions large and small at any given time. There was never a time I called him when he didn't answer personally. I wasn't sure what to expect because I had never been in this kind of situation before. He was very easy to communicate with and explained each step of the process clearly and thoroughly. While preparing her case for trial he was persistent and thorough. Her case was a complicated one and it required expert medical opinions and the review of volumes of records as well as depositions from numerous people. Throughout it all we were kept up to date and well informed. Mr. Moore is friendly and personable but nothing to be trifled with when it comes time for mediation or trial. Fortunately we were able to reach a settlement without going to trial. The opposing counsel told me afterwards that if it weren't for him we would not have fared as well at mediation and I sincerely believe that. The fact that he was not afraid to go to trial if we had to made a big difference. Although I didn't want to put my daughter through a trial, she will have ongoing medical needs for the rest of her life and has lost things that she will never get back. It was important to me that she not have to worry about how to pay for her future medical care and that she be at least somewhat compensated for her loss. I pray that I will never need a malpractice attorney again in my life but if I do, Chad Moore will be who I call. I cannot recommend him highly enough. He was truly a blessing to my family and we owe him so much. He is more than a competent attorney, he is a kind and genuine person who I am glad to have met.

Our 8 year old child was coached by their counselor to be Baker Acted just a week after same counselor had his twin Baker Acted. Children with normal life and mental health patterns before beginning with this school counselor at the start of the year. Adam was by our side within 4 hours of contact, working with his partner to get our Writ of Habeas Corpus together on a Friday afternoon and document gathering from others as well as our family's doctor and put in play a judge at the ready. He even handled the cops when they were called on us as the administrator couldn't get her story straight. Our child was released within the next 4 through Friday night to our and our doctor's care thanks to the quick thinking and firm hand Adam used to bring our Baker Acted son home to us. I'm deeply grateful to his quick actions and quick thinking to prevent our son from being held against his (and our) will creating traumatizing memories.

Richard worked diligently and played a crucial role in fighting for our rights. His knowledge on construction law and legal experience gave me and my wife confidence to work through a testing time . He also treated us as if we were his only client, which was a breath of fresh air. His communication was also superb. Ultimately he delivered us value in a very professional manner.

No one knows when tragedy will strike a family. Senseless drunk drivers and the costs they cause both financially and physically to your loved ones led me to Mr. Deem. Unless you are in an accident you cannot image the medical collection notices and insanity of the insurance industry. Just know its impossible to navigate on your own. Be prepared to hire an attorney to assist you with getting your claims paid and so much more. I am grateful to Mr.Deem and his dedicated staff for their commitment to their clients. It is not an easy road to recovery but having someone with knowledge and experience can lift your spirits.

Chandra and I worked have together on several trials. I served as a witness for a national bank and Chandra was trial counsel. The thing I like about her is that she was always prepared. Some of the other attorneys I have worked with either didn't seem to know the law/procedure or just didn't review the cases beforehand. That might be because of their workload; but, not Chandra. She was always ready for every possible scenario. The other thing I like about her was that she always got back to me quickly, even at night and on the weekends.

Jeff Myers is an extremely knowledgeable attorney who combines his background as a criminal lawyer with his healthcare expertise to offer his clients healthcare litigation expertise. Jeff has represented my company in contract matters. He has spoken at healthcare symposiums that I have attended and exhibits a very high level of knowledge regarding healthcare. He also represents two clients that I am associated with in their legal defense of their healthcare licenses. His defense of them excels as he is able to utilize his background as a criminal attorney to provide strong defenses for his clients.

Mr. Perrott represented me in a rather unusual case (and we won!). My ex sued me claiming that the dog that I had purchased while we were together was hers. Not everyone would understand the importance of a case like this, but to me, the thought of losing my dog was unbearable. Mr. Perrott was very sympathetic to this issue, and easy to work with. He was also very professional and very thorough in the way he prepared for the case, bringing relevant witnesses, including the breeder who he was able to have provide a written statement as well as testify telephonically from out of state (which didn't end up being necessary-- but he was prepared). I can't thank Mr. Perrott enough. You never want to be in a position where you have to seek the counsel an attorney, but if I am put in that situation, I would absolutely hire him again.

All of the legal problems I experienced with a divorce, an insurance matter, a collection matter, a real estate matter, personal injury matters, and other legal issues over the last several years were handled expertly by Mr. Albrechta. He went far above and beyond what was necessary to reach the best results for me. He really cares about his clients and does the best he can for them. Ms. Hibbard represented me when my insurance company denied a claim for damage to my home. I can't rate her highly enough. It was a complicated, difficult and lengthy lawsuit, with which she dealt vigorously, diligently and persistently. I received excellent advice (and I know because I myself am an attorney) and absolutely top-notch representation. She prevailed in the suit, winning a full recovery for me. I could not have asked for better. I recommend her unreservedly.

What a Litigation Lawyer Can Do for You

A litigation lawyer specializes in representing individuals, businesses, or organizations involved in legal disputes. Whether you're the one filing a lawsuit or you're being sued, a litigation attorney will advocate on your behalf throughout the entire legal process. Their goal is to resolve disputes, either through negotiation, settlement, or trial. Litigation lawyers can help with a wide range of disputes, including contract disagreements, real estate issues, employment disputes, personal injury claims, and more.

Litigation lawyers provide strategic legal advice and manage all aspects of your case, from filing motions to representing you in court, ensuring that your rights are protected and that you have the best chance of achieving a favorable outcome.

When Should I Hire a Litigation Lawyer?

You should consider hiring a litigation lawyer if you're involved in a legal dispute that you cannot resolve on your own. Common situations include:

  • Breach of contract disputes: If a party to a contract fails to fulfill their obligations, a litigation lawyer can help you seek damages or enforce the agreement.
  • Business disputes: Litigation lawyers can represent you in cases of partnership disagreements, intellectual property disputes, or business fraud.
  • Employment disputes: If you're facing issues like wrongful termination, workplace discrimination, or wage disputes, a litigation lawyer can help resolve these matters through negotiation or court action.
  • Personal injury claims: If you've been injured due to someone else's negligence and are seeking compensation, a litigation attorney can help you pursue your case.
  • Real estate or property disputes: When there are conflicts over property ownership, boundary issues, or lease agreements, a litigation lawyer can assist in resolving the dispute.

Hiring a lawyer early in the process is beneficial, especially if a lawsuit seems imminent or you have already been served with legal documents.

What Does a Litigation Lawyer Do?

A litigation lawyer handles all aspects of your case, from the initial investigation to the trial and even the appeals process, if necessary. Their role includes:

  • Case assessment and investigation: Analyzing the facts of your case and advising whether it’s worth pursuing or defending.
  • Pleadings and motions: Drafting and filing documents to initiate or respond to a lawsuit, including complaints, motions to dismiss, and answers.
  • Discovery: Gathering evidence, including depositions, interrogatories, and document requests, to build your case.
  • Negotiations and settlement discussions: Attempting to resolve disputes through mediation, arbitration, or settlement talks before going to trial.
  • Trial representation: Presenting your case in court, examining witnesses, introducing evidence, and making legal arguments before a judge or jury.
  • Appeals: If necessary, filing appeals to challenge or defend the outcome of the trial.

Litigation lawyers are also skilled negotiators and often work to resolve disputes outside of court to save time, money, and stress for their clients.

How Are Litigation Lawyers Paid?

Litigation lawyers typically use a variety of fee structures depending on the type of case, the complexity of the legal matter, and the financial circumstances of the client. Common payment arrangements include:

  • Hourly rates: Many litigation attorneys charge by the hour, with rates varying based on experience and geographic location.
  • Flat fees: For specific, predictable legal tasks (such as filing a motion), lawyers may offer a flat fee.
  • Contingency fees: In personal injury or other cases where you seek damages, a lawyer may work on a contingency basis, taking a percentage of the settlement or award if you win.
  • Retainer: Some clients pay a retainer fee upfront to secure ongoing legal services. The lawyer then bills against this retainer as work is done.

The exact structure should be discussed in the initial consultation to ensure you understand how and when you'll be charged.

How Much Does a Litigation Lawyer Cost?

The cost of a litigation lawyer varies significantly depending on the nature of the dispute and the lawyer’s experience. Factors affecting the cost include:

  • The complexity of the case: More complex litigation involving extensive discovery, expert witnesses, or multi-party suits typically costs more.
  • Time spent: Litigation cases can be time-consuming, especially if they go to trial. The longer the case, the higher the legal fees.
  • Type of fee arrangement: Hourly rates can range from $200 to over $1,000 per hour, depending on the lawyer’s reputation and location. Contingency fees generally range from 25% to 40% of the settlement or award.
  • Stage of litigation: Cases that settle early in the process are often less expensive than those that proceed to trial or appeal.

It’s crucial to ask about cost estimates during your initial consultation to avoid surprises.

Top Questions to Ask a Litigation Lawyer

Before hiring a litigation lawyer, it's essential to ask key questions to ensure you're choosing the right representation:

  1. What is your experience with cases like mine?
Ensure that the lawyer has experience handling your specific type of dispute, whether it's a contract issue, personal injury, or business matter.
  2. What are the potential outcomes of my case?
Ask for an honest assessment of your case's strengths, weaknesses, and the likelihood of success.
  3. What is your fee structure?
Clarify how you'll be charged, whether by the hour, a flat fee, or on a contingency basis.
  4. How long do you expect my case to take?
While it's hard to predict, an experienced lawyer can give you a rough estimate based on similar cases.
  5. How often do you settle cases versus going to trial?
Some lawyers are more inclined to settle, while others may be more experienced in the courtroom. It’s important to understand their strategy.
  6. What is your approach to resolving disputes?
Some lawyers prefer aggressive litigation, while others focus on settlement or mediation. Choose one whose approach aligns with your goals.

How to Check the Credibility of a Litigation Lawyer

To verify a litigation lawyer’s credibility, consider the following steps:

  • Check bar association records: Ensure the lawyer is in good standing with the state bar and has no history of disciplinary actions.
  • Read client reviews and testimonials: Online reviews can provide insight into the lawyer’s professionalism and track record.
  • Look for litigation experience: Review the lawyer’s website or professional profile to ensure they have handled cases like yours and have a record of success.
  • Request references: Ask the lawyer to provide references from past clients who can speak to their effectiveness and approach.
  • Research their trial experience: If your case is likely to go to trial, ensure the lawyer has a history of courtroom success.

What Should I Prepare for My First Consultation?

To make your first consultation with a litigation lawyer productive, you should prepare the following:

  • A clear outline of the dispute: Provide a timeline and key details about the legal issue you're facing.
  • Any relevant documents: Bring contracts, emails, letters, or any other documentation that pertains to the case.
  • A list of key players: Provide the names of individuals or companies involved in the dispute.
  • Questions about fees and the litigation process: Make sure you understand how the lawyer plans to approach your case and how you will be charged.
  • Your goals and expectations: Be clear about what outcome you're hoping for, whether it's a settlement, compensation, or another resolution.

By coming prepared, you can ensure that your initial meeting with the lawyer is both efficient and insightful, giving you a better sense of how to proceed with your case.
