I am still in the process of suing someone who hit me from behind. (7/2013) I just recently had surgery as a LAST(3 /28) resort. I had to do ALL of the leg work fighting with the insurance company to get this approved. I was hitting a brick wall. I finally received a call back and spoke directly to him asking him how much money my case could generate and it got the ball rolling. Letters were FINALLY sent out to aid in getting this surgery approved. It took me 6 months to get results . Linda, his secretary, while awesome, definitely put you off and makes you think that Randy is working on your case when in fact he has no idea what's going on. He does NOT return your calls in a timely manner. But I'm sure his hand will be out for his third of the case. I am not an expert, and have never sued anyone before. But I thought that hiring a lawyer was supposed to help you get results When spoken to, he has to find your file to look at it. Either he's in the weeds and needs help or is incompetent I have yet to decide. I had surgery 3 weeks ago and have asked for advice. I have re sent the request 3 times. perhaps I'm naive but I could use someone to help walk me through this process. I think a call to one of the higher-ups might get me some positive results I will send a new review when this is all said and done. When ask below if I would ever use this lawyer again that answer is up in the air. We will see what the end result brings

I HIRED RANDALL RICHARDS AND WAS APPALLED AT HOW I WAS TREATED. HE WOULD NOT RESPOND TO ANY OF MY PHONE CALLS (FOR OVER 7 MONTHS), I WOULD CALL TO ASK WHAT HE WAS DOING WITH MY CASE AND HIS RECEPTIONIST WOULD MAKE EXCUSES THAT HE WAS UNAVAILABLE TO TALK WITH ME, SHE WOULD LIE AND TELL ME THAT HE WAS DOING THIS AND THAT ON MY CASE WHEN I FOUND OUT THAT HE HAD NOT. I NEVER RECEIVED ANY CORRESPONDENCE FROM HIM BY PHONE OR MAIL EVER. I WAS BESIDE MY SELF FOR OVER 7 MONTHS JUST WAITING AND WAITING FOR SOME SORT OF RESPONSE THAT i NEVER RECEIVED. I BELIEVE THAT HE WAS JUST STALLING ME AND MY CLAIM. I AM SHOCKED AT HOW SOMEONE GAVE HIM A 5 STAR RATING, I TOTALLY AGREE WITH THE FIRST CLIENT REVIEW THAT WAS A ONE STAR! BEWARE OF THIS ATTORNEY. HE IS UNPROFESSIONAL THERE ARE OTHER WORDS I COULD EXPRESS ABOUT HIM THAT I WON'T USE, LET'S JUST SAY "HE IS NOT TRUSTWORTHY" PLEASE BE CAREFUL IF YOU ARE THINKING OF USING THIS ATTORNEY!

Major disappointment and not recommended at all. Made us change from another personal injury attorney because we knew her socially and she swayed us to believe we had a 'slam dunk' car accident case with her as our defense. After 15 years of submitting documents, waiting, and her not returning calls, staff sent a 'we are sorry' letter.

This lawyer and her staff were hired to represent my father after he was hit and left permanently injured by a car. It was a clear cut case and the insurance paid out the minimal amount the policy had on it and they were quick to pocket the money. almost year later we have not seen any of the money. This law office led us to believe they were representing us in this matter, but have not. as a result the elderly injured man had to pay back out of his own money what Medicare thought he owed and the department of treasury started taking money out of his social security. All that because of Asher and Assoc.were not following up on the letters we were forwarding to them for A YEAR! and not following the required procedures of reporting their fees and costs to Medicare, aND not representing or advising us to the hospital and the doctors when the bills were sent to Medicare instead of the no fault carrier, resulting in the debt. Upon their advice we were sending them all the medical bills and trusting them to act on them or advise us what to do. They were inefficient at best. After all the calls and messages to Ms Asher go Unanswered, our bills keep mounting and we see none of the settlement money the law offices of ASHER & Assoc.received almost a year ago we wonder if they ever planned to do anything more but pocket the money and ignore the client.

My brother Steven B. suffered near-death injuries as a result of Medical Malpractice. Background: Steven required surgery at some point for a relatively small issue. Some months thereafter he suffered multiple severe infections requiring several hospitalizations. Upon further diagnostic investigation, medical professionals discovered a surgical instrument that was not removed before closing the surgical wound and therefore leaving a rogue surgical instrument sitting in his chest routinely causing sepsis as a result of chronic infections. This was clear case of Medical Malpractice. Asher Law was retained. Fast forwarding 10+ years later, currently Steven has not received his settlement. Roberta Asher, Steven's Lawyer and the firms Principal attorney did not provide Steven any periodical updates of his case. 5+ years ago we started asking questions and submitting requests for information. Our attempts at soliciting responses were met with outright lies, the run-around, and ultimately zero returned calls and no responses to our requests. When we were able to reach one of the lawyers they made promises and never---not one time---kept ANY of there promises. They were just saying things to get us of their back. We have contacted the New York Bar and there is an active investigation currently ongoing. We suspect that the money was embezzled by the firm's principals. Once we contacted the bar, Mrs. Asher contacted us and wanted to work with us so that we would not pursue the Bar investigation. We declined. This lady has been rude and condescending. She lies and her staff lies for her. DO NOT TRUST ASHER LAW AND IT'S PRINCIPAL ROBERTA DORF ASHER. THEY ARE CRIMINALS BY DEFINITION. AND THE BAR ASSOCIATION WILL PROVE THAT THERE HAS BEEN CRIMINAL ACTIONS SUPPORTED BY CRIMINAL INTENT.

Preston Carlisle's office has been very unprofessional and uncaring. He and his office are not responsive to questions. This attorney and his staff have kept me totally in the dark about the entire process and have told me incorrect information and inconsistent information on many different occasions. They have lost nearly every document I have dropped off to them and then accused me of not bringing them. They appear to be not trustworthy at all and their inconsistent and inaccurate information make me question how they have operated in this practice for years. I do not trust them and do not find them knowledgeable AT ALL. They have not put in any real work and I have had to do WAY too much just as a client when all I should be focusing on is getting my injuries taken care of. Carlisle has told me to "Shut up," hes "not making any money off me anyway," and expressed literal disdain for my appearance of physical discomfort that stems from my injuries. I cannot control the fact that I am injured and I need an advocate not abuse from a person who is supposed to be helping me. I am absolutely disgusted by how I have been treated. Injured people beware! Stay away from this attorneys practice!!!!

I was in an accident and had several lawyers offering representation. I decided to go with John Appell based on a friend's recommendation. For the past six months, he and his team continuously failed to communicate with me on what they needed from me and what steps they were taking regarding my case. Even a simple request to receive the insurance claim information from the person who hit me was a huge task for his office. At one point his office told me that I can expect to see some (but little) compensation for the accident, so I thought thing were going well. The next time I hear from his office is via a letter in the mail stating after a review of my case that John will not represent me. I found this process long, unprofessional, and unnecessarily difficult. It also didn't help that I only spoke to John once during this timeframe.

I called Ms Wachsman only because another attorney suggested I speak with her. She gave questionable advice, as it was a case of domestic violence / sexual assault, and she said go to small claims court... she interrupted me without knowing any facts other than what she was told (by the initial attorney), and I still don't know what that is.... I attempted to tell her that a support group was recommended by the sexual assault org, however she yelled that if you don't see a psychiatrist there is no proof of emotional distress. That's not true. Only those who have the time and means to go to a psychiatrist have suffered because of a crime or a heinous, despicable act, or negligence? Support groups and actions/speech out of character doesn't indicate emotional distress? Ms Wachsman kept yelling that "she is the attorney!". I've spoken to several attorneys on this matter, and have had internships with attorneys when in college, and never was I spoken to like that. Although I scored a mere 165, in the 93 percentile, on my LSATs, I surmised it was higher than her score based on how she chose to speak to me... .... I'm a competitive athlete and an academic, so what she says doesn't phase me, I know not to trust it. However, lawyers give poor legal advice all the time, and if that advice were given to a weaker person, who has experienced a form of domestic violence or sexual assault, I fear for their safety and well being if they chose to listen.... I could say more, however I believe that it's important that this review receive approval, so I am going to leave it at that.

Beware of his promises and ask for copies of ALL correspondence because he does not do this unless asked repeatedly, Just be cautious with this attorney, His promises lead to an end of the case where he gets his money and his clients like me are left to deal with less than what he got paid.

What a Medical Malpractice Lawyer Can Do for You

A medical malpractice lawyer specializes in helping individuals who have been harmed due to the negligence or misconduct of healthcare professionals, such as doctors, nurses, or hospitals. These lawyers assist in cases where a healthcare provider deviates from the accepted standard of care, resulting in injury or death. Medical malpractice cases can involve misdiagnosis, surgical errors, medication mistakes, birth injuries, and other forms of medical negligence.

If you or a loved one has suffered harm due to improper medical treatment, a medical malpractice lawyer can help you understand your legal options, file a lawsuit, and pursue compensation for medical expenses, pain and suffering, lost wages, and other damages.

When Should I Hire a Medical Malpractice Lawyer?

Hiring a medical malpractice lawyer is essential if you’ve been seriously injured due to the negligence of a healthcare provider or institution. Situations where you should seek legal representation include:

  • Misdiagnosis or delayed diagnosis: If a doctor fails to diagnose or delays diagnosing a medical condition, leading to harm or progression of the illness.
  • Surgical errors: Harm resulting from surgical mistakes such as operating on the wrong site, leaving instruments inside the body, or performing unnecessary procedures.
  • Medication errors: Injuries caused by prescribing the wrong medication or dosage, or mistakes made by pharmacists in dispensing drugs.
  • Birth injuries: Injuries to a newborn due to medical negligence during labor and delivery, such as failing to perform a timely C-section or improper use of delivery instruments.
  • Anesthesia errors: Complications arising from improperly administered anesthesia, which can lead to serious injury or death.
  • Inadequate follow-up or aftercare: Suffering due to lack of proper monitoring or care after a medical procedure, leading to complications.
  • Hospital or nursing home negligence: Harm caused by the negligence of hospital staff, nurses, or administrators who failed to provide adequate care.

Medical malpractice cases are complex, and hiring a lawyer early can help ensure your rights are protected and your case is handled effectively.

What Does a Medical Malpractice Lawyer Do?

A medical malpractice lawyer provides various legal services to help injured patients hold negligent healthcare providers accountable. Their responsibilities include:

  • Evaluating your case: Reviewing medical records and consulting with experts to determine if you have a viable claim based on the standard of care and harm suffered.
  • Filing a lawsuit: Initiating legal action by filing a complaint against the responsible parties in the appropriate court.
  • Gathering evidence: Collecting medical records, expert testimonies, and other relevant evidence to build a strong case.
  • Negotiating with insurance companies: Working to secure a fair settlement that compensates you for your injuries without the need for a trial.
  • Litigating in court: Representing you during trial proceedings if a settlement cannot be reached, presenting evidence and arguing your case.
  • Calculating damages: Assessing the full extent of your losses, including medical expenses, lost income, pain and suffering, and future care needs.
  • Handling expert testimony: Coordinating with medical experts who can testify on how the standard of care was breached and how it led to your injuries.

How Are Medical Malpractice Lawyers Paid?

Most medical malpractice lawyers work on a contingency fee basis, which means they only get paid if they recover compensation for you. Key aspects of this payment structure include:

  • Contingency fee percentage: The lawyer's fee is typically between 25% and 40% of the settlement or award.
  • No upfront costs: You do not pay any legal fees unless the lawyer successfully recovers compensation on your behalf.
  • Case expenses: Costs for expert witnesses, medical record retrieval, and court fees may be deducted from your settlement or award in addition to the lawyer's fee.

Always discuss the fee arrangement during your initial consultation to understand your financial obligations.

How Much Does a Medical Malpractice Lawyer Cost?

The cost of hiring a medical malpractice lawyer is usually based on a contingency fee model. General estimates include:

  • Contingency fee: Lawyers typically charge between 25% and 40% of the total recovery amount.
  • Case expenses: Additional costs such as expert witness fees and court expenses can range from $5,000 to $50,000 or more, depending on the case complexity.

Ensure you receive a clear explanation of all potential fees and expenses before proceeding with your case.

Top Questions to Ask a Medical Malpractice Lawyer

Before hiring a medical malpractice lawyer, consider asking the following questions:

  1. What experience do you have with medical malpractice cases like mine?
Confirm the lawyer has a successful track record with similar cases.
  2. How do you charge for your services?
Understand the contingency fee percentage and any additional costs you may incur.
  3. What is the likelihood of success in my case?
Seek an honest assessment of your case's strengths and potential challenges.
  4. How long will the process take?
Get an estimate of the timeline for settling or taking the case to trial.
  5. Will you handle my case personally?
Ensure you know who will be managing your case and their level of involvement.
  6. Have you worked with expert witnesses?
Verify the lawyer's experience in collaborating with medical experts essential for your case.

How to Check the Credibility of a Medical Malpractice Lawyer

To ensure you're hiring a reputable lawyer, take the following steps:

  • Verify their bar status: Check with your state bar association for their license and any disciplinary actions.
  • Review their experience: Look for specialization in medical malpractice and a history of successful cases.
  • Read client reviews: Consult platforms like Avvo or Martindale-Hubbell for testimonials and ratings.
  • Ask for references: Request contact information of previous clients willing to discuss their experience.
  • Check professional affiliations: Membership in organizations like the American Association for Justice (AAJ) indicates a commitment to the field.

What Should I Prepare for My First Consultation?

To maximize the effectiveness of your initial meeting, bring the following:

  • Medical records: All documents related to your treatment and injury.
  • Evidence of harm: Photos, medical bills, and records of lost wages.
  • Communication records: Any correspondence with healthcare providers or institutions.
  • List of healthcare providers: Names and contact information of all involved medical personnel.
  • Questions for the lawyer: A prepared list to address all your concerns.
  • Timeline of events: A detailed chronology of your medical care and the issues encountered.

Being well-prepared helps the lawyer assess your case accurately and advise you on the best course of action.
