Mr. Carreras accepted my retainer and seemed to be working on my behalf until one day he just stopped. He didn’t communicate with me his reasoning nor did he answer any of my emails or phone calls with an explanation. Very unprofessional! I tried for months to reach him but he never responded. Because of him, I lost the sale of my property that was under contract. I am so disappointed in him and his law firm as I also reached out to his supervisor and didn’t get an explanation. I do not recommend him or his law firm.

Attorney Thomas has been handling a probate case for my mother's estate for over a year. The estate has no value, yet for some reason the estate has not been settled. I have called his office on numerous occasions to get the status of the estate and he WILL NOT EVEN RETURN MY CALLS. I will be filing a complaint with the Florida Bar.

We hired this lawyer to help us protect our mother from an abusive temporary guardianship. She said she knew a few judges and could easily come against the opposition and get us in court quickly to overturn the injustice. She took our retainer and did nothing except ridicule us in emails with another attorney who had referred us. Isn't that a breach of client/attorney privilege? We researched Florida laws that had been broken, sent her case law, sent her legal questions, sent character references and statements from witnesses, all to no avail. She ignored all our efforts to assist her in the case. Instead she told us she talked for an hour with the opposing attorney and then began to make threats as if she was voicing the other side's attacks against us, accusing us of lying and disobeying her instructions. When asked which instructions she was referring to she could not produce any. It was devastating. She did more harm than good. She did not care that my mother was being injured, in danger and this was a life or death situation. She had absolutely no empathy for me or my mother's pain and life-threatening situation. She went on vacation twice and accomplished absolutely nothing!

I hired her to respond to a paternity case that my daughter's father filed against me asking for 50 % time sharing. She had my case since February 20 and in August 20 we had the mediation. I found out during this mediation that if I didn't accept the conditions of the time sharing that my ex was asking in his petition I had to pay him for the night's difference that I'd have my daughter with me base on the fact that I make 3 times the money he makes. This should be basics for any family lawyer. If she'd have told me that from the beginning I wouldn't have paid a 3 hour mediation ( $300 an hour) and I'd have accepted my ex time sharing request from the beginning without the need of spending over $4000.

I would never ever recommend Aubrey to represent me or anyone else. She is a gold digger, she does not return calls, she is not there to help you just take your money. It takes her weeks to return emails and she recommends people to get court appointed guardians when not needed as well as not explaining what all that entails. Wanted to fire her but, it was too late in the process to get another attorney. When looking into getting another attorney sharing with them how I was being represented they shared to beware that the advice I was getting was wrongful and unjust. STAY AWAY LOOK ELSEWHERE WHEN LOOKING FOR AN ELDER LAW ATTORNEY SHE IS NOT THE ONE. She caused more stress and pain for me and the family then needed. I called for guidance and help and she convinced me that she could do it all. She did not do anything but, again take my money nothing was resolved and still isn't. She will have to live with her own actions and guilt. Beware! She is not the person you want to help your elderly parent or for that matter anything.

Parker was retained for a routinue condo closing. The paralegal copied the wiring instructions incorrectly onto the final documents. I caught the error when the documents were notarized. It took five days for the money to transfer, and during that time, although I tried to contact Parker he did not return my calls or email me. He may be knowledgable. I really can't comment. But he runs a sloppy, careless office, and the paralegal I dealt with seemed more like a clerk. The contract involved was for more than a half million dollars, and I think most people would have sweated that five day delay as much as I did. Parker never even apologized. He's apparently involved in bigger projects, which is great for him, but it is really highly unprofessional to ignore small clients under such circumstances(half a million is small?), and I don't think he really earned his fee. I used him to do a real estate closing. He refused to answer simple questions, never responds, made many errors, including 5 versions of the closing statement. Took forever to get him to correct. Charges on the wrong side, math errors, etc. Finally I gave up and closed after he wasted 2 weeks of time for nothing with his and his team, incompetence. Cost a few hundred dollars for nothing, unbelievably frustrating, the worst experience I have ever had with a lawyer and I have had many. Stay away.

This lawyer was not well informed and would make guesses about what he thought to be the law (differences according to county or distance between parties involved in litigation). Michael Edwards can be very disrespectful. His secretary on the other hand is very polite. Michael Edwards said he has no feelings with regard to his clients involved in family law litigation, and it shows. He is not motivated, loses documents, and takes very little action.

***CAUTION!!! DO NOT RECOMMEND*** North Tampa Law Group (Brian Arrighi) was hired to serve as the closing agent on the sale of my property in 2023. I recv'd an email from Mr. Arrighi on 04/23/2023 stating he completed my title search & there were TWO mortgages that needed cared for - he further emailed me a copy of the FHA partial claim mortgage document. I completed & returned the required form to Mr. Arrighi authorizing him to pull the payoff information for EACH mortgage loan from said providers. The final closing documents received however, apparently only included ONE mortgage (it failed to include the FHA partial claim mortgage) . I only learned this when I received a letter from HUD stating that I owed them approx $13K. If the amount was not paid in full w/in 90 days I would be charged 32% interest (total now over $18K). After spending months trying to sort out the issue with HUD, & the mortgage companies it was determined the error was w/Mr. Arrighi. I reached out multiple times requesting we discuss the matter to reach a resolution to this extraordinary error that shows a clear failure of due diligence in financial matters. Mr. Arrighi told me there was nothing he could do, he was busy & ended our call. I contacted another law group & confirmed this was a failure to verify required tasks per the role assigned North Tampa law. Additionally, I received an email from Mr. Arrighi that was intended for another client of his that contained the PCI DSS financial tranx information for THREE INDIVIDUALS/CLIENTS. This firm has a serious pattern of failure to exercise diligence in client financial matters. I've continued to attempt to resolve this matter with this office only to have Mr. Arrighi accuse me of hanging up on him (this never happened). This office takes zero ownership of their mistakes. This issue has destroyed my good credit score amongst other significant and unrecoverable events. It is inexcusable for a title company of legal profession to conduct business in this manner and place their clients in jeopardous situations. I would not recommend using them.

Two years ago, I had a real estate issue and visited the firm seeking guidance. Attorney Martha Bolton was gracious as she met with me, listening attentively to understand my situation. Even though she explained that my matter was outside the firm's scope of practice, she provided me with resources leaving me in a far better position than when I showed up just an hour earlier. That matter has progressed and now encompasses a larger legal scope. Today, I called the office asking to speak with Attorney Bolton. Adam answered the phone (Attorney Adam Rauman, I would later learn from the firm's website), and it was evident from the onset that he was bothered to have to be doing so. What followed felt more like an interrogation than a conversation, with him interrupting me at least three times in less than as many minutes to 'correct' me. Adam's attitude, tone, disposition, and overall professional demeanor were absolutely appalling during our conversation - so much so that I'm compelled to warn others, and provide him a stark reminder that he works in a service-based industry. Having specific legal knowledge doesn't elevate him above others; it simply means he's well-versed in a particular subject, just as we all possess expertise in our own areas. If client interactions pose such a challenge for Adam, perhaps the firm would be better served by keeping him focused on legal work behind the scenes. A skilled attorney doesn't always translate to a skilled communicator. Prioritizing his strengths while shielding clients from his shortcomings could benefit everyone involved. In such an esteemed field as the legal profession where compassion and respect are paramount, Attorney Adam Rauman's conduct was not only unprofessional but utterly disgraceful, and stands in stark contrast to my prior positive experience with Attorney Martha Bolton.

What a Probate Lawyer Can Do for You

A probate lawyer assists with the legal process of administering a deceased person’s estate. This often involves guiding executors (if a will exists) or beneficiaries (if no will exists) through the probate process to settle the estate according to the deceased’s wishes or applicable laws. Probate lawyers can help validate the will, distribute assets, resolve disputes among heirs, handle outstanding debts or taxes, and ensure the estate is legally and efficiently administered.

Whether you’re an executor of an estate or an heir facing probate proceedings, a probate lawyer can help you navigate the often-complex legal process to ensure the estate is settled correctly.

When Should I Hire a Probate Lawyer?

You should consider hiring a probate lawyer when you are responsible for managing the estate of a deceased individual, especially in the following situations:

  • The estate has substantial assets: If the estate includes significant assets like real estate, investments, or business interests, legal assistance is often necessary to handle the distribution properly.
  • The will is being contested: If there are disputes among heirs regarding the validity of the will or the division of assets, a probate lawyer can help resolve the conflict.
  • The estate includes complex or unclear provisions: If the will contains complicated instructions or there are no clear beneficiaries, a lawyer can ensure that the estate is administered according to legal requirements.
  • There is no will (intestate estate): When a person dies without a will, the estate is subject to intestacy laws, which determine how assets are distributed. A probate lawyer can help navigate this process.
  • Debt or tax issues exist: If the estate owes significant debts or is subject to estate taxes, a probate lawyer can help ensure debts are paid appropriately and taxes are minimized.
  • Probate disputes: If family members or other parties are disputing the distribution of assets or challenging the executor's actions, legal representation is crucial to defending your rights and ensuring the estate is handled properly.

Hiring a probate lawyer early in the process can help avoid costly mistakes and ensure the estate is settled efficiently.

What Does a Probate Lawyer Do?

A probate lawyer provides a wide range of legal services to help manage and settle an estate. Their tasks can include:

  • Validating the will: Filing the will with the probate court and ensuring its legal validity.
  • Guiding executors or administrators: Advising the person responsible for managing the estate on their duties, including inventorying assets, notifying creditors, and paying debts.
  • Filing necessary paperwork: Preparing and submitting the legal documents required to initiate and complete the probate process.
  • Resolving disputes: Mediating or litigating disputes among heirs or between beneficiaries and executors, including challenges to the will or disagreements over asset distribution.
  • Handling debt and tax matters: Ensuring that outstanding debts, taxes, and estate taxes are properly calculated and paid from the estate’s assets.
  • Distributing assets: Ensuring that assets are distributed to the beneficiaries according to the will or intestacy laws, and that all legal requirements are fulfilled.
  • Closing the estate: Completing the final steps of the probate process, including filing a final accounting with the court and formally closing the estate.

How Are Probate Lawyers Paid?

Probate lawyers typically charge for their services based on the complexity of the estate and the nature of the legal work involved. Common payment structures include:

  • Hourly rate: Most probate lawyers charge by the hour, with rates depending on the lawyer’s experience and the complexity of the estate. Hourly rates can range from $150 to $500 or more.
  • Flat fee: For simple estates or straightforward probate tasks, some lawyers may charge a flat fee that covers all of the necessary legal work.
  • Percentage of the estate: In some states, probate lawyers are allowed to charge a percentage of the estate's value as their fee. This percentage typically ranges from 2% to 5%, depending on the size of the estate and state regulations.
  • Retainer fee: Some lawyers may require an upfront retainer fee, which is billed against as the probate process progresses.

It’s important to clarify the fee structure during your initial consultation to understand how you will be charged and avoid unexpected costs.

How Much Does a Probate Lawyer Cost?

The cost of hiring a probate lawyer depends on several factors, including the complexity of the estate, the type of legal issues involved, and the lawyer’s fee structure. General cost estimates include:

  • Simple estates: For estates with straightforward assets and no disputes, probate legal fees can range from $2,500 to $10,000, depending on the lawyer's fees and the state's probate laws.
  • Complex estates: For larger or more complicated estates with multiple properties, business interests, or disputes, probate costs can exceed $10,000 and may reach $20,000 or more.
  • Hourly rates: If charged by the hour, expect rates between $150 and $500, depending on the lawyer’s expertise and geographic location.
  • Percentage fees: In some cases, a probate lawyer may charge 2% to 5% of the estate’s value, particularly for larger estates or those involving complex legal matters.

Always ask for a clear estimate of fees during your initial consultation to understand the total cost of probate representation.

Top Questions to Ask a Probate Lawyer

Before hiring a probate lawyer, it’s essential to ask the right questions to ensure you’re hiring someone qualified to handle your estate needs. Key questions include:

  1. What experience do you have with probate cases like mine?
Ensure the lawyer has experience with estates of similar complexity, especially if disputes or high-value assets are involved.
  2. How do you charge for your services?
Ask whether the lawyer charges an hourly rate, a flat fee, or a percentage of the estate, and request a cost estimate.
  3. What is the likely timeline for my probate case?
While it’s hard to predict exactly, an experienced lawyer can give you a general idea of how long the probate process may take based on the specifics of your estate.
  4. What steps will you take to manage and distribute the estate?
Ask about the lawyer’s approach to handling debts, taxes, and asset distribution.
  5. Will you be handling my case personally?
In larger firms, junior attorneys or paralegals may handle some aspects of your case, so it’s important to know who will be working on your probate case.
  6. What are potential challenges we may face?
A good lawyer will be able to anticipate possible issues, such as will contests or creditor claims, and explain how they would handle them.

How to Check the Credibility of a Probate Lawyer

To ensure you’re hiring a reputable probate lawyer, follow these steps to check their credentials and experience:

  • Verify their state bar status: Check with your state’s bar association to confirm the lawyer is licensed to practice and has no history of disciplinary action.
  • Look for probate experience: Review the lawyer’s website or professional profile to ensure they specialize in probate law and have experience handling estates of similar complexity.
  • Read client reviews and testimonials: Look for online reviews on platforms like Avvo or Martindale-Hubbell to see what past clients have said about the lawyer’s probate experience.
  • Ask for references: A credible lawyer should be able to provide references from past clients who can vouch for their professionalism and expertise in handling probate matters.
  • Look for membership in professional organizations: Membership in organizations like the American Academy of Estate Planning Attorneys (AAEPA) or the National Academy of Elder Law Attorneys (NAELA) can indicate a lawyer's commitment to estate and probate law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a probate lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • A copy of the will or trust (if applicable): Bring any estate planning documents left by the deceased, including wills, trusts, or powers of attorney.
  • List of assets and debts: Prepare a detailed list of the deceased’s assets (e.g., real estate, bank accounts, investments) and outstanding debts (e.g., loans, mortgages, credit cards).
  • Death certificate: Bring a certified copy of the deceased person’s death certificate.
  • Contact information for heirs and beneficiaries: Have a list of all individuals or entities named in the will or who are entitled to inherit under intestacy laws.
  • Questions about the probate process: Write down any questions you have about the process, costs, and potential issues you might face.
  • Relevant financial records: If available, bring any relevant financial documents, such as bank statements, property deeds, and tax returns.

By coming prepared, you can ensure a productive consultation and allow the lawyer to provide the best advice for your situation.
