Drew was very helpful in processing my case. I had been charged with a DUI, substance, and reckless driving. He was very informative on the possible outcomes and predictions of where the case would go. After receiving the results Drew quickly knew the best method for a beneficial result. He got them initially to drop all charges except for reckless driving. He recommended we not plead on that charge. Within an hour of the initial deal Drew returned with a full dismissal. All charges were dropped and there will be no history of this on my record. I highly recommend his services.

Attorney Plunk came into what should have been a slam dunk case dismissal and ran into a different DA that seemed to be unwilling to go by what had been stated by previous DA. Not only did Mr. Plunk keep me informed but he also tracked down the original DA and got all my charges dropped. Thank you for going the extra mile and going and finding the original DA and get this taken care of for me in one day. I was facing some pretty serious charges and I am so thankful to the entire firm!!

Mr. Judkins assisted me in winning a case in 6 months where a previous attorney that had had my case for over 2 years had failed and refused to carry on any further. He was very knowledgeable, thorough and communicated well with me. His entire staff was very professional and seemed glad to assist me at every turn. As this was a social security disability case he didn't stand to make a ton of money off his labors yet he worked as if he did. I would HIGHLY recommend him for whatever matters you may be needing assistance in.

Nick is an incredible lawyer. He went above and beyond the call of duty with my family, helping us reach a settlement with our state insurance company who was refusing to pay for the residential care of my special needs daughter. We were reimbursed for 100% of our expenses, thanks to Nick's persistence and hard work. I highly recommend him.

I have never seen a lawyer with such dedication and understanding (and i have been a client to many) I actually will miss working with him and his staff as they have been so generous to me. Also his rates where great as well. I would highly recommend him! He truly believes in justice fairness and honesty we need more lawyers like him (and people) in this world! Mr.Cobble and his staff where able to handle my case in a quick and timely manner and my desired outcome was always his interest even when it ment him making less. My firm has been associated with Mr. Dickenson since 1985. I have personally dealt with him since 1991. He represents us in several areas related to Credit Union operations including Collections, Bankruptcy, foreclosure, contract review and extensive legal research. His primary role as our attorney has been representation in foreclosure and bankruptcy matters. He not only has extensive knowledge of the bankruptcy code and case law, he has a pristine reputation with the local Federal court system. He also has the respect of other law practitioners, both debtor and creditor slanted, which is extremely valuable when dealing with potentially contentious cases. On many occasions, I feel certain that other attorneys have decided that if Mr. Dickenson feels strongly enough about a case to let them know our position is to litigate if not resolved, they often resolve the case instead of facing him in a trial situation. In a trial environment or a deposition, his demeanor is one of someone organized and confident. He is not cocky or blustery, but is polished and authentic. This demeanor has served him well. He never talks down to the other parties in a case, but always right at them. He can be intimidating by his demeanor, but only due to his mannerisms. When on a break in depositions or trials, he is very polite and personable to the opposing parties. When it is time to talk under oath, he is very thorough and straight forward. As to foreclosures, he is completely knowledgeable in the statutes covering all the nuances of statutory and case law. On more than one occasion, a situation has arisen that scared me when a person of interest would raise an issue I was unfamiliar with only to find out Mr. Dickenson had addressed during the process. One case in particular involved an IRS lien. An agent went after me for not providing a certain notification to the IRS. I found out Mr. Dickenson had taken care of it properly during the foreclosure process. In summary, the fact that I have many choices and have still elected to use Mr. Dickenson for 24 years is a testament to the respect my company and I personally have for him. It is always satisfying to hear the relief a good attorney has when learning we are represented by him, and the sigh of resignation when a not-so-good attorney learns who represents us. While not obtaining total perfection in every issue for 24 years, he has more than exceeded my expectations and there are no plans to change. His rates are very fair, and he actually picks up the phone when called if he is in the office. His integrity is also without question which is very important to my firm and myself. I highly recommend Tom Dickenson for competent representation. While specializing in bankruptcy and foreclosure, he is well versed in many areas of the law and will only take cases that he believes are ethical and worthy. An individual or organization needing a good attorney, especially in bankruptcy, foreclosure, or contract matters cannot go wrong in choosing Mr. Dickenson.

In December 2015 my house had an upstairs water line break while I was out of the house for a kitchen remodel. Water ran for 12-18 hours and ruined the newly placed hardwood flooring and most of my content. Insurance stepped in and provided a fair estimate of the work, but I was hasty in selecting a new contractor for the work that turned out to not be qualified (to say the least). This was a grave mistake. The contractor was behind schedule, placed my new kitchen cabinets outside to get rained on, but worst of all he did not know how to install hardwood flooring and did the worst job possible. When I expressed dissatisfaction with the work in place he walked off the job and let my house in ruin. Knowing that I was going to have to fire and sue, I started asking around for legal advice. Briton Collins was recommended to me by my mother who is in tune with the local legal community, so I consulted with Briton and decided he was the best advice available. Briton navigated me through the Notice of Default procedures so that the "process" was correct from the beginning. Then we stepped through the beginning of the arbitration process. Arbitration clause=red flag, don't sign that contract! We ultimately settled just before the hearing. Without Briton's strong presence during the process, I know I would have gotten nothing. I believe somewhat surprised I decided to settle (pleasantly surprised, I believe), Briton was extremely clear with me to make sure I understood what I was doing. I appreciate the repetition when it comes to confirming big decisions. I don't wish what I was put through on anyone, but if something similar happens to you, you will be better off consulting with a professional such as Briton.

After getting myself into serious enough trouble that it could have derailed my life, I couldn't be happier or more relieved after Mr. Grady Smith handled my case. After speaking with Mr. Morrell about my case, he recommended Mr. Smith as he was the most familiar with my local law enforcement and it certainly worked in my favor. Mr. Smith was very polite, knowledgeable, and explained everything in a way I could easily understand. I can't stress enough that the outcome was much better than I, or my family and friends, could have ever expected. I'll be recommending this law firm to anyone who asks for as long as I'm around.

My father has dementia and was admitted to a local nursing home. We tried multiple times to get him approved for Medicaid. Two separate nursing homes assured us they had experts that could work with us to get him approved. After several denied applications we hire Mr. Plant. He was very patient and walked us through the entire process. Krystal, his assistant was awesome. They worked with us completing the application, which was approved the first time! Once approved Mr. Plant and Krystal worked with us to have a will completed for mom and worked with her regarding a couple of other issues. I wish we had stared with Mr. Plant and team. We would have saved a lot of out-of-pocket expense with the nursing home and also, most importantly, a lot of stress. Trying to work with through the nursing homes cost my family a lot of sleepless nights. We were repeatedly having to produce the same forms and answer the same questions. I would recommend anyone having any elder law questions or issues to start with Mr. Plant and his team. I cannot express how happy we were with their services. Oh and yes, the fees were very reasonable.

I was in need for a consultation from a Lawyer well versed in Real estate and corporate law, setting up LLC's and such. I was having a hard time finding someone who would speak with me since I was out of state. I emailed a few people and received only a few responses, Mr. Turner was one of those people. He emailed me right away and then we set a time to speak. He spoke with me for over 30 min and gave great advice. No hard sales pitch. When my needs arise I will definitely be utilizing his services.

I first hired Mrs. Fisher to draw up a Durable Power of Attorney for my mother. I was very satisfied with her work so I also hired her to prepare multiple deeds, a lease agreement, and a rent-to-own contract. She is highly competent in her work and the turn around on the documents I needed was much quicker than I had anticipated. Lauren was quick to respond to my calls and emails with complete information. She is efficient, thorough, and a pleasure to work with!

What a Real Estate Lawyer Can Do for You

A real estate lawyer provides legal assistance in transactions and disputes involving property, including residential and commercial real estate. Whether you're buying, selling, leasing, or developing property, a real estate attorney can help ensure that your transactions are legally sound and your rights are protected. They review contracts, perform due diligence, resolve disputes, and provide legal representation in negotiations and litigation involving property matters.

Real estate lawyers are crucial in safeguarding your investment by ensuring compliance with local, state, and federal real estate laws, as well as protecting you from potential legal pitfalls related to property ownership and transactions.

When Should I Hire a Real Estate Lawyer?

Hiring a real estate lawyer is beneficial in various scenarios, including:

  • Buying or selling property: When navigating complex real estate contracts, it’s advisable to have a lawyer review and ensure that the terms are favorable and legal.
  • Commercial property transactions: For leasing, purchasing, or selling commercial properties, a lawyer can help manage the intricate legal aspects of such transactions.
  • Zoning or land use issues: If you're planning to develop property or change its use, a real estate lawyer can guide you through zoning laws and land use regulations.
  • Resolving property disputes: For boundary disputes, title issues, or disagreements over property rights, a lawyer can help mediate or litigate the matter.
  • Foreclosures or evictions: If you're dealing with foreclosure or managing a tenant eviction, legal representation ensures that the process adheres to local laws and protects your interests.
  • Title and deed issues: Lawyers can help clear title disputes, ensure the legitimacy of property deeds, and handle transfers of ownership.

What Does a Real Estate Lawyer Do?

A real estate lawyer provides a range of services to help with property transactions and disputes, including:

  • Contract drafting and review: Ensuring that purchase agreements, leases, and other contracts are legally binding, fair, and protect your interests.
  • Title search and clearance: Conducting a thorough title search to ensure that the property has no legal claims or liens that could affect ownership.
  • Facilitate closing: Managing the closing process in real estate transactions, including reviewing final documents and ensuring that everything is in order before the transfer of ownership.
  • Resolve disputes: Handling legal disputes related to property ownership, boundaries, zoning, or tenants.
  • Assist in financing: Reviewing loan agreements and mortgage documents to ensure the terms are fair and legally sound.
  • Zoning and land use advice: Guiding clients through the complexities of zoning laws and building regulations for property development or renovation projects.

How Are Real Estate Lawyers Paid?

Real estate lawyers typically charge for their services in the following ways:

  • Flat fee: Many real estate transactions, such as reviewing a sales contract or assisting with a closing, are charged on a flat-fee basis.
  • Hourly rates: If a lawyer is handling complex disputes or litigation, they may charge by the hour. Hourly rates can vary significantly based on the lawyer’s experience and location.
  • Contingency fees: In rare cases, such as property disputes or claims for damages, a lawyer may work on a contingency fee basis, meaning they only get paid if you win or settle the case.
  • Retainer: For ongoing legal support, some clients may pay a retainer, which is an upfront fee used as a deposit for future legal services.

It's important to clarify the fee structure with your attorney before hiring them to avoid any surprises.

How Much Does a Real Estate Lawyer Cost?

The cost of a real estate lawyer varies based on the complexity of the matter, the location of the property, and the lawyer’s experience. Key factors that affect pricing include:

  • Type of transaction or issue: Simple tasks, like contract reviews, typically cost less than handling a complex property dispute or litigation.
  • Experience and location: More experienced lawyers or those in high-demand areas, like urban centers, often charge higher rates.
  • Billing structure: Lawyers may charge a flat fee for basic services like document review or hourly for more time-intensive work such as disputes or litigation.

Flat fees for straightforward services like closing assistance may range from $500 to $1,500.

Hourly rates can range from $150 to $400 or more, depending on the attorney’s experience and location.

Always discuss fees upfront to understand the overall cost of the legal service you're receiving.

Top Questions to Ask a Real Estate Lawyer

Before hiring a real estate lawyer, ask the following questions to ensure they are the right fit for your legal needs:

  1. What experience do you have with real estate law?
Ensure the lawyer has experience in the type of real estate transaction or dispute you’re facing, whether residential, commercial, or development-related.
  2. What is your fee structure?
Ask how the lawyer charges for services - whether it's a flat fee, hourly rate, or retainer - so there are no surprises later on.
  3. How long will the process take?
Especially important for real estate transactions or disputes with deadlines, ask for a general estimate of how long the process will last.
  4. Have you handled cases similar to mine?
Experience with similar transactions or disputes can give you confidence that the lawyer knows how to handle your case.
  5. Will you handle my case personally, or will it be passed to another attorney?
Confirm who will be handling the bulk of your case work, especially in larger firms where junior lawyers may take on some responsibilities.
  6. Can you provide references?
Speaking with past clients can give you insight into the lawyer's experience and how they handle cases.

How to Check the Credibility of a Real Estate Lawyer

To ensure you’re hiring a reputable real estate lawyer, take these steps:

  • Check with the state bar association: Verify that the lawyer is licensed and in good standing with no disciplinary actions on their record.
  • Read online reviews and testimonials: Look for reviews on legal directories and platforms like Avvo or Martindale-Hubbell to see what past clients have said.
  • Ask for references: A credible lawyer should have past clients willing to share their experiences.
  • Review their track record and expertise: Look at the lawyer’s website or LinkedIn profile for information about their experience in real estate law and any relevant cases they’ve handled.
  • Membership in professional organizations: Lawyers who are members of respected legal or real estate organizations, like the American Bar Association’s Real Property Division, often signal credibility and expertise.

What Should I Prepare for My First Consultation?

To make your first meeting with a real estate lawyer productive, you should prepare the following materials:

  • Relevant property documents: Bring purchase agreements, lease contracts, mortgage documents, zoning permits, or any other paperwork related to your case.
  • A summary of the issue or transaction: Be ready to explain the situation, whether it's a property dispute, contract negotiation, or development issue.
  • Questions about the legal process: Prepare a list of questions about how the lawyer will handle your case and what steps are involved.
  • Financial documents or loan agreements: If the case involves financing or a mortgage, bring any related documents for the lawyer to review.
  • Your goals and timeline: Be clear about what outcome you're hoping for, and if there are any deadlines that need to be considered, such as closing dates or legal filings.

By coming prepared, you can ensure that your consultation is efficient and informative, allowing you to assess whether the lawyer is the right fit for your real estate needs.
