Richard --Made my life 100% better and resolved all my problems and KNOWS the law. I was placed in a very DIFFICULT situation because my sister was deem unable to take care of herself. She had NO Will or Power of Attorney paperwork done and was placed in a nursing home after being hospitalized Even though everyone was telling her to prepare her legal paperwork She always said --I am NOT going anywhere ! Thank goodness I met Mr Pakola. He is so personable and kind He knew how to get me Guardianship of My sister's estate-set up paperwork and prepared me extremely well versed for the court hearing so there was NO need to worry. He goes well beyond his job --even calling me on the day of trial to ask if I had any questions or concerns ! If I could place 10 Stars I would !

Mr. McMahon spent a lot of time in consultation with me, on a problem of a spouse who's developing dementia and doing dangerous things; wanting to drive when doctors have forbidden it, not taking prescribed medicine, being abusive.

I luckily was referred to Mr. Barnes by a friend. I needed a lawyer to help with a Medicaid application for my mother, whose funds were running out after she had been privately paying for the senior/nursing facility she was residing in. When I asked the facility upon her taking up residence how things worked when she could no longer private pay, they explained the Medicaid process that needed to happen when her funds ran low. Unfortunately, they gave me an unrealistic time frame as to when that was. If it wasn’t for Mr. Barnes and his legal assistant, Donna, my mom’s life, as well as my own (her daughter) could have been in total ruins. I was in fear that I would have to remove her for lack of payment and that she wouldn’t get the daily care she needed. During my first appointment with Mr. Barnes, he allayed those fears. He immediately assessed the abbreviated time frame involved with my request and let me know what and when everything on his end and my end needed to be pulled together. They got the application in so quickly that I finally was able to breathe a sigh of relief. As each ensuing DSS request came in they were there, quickly helping me to identify what I needed to provide, as well as writing support statements for DSS from me to approve/edit. When nerves got the better of me during this process and the long waiting period, both Mr. Barnes and Donna where there for me. They almost instantly responded, night or day, to all my calls and/or my frantic late-night emails, which was very much appreciated. I highly recommend Mr. Barnes services! I also recommend that anyone with a parent entering a senior/nursing facility contact him sooner than later for an assessment and a realistic time frame to prevent any problems personally or financially.

Helena Pesa is a pleasure to deal with and yet stands up for her clients. She's knowledgeable, spent a lot of extra time with me and always followed up. I've found that a lot of attorneys don't communicate, which is very important to me and that's why I really liked Helena Pesa - she kept me informed of what was going on. I give her my highest recommendation.

Jeff has been my lawyer in a drawn-out contentious divorce proceeding. Four years after meeting, he's still helping me handle details from the divorce. Through it all, he has been focused, calm, and a tremendous advocate for me. He's helped me understand the state law, as well as what makes for an appropriate negotiating position (and what doesn't!). I appreciate his sense of humor, fair rates, and responsiveness. He also has a great executive assistant who is professional and helpful. I strongly recommend Jeff as a divorce attorney.

I petitioned the court to placed my mother under guardianship due to various events that occurred that I was not made aware of. Jennifer was able to move the guardianship process through the court system at a very fast pace. She is VERY knowledgeable in the area of litigation, trusts, estate planning and guardianship and general law. She is very professional in dealing with clients and she demonstrates very high ethics in her field of practice. She was able to get all parties to the table for a settlement within a short period of time. She is amazing and I am very happy to have her as my lawyer. She is very fair with her fees and I am proud to say that she is MY LAWYER!

I retained Mr Karvay to help me finish an estate that my previous attorney refused to complete. Mr Karvay gathered the evidence and recovered 256000 dollars of the estate monies. I have had other attorneys in the past but none as knowledgeable as Mr Karvay. He is a no nonsense attorney and I had the pleasure of seeing how a real attorney works. I have already highly recommended Mr Karvay to represent another estate. You really want him to represent you in estate matters. I would not take a chance on another attorney because he is simply the best.

Laura Leavy is a very concerned, knowledgeable professional. We have been her clients now for a little less than a year. We are trying to purchase a home here on Long Island. We first started looking at Foreclosures and Short Sales; which is a long process. Nothing really panned out. Now we have found a Beautiful home and Laura is working hard to make sure everything is up to date and straight forward with the sale. She has kept us fully informed throughout the processes. She was in touch with our real estate agent and sellers attorneys as well as our mortgage banker. If she wasn't available for one reason or another, she made sure her partner and assistant were abreast of the situation at all times.

Mr. Corbett created a will for our family which was complex due to the fact that we have a large blended family. He worked with us to find out what our wishes were and gave us legal and sound guidance as to what would work best for our children. He explained exactly what our beneficiaries and legal guardians should do when we passed and gave us lots of information on estate planning as well. We were very happy and relieved to have all our affairs in order thanks to Mr. Corbett.

Steven represented me when selling my 2-family property in Ridgewood, Queens. It wasn't a particularly smooth transaction at times regarding the seller's lender, but Steven is very knowledgeable regarding real estate law in the city and was always accessible to answer my (often detailed) questions and put me at ease. He responded quickly and that is very important for such a complex transaction. In the end, it was a successful real estate transfer and I appreciate his service. I recommend him wholeheartedly. A+++

Richard Bonfiglio has been my divorce case lawyer for almost 7 years. He is genuinely skilled in the practice and never miss the opportunity to educate me about the law. On trial, he circumvented his opponent without an inch of attitude in order to gain respect and agreement from judge. Capable of quickly process large volumes of information due to solid professional knowledge and calm attitude, Richard is also blessed with excellent math, writing and memory skills. During the course of the trial, the judge noted Richard's unusually modest fees request, to which this lawyer answer was : "I can work by myself, no need for extras ". Richard Bonfiglio is now happily retired and lives in a peaceful country environment with his family. I am glad that I could leave this review today

I interviewed several attorneys for my divorce before hiring James Graham from Mangi and Graham. I found him to be easy to talk to as he explained my options patiently.and clearly. However in court he is a "shark". He is well known by all and has mastered the difficult task of being pleasant while fighting hard for my rights.. He never gave up and I felt as if he took my case and handled it as if it was his own. He always arrived early to court fully engaged and well prepared to win. He left no stone unturned on the many issues involved in my contested divorce. He shrewdly prepared me for my deposition and court appearances. He was well organized, a fast thinker and aggressive in getting what I deserved. I found him to be brilliant with financial issues and on top of his game. He was worth every penny I paid.

What a Trusts Lawyer Can Do for You

A trusts lawyer specializes in creating and managing trusts, which are legal entities that allow individuals to transfer assets to beneficiaries while maintaining control over how and when those assets are distributed. Trusts are used for estate planning, asset protection, tax planning, and ensuring the financial security of loved ones. Trusts lawyers help clients choose the right type of trust for their needs, draft trust documents, and advise on the administration and management of trusts.

Whether you're planning to pass on your assets to your heirs, protect your wealth from creditors, or provide for a disabled family member, a trusts lawyer can help you establish a trust that meets your financial and personal goals.

When Should I Hire a Trusts Lawyer?

You should consider hiring a trusts lawyer in various situations, particularly when you're planning for the future distribution of your assets or protecting your wealth. Common reasons to hire a trusts lawyer include:

  • Estate planning: If you want to ensure that your assets are distributed according to your wishes, a lawyer can help you create a revocable or irrevocable trust to avoid probate and provide for your heirs.
  • Asset protection: If you want to protect your assets from creditors, lawsuits, or potential future liabilities, a lawyer can help you establish a trust to shield your wealth.
  • Special needs planning: If you have a disabled family member, a lawyer can create a special needs trust to provide for their care without affecting their eligibility for government benefits.
  • Tax planning: If you're looking to minimize estate taxes or manage tax liabilities, a lawyer can help you create tax-advantageous trusts, such as a credit shelter trust or charitable remainder trust.
  • Charitable giving: If you want to leave a legacy through charitable donations, a lawyer can help you set up a charitable trust to ensure your donations are managed according to your wishes.
  • Business succession planning: If you own a business and want to ensure a smooth transition of ownership, a lawyer can help you establish a trust to pass the business on to your heirs or chosen successors.

Hiring a trusts lawyer early in the estate planning process ensures that your assets are protected and your wishes are clearly documented, reducing the chances of disputes after your death.

What Does a Trusts Lawyer Do?

A trusts lawyer provides a variety of legal services to help individuals create, manage, and administer trusts. Their responsibilities often include:

  • Drafting trust documents: Preparing the legal documents needed to create the trust, ensuring it is tailored to your specific goals and complies with state and federal laws.
  • Choosing the right type of trust: Assisting clients in selecting the most appropriate type of trust for their needs, whether it's a revocable trust, irrevocable trust, living trust, or special needs trust.
  • Trust administration: Guiding trustees through their legal responsibilities, including managing assets, making distributions to beneficiaries, and filing tax returns.
  • Modifying or terminating trusts: Helping modify or terminate trusts if circumstances change, such as changes in tax laws, family situations, or personal preferences.
  • Protecting beneficiaries' interests: Structuring trusts to protect the interests of beneficiaries, especially if there are concerns about financial management, disability, or dependency issues.
  • Minimizing estate taxes: Assisting clients in structuring their trusts to minimize or avoid estate taxes, ensuring more of the estate passes to beneficiaries.
  • Handling disputes: Mediating or representing clients in court if disputes arise among beneficiaries or between trustees and beneficiaries.

How Are Trusts Lawyers Paid?

Trusts lawyers typically charge for their services based on the complexity of the trust and the type of legal work involved. Common payment methods include:

  • Flat fee: For drafting basic trusts, such as revocable living trusts or special needs trusts, many lawyers charge a flat fee. This can range from $1,000 to $5,000 or more, depending on the complexity of the trust.
  • Hourly rate: For more complex trust planning, ongoing trust administration, or resolving disputes, some lawyers charge by the hour. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Retainer: For long-term trust administration or complex estate planning cases, some lawyers may require a retainer, an upfront payment that covers ongoing services.
  • Contingency fee (rare): In rare cases, particularly in disputes involving the administration of a trust, lawyers may work on a contingency fee basis, getting paid only if they successfully recover funds or resolve a legal dispute in your favor.

Always discuss the fee structure with your lawyer during the initial consultation to understand the total cost of services.

How Much Does a Trusts Lawyer Cost?

The cost of hiring a trusts lawyer depends on the complexity of the trust, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Basic trust creation: For simple trusts, such as revocable living trusts, fees may range from $1,000 to $3,000.
  • Complex trust creation: For sophisticated estate plans involving multiple trusts, tax planning strategies, or special needs considerations, legal fees may range from $5,000 to $10,000 or more.
  • Trust administration: If you are serving as a trustee and need ongoing legal advice, hourly rates for trust administration can range from $150 to $500 or more.
  • Dispute resolution: Costs for litigation or mediation in trust disputes may range from $5,000 to $50,000 or more, depending on the complexity of the case.

Be sure to get a detailed cost estimate from your lawyer during the consultation to ensure the services fit within your budget.

Top Questions to Ask a Trusts Lawyer

Before hiring a trusts lawyer, consider asking the following questions:

  1. What experience do you have with creating trusts?
Ensure the lawyer has experience drafting trusts and managing trust administration for clients with similar goals or asset structures.
  2. What types of trusts do you recommend for my situation?
Ask the lawyer to explain the different types of trusts available and which ones best suit your needs.
  3. How do you charge for your services?
Clarify the fee structure and request an estimate of the total cost.
  4. What are the tax implications of the trust?
Ensure the lawyer can explain how the trust will affect your taxes and strategies to minimize tax liability.
  5. How long will it take to set up the trust?
Ask for a timeline for creating and finalizing the trust documents.
  6. Will you handle the trust administration?
If ongoing management is required, inquire whether the lawyer will assist with trust administration or if you'll need a separate trustee.
  7. Can you help resolve disputes if they arise?
Ask about the lawyer's experience in resolving trust disputes.

How to Check the Credibility of a Trusts Lawyer

To ensure you are hiring a reputable trusts lawyer, take the following steps:

  • Verify their bar status: Check with your state bar association to confirm the lawyer is licensed and has no disciplinary actions.
  • Look for trust law experience: Review their website or professional profile to ensure they specialize in estate planning and trusts.
  • Read client reviews and testimonials: Look for feedback on platforms like Avvo, Martindale-Hubbell, or Google.
  • Ask for references: Request references from past clients who can speak to their experience with the lawyer.
  • Check for certifications: Look for certifications such as Certified Estate Planning Law Specialist (EPLS) or memberships in organizations like the American Academy of Estate Planning Attorneys (AAEPA).

What Should I Prepare for My First Consultation?

To make the most of your first consultation with a trusts lawyer, bring the following:

  • List of assets: Prepare a list of all your assets, including real estate, bank accounts, investments, retirement accounts, and personal property.
  • List of beneficiaries: Provide names and contact information of individuals or organizations you want to name as beneficiaries.
  • Existing estate planning documents: Bring copies of any existing wills, trusts, or other estate planning documents.
  • Financial information: Bring financial statements, tax returns, and other relevant financial documentation.
  • Questions for the lawyer: Prepare a list of questions about the trust creation process, fees, and how the trust will protect your assets and beneficiaries.
  • Goals for the trust: Clearly outline your objectives, such as asset protection, tax minimization, or provisions for beneficiaries, so the lawyer can tailor the trust to your needs.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation effectively and receive the best possible legal advice for creating and managing your trust.
