Atty Kelli Silva is a great attorney - when you need an attorney, look no further. For me,my health was bad and I was in the worst situation- I needed to be supported with benefits , including Workman’s Comp, SSDI and insurance challenges- Attorney Silva believed in me , and always told me not to worry , she will take care of the legal issues to help attain the benefits for me - My job was to focus on getting better- She kept her promise in so many ways . She is sincere, kind and the BEST lawyer you could ever ask for - The team that supports her is great - Mary Dianna and all the others behind the scene - Prior to this I didn’t know Keches law firm , I didn’t know Atty Silva , but what I did know is that after speaking with their team and reading the reviews,I felt confident this was the team for me- Three years later ,I can honestly say Kelli Silva and Keches law firm is the best and continue to be every step of the way!! Thank you!!

Attorney Rachel Fitzgerald is so brilliant! She got me everything I deserved from my work comp case! I couldn’t be happier. It was a long drawn out 4.5 year battle with my previous employer and she stuck it out and won me my case against them. Through all the trials and tribulations with this case Rachel made sure to have her team in constant contact with me. I got updates regularly on what was happening and in the end we prevailed. We settled WITHOUT having to go to court and I got all the medical bills paid by my prior employer and a settlement for my disability rating and lost wages. I couldn’t be happier. I HIGHLY RECOMMEND Attorney Rachel Fitzgerald!!

My workmans compensation settlement took 3 years, but Rachel didn't give up. I received a great settlement amount and would highly recommend Rachel and her team. Sara, her paralegal, was fantastic and got back to me almost immediately on all issues. Rachel is also handing my husband's disability claim. I am beyond thankful for Rachel and her staff.

Let me preface this by saying there was a language barrier which made it very difficult for me to understand the person I was speaking with, I am sure she had an equally difficult time. First, I called in to ask about a consultation to see if I have a case, and possible representation. She asked what type of case, which I explained and then she asked for more information. I attempted to explain it, I could tell she was not understanding what I was trying to convey as she asked me the same question more than once. She told me they don't offer free consultations, which I was fine with but when I asked her how much she hesitated and told me she could not tell me how much a consultation would be. I was confused and asked her how would I find that out. She told me someone would call me back within 2 business days and took my number. As we said our goodbyes she said if no one called me back in 2 days no one could help me. I then confused, asked her if I should call back after the two days then if I didn't hear back. She told me no, if no one called me back it meant no one could help me. I wanted to make sure I understood her correctly and said so if no one calls me back they won't do a consultation? She said I was correct. I said so you can't give me a cost for a consultation, then you tell me if no one calls me back that means you can't help me? So without knowing the details of the case, you not understanding what I am saying and being unable to provide me a price for a consultation so an ATTORNEY could explain what rights I may or may not have, you are telling me if I don't receive a call back it means no one can help me??? I told her this was the most unprofessional experience I have ever had with a law firm and I have 13 years of legal background in one area or another. I told her not to worry about calling me back. This is absurd. I hope someone from the firm does read this and call me back and ask for more details (as there are plenty I am not going to share on this platform, yet) as I hope this not an accurate representation of their firms professionalism or the way they treat potential clients. If not, I hope it is corrected, a good percentage law referrals are done via word of mouth! This was pretty appalling behavior and she needs trained and/or this firm needs training and some standard SOP's developed and implemented as soon as possible.

Bethany Stickradt did a fantastic job helping our family protect and navigate the complex assisted living facility issues for our handicapped uncle, who has cerebal palsy. He has lived at the facility in Newark happily for 18 years. Then it was sold and the new management tried to kick him out two times and harassed our family. There was no change in his level of care. He did not fit their marketing image. Bethany handled our appeal to the State. Thankfully they backed down. We are so very grateful we had Bethany representing us and used the Reese Pyle Meyer Law Firm.

When my mother-in-law was hit by a car and severely injured, we reached out to these lawyers for help. IMHO they screwed my mother-in-law over royally. K&K got $50,000 for themselves (of which they were forced to return about $25,000) and mom got NOTHING! Not a penny. IMHO, you should run far, far away before getting these guys to do anything for you. Would be minus stars if I could.

Attorney Matthew Exton with this firm, is NOT recommended! It took me 3 months to get my final settlement check out of a lawsuit I won. He kept changing the fees. I have his first one, which is NOT at all nothing like the final one. I complained to his firm & finally got a check in the mail with a letter from the firm. BUT, what the firm doesn't know is, Matthew Exton sent me an email which was NOT very friendly. He comes off great to begin with but when it comes down to it, he doesn't fight for you & treats you nasty.

She represented me. I was in an unfathomable abusive relationship , with no family. Kept locked away from the world. She was my Court Appointed Attorney who definitely works for the D.A. She can see the proof , like she had sent to her, of my innocence of the dirty jacket I had to wear, the early afternoon that I was detained and had 4 charges consecutively stacked upon me when a family member I trusted, my Ex Father in law decides to walk away and agreed to watch them the night before. Leaving my babies alone. I had the money to bond out. Just had no one in my corner because of my abusive situation. She knew all this. She hung me with the maximum punishment that day in court. Roxane Blount with all my heart I set there in that Judges chambers and laid my hands on you after learning of the horrible tragedy of your Son. Praying for healing , peace and for the Lord to keep you strong Yet you elbowed me when I had to admit a lie under oath knowing damn well I was innocent of abandoning my children. 5years deferred! I've literally looked back at this so many times and have seriously considered taking this to the State Bar. ALL FACTS HERE! SHAME ON YOU. EVERY ONE IN THE WORLD EVEN MY ATTORNEY SAID " BEING THE BEST IN THE ENTIRE REGION. MISS MOON THIS IS IMPOSSIBLE. YOU HAVE 3.5 MONTHS OR YOUR BABIES ARE GETTING ADOPTED. I WALKED IN THOSE HOT HOT SUMMER MONTHS. TO OVER 22 CLASSES OSAR DONE THE DAY I WAS RELEASED, PSYCHIATRIC EVALS, COUNSELING. I NAILED IT ALL. MY BABIES ARE AT HOME TODAY. THAT JUDGE LIFTED ME 10 FEET THAT DAY OF COURT. I DON'T THROW STONES AT PEOPLE. BUT YOU SHOULD WORK FOR CPS. THATS MORE FITTING FOR YOU

I called Attorney Alex about a deed issue on a house we were thinking of buying. I told him that I wasn't sure we were going to pursue the issue, wanted a consultation with him, and that I was concerned about getting a large surprise bill. Alex assured me that if hired, he would keep me updated on all charges as they accrued, yet he never explicitly told me when he started charging me and never gave me any of those updates he said he would. We had 2 phone calls and a few brief emails. He did take time to review our case after my first consulation call, but never told me that I was being charged. In the end, I told him that we would not need his services and suddenly got a $625 bill. When I complained, he told that their firm does NOT offer a free consultation and yet he chose not to charge me for the first phone call, but that was within his right to charge for everything after that. Be sure to ask each and every time you email or speak to someone in their office as to whether or not you are being charged. This attorney lacked transparency and did not keep his word about informing me of charges as we interacted. I expected him to clearly say to me when charges would be start and like he reassured me he would, give me updates on the total of any bill as we interacted.

I hired this lawyer to represent me in a child support modification case. I sent a $2000.00 retainer and was charged for every Email and phone call regardless of context. I traveled from northern Michigan to Alabama to attend the hearing. At about 9pm the night before the hearing I was contacted by a lawyer I had never spoken to before and whom knew nothing about my case. I had to try to explain everything to him as this was a somewhat complicated situation due to one of my adult children having a disability. The hearing was ultimately postponed for a few months and nothing was resolved. I was then told that not only had my retainer been used up but I owed hundreds of dollars. I feel cheated and would advise anyone thinking of hiring them to look elsewhere for someone that actually cares about their clients needs and takes some time to explain things. I had very little communication at all and I was afraid to ask questions due to the ridiculous fees for Emails and phone calls. I would be happy to provide the invoices I received to verify my statements are true.

My name is Kimberley Jones, and I wanted to tell you about my incredible story and the help I have received from Charles Elliott and Associates. I was in a terrible car accident,it was not my fault. I called Mr. Elliott from the scene and he personally came to pick me up. I was hit from behind while at a red light on 28 west and the person came barrleling behind me, unbeknowst to me, at 50 miles an hour......... My car was very badly damaged and my neck, back and hand was severely hurt. He made sure that I got the correct medical attention right away. I was in physical thereapy for my neck and back for months and I needed to have a bone replaced in my hand. His staff at the office was very professional and kind. I am a widow and I was shaken up very badly. They continually checked in on my progress and although the driver had no insurance the owner of the car did..... Charles Elliott and his team made sure I got what I deserved. Have used them several times since for much smaller matters, but the care and attention to detail that this law firm provides is outstanding. I would recommend Charles Elliott and Associates of Alexandria LA to anyone who needed legal assistance of any kind. Thank you Kimberley Jones

I hired Ms. Patrick upon being charged with Unlawful Imprisonment, Interfering with communications and assault and battery. I was so distraught and confused at first. Knowing I could possibly end up in prison for 15 years! Melissa first calmed me down and made me focus. I was then able to provide her with the information and evidence she requested. She listens and provides understanding in a confusing time with out judgement. I felt completely comfortable with her understanding her expert opinions and advisement. She guided me through the entire 2 years 9 months (due to Covid) that it took to go to trial after several plea offers. I'm more than greatful that I chose Melissa to represent me. And I am even more greatful to announce our verdict from the jury. It only took the jury about 20 minutes to reach a unanimous decision of NOT GUILTY on ALL counts as of Yesterday! Thank You Melissa! I truly believe you were God's choice.

Ellen represented me in my recent order of protection case. Her professionalism and expertise were invaluable assets throughout this challenging process. Prior to each hearing, I experienced significant anxiety. Ellen was able to skillfully navigate these concerns and help ease my anxieties. Her calm demeanor and clear communication instilled confidence, and her ability to explain complex legal matters in a straightforward manner was truly appreciated. While Ellen always maintained the utmost professionalism, she also possessed a genuine empathy for my situation. This combination of legal expertise and personal understanding made me feel truly supported throughout the process. Ultimately, Ellen secured a favorable outcome in my case, granting me the order of protection and restoring a sense of safety and security for both me and my child. I am incredibly grateful for her dedication and unwavering commitment to achieving the best possible result. Without hesitation, I highly recommend Ellen to anyone seeking legal representation in a similar situation. Ms. Morado was absolutely invaluable in helping me navigate a bewildering publishing/art/licensing/permissions debacle in which I was utterly in-over-my-head. What seemed insurmountably complex to me was long-familiar legal territory for her. She lucidly explained to me the process along the way; she was a fastidiously professional steward of time-tracking and invoicing; she graciously interfaced on my behalf with a rather stressful third party; and, in the end, she navigated myself and the other party to a clean, fair, mutually agreeable conclusion. I couldn't be more pleased, and can recommend her services categorically.

This attorney build his practice off my family pain . He had an ad on Craigslist.org doing pleadings for 250-300 each I used his services and reluctantly hired him for my appeal he was all I could afford , I did not know at some point later he decided to revive his legal career rather that mortgage lending foreclosures he decides to practice in family law child support and Title II ligation in the jurisdiction that I had him draft 2 law suits against officers of the court 2 lawsuits against DSHS and OAH . My trial judge was moved in rotation to family court and he followed him over there wait it gets better , he was suddenly referred by someone for a (.hmm I wonder who that was ...) senior attorney position at the local legal aid program were guess what My trial judge is the judicial liaison and 3 assistant attorney generals sit on his employers board ....he says no conflict of interest but he failed to tell me this I discovered it days ago . he was fired 6 weeks ago and refuses to submit his withdrawal from my cases and the supreme court is pending review , of matters that he has pretended to ligate and told me on April 7, 2023 he is going to loss on all cause of action less the attorney fees from the PRA claim which by the way he will split with me . This is the 3 time I have experienced a lawyer violate their duties to me and nothing is ever done about it hope your not poor because if you are there is no help for you . This is a business for them they care nothing about their harm to families they only care about themselves. Its the most despicable situation I have experienced .

I consulted Mr. Goldstein regarding a social security matter. My mother accompanied me to the appointment because she helped me fill out the paperwork when I was a minor. For context my mother is a US citizen of Asian descent but English is her second language. During the consultation, Mr. Goldstein cut us off many times, didn't address our concerns, and talked very quickly. Due to my mother's language barrier and the fast pace that Mr. Goldstein was speaking, I translated much of the conversation in her native language so that she could be fully aware of what he was saying. He then started mocking us verbally by making incoherent phonetic sounds to imitate our language. He also became upset that I continued to translate for my mother and he continued to mock me by making squinting facial expressions while verbalizing stereotypical "Asian sounds" every time I translated the conversation to my mother. This was his attempt to try to get me to stop translating. My consultation was the worst experience I have had with any type of professional, Mr. Goldstein demonstrated unprofessional behavior, prejudice, and inability to show patience and empathy. I don't recommend anyone see this attorney, especially if you are a person of color. Our experience highlights that Mr. Goldstein isn't capable of making clients of different ethnic backgrounds feel comfortable.

I hired Tim Ballard for a child custody case during a sensitive period following the loss of our daughter to cancer. While Tim seemed personable, the service and value I received were unsatisfactory. My experience with Mr. Ballard was costly and inefficient compared to previous attorneys. Over $8000 and nearly a year later, the only significant progress was one hour of mediation. The costs seemed excessive: $2000 for mediation prep and almost $100 for a brief email. Additionally, I questioned the 5.5 hours billed (Tim does his own billing and invoicing. One month I received several months billing all of a sudden) for mediation prep half billed on a day when Tim was handling another case. Several months I’m still waiting on discovery questions, child support worksheet, and some bills of my ex spouse to be paid. All of which are “in the works” Communication issues were persistent. I often had to rebrief him on basic case details, yet was billed for these updates. Despite being promised legal aid assistance, this help materialized late, failing to restore my confidence in the firm. The process was drawn out, with mediation dates constantly delayed from May to July to November. I felt my case wasn't advocated for effectively, particularly in dealings with the opposing attorney. Now in the process of switching lawyers, I'm disheartened by the substantial financial and time investment with minimal progress. I'm open to sharing more details with those considering this firm. A major concern was the inefficient communication costing over half the total fees. I preferred meetings over emails for efficiency, but this approach wasn't adopted. There were also missed opportunities, like enrolling my daughter in a new school, and periods where Tim was difficult to contact, though active on social media liking the opposing attorneys instagram posts. In summary, I expected more empathy and proactivity in handling my case. This experience felt like a financial and emotional drain during an already difficult time.

We have a healthy child and a special needs child, so our wills are a bit complicated. Lisa was familiar with the law, very professional yet also friendly, explained everything clearly, and was reasonably priced. She also drew up powers of attorney to give to our children, which I had not thought about. We had health care POAs but regular POAs, which allow someone to get your passwords, pay your bills, sue on your behalf, etc are useful in case both husband and wife become incapacitated, which we had not considered.

This is the second time I have used Mr Davis. He impressed me so much June 2015 that I had to use him again to see if he was real. This time it was a bench trial with criminal charges, aggravated assault 3 counts. I was innocent with no priors but the evidence was stacked against me. I was looking at doing time with these felony charges. Mr Davis was nothing short of super awesome in his aggressive approach. It was like what you would see in a movie. The bottom line was a verdict of Not Guilty. He was knowledgeable, kept me informed, very reasonable fee, and very professional. I wouldn't even think about using another attorney and I would highly recommend him and intend to do so. Thank you Steve Davis for believing in me.

Mr. Davis has been nothing short of a God sent to myself and my family. I interviewed several attorneys prior to talking to Mr. Davis. Mr. Davis was not only the most reasonable but, he was also the most understanding with the situation. He listened to everything I had to say no matter how trivial. I was lucky enough to give him an ordeal that "in all his years of practicing law he'd never had to do." And have complete faith and trust in him as we go into this final leg of this case. Thank you Mr. Davis! The kids and I will never be able to repay you for all you have done for us.

I used they service twice and I’m very pleased with both case results. The first one was on 2015 when I had a car accident and the second one was on 2016 when I also have a accident in my work. They explained everything to me and the communication was great. The staff is professional and responsable.

In September 2016 I had an injury auto accident. I hired Matthew Reinstein with Lawterssociates as my attorney to handle my case. He took over all the hospital bills and paperwork for me. What a burden he and his staff took off my shoulders. They worked dilligently and fast with the insurance companies for me and settled my case. I am very happy with the way they acted on my behalf in a professional manner. I would highly reccommend Lawter and Associates to anyone needing a lawyer. Larry

I selected this attorney to represent me based on research and the reviews. I started filing for disability back in the summer of 2015. All was fine until the parallegal working with me left the firm. From that point on nobody was responsive to any communication. I finally got my date in front of an administrative judge. I called the office to try to get someone to give me guidance on what was the process from this point. It took a week for me to get a call back. Then they said they were no longer handling my case and I should have recieved a letter in the mail. The so called notification letter was dated from the Monday of that week and postmarked 2 days later (had I not reached out to them I may never have known I was no longer a client). The letter said the office said they decided not to handle SSD cases anymore in September 2015. They said they had another firm handeling my case who is reputable and accomplished. The attorney at that firm that handles their caes is known for dealing with drunk driving, workers comp, and pit bull attacks. Not too comforting when you have a social security disability issue. When I called the firm they had no record of my case. I am 45 days out from a judicial hearing I have been waiting for for over 18 months and now I have to find an attorney becasuse Ms. Jurewitz dumped me and didn't have the courtesy to notify me. She didn't even take verify that the people she thought she was transfering the case to were knowledgeable in the area or actually took the case.

According to the Oceanside Social Security office, I was the first veteran (in March, 2014) to file for SSDI benefits in San Diego under the new Expedited Program for Disabled Veterans (only for veterans Rated 100%, Permanent and Total). What I did not understand, at the time of my initial electronic filing, was that there was a 70+% chance that my claim would be denied, which it was. In fact, my claim was denied a second time when I appealed their first decision. I could not believe that the SSA wrote, in both their Denial Letters, that I was capable of working 100% time, especially given the fact (documented by the VA, and the UCSD Moores Cancer Center) that I had incurable cancer and was undergoing chemotherapy twice a week for the rest of my life. What??? There is an old saying which is completely true, "Once a Marine, always a Marine." I had a choice to make. I could do nothing and accept their verdict, or, I could appeal. I decided to deny their denial of my claim. So, what do you do when you are about to embark on any conflict? You prepare and get the best defense you can. The first thing I did was search the internet, where I found the AVVO website. I searched San Diego disability lawyers, and then I found the one with the highest (10.0) rating, Lee Jurewitz. I emailed her office. No response. I called them, and it was lucky I did because their server was having problems. I told them my story and was accepted as a client. If you are reading this, you should understand that SSDI claims take a LONG time to process. My claim took 17 months from my initial application, to the successful hearing with the Administrative Law Judge and my attorney, Ms. Jurewitz. And I had an expedited claim, not only because I am a disabled veteran (100% P&T), but also I am a TERI (terminal illness) case. 17 months. There were others at the downtown Social Security office, waiting for their hearings, who had waited over four years. So, you need to learn several things: 1) Be patient. SSDI claims will take a long time to process. They are understaffed and overworked. 2) Hire a good, reputable attorney. The maximum they can make on an SSDI claim is $6,000, or 25% of the retroactive backpay, whichever is less. They are well worth the money (which is deducted from your final payout from Social Security). 3) Document, document, document all your medical appointments, etc. Help your attorney to help you. 4) Be honest with your attorney, and above all, the Administrative Law Judge (ALJ). If you are truly disabled, it will be obvious to everyone because of your medical documentation and your demeanor. Do not fake anything or you will ruin your credibility and you will deserve to lose your case. It may seem that the ALJ hearing is adversarial, but it is the job of the judge to make certain you are disabled, and believe me, the ALJ will ask you some very personal and embarrassing questions--but that is their job. Be honest and make sure the judge understands your disability. Explain how your disability affects your life and why you cannot work. SSDI is not just handed out, and it should not be. If you are able to work, or you are faking it because you think you might get some easy money from the government, I will tell you right now that you are sworn to be truthful during your hearing and the penalties for defrauding the government are severe. They should be. So, if your initial SSDI claim is denied, which in all likelihood it will be, and you have a legitimate case, I would strongly urge you to find a good, reputable attorney to represent you, and AVVO can help you find the right attorney for you.

Without explanation, changed opinion almost immediately after retainer payment. Tried to convince myself that the Conick didn’t have a memory problem, but his memory problem is just one issue. Had to repeat several times and/or refer to typed information/messages the type of documents, witnesses, facts, issues, history, etc. But no matter how many times repeated, Conick continued to demand another repeat. Conick refused and/or failed to answer even a few basic and simple questions. During a ten month period Conick demanded that I produce documents in response to Plaintiffs’ Discovery while concurrently he Conick agreed and allowed Plaintiffs to NOT respond to Discovery questions or produce documents required by them. This would also be concurrent to Plaintiffs’ fictitious court rules claimed in Plaintiffs’ complaint, ignored terms of documents and ignored controlling common law as well as other issues. This is only some of the problems with Conick.

I could not have been happier with Diane's assistance to me. She was compassionate, understanding and helped me a great deal with my case. Although it has been five (5) years since she worked on my claim, she recently took the time a few weeks ago to address a social security detail over the phone with me - I appreciated that very much. I highly recommend Diane's legal expertise!

I do not believe she was compassionate she did not put an effort in my case, basically everything was handed to her on a golden platter, and if she took the time to read any of the documents she would not have gone into court and bullshit to the judge just to win the case and walk away with $6,000. Of you think if you win it was worth the $6,000 that she basically stole from you and you did all the leg work and on top of that I did the work to get my children their benefits, they deserved but she did Nothing because she had gotten her money, so We filed the paper work that she should have with the court and she turns around and send us a letter about the money they would be getting because the court notified her, not only does she try to take the credit like she did the work!! What a joke but yet have the nerve to bill me for more money after she already received her payment the maximum amount of $6,000, you sure know how to play on the disabled and poor in hopes they might be stupid enough to fall for your games Now I understand why people always say you cant trust attorney, you might be the reason that gives attorneys a bad rap

Kevin and his staff have been outstanding to work with over the years helping us with our parents needs...first and foremost, understanding the next steps for our Mom when she developed Alzheimer's and needed to go into a nursing home. His assistance with getting through the Medicaid process was huge. Kevin's knowledge and help getting our father Veterans Aid & Attendance Benefits...we will be forever grateful...a very time consuming and grueling process. Kevin never hesitated to take a question or call back with answers. His compassion dealing with my father as he aged, and recent death...his kindness and understanding will never be forgotten. Kevin and his staff are the best!

What a Social Security & Disability Lawyer Can Do for You

A Social Security and Disability lawyer specializes in helping individuals navigate the complex process of applying for and securing Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI) benefits. These lawyers assist clients in filing applications, gathering necessary medical evidence, appealing denied claims, and representing them in hearings before administrative law judges. A lawyer can help maximize the chances of approval by ensuring that the paperwork is accurate, deadlines are met, and legal standards are addressed.

If you are disabled and unable to work, or if your Social Security Disability claim has been denied, a Social Security and Disability lawyer can guide you through the legal process to obtain the benefits you’re entitled to.

When Should I Hire a Social Security & Disability Lawyer?

You should consider hiring a Social Security and Disability lawyer in the following situations:

  • Applying for SSDI or SSI benefits: The application process for disability benefits can be complex, with strict requirements and documentation. A lawyer can assist in completing the application correctly and submitting the required medical evidence to improve your chances of approval.
  • Denied disability claim: If your initial claim for SSDI or SSI benefits has been denied, a lawyer can help file an appeal and represent you in hearings. Many claims are denied initially, and having legal representation during the appeal process significantly increases the chances of success.
  • Requesting reconsideration: After an initial denial, you have the right to request reconsideration of your claim. A lawyer can help present new medical evidence or correct any errors in your original application.
  • Hearing before an administrative law judge (ALJ): If your reconsideration request is denied, you may request a hearing before an ALJ. A lawyer can represent you during the hearing, preparing you to answer questions and presenting a strong case based on your medical and work history.
  • Proving medical conditions: If your disability involves complex medical conditions, a lawyer can help gather expert medical testimony or additional evidence to demonstrate that your condition meets the legal criteria for disability.
  • Overpayments and cessation of benefits: If the Social Security Administration (SSA) claims you were overpaid or attempts to terminate your benefits, a lawyer can assist in challenging the decision and protect your right to continue receiving benefits.
  • SSI for low-income individuals: If you are applying for SSI, which is based on financial need in addition to disability, a lawyer can help ensure that your financial records are correctly submitted to meet SSA’s strict income and asset limits.

Hiring a lawyer early in the process can help you avoid mistakes that could delay or jeopardize your claim.

What Does a Social Security & Disability Lawyer Do?

A Social Security and Disability lawyer provides a range of services to help individuals navigate the application and appeals process for SSDI or SSI benefits. Their responsibilities often include:

  • Filing initial applications: A lawyer can help prepare and file your SSDI or SSI application, ensuring that all necessary forms are completed accurately and medical evidence is included.
  • Gathering medical evidence: A lawyer works with your doctors and healthcare providers to collect medical records, treatment histories, and expert opinions to support your disability claim.
  • Filing appeals: If your initial application is denied, a lawyer can file an appeal and guide you through the reconsideration process, ensuring that any additional documentation or evidence is provided.
  • Representing you in hearings: A lawyer will represent you in front of an administrative law judge, helping you prepare for the hearing and arguing your case to demonstrate that your disability prevents you from working.
  • Handling deadlines and paperwork: A lawyer will ensure that all deadlines are met, and that any requests for additional information from the SSA are responded to promptly.
  • Negotiating settlements (for private disability insurance claims): If your disability benefits claim involves private disability insurance (in addition to or instead of SSDI/SSI), a lawyer can help negotiate a fair settlement with the insurance company.
  • Fighting benefit terminations or overpayment claims: If the SSA attempts to terminate your benefits or claims you were overpaid, a lawyer can defend you in administrative proceedings or file for a waiver or reconsideration.

How Are Social Security & Disability Lawyers Paid?

Social Security and Disability lawyers are typically paid on a contingency fee basis, meaning they only get paid if your case is successful, either through the approval of your disability benefits or winning an appeal. Here's how it generally works:

  • Contingency fee: The fee is usually 25% of your past-due (backpay) benefits, but no more than $7,200. This fee structure is set by the SSA, and lawyers cannot charge more than this amount for SSDI or SSI cases.
  • No cost for future benefits: Lawyers are not entitled to any portion of your future monthly disability benefits. Their fee is strictly limited to a percentage of your backpay.
  • Additional costs: In some cases, you may need to pay for additional expenses, such as obtaining medical records or expert witness testimony. These costs are usually minimal, but it’s essential to ask your lawyer about any additional expenses upfront.

It’s essential to confirm fee arrangements with your lawyer during the initial consultation to avoid misunderstandings.

How Much Does a Social Security & Disability Lawyer Cost?

The cost of hiring a Social Security and Disability lawyer is typically structured around the contingency fee system outlined by the SSA. General cost information includes:

  • Contingency fee: The lawyer’s fee is capped at 25% of your backpay, with a maximum of $7,200. For example, if you are awarded $10,000 in backpay, the lawyer will receive $2,500 (25%), and you will receive the remaining $7,500.

Overall, there is no financial risk in hiring a Social Security and Disability lawyer, as they only get paid if your case is successful.

Top Questions to Ask a Social Security & Disability Lawyer

Before hiring a Social Security and Disability lawyer, it’s important to ask the right questions to ensure they have the experience and expertise to handle your case effectively. Key questions to ask include:

  1. What experience do you have with Social Security Disability cases?
Ensure the lawyer has experience handling SSDI and SSI cases similar to yours, particularly if you have a complex medical condition.
  2. How do you charge for your services?
Confirm that the lawyer charges a contingency fee and that you won’t owe any fees unless your claim is successful. Ask if there are any additional costs for medical records or other expenses.
  3. What is the likelihood of success in my case?
Ask the lawyer for an honest assessment of your case and the potential challenges you may face.
  4. How long will the process take?
Disability claims can take time, especially if you’re appealing a denial. Ask the lawyer how long they expect the process to last and what the typical timeline is for cases like yours.
  5. How will you help me prepare for my hearing?
If your case is going to a hearing before an administrative law judge, ask the lawyer how they will help you prepare for testimony and present your medical evidence effectively.
  6. What happens if I’m denied again?
Ask about the next steps if your reconsideration or appeal is denied, including the possibility of further appeals to federal court.

How to Check the Credibility of a Social Security & Disability Lawyer

To ensure you are hiring a reputable Social Security and Disability lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice law and has no history of disciplinary actions.
  • Look for Social Security experience: Review the lawyer’s website or profile to ensure they specialize in Social Security and Disability law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on Social Security Disability matters.
  • Check for memberships in relevant organizations: Membership in organizations like the National Organization of Social Security Claimants' Representatives (NOSSCR) can indicate that the lawyer is committed to representing disability claimants.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a Social Security and Disability lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Medical records: Bring copies of your medical records, including doctor’s notes, test results, treatment histories, and any disability-related diagnoses.
  • List of medications and treatments: Provide a detailed list of any medications you are taking, treatments you have received, and ongoing medical care related to your disability.
  • Denial letters (if applicable): If your disability claim has been denied, bring a copy of the denial letter from the SSA, along with any documentation related to your appeal.
  • Work history: Provide information about your previous jobs and work history, including details about how your disability has impacted your ability to work.
  • Social Security application (if already filed): If you’ve already submitted an application, bring a copy of the application and any correspondence you’ve had with the SSA.
  • List of questions: Prepare a list of questions you have about the legal process, the lawyer’s fees, and what to expect in terms of timelines and outcomes.

By preparing thoroughly for your consultation, you can help the lawyer assess your case more effectively and provide the best possible legal advice tailored to your situation.
