Upon recommendation of my personal attorney, I contacted Lori J. Cerato, Esq. with questions regarding Elder Care issues. At our first meeting was very satisfied with her approach to settling my Aunt's Estate. I was impressed with her candidness regarding fees. I recommend you check out her website for her most impressive credentials. (www.attorneycerato.com) Attorney Cerato's staff are friendly and knowledgeable. Emails and phone calls were answered promptly. On a scale of 1 to 10, I would rate Attorney Cerato an 11!

After the death of my beloved husband in 2018, I was extremely fortunate to find the services of Jennifer and Jerad Tomac with “Tomac & Tomac, PLLC” in Rapid City, South Dakota. They were instrumental in helping me through the most difficult time in my life. Jennifer made the whole process easy with a very creative approach regarding the estate and trust, while I was dealing with so many issues. Now, thanks to Jennifer and Jerad Tomac, these very professional and timely attorneys, I am all set with my estate planning. Jennifer is very compassionate while exceptionally intelligent in many areas of the law. I became very ill, and she even came to the hospital (which was an hours drive from her office), in order for me to sign some important documents. She also has the gift of explaining complicated legal matters in a language that is completely understandable by anyone, and is the most caring attorney I have ever met. She truly was a blessing to me, and I highly recommend her without reservation. She will fight for you, be attentive to you, and she will give you the wonderful feeling that “everything will be fine”. I am so grateful, thank you Jennifer,

Jenny was extremely helpful and professional as we worked through developing my will and trust after my first child was born a few years ago. I knew I needed to get my “end of life” documents prepared but didn’t really know where to start, and Jenny made it easy. Thankful to have this foundation laid in the event something terrible happens; I’ll know at least it won’t be a messy situation for my children.

Ms. Tomac is an excellent attorney in the legal areas related to estates and trusts. She is very knowledgeable and provides no nonsense guidance and explanations. Ms. Tomac has guided me through the executorship of my mom's estate, a very difficult position emotionally. Her knowledge of the court system, of the administrative process that needed to happen when and where, and what to expect at each phase has been invaluable. She helped me to understand my mom's will and codicils as they were written, and helped me finalize her estate in accordance with my mom's wishes. We recommend her highly to anyone needing these type of services.

Daniel Baltuch is a sensitive and knowledgable source of information and counsel. Daniel helped to edit a care agreement written by my father's attorney to cover my taking care of him. Daniel is quick to establish rapport, a good communicator, a quick study, and he stays on point. We efficiently clarified the situation, made a plan, and contracted for my agreement with him. Daniel returned his deliverable within 6 hours, accompanied with verbal explanation. Daniel was attentive to time spent to protect my spending. I am grateful to have found him.

Like many other families, we were faced with decisions that we really didn’t think we would need to make… my Dad’s dementia was deepening and my Mom, his Caretaker, was beginning to rapidly fail herself. It came to the point I knew my Dad needed more care than what my Mom was capable of providing. It needed to be done quickly and correctly. Frankly, I was worried my Mom would pass before my Dad. My parents are retired school-teachers. That means they are not rich, but they do have income. It certainly means they do not have the money for Nursing Home care that my Dad needs, and for that matter, my Mom needed for him to have. I knew that trying to do the paper work and application for Medicaid was far beyond my ability and know-how. I recognized at that point we needed an Attorney to handle this for us. I looked for a nearby attorney and found Richard Shea. This was one of the best decisions made in this difficult junction of our lives. Richard reviewed everything carefully…. He answered questions timely… He worked as a partner with our family. We are so grateful we hired him…it turns out that one of the accounts my mom had saved money through her job, would have been at risk if we had made the application first. Richard identified the situation and made suggestions on how to restructure it, which we did. While the amounts would not seem large to most people with an IRA or Pension, it was huge for my mom, and meant a lot to her monthly income. This one detail, more than paid for Richard’s fee. My Dad is in a great facility. My Mom is able to relax and reclaim part of her life because she doesn’t have the heavy burden of caring for my father any longer. She can sleep at night and not have to worry if my Dad was going to get out of bed and turn on the stove and burn the house down! (He actually came close one time.) She is actually getting healthier. During her last check-up, her doctor told her he was pleased with her resurgent health. I cannot recommend Richard enough. He is well worth his fee since he will fill out the paperwork and handle the application process and deal with the questions from the Examiner. These are details that are nerve racking enough, let alone during a stressful time. If you are faced with these decisions, I recommend you hire Richard to handle the details. You have enough stress as it is, let him handle the part you that you are not an expert in handling. You will feel a lot better that you did.

After my mother passed away I needed to sell her home in Kona, and I have never bought or sold a home before - it was all new to me. I live on the mainland, and Donna was recommended by a family friend in Kona. I spoke to her on the phone and was very impressed by her knowledge of real estate law, her professionalism, and her communication skills. We got good advice from Donna (disclosure list, etc.). We also had her look over anything we were given, by the realtor or the escrow company, to sign. She said the forms looked pretty standard, but there were a few things she had us change - she had our best interest at heart. My husband and I agreed that paying for an attorney look things over was well worth it for our peace of mind, and fortunately Donna’s rates were very reasonable. After escrow closed we asked Donna to apply for the HARPTA refund, and about six months later we got the entire amount! So thank you, Donna Payesko, for being there when we needed you and for helping to make sure everything went smoothly! Mahalo!

Donna Payesko has provided me advice in several areas of the law over a period of years. In various legal matters, I needed someone who could navigate complex waters -- in guardianship matters; other elder, finance and tax law issues; real property and matrimonial protection. Each matter required a clear understanding of what was involved, the parties’ claims, the possible options/ solutions and the steps and procedures necessary to move forward to resolution. Ms. Payesko's ability to isolate each issue, clarify the law regarding such matters and move forward expediently helped reduce the stress of the situation. Ms. Payesko speaks well -- clearly and directly -- outlining the process using terms I understood. She is meticulous in her written communications, paying attention to detail and meeting all deadlines. When I was required to furnish documentation to her for a legal matter, she was patient with my efforts to locate those documents, yet clear about their importance to the case. I could communicate in a variety of ways (scan, fax, email, phone, etc.), knowing she would receive my communication and respond in a timely matter. Ms. Payesko is an excellent listener and asked specific relevant questions to expedite the process. I would highly recommend her to anyone seeking legal advice or the ongoing services of an attorney.

Peter has ably assisted my family over the past 10 years, providing a rare combination of professional expertise and wisdom in navigating family relationships. He has handled both of my parents' estates, as well as that of my brother. I served as power of attorney and co-executor for all three, so I have worked closely with Peter throughout this work. Prior to their passing, he helped our family with comprehensive estate planning by suggesting and implementing a careful program of trusts and real estate transfers. My brother had Down Syndrome, and Peter understood and assisted us with all the complications of special needs law. Only recently did I discover that Peter has an LLM, additional training beyond his JD, in taxation law, and he lectures at Boston University in probate and family law. When getting a divorce the outcome is probably 90% is decided before you hire a lawyer. I contacted 2 other lawyers prior to finding Mrs. Howell and the only conversation was only price and retainer. My first meeting with Mrs. Howell was questions about the issues some history and a guesstimate of the outcome and then the price and retainer. Mrs. Howell makes herself highly visible throughout the process. Her pace is extremely fast to help keeping the billable hours as low as possible. She stepped up to do process my wife layer would normally do to reduce the cost the overall lawyer cost. Another major item is her negotiating skills to help change the outcome. Nobody wants this but what it could have been verses the final decision I am pleased with. She is Awesome at what she does.

Jennifer is great with employment law, intellectual property, and competition. She defended us against three large law firms in a jury trial. Her professionalism, sense of humor, and expertise kept us moving forward and winning our case against the plaintiff who had hired three large law firms.

I've been using David Faloni for over 5 years now for all my legal matters. I can't say enough good things about David and his staff of professionals. His rates are the best around. David takes a great personal interest in each and every person. I have recommended many people to David. He recently handled my house closing. He arrived early to the closing and everything was in perfect order thanks to David and Stephanie his Senior Paralegal. The buyers lawyer had dropped the ball on so many items and David and his team went above and beyond to get things accomplished so I was able to close on time. He stayed for the entire closing unlike the buyers lawyer who said hello and left the closing to her staff to handle. Afterwards David offered to take us to lunch. This firm is a 10+ in my book

Dan listened and questioned to create a draft. He then allowed us to amplify and make alterations to the draft. Then he rechecked to results. We were able to gain all of the paperwork we needed at a nominal expense - yet he spent a great deal of time being sure that we were taken care of courtesly and correctly.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
