I am a local Realtor in Manatee County and based on the experience I had working with Donna with my elderly mother, I have referred several friends, family, and clients to her to assist them with their family members. Donna tells it like it is and walks you through the process step-by-step. I can't recommend her enough! Such a blessing!

I have worked with Donna for over 20 years, in the matters of Estate Planning, and Elder Law. She is knowledgeable, competent, easy to work with, and she truly cares about the people she helps! She is not only the attorney I recommend to my clients, she is my own attorney as well. I have worked with other attorneys in town, but none can compare to her level of compassion and competence. She is down to earth and takes time to explain complex issues. She is just excellent!

It is important to Steve that his clients fully understand different ways to structure a trust, so that we are able to make informed decisions. He addresses both the legal and more affective aspects of the trust. He also stresses the importance of regularly revisiting the trust so it remains accurate & up to date. He uses subsequent appointments to continue to educate his clients, and offer criteria for making adjustments given changes in law or family circumstances.

From the moment I talked to Steve I was impressed at his promptness to return my call. Thank-you, Steve, my friend!

I researched a long time before I finally settled with Steven Oakley. He was very professional and had a great presentation and made us so comfortable from the beginning. We trust our estate planning with him and would recommend others to do the same. It takes 3 meetings to get your estate planning done. The first is a free initial meeting where he explains what he does and the pricing options. Then if you do decide to go with him then during the second meeting you provide all your information for your estate planning. You get a DPOA , an advance directive, beneficiaries if you or your spouse dies all set up and more. Then during the third meeting he hands you your estate planning folder with everything in it along with a CD copy and he goes through everything with you. You also receive an Emergency Medical Information Card you can keep in your wallet if ever you get hospitalized. He answered all our questions and everything that I wanted on my checklist for estate planning was marked off because of him. There is a yearly annual review that you must pay for but it is worth it because you need to keep your estate planning updated or else some things might become invalid. The price is on the higher end but you definitely pay what you get for and I wouldn't want to pay cheap when it comes to my family and estate planning. Like he said to us during his presentation, think of it as an investment into your future for you and your loved ones.

Even during “normal times” the death of a parent is difficult enough. Our mother passed away during the peak of the COVID-19 pandemic, which made dealing with her death and financial issues even worse. Since our family had previously sought the counsel of Stephanie Townsend-Allala when my father passed away and we were very satisfied with her legal services we sought her expertise again. When we talked to her about our concerns she took her time to answer all our questions and concerns. She made us feel at ease by her caring and compassionate manner. We are tremendously grateful for her expertise and knowledge in Elder Law. Our family highly recommends her legal services.

My family consulted Ms. Allala concerning our Mom's estate after her passing. The State of Texas sent us a Texas Estate Recovery Program questionnaire to determine if the State of Texas had any claim against our Mom's property. Ms. Allala was extremely patient in helping us answer the questions correctly. She answered all our questions with precise knowledge of statutory claim exemptions. Ms. Allala demonstrated professionalism beyond the call of duty. Her staff was also very friendly and kind during the set up of our consultation. Ms. Allala also gave us the peace of mind that we craved during our stressful time of taking care of our Mom's estate. We highly recommend Ms. Allala and her law firm in dealing with elderly care.

No question was too dumb. Stephanie answered them all and encouraged us. She is professional, knowledgeable, and offered emotional support to us as we faced difficult decisions in our situation. My family is grateful to her. We cannot praise her enough for all that she has done. Without hesitation, we recommend her highly and without any reservations.

Stephan Waltar is very knowledgeable and experienced in estate planning. He is the author of two books on the subject, both of which I read and found to be clearly written and very helpful. I felt that he wrote these books because he truly cared about people being well protected and informed. He and his staff were easy to communicate with, any questions were answered fully and we received prompt responses to any emails. We were provided with a 3" binder made personal for us that clearly organized all of our info and documents on our estate planning, medical directives, power of attorney, ect. A digital copy is kept securely as well. We felt like it was money well spent to have our estate set up by a legal expert rather than a one size fits all computer program. it is complicated and it is essential that it be done properly. When we were at our bank to transfer our account, the manager had to call the legal department to walk her thru the process, as even for someone who works in the financial field it was complicated. One our side we had been provided by Mr. Waltar's office with all the correct legal documents and it was easy. In the future as laws change it is also good to know that we have a legal expert to confer with who will keep us updated and our plans on track.

In 2017, I was seeking legal expertise in the area of Elder Care. My journey led me to Jean Galloway Ball. Since then, she has been instrumental in guiding me through/about Elder Care as well as Estate Planning/Trusts. She was able to assess my situations immediately, provide the challenges ahead for me, options for resolutions, thorough in ensuring I understood all documentation, and, above all else, understood me. I am thankful for her knowledge, frankness, concern, and patience. As a result of her professional demeanor, and just who she is, I felt at ease during and after each session even though, many times, the situation that I was dealing with didn’t warrant it. I highly recommend Jean Galloway Ball. She will never give up on her client.

My husband left behind a very muddled and complicated estate with no will, loans that were owed him, real estate owned in several states, a construction project that was barely started, unpaid taxes, money in a foreign account that was frozen, a safe deposit box owned by him alone and a jealous girl friend who sued me. Jean and her associates have helped me through the process of becoming the administrator of his estate, reactivate my late husbands LLC so I can continue the construction project and has countered the suit effectively. Jean has begun the process of forcing the repayments of the loans by placing liens against the debtors property which he has for sale thereby preventing sale without repayment of his loan. There is still much to be done, but I have confidence in Jean's ability to advise me and help me find the specialized help I need to complete this task..

Cathy, Leslie, and her team were awesome from 2020 through 2021. I couldn't ask for a better team. My mom went to the hospital in April 2020 end up in a medical coma for months. My mom didn't update her estate planning to allow for me to assist her in daily life. Mind you this is the first time I ever had to deal with something like this, I am a young 34 year woman. They educated me on different options on what to do, assist me with everything I had to do for my mom. I end up having to go to court to get guardianship/conservatorship for my mom. Leslie was awesome in assisting me with what I needed to do for court paperwork, accounting, etc. When my mom recover and she was able to get her rights back, Cathy took the time to speak with my mom to get her estate planning done as well get her rights back. My mom was impressed by the service they provide to her. Unfortunately, my mom passed away in April of this year, and again I went back to Cathy and her team for more guidance on what is best to do to avoid any issues. When it came to family disagreement on the Last Will, I ask for Leslie to help out to speak with my family. She was able to get them to come to an agreement to move things smoothly. I couldn't get through this mess in the last past two years without them. I would give them 10 stars if I could. They were very reasonable on price with me. Thank you so much for everything you have done!

Stephanie and her team helped our elderly parents navigate the estate planning process with ease. She provided professional guidance to our family in consideration of Medicaid, a reverse mortgage, and veterans' benefits -- all very daunting tasks for the "Regular Joe". Her company is so aptly named because her compassion shone through at every step of the way -- including coming to our parents' home for meetings and signings, and visiting our father while he was in hospice. Without Stephanie and her team, our family would not have been as prepared as we were for essential legal decisions at the end of our father's life. For my sisters and myself, it was truly a gift that my parents had the foresight to plan and that we found Stephanie to be the one to make those plans happen. To our family, she is a true professional with a big heart and we are so very grateful.

He informed me of what needed to be done, how long it would take, and what it would cost. All my questions were answered with great detail and patience. He is very confident and knowledgeable and the price's were very fair compared to the other quotes I was getting. Everything went very smoothly and without any problems. Mr. Vicknair did such a good job with my Wife's Estate that I also decided to retain him for my Last Will and Testament which included a Power of Attorney, and Health Power of Attorney. My sibling misused a power of attorney to prematurely take control of my father's life and put him in a nursing home two hours away from his home. Luckily for my father, Ted was the first attorney called to help my father. Ted pushed back on the nursing home's refusal to let him meet with my father. Ted drove 30 miles to bring my father a new durable power of attorney and healthcare power of attorney to sign. Ted doing that put my father back in control of his life and got him back home within a week. Throughout the whole process, Ted answered all of the questions my father and I had about the powers of attorney. He explained every part of the powers of attorney to my father when he met with him and even answered the questions my cousins asked as witnesses. Ted is very good and patient at listening to what you want and then explaining complex legal concepts while going over all of your options. My father likes and trusts Ted so much, that he had Ted create two trusts and a new will. My father was more than happy to drive four hours round trip on two different occasions to meet with Ted to sign documents. That's how much my father likes and trusts Ted. My father wanted things in the trusts that aren't allowed by law. Ted did a great job of explaining to my father that the law didn't allow some of the things my father wanted, but Ted did research to come up with legally allowed solutions to achieve nearly the same thing my father wanted. Ted worked really hard and patiently to give my father everything he wanted. Ted treated my father and me with with respect, honesty, patience and compassion while giving us great legal advise and services. He's a great attorney and an even better person.

Then things turned. 6 years later about 5 different lawyers and at some points a pro se’ it was finally over. Throughout the 6 years Joe did an outstanding job. He was always there when I needed him. Would always return calls and made sure he guided me through ever obstacle we faced. He made sure we were both prepared for every hearing, CMC, motion and cross motions. Above all the legal parts of the divorce Joe would always make sure I stayed focused on what I needed to in my everyday life reassuring me he had things under control and could always find a way to real me back in when he could see the frustrations building up in me. Nancy is a wonderful, trustworthy attorney.  My sister and I were impressed by her knowledge of Medicaid and elder law.  She saved our family a substantial amount of money that we did not know could be protected.  I honestly wish I had contacted Nancy at least two years earlier. Nancy always answered our questions and followed up with me through each step of our case.

I live in Maine, but when my grandmother passed in Pennsylvania, I had no idea of what I needed to do. I had never dealt with the process before, and were certainly unfamiliar with anything Pennsylvania specific. I found Barry's firm on a google search, and was lucky I did. Barry was so responsive, walked me through each step of the process, and was always available for questions. He was so knowledgeable that it really put my mind at ease that we had him working for us during the process. And for someone out of state, he went above and beyond to make sure the time I spent traveling back and forth from Maine to PA was limited to focusing on the emotional aspects of loss. I would highly recommend using the law firm of Barry S Rubin and will definitely engage again if the need arises.

We put off estate planning for too long – for various reasons, including “we don’t have enough assets”, “it’s uncomfortable to talk about”, “our blended family is too complicated”. Working with McCreary Law Office helped us move forward with confidence. Jana McCreary is organized, thoughtful and attentive. She listened to our concerns and explained how a solid estate plan, including powers of attorneys, medical directives, and other components can protect our wishes, assets, and legacy. I know her thoroughness caught things we would have never even thought of and will protect our heirs when the time comes. It was a pleasure working with her and is a great feeling to know this is taken care of. I highly recommend McCreary Law Office.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
