Denis Hertz-McGrath takes State Public Defender cases like mine because no one will hire her privately, and for good reason...she is a terrible attorney. I was charged with Disorderly Conduct and Battery. I was laid off from my construction job and needed a Public Defender. The Public Defender gave my case to Denise Hertz-McGrath. This attorney did absolutely nothing on my case. She never spoke to a witness. She met with me once for 12 minutes, after calling her office over 6 times without even the courtesy of a return call from her. During this 12 minute meeting we had it seemed her only goal was to get me to hire her privately, though the State was paying her the "State rate", which she stated wasn't enough for her to really dedicate the resources I needed. I think it all boiled down to a greedy attorney trying to take my money after getting the Public Defenders money for taking my case. In court she actually was talking about the wrong case and had to be stopped by the Judge. I ended up doing county jail time because she upset and argued with the DA. If Denise Hertz-McGrath was the last Attorney in Wisconsin, I'd suggest you represent yourself.

McGrath is one among very few Kenosha attorneys that invests herself 110% for your criminal case. She pulls no punches; our experience was that she represented us as if we were her own family. She does not hesitate to challenge or clarify the judge's statements and/or rulings when necessary (and we found it to definitely be necessary). She is one intelligent, matter-of-fact attorney worthy of her retainer fee !!

I wasn't sure if I should hire an attorney because the reviews I read said it wasn't worth it because they usually find you guilty. But I thought if there was any chance it would have to be thru an attorney. I called Atty. Rifelj and explained my situation. I had a BAC of .18 and facing ILD interlock device for a year. This is automatic if you are over .15. Nicholas was compassionate, discreet and said he would handle everything. I did not even have to go to court. So for a flat fee he did just that. He got my fine reduced and got me out of the ILD . I would definitely recommend you contact Nicholas if you are in need of an attorney. He did a great job for me.

My GF had a good OWI case with promising evidence of getting the case dropped. She went ahead with Nicholas because he had a flat fee and she was on a budget. Nicholas did all the paper work and represented her in the Municipal court. He stated that he will put the officer on the spot in the Circuit court because we lost the municipal court. As a lawyer, shouldn't you be fighting for your client in all courts? Isn't that your job? I was so confused as to why he needed to wait. Then he filed for an appeal to the Circuit court and didn't even send the appeal in certify mail. The city attorney said they never received it. The judge ruled with the city attorney and she could no longer appeal the case. So now, she is stuck with a loss of $2600, and a OWI on her record. She could have gotten the same result by just going to court and plea no contest and saved her self $2600. Throughout the case, this lawyer just made it feel like he didn't care what happens to his client. I would recommend staying away from this lawyer if you can. It seems he just wants your money and doesn't care what happens.

I was cited for and OWI 2nd and battery to a law enforcement officer in 2022 . A couple months later was cited for and OWI 3rd. Jason helped me a lot through every aspect of hearings, arraignments, options I had, and what the prosecutor was likely going to present. He asked me for all paperwork necessary through my treatment to present to the judge to help with my case. All details considered in my case, I was given minimal time on the bracelet and all other charges dropped. I would recommend Jason for any criminal charge because he is very thorough when explaining things, and answers any questions you may ask in depth. I felt I had someone on my side throughout my experience that truly wanted the best outcome for me.

He immediately reached out to me and gave me a consultation. Speaking to Matthew gave me the confidence I needed to hire him to keep my innocence. He immediately took note of my side of the story in full context and told me of what to prepare for in the charging court. Matthew's wit and knowledge was important in getting my case completely dismissed before I was even charged!

She could never remember anything and felt as though she didn't take my case seriously, though it was a very serious case. I would call and not hear from her for weeks, which was not appreciated. she shouldn't have taken my case if she could not keep up with her work load. I hired Alf Langan for a family court case back in 2012. I wrote an honest poor review of my experience. Now he's disputing my review as if he never represented me. Here is my honest review below, as the original was removed due to his dishonest dispute. If you have this many Poor reviews and have also been disciplined as a lawyer, maybe you should take a look at your performance rather than get honest review removed. I hired this attorney for a very simple family court matter. I made a huge mistake. He does not respond very well to emails, if at all. He sent about 10 emails about a certain topic for NO reason as they were not getting us anywhere. Then I am charged for them. He charged me for part of my initial conversation with him, never telling me this until I see the bill. I waited 2 weeks for a call back and made 3 calls total before getting one back. He sent me a time sensitive email and implied that I needed to answer him and he would pass the answer to the parties involved and then he never did tell them. I left him a voicemail the same day regarding difficulties with the party because of his inaction and requested a call back asap because of this and it is now 2 full business days later and still no word. Today I hired a new attorney who has a much better rating than this man. In my opinion, do NOT waste your money. I have gone through almost $1,500 and all he did was go to one court date and send countless useless emails. Then I had to call him to let him know that these emails were useless and he wasn't listening to me. Although he seems like a nice man, as an attorney; get someone else.

It's obvious this place rips people off all the time. The district attorney is childish and routinely brings false information into court without consequence. I assume he maintains the attitude of if you can't beat em, cheat em. He's not as smart as he thinks and its time for him to be held accountable for his unquestionably illicit legal tactics and false imprisonments. This attorney seemed knowledgeable and eager to help with my case. After retaining, he initially seemed to be somewhat productive in helping my case, however after a couple months, things began to not go in my favor, phone calls were not returned promptly, emails were not returned & I was billed for them anyway. A check payment was lost, and after a month passed, his assistant called for repayment. Overall this attorney did not seem to fight for my best interest. A few months after our pitiful agreement was signed, more problems began, so I reached out to him via email for advise. I NEVER received a response to that specific email, however I did receive a bill for it. I never paid the bill, but continued to receive it a couple more times. This attorney was a waste of retainer, time & do not recommend him to anyone.

At first he seemed extremely knowledgeable, eager to work with me and ready to help me get custody. After hired though I only heard from him about payments for my retainer. Which I had paid when stated I would but somehow they misplaced two checks. Once he got the full retainer he charged me for reading and responding to emails, but never actually responded. Then the final straw was he told me that my case was taken care of, and I didn't hear from him in four months. By then I was assigned a court date for contempt of court. Turns out the court date where he was suppose to take care of everything he cancelled. Once in contempt I went to get a public defender. After this he all of a sudden called me nonstop trying to be my public defender. Has some nerve on that one. I fired him and am now looking for an Atty to fix all this. This time I'm researching and reading reviews. I'm told that the mess he made of my very simple case is deplorable, and professionals I've talked to thus far can not believe how bad he treated me and my case.

Be aware of the fact that just because a lawyer is appointed by the courts in a CHIPS case, the financial responsibility lies upon the individual. Atty. Was assigned one of their attorneys as a public defender. Just my luck to receive one that wouldn't defend me. It was as if he was too passive. Just didn't want to argue on my behalf or at all for that matter. I went to court for disorderly conduct, domestic violence. I told him I would not plead guilty to domestic violence because my ex lied when she said I pushed her. He proceeded to to convince me to accept a plea bargain assuring me that it was only for disorderly conduct as I did punch my truck. I agreed because he assured me that domestic violence was not going to be charged, just the disorderly conduct. Once I accepted the no contest plea I was given 16 months probation and ordered to attend domestic violence counseling. When I started to protest my attorney told me not to interrupt the judge. I wouldn't recommend this firm as far as their public defender goes. He will lie to you and you will suffer for it.

They allowed us a payment plan that worked, he destroyed the parole officer, the persons accusing my spouse of the crime were absolutely destroyed in court (one went to prison for filing a false police report) and even had my spouses parole officer saying "you had a damn good attorney". My spouse was facing many years in prison. Lane even had the judge asking why the parole officer tried to take this to a revocation hearing. Ignore the bad reviews. I had a terrible experience with this law firm. I reached out to this firm to settle a land contract dispute with someone who was not paying their mortgage. Sadly, due to a lack of knowledge, my attorney prepared a case which was not within my legal rights under Wisconsin law. To make matter worse, the law office lacked basic communication, which caused the matter to drag out for months. To name a few issues, they did not contact me when the retainer ran out, nor did they contact me when they needed a court filing fee. Instead, they would stop working on the case until I reached out to them inquiring about progress. After paying to take the case to court, it was immediately thrown out by the judge. In the end I was left without resolution in the case and a request for a much larger retainer to continue legal representation. After being out $1500 in representation costs, fees, a flight and hotel, and months without pay from the land contract, I cannot recommend this law firm.

Would not recommend, after paying $3,500 John German did nothing for us to help argue our case and get it lowered. It’s like he just collected a nice paycheck and did nothing. Very hard to get in communication with says he will call and that doesn’t happen until days later.

Several calls to her office were rudely answered by her assistant. Did not answer the questions and repeated what I already knew. When I asked what the purpose of her services are _ " to lookout for the best interest of the client" okay please educate me to what the entails. " to look out for the best interest of the client". Great thank you for telling me what I already know. She is the worst attorney and has absolutely no business practicing law NOR being pushed on anyone from the Juneau County Court House. I will be lodging a formal complaint with the State Bar Association.

Rebecca was hired to be a representative and failed to fairly represent both sides. Due to initial bias judgement, was neglectful when provided important information and proof provided by the side she favored less.

I hired Rebecca to represent me in my divorce proceedings. It was clear from the beginning that she assumed that my case was, "just like all the others" and from the get go she was more interested in listening to the opposing counsel than me. The next attorney I hired to replace her confirmed that I was being completely under-represented and the differences in how they conducted business were stark. My next attorney helped me navigate the most challenging thing I have ever dealt with and I walked out of court knowing that I had won. Rebecca promised me that I would walk out of court feeling as though I had lost. She was very difficult to work with and my next attorney made things easy. Rebecca misled me and actually misrepresented my position out of spite after I challenged her on her conduct. Hiring her set me back on time and money and could have cost me custody of my children, which proved easy for my next attorney simply because I am a great father and just needed someone to represent me honestly. Rebecca was the wrong choice.

I retained Attorney Kay to send a letter to another attorney in order to stop what was becoming harassment by a third party and their attorney. One letter from Attorney Kay and the harassment ceased. Fees were more than reasonable.

Kay and Kay Law Firm was hired to represent me in a small claims case. Then Kay and Kay Law firm took action to convert this case to a large claims case without the knowlege or consent of the cliemt. This exposed the client to almost twice the amount of damages. This resulted in a significant amount of billable hours for work he WAS NOT hired to do. After several months of not receiving any billing documents, Kay and Kay sends one in the thousands of dollars. I then send a certified letter requesting that I be allowed to pay $500.00 a month, until my property got refinanced, requesteing that he inform me if it was not acceptable. He DID NOT object to proposed payment plan while accepting several payments. Despite these facts, attorney, Timothy T. Kay, then filed a motion stating I was refusing to pay. All these facts are supported by court documents. Again, watch out for this one.

Possibly the worst lawyer in south east Wisconsin. I hired him years ago to fight a misdemeanor case, not only did he want me to plead guilty to a FELONY it took two years to get to that point at court. Hired a new lawyer that actually knew what he was doing, case resolved within a year, no felony. The only people that say they are happy with Timothy kays work have never had a different lawyer. Got charged more than I could afford for taking two steps backwards. Tim Kay ruined my life, do not let him ruin yours.

Patricia, was nice but non aggressive. Many of my issuses and evidence she would not bring before the judge. She felt the judge didn't want to hear me "trash talk" the other party. But during the trail the judge didn't have a problem listening to the other party trash me, with hardly an objection from her. She felt the judge had already made his mind up about the outcome and attempt at a defence would only upset the Judge. In short, hire someone with more experience to handle your family court issuses. Don't waste your money or your chance in court by hiring Patricia.

He is not organized and his office isn't organized either, and he doesn't have a secretary to make copies or invoices for you... I had to file 3 or 4 complaints with the State Bar of Wisconsin in order to get him moving with a appeal case which he missed the deadline date for that... and with the lawsuit that he hasn't started like he said he would!? He wouldn't text me or return phone calls unless you file with the State Bar of Wisconsin.. I got the impression from him he was always worrying about his reputation not for his clients...

Worst in the business. I understand he was a public pretender but come on. Wouldn’t answer the phone or make any contact at all. Just went along with the DA. The judge actually made the recommendation of what the sentence should be.

In a case as mine, this was probably the worst attorney I ever had. He was unprepared, forgetful, never enter a motion for discovery, a waste of money, and the list goes on. Needless to say, I was wrongfully convicted for a crime I didn't commit back in 2007 to 20 years in prison and 10 years of extended supervision. A case that was based primary on hearsay. I took me 13 years of fighting the court system back and forward and it wasn't until recently that the federal court remanded the case back to Circuit court for review in part because of ineffective assistance and newly discover evidence that he could had used if he took the time to enter a motion for discovery and familiarize with the case as any decent attorney would have done. The Circuit Court agree and vacated my conviction and the Court of Appeals reaffirmed it. I am now on bail and waiting the possibility of a retrial. I am glad that not all attorneys are the same, so make sure you do your homework, and stay away from Leonard Adent if you want a fair chance. I wish I could do a worst rating, but one start is the least they let me, he doesn't even deserve that.

After a year and a half of fighting this OWI case for me, he neglected to show up and thus a guilty plea was entered for me. It seems like at one point he might have been a great lawyer, but his time has gone. Stay away.

I have never seen the district attorney get showed up in court before untill now. DA offered to settle my case and then dismissed it after talking with my attorney. Sometimes slow to call back but he has a great knowledge of the law and got the job done. Good attorney with good reputation. The price was much better too.

They don’t review and information given and the judge in branch 3 traffic court said that “ if the officer shows up and has a calibration sheet saying it’s in spec. Then the ticket stands as it is.” I understand the ticket and would pay the fee, but it’s my wife’s first ticket in 24 years of driving. I just want to keep it off her record, if possible. The area she got the ticket off from 94 to industrial ave in Tomah is a bad section. But I would vote out this DA and put someone that cares about people just trying to pay bills to survive.

I watched the video of the DA totally disrespecting an officer, violating the law because of who she thinks she is and now making excuses. It is abhorrent to me that an officer of the court so blatantly holds herself above the law. I hope she is at least reported and reprimanded by ARDC and suspended from her duties without pay.

What a Criminal Defense Lawyer Can Do for You

A criminal defense lawyer provides legal representation to individuals or organizations accused of criminal conduct. If you're facing criminal charges, a defense lawyer will work to protect your rights, build a defense strategy, and ensure you receive a fair trial. Their primary goal is to reduce or dismiss charges, secure an acquittal, or negotiate a favorable plea deal.

Criminal defense lawyers have extensive knowledge of criminal law and court procedures. They investigate your case, identify weaknesses in the prosecution's evidence, and represent you in court, ensuring that you have the best possible defense.

When Should I Hire a Criminal Defense Lawyer?

It’s crucial to hire a criminal defense lawyer as soon as possible if you are facing any criminal charges. Some situations in which you should seek legal representation include:

  • Arrest or police questioning: If you've been arrested or are under investigation, hiring a lawyer early on can prevent self-incrimination and protect your rights during police questioning.
  • Felony charges: Crimes such as murder, assault, drug trafficking, or robbery carry severe penalties, including long prison sentences. A defense lawyer is essential in these cases.
  • Misdemeanor charges: Even for less serious offenses like DUI, theft, or simple assault, a lawyer can help reduce penalties, negotiate alternatives to jail, or get charges dismissed.
  • Plea negotiations: If you’re considering a plea bargain, a lawyer can evaluate the deal, advise you on its consequences, and negotiate for more favorable terms.
  • Probation or parole violations: If you’ve been accused of violating probation or parole, a lawyer can defend you against additional penalties or revocation.
  • Juvenile offenses: For minors charged with criminal acts, a criminal defense lawyer can protect their future by minimizing legal repercussions or keeping the case in juvenile court.

What Does a Criminal Defense Lawyer Do?

Criminal defense lawyers provide comprehensive legal services to protect their clients’ rights throughout the criminal justice process. Their duties include:

  • Case evaluation and investigation: Reviewing the evidence, interviewing witnesses, and investigating the facts to develop a strong defense strategy.
  • Legal advice: Advising you on your rights, the charges you’re facing, and potential defense strategies, including whether to take a plea deal or go to trial.
  • Negotiating plea bargains: Working with prosecutors to negotiate a plea deal that could reduce charges or minimize penalties.
  • Court representation: Representing you in all court hearings, including bail hearings, pretrial motions, trials, and sentencing hearings.
  • Filing motions: Filing motions to dismiss charges, suppress evidence, or reduce bail, depending on the specifics of your case.
  • Trial preparation and defense: Preparing a defense strategy and presenting arguments, evidence, and witnesses during trial to contest the prosecution's case.
  • Appeals: If you are convicted, a defense lawyer can appeal the conviction or sentence, arguing errors in the trial process or legal rulings.

How Are Criminal Defense Lawyers Paid?

Criminal defense lawyers generally charge clients in one of three ways, depending on the complexity of the case and the lawyer’s experience. Payment structures include:

  • Flat fee: For straightforward cases (e.g., minor misdemeanors), some lawyers charge a one-time flat fee that covers all aspects of the defense.
  • Hourly rate: For more complex or ongoing cases, lawyers may charge by the hour, with rates varying based on the lawyer’s experience and geographic location.
  • Retainer fee: In cases where extensive work is expected, the client may pay a retainer fee upfront. The lawyer then bills against that retainer for their work on the case.

The cost of criminal defense services can vary greatly, so it’s important to discuss fees during your initial consultation.

How Much Does a Criminal Defense Lawyer Cost?

The cost of hiring a criminal defense lawyer depends on several factors, including the severity of the charges, the complexity of the case, and the lawyer’s experience. General cost guidelines are:

  • Misdemeanor cases: For relatively minor offenses, such as a DUI or petty theft, a flat fee may range from $1,500 to $5,000.
  • Felony cases: More serious charges, such as assault or drug trafficking, can range from $10,000 to $100,000 or more, depending on the complexity and duration of the case.
  • Hourly rates: For cases billed by the hour, lawyers may charge anywhere from $150 to $500 or more per hour, depending on their expertise and the case's location.
  • Additional expenses: You may also be responsible for other costs, such as filing fees, expert witness fees, or the cost of private investigators.

Be sure to clarify the lawyer’s fee structure and any potential additional costs during your consultation.

Top Questions to Ask a Criminal Defense Lawyer

Before hiring a criminal defense lawyer, you’ll want to ensure that they’re a good fit for your case. Here are key questions to ask:

  1. What is your experience with cases like mine?
Make sure the lawyer has a strong track record with the specific type of criminal charges you’re facing, whether it’s DUI, drug offenses, or violent crimes.
  2. What is your fee structure?
Ask how the lawyer charges for their services and whether you’ll be responsible for any additional costs.
  3. What are the potential outcomes of my case?
A good lawyer should provide an honest assessment of your case and the likelihood of dismissal, a plea bargain, or conviction.
  4. How many cases have you taken to trial?
While many criminal cases settle with a plea deal, it’s important to hire a lawyer with courtroom experience in case your case goes to trial.
  5. Who will handle my case?
Ask if the lawyer will be personally involved or if other attorneys in the firm will handle most of the work.
  6. How do you communicate with your clients?
Be clear on how often and through what channels you can expect updates on your case.

How to Check the Credibility of a Criminal Defense Lawyer

To verify the credibility of a criminal defense lawyer, take the following steps:

  • Check their standing with the state bar: Confirm that the lawyer is licensed and in good standing with your state’s bar association. Look for any past disciplinary actions or complaints.
  • Read online reviews and testimonials: Platforms like Avvo, Martindale-Hubbell, or Google can provide insights from previous clients about the lawyer’s communication, professionalism, and case outcomes.
  • Ask for references: A reputable lawyer should have past clients or other professionals who can speak to their competence and work ethic.
  • Review their case history: Look at the lawyer’s website or professional profile to see their experience with criminal cases, including high-profile or complex cases.
  • Look for trial experience: If your case might go to trial, make sure the lawyer has a strong history of courtroom advocacy and success.

What Should I Prepare for My First Consultation?

To make the most of your first consultation with a criminal defense lawyer, bring the following:

  • Details of your case: Be prepared to provide a detailed account of the charges against you, including any documents related to your arrest, police reports, and court dates.
  • Criminal history: If you have any prior criminal convictions, inform your lawyer so they can understand how that may affect your current case.
  • List of witnesses or evidence: If there are any potential witnesses or evidence that may support your defense, share this information during the consultation.
  • Questions for the lawyer: Prepare questions about their experience, legal strategy, and fees to ensure you understand how they will handle your case.
  • Bail or release documents: If you’ve been released on bail, bring any paperwork related to your release conditions or restrictions.

By being well-prepared, you can help your lawyer quickly assess your situation and begin building an effective defense strategy.
