Contacted three highly regarded local attorneys for guidance around settling an estate with out-of-state assets and residency. One office didn't return my call. The second office cancelled our initial consult on learning of out-of-state assets. Merv personally contacted me back for details of the estate situation. He followed through with a thoughtful and professional (free) consult despite clear evidence I'd instead need to use an out-of-state attorney. He patiently answered numerous questions, put me at ease, and provided counsel that aided me immensely. When it is time to review or revise my own estate planning Merv will be the first person I call.

Mr Miller was so accommodating assisting me previously, I was confident he would be equally helpful . We discussed the pros and cons in layman’s terms. All my concerns were addressed to my satisfaction. His staff was genuinely helpful in all aspects, as well. This was all done following Corvid guidelines and his concern for safety. All Documents were signed digitally, and Notary physically visited my home to finalize. The new Trust documents were delivered FedEx to my home in a professional and organized binder. Can’t thank Mr Miller enough for his kind services and surely recommend for any Estate Planning.

My father, now deceased for close to a quarter of a century, was meticulous. He spent months looking for an estate lawyer he could trust. He settled on Merwyn a year or so before his passing. He did not have a large estate but he was particular about how he wanted it passed on especially how he wanted it set up for my mother who survived him by more than a decade. Merwyn was successful. It was only natural that my wife and I used Merwyn to establish our trust a decade or so ago. And just this year we had our family trust reviewed and updated to ensure our estate would pass to our direct descendants with as little as possible ending up in federal or state coffers. Neither my wife or I will be around to see how we succeeded, but I have faith, based on my experience with my parents estate, that we will meet our goals with Merwyn’s help.

I very seldom write reviews but I feel compelled to tell people what a great experience I had with Benjamin Fox at Hubert Fox Trust and Estate law attorney office in Elk Grove California. One look at their website and you will feel at ease before you even pick up the phone. Dealing with attorneys can be very scary, at least it was for me. After just a few minutes speaking with Ben about a Trustee issue, I felt confident he knew what he was talking about and he explained my options in a very straightforward way without making me feel like an idiot. Ben has a natural warmth and grace that made me feel confident and comfortable to have him represent my best interests and speak to a judge and jury on my behalf. Ben was attentive to my concerns, requested to look at the Trust in question ,immediately reviewed the material and gave his advice free of charge. He spoke with clarity and honesty and he left a positive impression that I will not soon forget. Thanks,Ben!

I was in need of a personal injury attorney, and came across attorney Michael Wak’s page…I am beyond glad I did! To begin, his assistant Susan is very pleasant and friendly. Attorney Waks is very direct and personable, and I appreciate him calling and checking in on me during the process. I am well pleased with my offer, and the experience I have had with this office. I pray I never have another accident, but if I do, I will 10/10 return and recommend him to anyone! Thank you !!!

A while back I was hit by a reckless driver on the freeway causing me to roll several times. The next day I had insurance companies calling me pressuring me into say how I felt. I didn't know what to say so I sought out representation. Over the course of my case, Mr. Maurer and his team handled everything from the smallest detail of the case to just "how are you today?" with the upmost care and attention. The entire process was stress free from the time they took over. I would receive updates consistently so I always knew the standings of the case. I hope I'm never in a situation where I need representation again but if I am he will be one of the first people I call.

We consulted Alena for assistance in our case unknowing if we really had one and if we could achieve justice for a very special person in our family. From the beginning Alena was compassionate, caring and very knowledgeable. We felt comfortable and at ease knowing our case was in her hands. She was very informative and she explained things to us that made sense, she let us know what was occurring and what will happen throughout the whole process. This case meant so much to our family, not for compensation but for justice for the man whom held our family together.. She was our saving grace from the very beginning. The outcome was more then we expected and we will forever be grateful for her. We can never explain how much this meant to us. Thank you Alena for your hard work and dedication, you fought for our family when not many would. We appreciated you then and now. Thank you again. Teresa & Family

Alena is smart, strong, fearless, resourceful, resilient and compassionate. She represented me and my wife when everyone else was too scared to take on such a big hospital in such a complicated malpractice case. Alena handled my criminal case and did so brilliantly. I was extremely overwhelmed having been arrested and having no idea what to do next. A good friend suggested I call Alena. He told me that Alena was aggressive in court and had an ability to communicate with the prosecutors in a way that would benefit resolution of my case. Boy, was that true. Alena showed up in court and all I needed to do was watch. She knew her way around the courtroom and the prosecutors. She was very friendly but assertive. She fought for me and explained everything to me clearly and willingly. After several appearances my case was resolved. I Was so relieved and so thankful!

I knew I needed to create an estate plan for many years but the thought of doing it was so daunting, I had put it off. I had several friends who had gone to Nicole and they spoke very highly of her so I made the appointment. Nicole and her team made the process of estate planning understandable, streamlined and painless. Her expertise and experience, coupled with her compassion and kindness, gave us 100% confidence we were in good hands. Had I known how easy she would make the process I would have done it years ago. They lifted a weight I had been carrying around unnecessarily for years. I have since referred all my friends to her office and encourage them there is no reason to put it off.

I searched for about two hours for a civil suit attorney in San Diego. There are many, and I spoke with three. Jennifer was outstanding, and I definitely found our new attorney. My wife and I have three small businesses, and run into issues sometimes. Jenifer was available to consult us within an hour of speaking with her team, called us on time, and spent 40 minutes with us over the phone... she never brought us fees or retainers the entire time. Jennifer gave us the info we were looking for, and we could tell she knew what she was talking about; confident in her answers while not being too confident. In no way would we look anywhere else.

I spoke to Ms. Brown and her paralegal, Carol, a couple of months ago regarding the conservatorship of my daughter, who is in a longterm care facility. I talked to Carol several times before speaking to Ms. Brown. Based upon my experience with a previous attorney, I was taken by the compassion, understanding and kindness that Carol showed me in those initial encounters. She offered me some ideas for handling a particularly difficult situation before setting up an appointment with Ms. Brown. When the need became more pressing, I finally talked to Christine, who took a practical approach to the predicament in which I found myself and in the end, saved me from a prolonged court fight and significant fees. I can't recommend this firm highly enough. In my experience, there aren't many attorneys who will take on conservatorship matters as they can be fraught with emotion and contentiousness. These women have kind hearts and that is rare in the legal profession, whether due to training or personality. I found in this firm that it is possible to have compassion and still be professional.

My mom set up a trust 20 years ago when she was a single mom with 3 kids and absolutely no time. When I sat down with her recently to review her estate plan, she was shocked to find the trust was not set up at all the way she thought she'd instructed the lawyers to do it. She wasn't even sure what law firm had originally set it up because there hadn't been any follow up from them in all that time. She also had only partially funded it and most of her assets were not in the trust's name. I was very happy to find Meier Law to help her restate the trust and get her full estate plan in order. They walked us through every step and helped her feel confident in the plan and how things would be set up to achieve her goals. They also provided detailed instructions on funding the trust and have a plan to check in every few years to see if any updates are needed. Meier Law is probably not the cheapest option out there, but an estate plan is worthless if it isn't actually set up and funded correctly. So personally I think their prices are a bargain for the level of support we're receiving and the peace of mind to have this all in capable hands.

He addresses both the legal and more affective aspects of the trust. He also stresses the importance of regularly revisiting the trust so it remains accurate & up to date. I researched a long time before I finally settled with Steven Oakley. He was very professional and had a great presentation and made us so comfortable from the beginning. We trust our estate planning with him and would recommend others to do the same. It takes 3 meetings to get your estate planning done. The first is a free initial meeting where he explains what he does and the pricing options. Then if you do decide to go with him then during the second meeting you provide all your information for your estate planning. You get a DPOA , an advance directive, beneficiaries if you or your spouse dies all set up and more. Then during the third meeting he hands you your estate planning folder with everything in it along with a CD copy and he goes through everything with you. You also receive an Emergency Medical Information Card you can keep in your wallet if ever you get hospitalized. He answered all our questions and everything that I wanted on my checklist for estate planning was marked off because of him. There is a yearly annual review that you must pay for but it is worth it because you need to keep your estate planning updated or else some things might become invalid. The price is on the higher end but you definitely pay what you get for and I wouldn't want to pay cheap when it comes to my family and estate planning. Like he said to us during his presentation, think of it as an investment into your future for you and your loved ones.

Unlike an other attorney that was appointed by the court (C.d.C), who is all about taking children from families. He is not that kind of person. He is all for reunification of families and making sure they get fair services offered to them if needed. He returned my calls very promptly, and i never had a hard time getting in touch with him. He has the coolest mustache too....

Hannah is AMAZING, she was very professional, and actually cared about our case as oppose to other attorneys that just look at you as a dollar sign! She was very patient, and answered all of our questions promptly, and understood the stress and how neurotic I am. If you want an attorney that will take care of your case as if we’re her own, make sure that you hire her! Thank you Hannah!!!

We couldn't ask for more in terms of service, advice, cost, and flexibility. We had a trust and other documents that were 14 years old. Of course, things had changed dramatically for our family, including grandchildren. And, we honestly didn't understand our dated documents. We found Hannah through Yelp. She was highly rated. And, her military service, education, and community service sealed the deal in terms of contacting her. We scheduled our free consultation and brought with us all of our documents. We spent well over an hour with Hannah where we discussed our concerns, asked a lot of questions, and received answers that we could actually understand. At the conclusion of the session, we felt very comfortable that Hannah was the right lawyer to help us update our documents. We learned about how the laws had changed and Hannah reviewed all of our documents and also advised us on which assets should be included in the trust. She provided us with several alternatives for achieving our goals. She then committed to a timeframe when the updated documents would be ready for review. We had several email exchanges during the course of her updating the documents. And, once she delivered draft documents to us, we changed our minds in several areas and we provided Hannah with our requested changes. We fully expected her to request additional monies and made that offer, but she declined to increase the bill. Once the final documents were completed, we met in her office with her notary and signed all of the documents. And, she was patient in answering a few more last minute questions/clarifications. Without hesitation, I would wholeheartedly recommend her to anyone needing legal services. She is personable, smart, patient, flexible, and reasonable. Why would you want to go to anyone else when Hannah can meet and exceed your expectations?

I was unexpectedly hit by a car from behind by a woman going 40 miles per hour and slid into two other SUV’s on I-5 resulting in a four car accident. My car being the only one to get totaled. I suffered horrendous neck and back problems within days of the accident and underwent three years of constant doctor’s appointments and pain. What was so upsetting was the fact that the insurance company hadn’t reviewed my file when it came time to offer me a resolution. I had new insurance adjusters assigned to my case constantly and they only cared about offering me the least amount of money possible. They didn’t care about my medical bills, pain or what I had been through. My car accident lawyer, Brian Ellis was very helpful throughout the process. I’m so thankful I had Brian Ellis and his wealth of knowledge and experience in dealing with my car insurance company. My insurance didn't want to pay for the coverage that I had paid to them for years just in case an accident would happen. Once the accident happened, it was upsetting to see how little my insurance company cared or wanted to help. I would highly recommend calling Brian to discuss your case if you’ve been in a car accident or suffered and injuries. I think it’s a big mistake to not have someone on your side and to try and handle a serisous matter yourself or with someone who may be unqualified. Brian Ellis is a qualified personal injury attorney in Temecula. It would be wise to call the firm to discuss your case if you’ve been hurt by the negligence of someone else. He listened to me, what happened and took my case on the contingency fee so I didn’t have to pay him anything until my case was resolved. Thank you Brian and The Ellis Helm firm for everything you’ve done.

Thank you Brian Ellis. You really helped me during a difficult time. I was in a car accident and got side swiped by another car. I was in the hospital for two weeks recovering from my injuries. My hospital bills were tremendous. Brian not only helped me sue the other car for hitting me, but he was able to get enough money for me to pay all my hospital bills as well as money for my pain and suffering. It didn't cost me anything to hire him. I would recommend calling Brian if you have been in a car accident.

Pam helped us complete a trust for my husband's mother and sort out a neglected set of small investments. The goal was to structure everything so that my mother-in-law could stay in her home but be eligible for Medicaid if and when she required a skilled nursing facility. My mother-in-law was house-bound and Pam was so helpful with coming to the house, explaining everything, and guiding her through the process. When my mother-in-law died, Pam's work really made it straightforward and all the disposition of assets went smoothly with no problems or probate. We liked Pam so much we had her do our estate plan soon after. She was very expert in her recommendations and made a process that can be a little traumatic, both easy and painless. We can now be sure that we will leave an estate that will not cause our beneficiaries undue trouble and will not cause our assets to be subject to unnecessary taxes or probate. Pam really knows what she is doing and the cost was reasonable as well.

When you feel the need to hire an attorney, there is a "sticker shock" for most of us when we find out the cost. However, for my case, Pamela did everything to keep her fees and the court cost to a minimum. And, she kept me informed from the beginning to end, letting me know the pros and cons (I almost feel she was to cautious). In her, I found no dishonestly in running up the cost, and yes the cost did run up, but this was because of a system that can be very frustrating, it wasn't on her! And, she warned me how the 'system" works and of potential problems that might arise there too. You have to make up your mind as to whether or not the cost is worth it, but I strongly feel that you will have an honest attorney who cares, and wants you to keep as much of your money as possible. Oh, and for what is worth, she is nice person.

Seriously, if you are dealing with complex business or estate problems and want to sleep at night, then you should see John Rank. Over the past two decades John has been there for our family and walked us through some of the most complex legal problems you can imagine. He carefully, thoughtfully, and skillfully put together our parents' estate, executing it efficiently upon their deaths. His analytical ability and knowledge of the law keeps us abreast of our own estate issues as the law changes, making necessary adjustments when needed. Most importantly, he takes the long approach, which is comforting. I couldn't give any professional higher praise.

Michael Molland represented me in preparation for trial in a consumer law case opposing a large corporation. He inherited a complicated case and was quick to understand the intricacies involved. From the beginning, he was able to accurately pinpoint areas of strength and weakness in my case. He intelligently used this to define multiple legal strategies and as a result opposing counsel had to rethink their success at trial. In preparation for trial, the combination of his knowledge, extensive legal background, and skill as a litigator was clearly evident. At all times I felt a confidence in his legal representation. He is an excellent attorney who I would highly recommend to clients with cases both small and large.

Michael Molland has represented Citizens Advocating for Roblar Rural Quality (CARRQ) for several years in our fight to prevent the development of a gravel mine in rural west Petaluma. As an all-volunteer neighborhood group, CARRQ took on the uphill battle against the project developer and the County of Sonoma to stop the project, but it was not until Michael stepped in to help us that we were able to achieve any success at all. Michael took our case because he believed in our cause and wanted to help us make a difference in our community. He helped us craft strategies to oppose the project and guided us through years of legal actions. He (and his team) devoted hundreds of hours to our case and skillfully and tenaciously represented us before public agencies and in court. Of most importance to me though, has been Michael’s integrity; his ability to listen and put clients at ease, and his passion for doing what is right. I will be forever grateful to him for his counsel and I highly recommend him.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?

  6. What documents should I bring to the consultation?

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
