Lance put me at ease about what I needed to do to bring my documents up to date for Florida purposes. He answered my questions and explained (more than once) the purposes of the documents that were necessary. He was so patient -- made preparation less stressful. And Chantel, his paralegal, was so helpful also. A great experience!

We hired Atty. McKinney to prepare a simple estate plan for my wife and myself, primarily wills for us both and the ancillary documents that typically are included in such a document set. We thought initially that the fee was a bit high, but in retrospect, we were well served by the thoroughness of what was included. We have no regrets.

Minerva Vazquez was invaluable in helping us get through a very difficult time. After my father passed away it was stressful and emotionally taxing. We had to grieve his loss, arrange funeral services, sort through all legal and financial matters related to his retirement, insurance and estate. Although my father was a dedicated, hard-working man he did not have a will or trust prepared. This created a level of anxiety and uneasiness for my mother and other members of the family. We were able to sort through all other financial matters except for the will and trust. It was important to my mom that a will and trust be created in case anything should happen to her. With my home being in North Carolina and my Mom’s in Miami, Minerva and staff went above and beyond to communicate and schedule a time to meet with us to finalize the will and trust. They were very responsive and thorough. Minerva walked us through the process and answered our questions no matter how trivial. Her experience and knowledge gave my mom and I a sense of peace and confidence that things were taken care of. We would not hesitate to refer others to this firm. We will continue to retain their services for years to come.

Marcella is one of the most caring, compassionate, honest attorneys I have ever dealt with. After having a horrible experience with a probate attorney 11 years ago, I met Marcella to complete my own will and legal documents. She was a breath of fresh air and made me realize just how dishonest the other attorney had been with my family at the time of my parents deaths. Thank God for honest attorneys like Marcella. I recommend her all the time and would never use anyone else for my estate planning.

I 'm from out of state residing temporarily in corporate apartments and was in need of a Power of Attorney. Thank goodness there was a neighborhood lawyer less than a mile away that provided the service that I needed, Mrs./Miss Marcella was that lawyer. She even answered by e-mail on Sunday afternoon concerning my POA.. The next day after work my POA was ready and my wife was very happy when she received the POA the next following day. Also a UPS Store was in the neighborhood. Now how convenient is that. Two birds with one stone. If you live around the Town Square Market at River city in Jacksonville you are very lucky to have this Lawyers service at your door step. By all means please stop in and give her a visit.

There are always two sides to every story, as indicated by the reviews and responses. I can only give you my perception and outcome from my dealings with Mrs. Taylor. First, I called to schedule an appointment with a "lawyer for people with limited income" and the fee was $295 per hour, now let me assure you I have never paid that amount of money in any of my appointments with Mrs. Taylor. Now, I'm sure someone will say, "you get what you pay for", in this case, I would say, "Board certified". In my opinion, Mrs. Taylor simplifies everything by telling you the bottom line. I would recommend Mrs. Taylor and if she isn't able to return your call right away, call again or better yet pay $300 or more per hour for the same law advice. In addition, I have in the past called for legal advice in which I will not mention names and I still have not heard back. In conclusion, Mrs. Taylor is, in my opinion, an honest and caring person with years of attorney experience. She is the first lawyer you should call if she can't help you she will tell you.

Not only did she help us set up all necessary documents every family should have ( living will, power of attorney etc.) but most importantly, she helped us navigate through the complex matrix of applying for Medicaid long term care for my husband. One of the most settling things I did with my parents was to sit with Mr. Walser and have him explain to all of us how to prepare my parent's estate. It put both my mother and father at complete ease knowing they had someone they could trust to call should they have any questions. My dad has since passed and everything went exactly as Mr. Walser told us it would with his estate. It isn't an easy task preparing for your parent's to leave you but it doesn't have to be filled with worry if you get good advice in advance. Thank you Tom, for all you have done over the last twelve years I have known you.

Mr. Glisson has very reasonable rates and does not nickle and dime for every little thing. My sisters and I hired Mr. Bunin to get a squatter out my father's residence so we could finish the probate and sell the home. Mr. Bunin did an amazing job for us. He always kept us informed, and was always honest with us even if it hurt. He promptly returned phone calls and responded to e-mails. His style was to get to the point quickly, and not waste time. Within just a few short months, we were able to get the matter resolved and got the squatter out of the house. We had to pay the squatter a little money in order to get him out, but we were okay with that because it would have cost us a lot more if we had to go to trial. I would definitely recommend Mr. Bunin for any legal matter.

Fernando was referred to me by a friend because she said he did a good job creating her trusts and I wanted a trust to protect our assets in case we got sued. He also helped us design a will that 'poured over' into our trust so if my husband and I were to die, my son would get what he was entitled to without any hassles or legal costs. Fernando is an expert in wills, trusts, and estates as well as Elder Law. It is all he does! He does not dabble in other areas of law like so many lawyers around town do. I'm very happy with Fernando's legal services and advice. I recommend him to all my friends and clients because he is great at what he does and his prices are very reasonable. Don't make the mistake of going to an online service or "jack of all trades" lawyer to save a few hundred bucks and risk losing your child's inheritance or your assets if you're sued . Go see Fernando, you won't be sorry.

I first met Jane in 2004. At that time she wrote a durable power of attorney that is as valuable today as it was the day she wrote it. When questions regarding the needs of someone who is incapacitated arise, people can become very tense and forget that their ultimate goal is the welfare of the incapacitated person. Jane has been able to help me and my family members to remember that we are all seeking the best interest of someone who needs special support. She responded very quickly. When I became a caregiver for my elderly parents, I didn't know there was such a thing as an eldercare attorney. After I began getting help from Ira Wiesner, I quickly learned how essential his knowledge and advice are. To begin with, he re-did our family documents done with a previous lawyer. Our Durable Power of Attorney went from several pages to twenty; it now covers everything we need. When it was time for my father to go to skilled nursing care, Mr. Wiesner reviewed the community's contract and other written materials so that we were able to sign with confidence. We are also reviewing our long-range financial planning with him. I am grateful every day to have such excellent advice. And it is truly a pleasure to speak with everyone in Ira Wiesner's office.

Ira Wiesner was recommended to me by several individuals I respect. I needed some practical advice and guidance regarding a very difficult and rather exploitive situation with my mother. I had no idea what my options were, given that my mother, now suffering from dementia, had signed contracts, prior to the dementia, which gave Carte Blanche to a facility which was not providing appropriate care to her. He listened carefully, made some initial suggestions, reviewed the situation and gave me sound advice for a first step. He realized my stress level needed to be reduced, so his advice was not only financially sound, but helped me to get some much needed respite. His knowledge regarding elderly people and the facilities that care for them was comprehensive and pragmatic. His previous experience as a lawyer-ombudsman makes him uniquely qualified to know the buzz words and excuses used by facilities that do not provide adequate care. We are now entering step two in managing my mother's situation and it is something I can handle, knowing that she will be protected. I was so pleased with Mr. Wiesner's ability, that I asked him to redo some legal documents for me. I have an excellent attorney in another city, and with the hours I care for my mother, I could not get back to that city easily to update my documents. This was managed at my convenience and I am most appreciative for that. I highly recommend this attorney for anyone with questions or problems regarding older individuals.

Ira Weisner as able to help my family in time of crisis due to major financial exploitation of an elderly relative. We laid out our case to him, he listened attentively (didn't interrupt to show how smart he was like so many lawyers--and believe me, he's smart). He honestly assessed our chances of not only bringing a case, but also of how to protect ourselves from further exploitation. See, Ira is not just an estate planner, but a national expert in elderly abuse, so he was likely the best person in Sarasota to talk to about this. As for our case, he told us that in one aspect our chances were slim (other lawyers would told us to press forward on the case just to collect bills later), in other aspects of our case, he really helped in telling us the steps forward to take. His good character was so apparent throughout this process, that my elderly family member who was exploited, decided to switch lawyers and trust their estate planning with him and now we all feel protected. I couldn't recommend Ira Weisner highly enough.

I had the pleasure of talking with Chris, and decided to go with them. They were helpful, kept me informed about all procedures and needing any new information from me. It turned out to be a longer process because of Covid-19 , mostly hurry up and wait for the courts. I then had issues with a relative that further delayed things, so I had a probate case for 4.5 years. Neil’s son Chris is excellent in the office, I enjoyed dealing with him by phone or email. After my father passed away unexpectedly in 2019, I immediately began the work of acting as his personal representative. Unfortunately, my father had no legal Will which led to a contested estate. The estate attorney I hired initially was not interested in handling litigation filed by another heir, and recommended David Garten for the job. Calling David Garten was the best decision I could have made. David Garten is an expert in Florida State Estate Law. He is a litigation attorney who handles contested estates and defends his clients with zeal. He exudes the calm confidence and total professionalism of an expert in his field. There are none of the blustering or hyperbolic statements that you will find with unqualified attorneys who are just trying to get your business. David will never leave you with a false sense of confidence on any issue. David’s credentials are impeccable, and he is a regular contributor to Florida State Bar Association publications. David’s staff is top notch and well organized, a sure sign of an excellent attorney. I also found David and his staff to be approachable and easy going, not stuffy or hard to communicate with as some attorney’s offices can be. David’s work on my father’s estate was exemplary. He successfully negotiated settlements and diffused or won the unnecessary litigation brought against the estate. At one point David parlayed a pre-trial deposition into a settlement that enabled me to continue my work to close the estate without interruption. This is one of many examples of David’s expert handling of my father’s estate. David is very cost conscious and employs other Estate Attorneys to handle the more routine aspects of estate administration. You can rest assured that you won’t be gouged. David’s calm approach to angry opposing counsel, random unnecessary litigation, and wary nerve-wracked clients, was incredibly reassuring as we worked through various issues. I would highly recommend David Garten to represent you if you are the executor or personal representative of a contested estate. In fact, I would say that if relatives are likely to litigate after the loss of a loved one, skip the standard Estate Attorneys and call David Garten for the representation that you really need.

I was living out-of-state when notified of my estranged husband's death. I needed to be advised and represented by an attorney who was familiar with Florida's state statutes for elective shares regarding the surviving spouse. My situation required a lot of special research. David made me feel comfortable and confident that everything was covered. He kept me appraised of the current status, even though there were time issues holding up our progress. Given the circumstances of my case, I felt David was attentive, personable and gave my case the required attention to detail needed. I was especially impressed with the follow up on David's part and his paralegal, Cheryl. At the conclusion of my case, they both made me feel like I would want to use there service again and/or would refer my family and friends to them. David and Cheryl, thank you again.

After being victimized by several other attorneys regarding Trusts, Elder Law and Guardianship I did extensive research prior to finding a West Palm Beach attorney with the expertise and experience of David M. Garten, Esq. He was very responsive regarding scheduling and thoroughly knowledgeable in his field of law. He was always sympathetic and concerned to act in my best interest. His fees were reasonable and there was never a suspicion that his time billed was inflated. Hiring Mr. Garten actually turned out to be an extremely excellent value when at our first meeting he suggested he would, and actually did notify my insurers who ended up carrying a significant portion of my case with Mr. Garten's supervision. I now know how fortunate I was to have been represented by such a caring, compassionate, and expert attorney. I would never hesitate to encourage anyone needing the type of legal services offered by Mr. Garten to meet with him. Although it was very unpleasant going thru a lawsuit, David Garten’s advocacy made the situation a lot more tolerable. I will remain forever grateful for his services.

Steve and everyone in is office are the best. When my wife and I first met with him at the initial consultation, he determined that he couldn't help us. However, he still took time to explain our options to us even though he wouldn't receive any benefit. When our situation changed, I went back to Steve for help. This time he said that he could help my wife apply for medicaid. We became clients of his and I'm glad we did. A couple of issues came up during the application process and Steve knew exactly what to do. He was very thorough and made sure everything was in order before submitting the application. When medicaid eligibility was denied, he knew that the reason given wasn't valid. Steve challenged the denial and they tried another reason for denial, but Steve knew that wasn't right either. Steve kept fighting for what he knew was right and after challenging three reasons for denial, Steve finally got my wife's application approved. Steve is an experienced Elder Law Attorney. He and everyone in his office are very patient and caring. I highly recommend them.

Mr Anderson is an excellent communicator who helped my wife and I through a difficult bankruptcy case. Our prior legal counsel was no match for an aggressive trustee attorney, but Mr Anderson rescued our retirement fund through careful, tireless dedication, working many hours to help us rebut the Trustee in court. His significant knowledge base and skill set in bankruptcy court helped dig us out of a deep dark hole. We will forever be thankful that we had Mr Anderson to help and represent us.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
