Dan listened and questioned to create a draft. He then allowed us to amplify and make alterations to the draft. Then he rechecked to results. We were able to gain all of the paperwork we needed at a nominal expense - yet he spent a great deal of time being sure that we were taken care of courtesly and correctly.

Linda Faingold is a joy to work with. She is incredibly knowledgeable about her topic and took the time to break everything down and make sure we understood. She will be doing another one for me in the next two years ;)

Emma Hemness did estate planning for me and set up a special needs trust for my son. I found her to be kind, compassionate, intelligent and professional. There is much to be considered when leaving behind a child (at whatever age) who can't take care of himself. I have been blessed to have this young man in my life. Ms. Hemness thought of everything. She helped me to create a trust including a special needs trust and put together a living will. She helped me to consider end of life choices and create a power of attorney. The power of attorney will allow a family member an easy transition to administer my estate and help my son at my passing. She did all this while insuring my son would not be deprived of the social safety net that is helping him now. I am more than grateful to her for making something very difficult like this possible. I rest easier knowing I have done the best I can to protect my son.

I am so grateful to Deeb Elder Law. My mother had always been a very independent (read stubborn) lady until COVID 19. She was so ill and was hospitalized several times, but amazingly recovered. Still it took so much away from her mental and physical capacity. It also required her to move to a long-term care facility. I live in another state (Michigan) and dealing with all my mother’s needs was a logistical and emotional nightmare. From the time I hired Deeb Elder Law, a huge weight started to lift off my shoulders. Dayna Kennedy has been a God-send. She is so calm and professional while still being caring and accessible. Dayna has helped me navigate all the pitfalls of getting my mother moved, dealing with the State of Florida for Medicaid, working with Social Security, and dealing with all the minutiae that taking over a loved-one’s care. I honestly don’t know what I would have done without the caring, helpful professionals at Deeb Elder Law. I’ve been treated like family.

I had to deal with an guardianship accounting issue dating back to 2005. I visited multiple lawyers prior to meeting Ms. Woods and found that they really didn't seem to have a full grasp of what needed to be done to properly file the guardianship accounting paperwork. Within ten minutes of our initial meeting, it was clear Ms. Woods knew the exact steps to take to get the paperwork in proper order. She was able to give my wife and I very specific instructions on the paperwork we would need, the paperwork she would need and the paperwork the court would need. She also asked us questions we didn't know to ask and that none of the other lawyers even brought up. With her guidance and the assistance of her associates Karen and Norma, we were able to get all of the paperwork put together in a couple of weeks (which is even more impressive when noting these were holiday weeks). The paperwork has now been properly filed with the court and we now know how and when to get this paperwork filed for future years. I cannot begin to stress how much peace of mind having someone who knows the process as well as Ms. Woods does can provide. I would highly recommend her for any family law matter.

Charlotte gave me a date everything would be ready and it was done professionally and on time. Charlotte took the time to explain exactly how the Trust works and explain all of the details contained within. My association didn't end when I paid and left. I have worked as an IT director for two major Law Firms for 30 years and I know the business well. Susan Rooth was initially hired by my parents to prepare the standard paperwork for estate planning. This was done with a high degree of competence at very fair rates. Approximately five years ago, it become clear that my parents, in their mid 80s, could no longer care for themselves. In a meeting with me and my wife to review some of the paperwork, Susan took a very active role and helping me find home care resources that fortunately we could afford, and stay involved up through today to see that they were well cared for. They have both since passed away, and Susan and her staff did an excellent job in assisting me with handling both estates, and she is still assisting today. It was a lot of work that would have been very difficult for me to do on my own. Her rates continue to be very fair and her staff is highly competent and responsive. Also, she is well known by many of the local banks and that made things go much smoother when needed. Although as stated, her Firm provides an excellent work product at reasonable rates, what I am most impressed with about Susan and what motivates me to write this review is the level of personal interest and compassion that she displays for her clients and the level of assistance and concern she has that goes far beyond the basic provision of legal services. It is truly exceptional, and I say this as someone who has been in the industry. Overall, for anyone with aging parents who needs these services, or in need of estate planning for the themselves, I offer this unqualified recommendation - you will not find anyone better, or more caring and helpful on a personal level.

After spending several years actively searching for answers, advice, and guidance for our family Estate planning, we met Teresa who was speaking at a seminar (for attorneys) on Estate Planning. We had been to a number of seminars and classes, met with countless professionals, in all the pertinent fields and had a good idea what we wanted but had found no one who could get us there. After listening to Teresa's presentation, we knew we had found the right person to handle our very complicated Estate Planning with multiple family owned businesses, four generations to consider, and real estate ownership in multiple states. We were not misstaken. Teresa and her team of experts have gained our trust and confidence through this journey. It seems that I have known David forever. I have retained him over a number of years from time to time and been very happy with the results that he was able to obtain for me. My first experience with him as an attorney many years ago was when my father retained him to pursue a fire damage claim to our family’s seashore summer house in New Jersey. In the offseason, workmen were renovating the interior of the house and, specifically, installing a new kitchen. After they had left for the weekend, a fire started in the house in the middle of the night and there was significant fire damage. David had the moxie to retain the retired Fire Marshall for the City of Philadelphia as an expert witness who confirmed David’s suspicion as to the cause and origin of the fire. Before they had left for the weekend, the workmen had decided to have a party in the living room to celebrate the end of the work week. Along with the empty beer cans, one of the workers inadvertently dropped a lit cigarette inside the living room couch to smolder for several hours resulting in the fire. In proving the origin and burn pattern of the fire, David was able to secure a sizable and unexpected settlement from the insurance carrier for the renovation company. The latest matter that David handled for me was the administration of the estate of my late mother who owned personal and real property in the States of New Jersey and Florida. His administration of the estate in those separate jurisdictions was seamless. His particular knowledge of New Jersey income tax procedure saved me tens of thousands of dollars that my accountant was prepared to have me hand over to the tax authorities in that State. Even when the Florida estate administration became complicated by the homeowners association action to foreclose on the Florida house for alleged non-payment of HOA fees, David was able to have that matter resolved and dismissed. He is quite a talent and I would highly recommend him to anyone.

I am a CPA in the suburban Philadelphia are, and have known David personally for over 50 years and professionally for more than 30 years. If I have a particularly complex estate or trust matter which may or has included fiduciary litigation, income, gift or estate taxation, and has litigation between beneficiaries, creditors or as against the Internal Revenue Service, I have David on my speed dial. Ultimately, these matters are referred to him, and our office has retained him on any number of related files. Not only a good friend by his deeds, I once had to explain to my father that the reason we were good friends was that he was and is fearless, no matter the adversary in and out of business. So it was no surprise to me when he took on the fifth largest law firm at the time in Philadelphia and beat them representing a contestant in a will contest over a several million dollar estate even though his adversaries had the advantage financially and with a far more extensive staff at their disposal. I would enthusiastically recommend him to any potential client.

I became a client of The Slonim Law Firm, Melbourne, after considering several firms. It was time to update my will and estate documents. My attorney was Paul Lemieux. He helped answer difficult questions pertaining to my individual situation. His was not a cookie cutter approach! I really did not have a clear idea of what to do going into our first meeting and it only took 2 meetings to complete the tasks. Paul answered all of my questions and I am genuinely proud of and satisfied with the result.

Our Asset Protection and Medicaid application started with an attorney in Leesburg, VA. The trusts they wrote and the strategies they used to protect the assets made our case unnecessarily complex almost to the point of failure. It later surfaced that they were not qualified to file a Medicaid application in the state of Florida. This attorney said we would have to find a qualified Florida attorney at our own expense. We learned what a bad attorney is. We chose Jason Penrod of Family Elder Law for the Medicaid application. Family Elder Law reviewed the trusts from our Leesburg attorney and explained clearly to us how the battery of trusts the Virginia attorney had created were inadequate and could jeopardize the process and require going through probate; something even a basic trust can avoid. Family Elder Law took control after seeing the substandard work from the Leesburg attorney and drafted a Qualified Income Trust (QIT) to replace a poorly written Living Trust and corrected other Trusts. Their revised Trusts contained the proper language required for the States of Florida, Maryland, and Virginia where the assets were located. We now know what a good attorney is. We also worked with the staff of Family Elder Law and they earned our trust and confidence with their in-depth knowledge, clearly stating the direction we would proceed, and why this was a better strategy than what the Virginia attorney had started. Everyone, including Jason, were willing to clearly answer our numerous questions. When we emailed or sent a text, they responded within minutes not days. They knew how the different Trusts were essential to achieving a successful outcome. They clearly guided us in the roles and responsibilities for managing these Trusts and how to avoid possible costly errors. Several years have passed since we placed our faith in Jason and my mother-in-law sadly has since passed. I can say that fulfilling her final wishes were positive.

I met Jason a few years ago when he helped my father with my elderly aunt's transition from Texas to a Florida ALF. Now several years later Jason and his associates have helped me navigate the uncharted waters with my mother and father and all of their needs. You never know how quickly life can change. My mother suffered an injury that rendered her unable to care for herself and my father. We were totally unprepared for everything that had to be taken care of in a short amount of time. Jason and his staff have been an invaluable help to me. Not only with the legal aspects but they were there for me emotionally. I had no idea where to start. Jason and his associates knew exactly what needed to be done and when. I was able to concentrate on my parents and not worry about the legal details. My father has since passed away which brought other changes to our situation. I am currently working with Samantha Carter. There are no words to express my gratitude for everything she has helped me with. She is always there to answer my questions. I never dreamed how complicated life can be. But just knowing that Jason and Samantha are there has taken a huge burden off my shoulders. I would recommend them without hesitation to anyone with elderly parents.

Amanda made a difficult time in my life much easier for me. Her amiable personality and intimate knowledge of elder law as well as the workings of the DCF made it a less stressful process getting my Mother approved for Medicaid. She is very easy to talk to and one feels immediately at ease with her. Her fee was much more reasonable than I had expected and she was able to make the whole process, from initial interview to final acceptance by Medicaid, smooth.

We went to her for estate planning and Eileen held our hand through it all. We had no idea where to start or even if we should do it. But you really have no idea how much there is to consider, even if everyone is healthy and you don't have "that much." There's stuff you don't even think about! She explained everything to us very clearly. We were very comfortable and happy that we did it. I've recommended her to some of my closest friends and I'm pushing them to now get their affairs in order. It really does make you sleep better at night. There's so much I didn't know, you really do need a pro to keep an eye on that part of your life for you. She's very sharp, personable, and easy to work with. She is an excellent communicator and we can't recommend her enough.

We moved to FL and needed an attorney. We attended an estate planning seminar given by Ms. Maastricht, checked out her credentials, and went for a consultation. We hired her to do our estate planning and couldn't be more pleased. She is even better than the attorneys we had up north. She listens; she advises; she responds appropriately. Great attorney -- and, like Farmers Insurance, we should know a thing or two about attorneys since we have seen quite a few.

I was referred to John Clarke after contacting five or six other lawyers that did not want to bother with my case; I got the impression that they didn't think it was worth it for them. When I first spoke with John, he actually listened! And then he asked me pertinent questions. Throughout our interactions, he called to keep me up to date and if I called him, he got back to me by end of business day. He made us feel as if our case was the most important one he had, which I know it wasn't. John is the ultimate professional and it would be hard to find anyone better, in so many ways. From diligence and responsiveness to patience and understanding, he has all the traits needed to guide you through any negotiations/agreements or trial. I highly recommend John Clarke to represent you!

Mr. Clarke is tough and smart! After my house was sold at a foreclosure auction, the bank sued me for a deficiency of $150K. He analyzed the case carefully and found that the servicer, which had acquired the loan from the original lender, hadn't filed the correct documents to prove standing. As a result the court dismissed the case. I only wish I had hired him before they took my house!

A friend recommended we speak to Mr. Clarke after my husband and I were injured in an accident. We weren't sure how to proceed. Mr. Clarke took 90 minutes to get all the details of our case, and clearly explain what remedies we could realistically seek. He also explained how are damages would be assessed, and the pros and cons of settling the case prior to suit. We were very impressed by his professionalism, knowledge and dedication to his clients.

I needed a special attorney to handle a complex case involving probate, guardianship, sale of realestate, income tax and asset management. I literally searched google, asked family and friends for an attorney that could take care of all these matters for me and all roads led to lee. It took 2 years to resolve each and every issue but at the end of it all ... I prayed and thanked God I found him. He will always be strait with you, work hard to resolve an issue. He is very reasonably priced which surprised me because I had dealt with attorneys half his ability and paid much more. My best advice to any one reading this review to do your self a favor and give him a call. You have nothing to lose but everything to gain.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
