Recently my aunt passed away leaving behind an estate that had property in two different states (WA and PA). At the time we felt overwhelmed not knowing where to start. Anna helped my family walk through the different tax considerations for each state, consulting with attorneys in PA to make sure all details were considered and covered. Every step of the way she made us feel like our concerns were being heard and was always available to answer our questions. My family not only appreciated Anna's knowledge and expertise, but also the patience and time she devoted to making sure we knew what was happening and that we understood all of our options. We feel so fortunate to have had Anna advising us during a difficult time for our family.

OK, this was a great experience. My wife just had twins! That made me think I should have some plans in place. A colleague at work referred me to Anna Cashman for financial, estate, and 'future' planning. She walked the 'four' of us through the process, which Anna made very simple, straightforward, and easy. It showed us how knowledgeable she was. Boy do I feel great having a plan for my new family. Thank you Anna, keep up the GREAT work!

We want to express our deepest gratitude to Courtney Bhatt for her recent work on a complex special education issue in a rural school district in the greater Seattle area. Our gentle, autistic child was in a miserable kindergarten situation in which she was repeatedly intimidated, humiliated and punished for autistic behaviors (including an inability to express herself verbally) by untrained staff assistants and a classroom teacher who inexplicably refused to fully incorporate the advice of autism experts. All polite attempts we made to address these issues ourselves failed. Add to this scenario a principal with a history of secretive behavior and a district special education director who routinely bullies and intimidates staff, students and parents. It was an absolute mess and our young child suffered greatly—physically, mentally, and emotionally. Moreover, the district placed our child and her disabled peers in a moldy classroom which sickened our child (as well as other children and staff) and then steadfastly refused to address the issue in a timely or thorough manner. The good news is that all this changed when Courtney entered the equation. Courtney has polite, soft-spoken mannerisms but is firm and very authoritative. She sorted through the multiple violations of special education law and obtained a formal mold testing. This testing confirmed the existence of black mold and above average levels of several other types of mold in a few classrooms, including our daughter’s. Courtney skillfully navigated the unprofessional and unethical behaviors of two district administrators and certain school staff. She quickly negotiated a new school placement for our daughter with a compassionate teacher who understands autism. Additionally, Courtney was instrumental in crafting a new IEP with goals and accommodations which made sense for our daughter. Moreover, Courtney always actively listened to our many concerns regarding the matter. She always made time for us. Courtney is clearly a brilliant attorney who knows the law. Her responses to emails and phone calls were lightning-fast and she treated us with the utmost respect and regard. Thanks to Courtney's intervention, our daughter's natural joy has returned and she finished her school year in an autism-friendly school with clean air! Our child is looking forward to returning to that same school in the fall. Courtney's work was so much more than just "legal help." Her advocacy on our daughter's behalf had a profound impact on a disabled child's QUALITY OF LIFE. We do not say this lightly. Special education lawyers advocate for so much more than just a good school setting or a decent IEP, they are advocating for the quality of life of some of the most vulnerable, innocent children in society who cannot speak for themselves. We are forever grateful to Courtney for her strong moral compass and her skilled, compassionate advocacy on our daughter's behalf. It made all the difference in the life of one small child. Thank you, Courtney.

Ms. Bhatt was a life saver for my child and my family. I needed to transfer my child out of a particular school that was bullying my baby and the entire family. It took one meeting with Ms. Bhatt and I knew I was in good hands with her. At the one (and only one) meeting with the school, She is calm, firm and got the job done. Thank you Ms. Bhatt. We couldn’t have done it without you.

Courtney is simply a great lawyer. She believed in us, she believed in our case. I had never been involved in a lawsuit before. She made me feel protected and that I had someone fighting for me. She built a strong case and defended our interests at every turn. She was available and patient. When its time to be strong she is a appropriately aggressive. Courtney was EVERYTHING that we needed EVERY step of the way. She made the scary not so scary and did exactly what she set out to do. I cannot recommend anyone more highly than I do her. I wish I had the words to describe how wonderful of a job she did for us. Amazing is thrown around a lot but that's exactly what she is.

Being a Home Owners Association ( HOA ) with a volunteer board, we were in need of professional guidance to secure the sale of a tract of land that the HOA owned. The sale required very thorough investigation as to the process, the local regulations, and the CCR's of the HOA. Mr. Hamell and his team guided us through every step to secure the transaction and communicated with us on a level that we could understand. They were the mediators for us in dealing with the developer and it was actually, dare we say, an enjoyable experience. Our HOA highly endorses Mr. Hamell and we intend on using his firm in the near future for other projects that we are undertaking.

Chris handled our unusual family law case with intelligence, needed flexibility, and legal expertise (which is not to be assumed for any lawyer). He showed real skill at legal argument, in briefs and on his feet in court. He also demonstrated the judgment regarding larger, non-legal issues to warrant our trust in his choices and recommendations for overall approach. I am convinced that if our case had not been reassigned to the worst, most lawless judge in King County Superior Court, we would have had a satisfactory solution. Fortunately, on appeal, the issues were well preserved so that success appears likely at the higher court, (a court of law), and we have Chris to thank for that.

Mischelle evaluated a professional employment contract for me. She is a superb lawyer, because she balances humanistic care and concern for my long-term best interests, with a keen analytical mind that identifies potential problems rapidly. She has real-world solutions and suggested changes to contract language that all parties to the contract agreed would be fair, reasonable and an improvement over the original proposed document. I quickly learned to trust Mischelle with my legal questions, feeling that I am consistently receiving the best possible legal representation. To objectively rate Mischelle as a "superb" attorney is an understatement.

My concerns dealing with a municipality were in the development and annexation lines. My points of concern were dealt with in a precision like manner. The legal and practical aspects were addressed from a municipal and a developers view. Having this information allowed me the opportunity to make my decisions based not only on economics, but time and "frustration" factors. Mischelle R. I have been fortunate to have Mischelle provide to me legal advice and services for over 10 years. I have found her knowledge and legal expertise to be unsurpassed. She is extremely proficient in many legal areas and is able to combine that legal knowledge with great "street smarts" and business savvy successfully accomplish the matters that she was asked to work on. From simple business issues to representing me in the State Supreme Court I felt I could have no finer attorney or individual looking out for my best interest. She has the ability to be tenacious when required to accomplish her objective but also possesses the negotiating skills and intuition to settle issues with minimal legal expenses, an invaluable combination. I would strongly recommend Michelle for any legal challenge you may face and feel privileged to have representing my interests.

I made the best decision when I chose Catherine Fleming of Fleming Law to represent me in my lawsuit against the city of Seattle. I had a bicycle crash on a poorly marked Seattle street which left me semi-paralyzed and permanently in a wheelchair. Catherine is a personal injury attorney but has a special interest in representing injured cyclists, pedestrians or vehicle drivers who sue municipalities for negligent road design. My case was a complicated one due to a preexisting condition, but Catherine had built a strong case, and the city did not want to risk going to trial. They proposed settling out of court, and during her skillful mediation, I was granted a 7-figure settlement, an amount which far exceeded my expectations and for which I am forever grateful to Catherine. This can only be attributed to her in-depth preparation, knowledge of the law, and prior experience with cases against the city of Seattle. I found Catherine because of another attorney’s high praise. He is a prominent Seattle attorney, and even though he specializes in bicycle accidents, he said he doesn’t like taking cases like mine, against the city of Seattle, as they were high risk and hard to win. He said there’s only one attorney that he knew of who has won these types of cases, and that’s Catherine Fleming. It was this referral by another highly reputable attorney and my initial conversation with Catherine that led me to retaining her for my case. She absolutely proved to be the right choice. Catherine is a hardworking perfectionist who skillfully builds a case with tenacity, thoroughness, and an unwavering commitment to fight for her clients. If you have been injured, either cycling, walking, or driving, and think it may be the result of poor signage or road design (or any other reason), consult with Catherine Fleming at Fleming Law. She is one of a few who has the expertise to take on these cases and has earned respect for her many wins. She has earned mine, and I am most grateful that this large settlement amount brings us a newfound financial freedom and peace of mind for whatever our future holds.

We are so glad we found Catherine Fleming and Fleming Law! After my wife’s bicycle crash in Seattle and subsequent spinal surgery, we faced an uncertain future. Before, she had been a strong cyclist and active hiker, but now was confined to a wheelchair with incomplete paraplegia. Not only did we experience the loss of the many activities we had once shared, we now faced looming medical expenses, and the possibility of needing long-term care in the future. We believed that the area where my wife crashed was confusing and dangerous for bicyclists, but were unsure if we had any hope of recovering anything for damages. Catherine agreed to take us on as clients and worked tirelessly to build our case against the city. She amassed evidence that the street design at the site of the accident was unsafe, and furthermore that the city had been aware of this fact. As the case progressed, it became clear that we had chosen the right attorney for the job. She demonstrated a thorough understanding of the issues and the law surrounding bicycles and traffic safety. It was also evident that she also commanded the respect of her counterparts in the City Attorney’s Office. After Catherine guided us through a successful mediation, we were delighted with the settlement. While no amount of money can replace my wife’s mobility, we now face the future with less anxiety. -- Bobby Ball

I recently had the privilege of working with Rickert Mediation & Arbitration, PLLC, and the experience was nothing short of transformative. From the outset, their balanced approach to mediation was evident. It's rare to find a mediator who not only deeply understands the complexities of legal disputes but also genuinely cares about the emotional and personal wellbeing of all parties involved. Mr. Rickert, with a combination of professionalism and compassion, navigated through our challenging situation. His insightful guidance and impartiality fostered a space where both sides could be heard and understood, leading to a resolution that respected everyone's needs and concerns. What truly set Rickert Mediation & Arbitration, PLLC apart was their ability to make a real difference in our lives. It's not just about reaching an agreement; it's about finding a path forward that allows for healing and growth. Their work has positively impacted my life and, most importantly, the life of my son. I am deeply grateful for their services and cannot recommend them highly enough. Thank you, Rickert Mediation & Arbitration, PLLC, for your dedication and impact. Your work truly matters. Alan stepped in when my case was obviously taking a nose dive due to my other attorney's incompetence. Alan prepared to cross a very important witness, and very impressively destroyed her by catching her on clear lies, double standards, and clearly discriminatory behavior. He was impressive thinking fast on his feet, and bringing his questioning get to clear points. He is spectacular in court!

I was incredibly nervous about hiring an attorney, and certainly I didn't think anyone would understand what I was experiencing. Michael Wampold's confidence and compassion were the perfect mix for me. Michael knows what he's doing. He, and his partner in the process, asked me the right questions, which not only helped them understand my case, but also helped me feel better about the whole process. Michael was very personable and respectful, and when we got to the courtroom, I realized he wasn't simply an attorney, he was my advocate who made sure my rights were protected in every way..

I worked with Howard extensively on a variety of matters for Suncadia, some of which were highly complex negotiations with adjacent property owners over access rights issues across the property. In the midst of significant legal uncertainties and negotiations with emotional and unsophisticated neighboring property owners, Howard was always a combination of solid technical expertise, excellent counsel on negotiation strategy and a calming and trustworthy presence in face to face meetings. He is also a pleasure to work with. I highly recommend Howard as a man of intelligence, character and good nature.

Johanna is my go-to estate planning attorney in Washington State. My own estate planning practice is based in Bay Area, but I often have clients or colleagues ask me for referrals to a trustworthy and personable attorney in Seattle. I always refer them to Johanna, because of her hardworking reputation and professionalism. I have also witnessed first-hand her patience and attention to detail in walking her clients through the estate planning process. Simply put, in an area of law that can be difficult to navigate, Johanna is someone I trust. My staff and I happily refer clients and colleagues to her.

Johanna Coolbaugh was proactive, thorough, and knowledgeable. She took the time to understand our personal situation and needs, thus making sure that our estate plan was comprehensive and appropriate for our family. Estate planning was something my husband and I had discussed for a long time, but were overwhelmed with the options and legal speak. Johanna put us at ease and made sure our plan was comprehensive--she ask questions that we hadn't even thought of. Additionally, Johanna was super responsive, whether it was via email or phone. No question was a dumb question, she answered all of our questions quickly and in language that we understood. We would definitely recommend Johanna to friends an family.

In the last few years, Johanna has taken on the lion's share of the work at their end on these clients and I find she is completely on-board with all the family dynamics, issues and able to devote the right about of time to managing all the details which can make or break relationships like these. I look forward to having my CPA firm work with Johanna on mutual clients in the future.

I am a lawyer in Pennsylvania and I just completed a Products Liability case in Pennsylvania involving the alleged failure of a defective bicycle part manufactured in another country. I had a jurisdictional problem whereby personal jurisdiction over the foreign manufacturer was at issue in Pennsylvania. Because the Statute of Limitations, (or time within which suit had to be filed) was expiring, I needed to file a protective action in Federal Court in Washington State at the last minute since the foreign defendant clearly did business in Washington State. Through the trial lawyer list serve on the internet I contacted Phil Arnold who practices Seattle and throughout Washington State. Phil immediately responded to me and immediately took time out of his busy schedule to act as local counsel and get the suit filed in Fed Ct and then convince the Court to have the the case stayed in Fed Ct in Washington while my case proceeded in Pennsylvania. Because of Phil Arnold's responsiveness and legal skills, in filing this protective action in Washington at the last minute, I was able to obtain a favorable resolution of my case in Pa. Phil did not have to help me, but he never hesitated a bit. That is why I am proud to be a trial lawyer and member of the American Association of Justice in which Phil is also a member. We help each other all around the United States. Our common bond is the plight of the victims we represent. And I am honored to recommend Phil Arnold and his firm to anyone in the United States of America who has a personal injury case in Washington State.

Mr. Arnold has a great understanding and so knowledgeable on Personal Injury and Maritime Law & Safety at Sea. Mr. Connor represented my son, who has a disability, in a lawsuit against his employer. Steve was recommended to us by another attorney. Steve, his partners, and his staff provided excellent service and advice throughout the legal process and secured a favorable settlement of our claims. Steve's strong advocacy for my son gave us the strength and commitment to pursue the lawsuit. The discovery phase of a lawsuit, where information is provided by the plaintiff and defendant, can be long and demanding. Steve, his partner Anne-Marie Sargent and their staff helped us to provide strong information and witnesses to support our case. They were always readily accessible, listened carefully to our questions or concerns, and kept us informed of every step throughout the case. My son and I were very comfortable with Steve and Anne-Marie personally and trusted their expertise. When it came to settlement negotiations, Steve fought hard for us and was able to use the strong case he had developed to secure a very favorable settlement. I highly recommend Steve Connor if you need an attorney's help with any employment or labor issues. He's the best!

Steve Connor recently defended my business partner and me against a breech of fiduciary duty suit that dragged on for two-plus years. Throughout the entire experience Mr. Connor never lost interest and always approached our defense with energy, frankness, and support for the two of us. Steve explained every step that he took and why he was taking it. We ended up going to trial where Steve really showed us what he was made of. We did ultimately prevail in court which was extremely gratifying. Anyone seeking legal representation could do no better than to choose Steve Connor as their advocate.

I hired Stephen Connor to represent me in a disability lawsuit against a Labor Union and an employer. The first thing that impressed me about Steve was before he agreed to represent me he asked me what my expectations were and told me what to expect through this process. 1. That the process would probably take up to two years. 2. That I most likely would not become rich and be able to retire if we won my case. 3. That if we won I would probably receive some lost wages and benefits and get my job back. That was more than I was expecting so if it worked out that way it would be a bonus. From the beginning Steve and his partner Anne-Marie saved my case when I ignored his advice and made some decisions on my own without consulting him. Steve was able to guide my case through the EEOC process and file the request for a lawsuit. Steve was very good at explaining what was going to happen and how long it would be for a response from the defendants. throughout this process Steve, his legal team and I spent more and more time communicating. When Steve was unavailable in court or on another case I was able to contact his partner or associates and he would get back to me right away. I had learned the hard way at the beginning of this process to listen to Steve's advice and trust his experience and it paid off very well in the end. A few times when I felt like giving up after multiple delays Steve would tell me to be patient and stick to our plan. That we were doing well, that the defendants were counting on wearing me down and trying to frustrate me and convince me to give up. Steve was a tough negotiator and very thorough and effective through disclosures and depositions. He advised me several times that we were not ready to compromise yet, that we had more work to do and we were still making progress. At this point we had a few tense showdowns with the defendants and in the end the agreed to settle my case. There is one more example I want to share of Stephen Connors professionalism and integrity. The fee agreement between Steve and myself had some specific language which because of the way it was written enabled me to avoid paying several thousands of dollars worth of fees on a technicality. I had no idea this was the case until Steve pointed it out to me. I told Steve that I appreciated his honesty and that I would be happy to pay the extra fee. Without his help I would have ended up with nothing. Professionalism, integrity, expertise, experience and tenacity from Steven Connor, Anne-Marie Sargent and their associates are what enabled me to settle my lawsuit in a very satisfactory manner and to return to my job after more than three years. Without the help of Steven Connor and the firm of Connor and Sargent I would have ended up with nothing and my future and that of my family would have been changed forever.

I hired Russell in the Fall of 2013 to represent me in a multi million dollar securities fraud lawsuit. The lawsuit came to an end in the Fall of 2015 after a three week trial by jury in which we prevailed on all counts. I cannot say enough good things about Russell Knight! He is very through and organized. He took well over 5000 pages of documents and testimony, wove it into a story that the jury could understand and lead them day by day to the final outcome. Russell is as steady as they come. Do not let his boyish face and soft demeanor fool you. I guarantee that he will not let anyone take advantage of him or the situation. Most importantly, the jury really liked Russell. After the verdict, both sides sat down with a couple of the jurors to get their feedback. They stated that Russell had presented a full, concise, believable story, which they appreciated. If you have a large case, which this was, and need an attorney that will spend whatever time is necessary and keep you informed every step of the way, you cannot do better than Russell Knight. Obviously, I highly recommend Russell and the entire Smith Alling firm!

I worked with another partner at the Lasher firm who introduced me to Mario Bianchi, who ended up representing my family on a very complex transaction. We were sued by an aggressive lawyer/investor who hired a strong litigation firm and lawyer who I was told was a legend in this field... well he was no match for Mr. Bianchi. Mario was calm, "right on" the legal aspects, and focused only on what we needed to focus on to carry the day with the Court and the Judge. Litigation is an extremely frustrating endeavor and it tests all your stamina financially and emotionally. Make sure the litigation firm you hire not only knows the high-stakes game you need to expertly play but is ethical and won't take you on a wild goose chase to waste time and precious resources. Wouldn't hesitate for a second to recommend the Lasher firm and their star litigator Mr. Bianchi.

My family and I recently worked with Mario. We were impressed with his representation in our case against my ex-business partner, who is also my brother. I often make a point to recognize extraordinary talent when I come across it. Mario is an extraordinary talent. Through most of my life, I’ve managed to dodge a great deal of conflicts by either walking away or by bullying my way through my adversaries, using any means available, fair or not. A few years ago, my father passed away. At this time, I decided to make some drastic changes in my life. I decided to be more thoughtful in the ways I treat others and try to lead by example. It’s ironic that while I have made a 180-degree turnaround in my life, I also encountered the greatest betrayal of my life, both personally and professionally. This was unchartered territory for me; in the past, I was often the one doing the perpetrating and not the one being taken advantage of. To make matters worse, I was conned by my brother. I was, therefore, susceptible to one low blow after another. I was dejected and hopeless until coming to the realization that a previous experience in life could help me through these trying times. Indeed, it did. A few years ago, I saw Mario in action when he represented as co-counsel one of my business partners. I was impressed with his work, especially his attention to detail. Mario has an ability to see a case from all angles, like Gary Peyton on the basketball court. If was going to fight the injustice levied against me, I would have to hire the best man for the job: Mario. I considered this case against my brother to be one of the most challenging times in my life. And consider this: I have survived a heart attack and braved the big seas as child boat refugee fleeing communist Vietnam on my way to freedom in the United States. Hell yes, Mario was the right man to hire. Please excuse my language but this is how my family and I feel about the guy. I needed to win the case against my brother; he had already taken so much from me and my family. Thankfully, we did win the case. To quote the late rapper Biggie Smalls: “I don’t have to worry about that, my attorney handled that!” I told Mario I would write him a glowing review, even though he did not ask for one. So here it is. It is fitting my 10-year-old son calls Mario “Super Mario.” If you are dealing with any of life’s legal obstacles that are too important to lose, call Mario. Having he and his team in your corner will give you the best fighting chance. He is worth every penny and then some!

I am writing this review from the perspective of a client who has a case which has yet to be resolved. Therefore, my review of Mr. Corbett's work on my behalf is not influenced by a favorable or unfavorable outcome. Integrity and brilliance best describe David Corbett. He has the unique ability to know what the response will be from his opponent, prior to formulating an argument. This allows Mr. Corbett the ability to know if his argument will be strong or weak. Mr. Corbett researches the applicable laws and previous rulings on similar cases so thoroughly that he is able to clearly articulate how the law applies to the case at hand. Not all judges and lawyers will research the applicable laws thoroughly. For this reason, Mr. Corbett is able to articulate effectively on behalf of his clients. He has constantly kept me informed about his research, and his work on my behalf. I have seen how his work developed because he shared his thoughts with me as he worked on my case. He has restored my faith in the law, and in justice, regardless of the outcome of my particular case. If there is justice in the modern court system, he will find it. On the subject of integrity, I have actually seen him with a stop watch in his hand so that he is only billing a client for time that is used on their behalf. I have never known any attorney to be so conscientious. I consider the work Mr. Corbett has done on my behalf to be one of the best investments I have ever made. I trust him completely, and I highly recommend him.

Chris is a guy you want in your corner. Calm, knowledgeable and professional. Chris and the team at DUI Heroes kept me informed through a long process and always gave it to me on the level. Chris doggedly pursued a favorable outcome over a period of almost three years. I am the type to plan for the worst and hope for the best and frankly, Chris was able to reach an agreement better than I could have ever hoped for. From my family to yours, I thank you so much and wish you the very best.

I hired DUI Heroes after a truly bizarre case where Lynnwood PD arrested me after I called 911 for assistance. After being followed into the parking lot of my destination and blocked in by another driver with an apparent case of road rage, the police chose to harass me instead of offer any type of assistance. Without reason, they asked me to provide a BAT and I refused since it was unjustified. I was unfortunately unaware of the WA implied consent law and the kangaroo court system that our DOL operates. The whole firm was very professional and made sure that I was kept informed throughout the process, which lasted about four months and resulted in the criminal charges being completely dismissed. I really liked how each attorney in this firm worked on my case, providing me with the benefits of all of their collective strengths vs just having one attorney. Chris was my primary point of contact and let me know up front that full dismissals are rare, so while I was hoping for my charges to be dismissed I was not expecting it. I appreciate that he was calm, kind, and very straight with me throughout the process. He definitely made my day (year!) when he called me the evening before my hearing to let me know the Prosecutor had dismissed my case. I believe it was beneficial to have local representation from Snohomish/Lynnwood since that is where my case was (rather than a firm from Seattle or Bellevue) because the attorneys and judges see each other every week and are more familiar. I unfortunately still had my license suspended for one year, but compared to what could have been I'm relieved and happy with the result. Thank you Chris, Jonathan, Rachel, Kaia!

What a Litigation Lawyer Can Do for You

A litigation lawyer specializes in representing individuals, businesses, or organizations involved in legal disputes. Whether you're the one filing a lawsuit or you're being sued, a litigation attorney will advocate on your behalf throughout the entire legal process. Their goal is to resolve disputes, either through negotiation, settlement, or trial. Litigation lawyers can help with a wide range of disputes, including contract disagreements, real estate issues, employment disputes, personal injury claims, and more.

Litigation lawyers provide strategic legal advice and manage all aspects of your case, from filing motions to representing you in court, ensuring that your rights are protected and that you have the best chance of achieving a favorable outcome.

When Should I Hire a Litigation Lawyer?

You should consider hiring a litigation lawyer if you're involved in a legal dispute that you cannot resolve on your own. Common situations include:

  • Breach of contract disputes: If a party to a contract fails to fulfill their obligations, a litigation lawyer can help you seek damages or enforce the agreement.
  • Business disputes: Litigation lawyers can represent you in cases of partnership disagreements, intellectual property disputes, or business fraud.
  • Employment disputes: If you're facing issues like wrongful termination, workplace discrimination, or wage disputes, a litigation lawyer can help resolve these matters through negotiation or court action.
  • Personal injury claims: If you've been injured due to someone else's negligence and are seeking compensation, a litigation attorney can help you pursue your case.
  • Real estate or property disputes: When there are conflicts over property ownership, boundary issues, or lease agreements, a litigation lawyer can assist in resolving the dispute.

Hiring a lawyer early in the process is beneficial, especially if a lawsuit seems imminent or you have already been served with legal documents.

What Does a Litigation Lawyer Do?

A litigation lawyer handles all aspects of your case, from the initial investigation to the trial and even the appeals process, if necessary. Their role includes:

  • Case assessment and investigation: Analyzing the facts of your case and advising whether it’s worth pursuing or defending.
  • Pleadings and motions: Drafting and filing documents to initiate or respond to a lawsuit, including complaints, motions to dismiss, and answers.
  • Discovery: Gathering evidence, including depositions, interrogatories, and document requests, to build your case.
  • Negotiations and settlement discussions: Attempting to resolve disputes through mediation, arbitration, or settlement talks before going to trial.
  • Trial representation: Presenting your case in court, examining witnesses, introducing evidence, and making legal arguments before a judge or jury.
  • Appeals: If necessary, filing appeals to challenge or defend the outcome of the trial.

Litigation lawyers are also skilled negotiators and often work to resolve disputes outside of court to save time, money, and stress for their clients.

How Are Litigation Lawyers Paid?

Litigation lawyers typically use a variety of fee structures depending on the type of case, the complexity of the legal matter, and the financial circumstances of the client. Common payment arrangements include:

  • Hourly rates: Many litigation attorneys charge by the hour, with rates varying based on experience and geographic location.
  • Flat fees: For specific, predictable legal tasks (such as filing a motion), lawyers may offer a flat fee.
  • Contingency fees: In personal injury or other cases where you seek damages, a lawyer may work on a contingency basis, taking a percentage of the settlement or award if you win.
  • Retainer: Some clients pay a retainer fee upfront to secure ongoing legal services. The lawyer then bills against this retainer as work is done.

The exact structure should be discussed in the initial consultation to ensure you understand how and when you'll be charged.

How Much Does a Litigation Lawyer Cost?

The cost of a litigation lawyer varies significantly depending on the nature of the dispute and the lawyer’s experience. Factors affecting the cost include:

  • The complexity of the case: More complex litigation involving extensive discovery, expert witnesses, or multi-party suits typically costs more.
  • Time spent: Litigation cases can be time-consuming, especially if they go to trial. The longer the case, the higher the legal fees.
  • Type of fee arrangement: Hourly rates can range from $200 to over $1,000 per hour, depending on the lawyer’s reputation and location. Contingency fees generally range from 25% to 40% of the settlement or award.
  • Stage of litigation: Cases that settle early in the process are often less expensive than those that proceed to trial or appeal.

It’s crucial to ask about cost estimates during your initial consultation to avoid surprises.

Top Questions to Ask a Litigation Lawyer

Before hiring a litigation lawyer, it's essential to ask key questions to ensure you're choosing the right representation:

  1. What is your experience with cases like mine?
Ensure that the lawyer has experience handling your specific type of dispute, whether it's a contract issue, personal injury, or business matter.
  2. What are the potential outcomes of my case?
Ask for an honest assessment of your case's strengths, weaknesses, and the likelihood of success.
  3. What is your fee structure?
Clarify how you'll be charged, whether by the hour, a flat fee, or on a contingency basis.
  4. How long do you expect my case to take?
While it's hard to predict, an experienced lawyer can give you a rough estimate based on similar cases.
  5. How often do you settle cases versus going to trial?
Some lawyers are more inclined to settle, while others may be more experienced in the courtroom. It’s important to understand their strategy.
  6. What is your approach to resolving disputes?
Some lawyers prefer aggressive litigation, while others focus on settlement or mediation. Choose one whose approach aligns with your goals.

How to Check the Credibility of a Litigation Lawyer

To verify a litigation lawyer’s credibility, consider the following steps:

  • Check bar association records: Ensure the lawyer is in good standing with the state bar and has no history of disciplinary actions.
  • Read client reviews and testimonials: Online reviews can provide insight into the lawyer’s professionalism and track record.
  • Look for litigation experience: Review the lawyer’s website or professional profile to ensure they have handled cases like yours and have a record of success.
  • Request references: Ask the lawyer to provide references from past clients who can speak to their effectiveness and approach.
  • Research their trial experience: If your case is likely to go to trial, ensure the lawyer has a history of courtroom success.

What Should I Prepare for My First Consultation?

To make your first consultation with a litigation lawyer productive, you should prepare the following:

  • A clear outline of the dispute: Provide a timeline and key details about the legal issue you're facing.
  • Any relevant documents: Bring contracts, emails, letters, or any other documentation that pertains to the case.
  • A list of key players: Provide the names of individuals or companies involved in the dispute.
  • Questions about fees and the litigation process: Make sure you understand how the lawyer plans to approach your case and how you will be charged.
  • Your goals and expectations: Be clear about what outcome you're hoping for, whether it's a settlement, compensation, or another resolution.

By coming prepared, you can ensure that your initial meeting with the lawyer is both efficient and insightful, giving you a better sense of how to proceed with your case.
