We are contemplating a move back to Washington state where we lived for many years. Without proper estate planning we would potentially be subject to the Washington estate tax. n our initial contacts with the firm, we clearly identified that we were residents in another state. We were instructed to provide our detailed financial picture as well as our current estate planning documents which we provided promptly and told that our information would be forwarded to the attorneys for evaluation. The following is the email response. “Thank you for filling out and returning your Questionnaire. I will forward your information to our attorneys for review. Once they have completed their review, I will be back in touch with you regarding a quote for services and the next steps for scheduling.” Well over a month went by with no word back from STIB. I finally contacted them by email requesting a status update. Within minutes, I received the following reply. “Thank you very much for contacting our firm. Unfortunately, we are not able to take on your case. Our firm does not advise out-of-state residents on tax issues. Our focus is estate planning and long term care planning.” The STIB website clearly tax issues as part of estate planning. I also found no restrictions on attorneys in Washington state providing consultation to out-of-state residents considering residency in Washington. Needless to say, I was astounded by what I consider to extremely poor communication and timely follow-up. If it is indeed not their policy to advise out-of-state residents on tax issues, I would have expected to have been informed of that policy up front thus saving us the time of compiling and sending detailed and confidential financial and estate planning information. In my opinion, this represents incompetent and totally unprofessional behavior.

Representation was pathetic at best. Ken is very hard to communicate with as he doesn't give you the total answer till after the fact. Does not listen very well to his client, nor did he believe in his client/me. Accounting practices leave very much to be desired, missed numerous entries/expenses and the math was horrible. Has a negative attitude about the Judges and failed to counter the Mediator on numerous questionable decisions. Nice guy, just not a fighter. In my opinion, If payment was based on his performance, he would owe me money. Five year Sham

They have been working with me for almost one decade on EB-5 immigration now. I finally got my 10 years permanent residency. I had a wonderful experience in working with them. The E-5 process is very long and it needs patience from every party. This lawyer firm is very responsible, responsive and considerable about your situation, questions and concerns. They helped me all the way through many difficult times. I would highly recommend them. You will get what you paid for if you hire them. Trust me. They are the best.

I really needed an attorney to help me amend a number of critical documents when experiencing a major change in my personal life. I just walked into the Scarff Law offices one morning after googling a family lawyer close to where I was at the time. I had the best experience from start to finish, with my first interaction being with Beth Miller and the rest of my experience being with Elizabeth Runtz. I could not have asked for, or received, better support both from a legal and inter-personal perspective. Elizabeth truly cared and showed immense empathy - all with a wonderful sense of humor. She has amazing support from the senior partners when she believes she needs it and I could not recommend her and the team at Scarff law highly enough. Many many thanks Elizabeth.

Tom is a great attorney who is very experienced in family law. He not only slammed the other party, he slammed the other attorney by catching his every mistake, missed deadline, and had the ability to quickly motion to strike when rules aren't followed. He is accurate in predicting how the court may rule and his judgement is spot on. His level of service is what you want from an attorney as a small practice. You get prompt and timely responses, honest billing, quality and attention to detail. I would highly suggest reaching out if you have a legal matter in his field of practice before calling a larger firm where you are left in the dark except when it's time to pay the bill.

Our family is so thankful to Renee for her expert legal advice and compassion during the most stressful time of our lives. Our married daughter was 8 months pregnant when her husband walked out the door, leaving her and her 7 year old son with no explanation or financial support. We hired Renee who immediately went to work on a parenting plan, child support, and did her best to help support us with our court cases. After a year long case, our daughter's divorce was finalized and she was awarded primary custody of both young children. Now we are able to ensure our grandchildren are going to be raised in a stable and loving home with our family. Stacie, paralegal, was also amazing and there for us when we had so many questions! What a great team, we are so THANKFUL to have outstanding legal advice and representation.

The first impression during the consult was Renee was very intelligent and knew her stuff. She appeared to be honest with what she truly thought we could accomplish. She had another attorney Karan help because it was cheaper. But it took his WAY longer to do everything and he clearly had no idea what he was doing. We stared to feel like she didn’t have time for us and was squeezed our case into her work load. Looking back she shouldn’t have taken our case and been honest that she couldn’t take another client, she tried her best but was too busy to really give our case the attention it deserved, this was about our child after all and deserved to be not just squeezed in. The worst part is at the end of it all, not being satisfied we reached out after already having paid $10,000, we had a balance of a little over $600. She then told us to pay what we could. At that point we had nothing to pay, we had paid all we could and didn’t bother attempting to borrow money from friends and family we just didn’t pay anything. Months had passed with no communication and then my husband gets a phone call saying we are in collections and that Renee is suing us over $600 we owed her. I called the office confused they said since we didn’t pay anything they sent us to collections. I explained Renee said to pay what we could, which was nothing Stacie here paralegal then said that meant “within reason”. If some type of minimum payment was due then that should have been stated. I reached out via email to Renee stating I want to see my final notice that says you’re sending me to collections. She said she doesn’t need to do that and that she had said she would “be willing to accept anything”. So now we are in collections and she will not pull it from collections after telling us we only needed to pay what we could. Renee stated one thing and did another. If we knew this was going to collections we would have asked friends and family to help. After paying her THOUSANDS of dollars and being told to pay “what we could”, we find ourselves in collections over $600, Do NOT recommend. Do NOT use.

If you're facing complex legal issues surrounding estates, probate, or real estate, look no further than Roach Law Firm in Walla Walla. They went above and beyond in helping me navigate a challenging situation. When a family member passed away without a will, I was overwhelmed and unsure of the next steps. Roach Law Firm guided me through the entire probate process with patience and expertise. They guided each step, keeping everything on track and ensuring a smooth resolution. I was also impressed with their assistance when selling the house involved in the estate. Their guidance throughout the process made a potentially stressful experience much easier. The entire staff at Roach Law Firm deserves high praise. They were incredibly helpful, responsive, and always available to answer my questions. I never felt like just another case number. In a nutshell, Roach Law Firm provided excellent service. They are true professionals who made a difficult time much more manageable. I highly recommend them to anyone seeking top-notch legal representation in Walla Walla.

I definitely recommend Mr. Tario to anyone needing representation for personal injury. He was professional and knowledgeable, and helped me win my case. I liked how at ease he was during the whole process from beginning to end. You can tell he's done this many times, and he knows what to expect and what to do next. The only thing that caught me by surprise was the additional fees. He is upfront about his 40% contingency fee and let's you know there is an additional charge for filing fees and whatnot. However the additional fees are 2000.00$ on top of the 40% which is already a little higher than the 33.3% that other lawyers charge. I just wish I would have known that or maybe I overlooked that in the contract.

Ten years ago Richard was just ok. Although recommending a Special Needs Trust for my parents' wills turned out to be an unnecessary and expensive proposition. In needing to dissolve this SNT following both of their passing, we sought a meeting with him, but had a Zoom meeting instead. He simply read our emailed questions back to us with out answering them. He was not helpful and seemed to be confused, just referring us to other associates for things we needed.

Two years ago my wife and I selected Richard on the strength of friends' recommendations. We very quickly realized we had chosen wisely. He prepared a complete estate planning package for us - trust, wills, durable powers of attorney for asset management and health care, and advance health directives. At first meeting he projected a quiet confidence that immediately set us at ease. From initial conference through document filing Richard was the consummate professional, knowledgeable, approachable, thoughtful, responsive, patient, and caring. His staff also exhibited those same fine attributes throughout. Together Richard and staff made our estate planning a most pleasant and productive experience. Richard brings to his practice many strengths. The ones we most appreciated were his willingness to listen carefully to what we thought were our needs, his ability to clarify a complex subject and thereby help us better understand and refine our needs, and his calm, reassuring manner of gently guiding - never pushing - us toward the products most appropriate to meet those needs. Three months ago we again had need of Richard's services. We received a panicked call from the escrow company handling the refinance of our home advising we needed to remove it from our trust 'right then' in order for the refinance to move forward to closing a few days away. I phoned Richard at 5:00 pm that day and the next morning at 10:00 am we were in his office signing the necessary documents. No muss, no fuss, just a great example of the exemplary service Richard and staff routinely provide. Richard was an absolute delight to work with throughout the entire estate planning process and again during our recent need for his expertise and services. We've already recommended him to friends and will continue to do so. I don't suppose anyone looks forward to requiring legal services, but it's comforting to know that when that time inevitably comes again we'll be able to turn to Richard for support.

Ms. Reinbold represented me in my divorce. It was a long protracted process and involved business and personal assets. There were other complex issues she had to deal with and she faced highly paid, seasoned attorneys from Seattle, Spokane and other large markets. These attorneys tried to use various tactics to give my ex-wife unfair advantages. She beat them all... not one issue did she lose even though some cited cases used against us were not presented until trial. If you want a fighter who thinks quick on her feet I highly recommend Ms. Reinbold.

Kathryn Resnick was referred to me through the Senior Will Program with Law Advocates. I so appreciate her participation in this important service. We found Kathryn and her staff extremely professional and committed to the highest standard of legal procedure. Kathryn has a profound knowledge of state and federal laws and regulations and how those domains apply to her client’s personal needs. She keeps herself and her staff updated with the ever changing strictures within the legal community. For us, she provided several services: an updating of our will, she’s helped provide clear understanding of our family trust, and she had a commitment to work with our financial advisers in order to give us greater confidence in our financial and legal concerns. Kathryn has an ability to put abstract and ambiguous legal jargon into basic layman’s terms. We were comfortable asking her questions and her answers were never returned in esoteric attorney type piffle. Through the years we have recommended her practice to several friends and they share our appreciation of her professionalism. We recommend her law practice with all enthusiasm. Coleen & Rob Cheesman

She is a competent attorney, but she told me so many times that she would do something that she never did. It was very frustrating, especially with the amount of money I was paying her. Examples are she would tell me she would get back to me within a couple days and she wouldn’t, she said she would look into many things for me which she never did. When going through a divorce you need an attorney who will do the things they say they are going to do when they say they are going to do them.

Will Reingold was one of the attorneys who represented me in my divorce. Will’s overall attentiveness to the case and its myriad of deadlines demonstrated a high degree of detail-orientation that was incredibly reassuring during a very difficult period. It was a contentious case in which many motions were filed by both parties, which meant a lot of legal writing had to be done. Will’s writing was unfailingly crisp, concise (while still comprehensive), and persuasive. Through his writing I could tell how seriously he took my case, and how much he cared about the way his rhetoric would put me in a position to achieve a positive outcome. Additionally, the speed with which Will was able to produce incredibly well-written artifacts was equally impressive. If you are looking for someone to do excellent work for you, you will be hard pressed to find a better writer than Will.

I feel so honored to have been excepted and then hired Jim to handle my divorce back in 2007. I just picked him out of the phone book and hit the jack pot when I retained him. He was professional,  sensitive , and extremely helpful. He has always left an enormous impression on me. I am a flight attendant who had two children and was now living out of the state. He arranged meetings with me at the airport because he knew I didn't live in town and I did not have a car. My ex- husband was a con man and I came with all the proof he needed to take my case and win my divorce. In thinking about him today, I googled him to  see how he and his business is doing. I would like to thank him for his caring, friendly, and professional service. I would highly recommended him every day and all the time.  30+ years strong that is wonderful. Thank you, Jim

My wife and I retained Mr. Rawnsley for a very delicate family law matter. We had been falsely accused of child abuse by my ex wife and an unsuccessful defense of the accusations would have been catastrophic for our family. For reference, I have worked with many attorneys in the past 10 years dealing with my ex so I have an unfortunately large amount of experience in assessing the quality of legal counsel. Mr. Rawnsley was very professional, highly informed about the relevant statutes and had a good understanding and relationship with the judicial officer (something that is very, very important). All of my previous counsel lacked in some area or another. One may have been less competent, where another may have not had the quickness of wit and depth of understanding of the law to successfully represent my interests. I can say with total confidence that Mr. Rawnsley was the complete package. He was, by far, the best attorney I have ever hired for a family law matter and it isn't really close. I am grateful for his efforts and would recommend him to anyone else.

For context: the following stems from a separation/divorce and parenting plan fight that has been ongoing for almost three years. During the first year, I felt that the firm was doing a great job going to bat for me to help me avoid a "pro se" nightmare that I was facing. However, even after the entrance of the divorce decree and final orders almost a year ago, the opposing party still decided to interpret things her own way. A year ago, I warned my lawyer that the opposing party intended to take some actions related to federal taxes. The firm either ignored what I said or chose inaction on the matter, and to this day claim not to have any knowledge of the tax situation despite email chains to the contrary from early 2021. I have now lost out on 2 years worth of tax refunds totaling more than $10,000 because of that one single action taken by the opposing party, even though it is contradicted by what is written in the final court order. No action taken in this instance, but everyone knows if I, the father, had done the same thing to her, I would've been dragged through the coals by the court. Early November, 2021 - I write an email to confirm pickup dates and times for Thanksgiving and Christmas breaks. I am told I'm wrong on both and that I won't be getting to see my children until three days after the day Christmas break begins. I re-involve my attorney to help settle things. It goes to mediation, doesn't get resolved, the day of her lawyer finally confirms with my lawyer that I'll be getting them two days late and "take it or leave it" essentially. The parenting plan was violated when those two visitation days that should have been mine were withheld from me. Opposing party used various excuses and reasonings, but the bottom line is they broke the parenting order. I asked my counsel to hold her accountable, asked if there was a contempt motion we could make. It has been almost two months since those days were lost, and I have been attempting that entire time to get a contempt motion filed against the opposing party, but nothing happened. I tried asking every few days if something had been done; nothing had. It was always "Oh they didn't answer yet" or a message from opposing counsel that said "I just forwarded this to my client, let's see what she says" or "Oh sorry, I didn't see this until three days after you sent it, let me send it to my client". No motion was ever filed, and I have yet to find out if I'm ever going to get my two days back that I lost due to her choices. I pleaded with my counsel to do something. Take action. If it had been me as the father who had done what she did, she and the court would have already shredded me apart. I begged over and over for almost a month, and finally said if something wasn't going to happen soon that I would retain new counsel. That's when I received the professional equivalent of "fine I quit". Complete with self-congratulatory claims referring back to the previous work done from a year ago. To clarify with a mechanic analogy: "The car ran great the day I fixed it a year ago, I can't believe you're upset now that something else broke and I haven't fixed it yet!" If they had done what I had asked, I wouldn't have had to replace them. Two months of back and forth. Hours and hours billed for emails and phone calls, and not a single legal action filed despite several written "threats" to opposing counsel about the intent to file a contempt motion. It was as if the mere mention of the motion would've been sufficient to inspire the opposing party to mend their ways. But it wasn't. And it isn't. By the time I had hired a new lawyer, it felt as if the opposing party had two lawyers and I had none. Don't expect them to explain the reasons why behind the advice they give you. I learned more in 24 hours with the new counsel than I did over the last two years with this firm.

PWR law is the worst I would recommend finding better legal help. Patrick Rawnsley is a terrible money hungry attorney that doesn’t get good results for you if you’re not wealthy and willing to pay out your life savings. Starting he charge me a $5000 retainer fee then he burned through it in less than a month after only appearing in court for me one time. Supposed to help me with my parenting plan And charge me another $2000 retainer or he would drop my case, he burned through that and then came up with an additional $3000 of more unjustified charges. He was my attorney for less than 3 months and only appeared in court for me one time. He was supposed to help me get my youngest son into our parenting plan but was unsuccessful in all. He was a waist of $7000 and of course he falsely charged me an additional $3000 then sent me to collections with new charges with a total of over $6400. He would set up in person meetings with me his legal aid then charge me almost twice as much for each meeting. When I asked if we could just meet with the two of us he would still charge me on the backend to discuss the case with his legal aid which would be more expensive he said. 4 years later and I’m still trying to dispute what he’s done to my credit. He didn’t even care that I was broke and using student loans to pay him to help me be in my kids lives. All of this is true and I would highly recommend you use a better attorney that won’t screw you over when you are already suffering. Please tell me how an attorney can charge a poor client over $13400 but only show up to court one time and represent them for only a couple months and leaving their client in the same situation when they came to him.

I hired him to represent me. He does not fight at all for you. He "goes with the flow" and does the bare minimum. He will contact you the day before a hearing to inform you that you must attend. When asked why he didn't notify earlier his response is "my bad". Will only communicate via phone so there is no record of conversation's or what he said to client. Spends half his time in Utah. Gets easily confused by prosecutor with regards to charges and negotiation.

Scott Terry is incredible!! I had a DUI charge back in 2003 that we took to trial by jury in which the charge was completely dismissed. We also had a Boating Under The Influence completely dropped by the 2nd court appearance a couple years later. I had a couple other DUI charges after that so I called up Mr. Terry...he also beat those charges. Scott represented me for a gun/marijuana charge in which I walked away from as well. He even answers his cell phone at 1 am on vacation! When you are a client of his you get the privilege to call him when you need him most. Mr. Terry is an attorney you can trust and count on. Scott Terry is a Jedi Lawyer!

I was injured at a Holiday Show, and called Scott, I have known him for years and fully respect him. Scott and his team made everything real easy. They kept track of the stack of bills, and would stay in contact with me, just to see how I was doing with my recovery for nearly two straight years, through surgery and physical therapy. Scott was proactive, great at returning calls, explaining everything, and keeping me informed. He has good people skills, and has respect from the people in his industry . His assistant Kelly was very aggressive with the insurance company that would drag their feet. There were no surprises, or issues. From start to finish the team was professional, incredibly knowledgeable, honest, caring, and fair. All in all I had an amazing experience with Scott, and was very happy with the outcome in my case.

Mr. Whipple and his competent staff helped us through the complicated probate process. They explained what was happening and what would happen later and made it less of a mystery. They did their best to implement our wishes in the distribution of the estate. We have nothing but thanks for them and their integrity. We would not hesitate to use their services in the future.

I contacted the law offices of Bryana Cross Bean and scheduled a consult for questions regarding my future Medicaid benefits. I presented my information and documentation and explained the circumstances regarding my situation. I received no feedback for future steps that I and/or we could take regarding my situation. I was even more appalled when she said, "You cannot afford me." The only pieces of information provided from Bryana Cross were two post-it notes with no indication of any assistance she would be able to provide if I retained her services.

Attorney Cross Bean assisted me and my family during a probate issue right after my father passed in Tacoma. Being from Indiana, I did not know anything about Washington state laws. When she took over my case, she explained everything to me and my family on level that we could understand, and then proceeded to get executorship, processing filings, giving me information on how to guide through that process. When we had a problem with real estate she had recommendations that we could choose from, not knowing anything about the area. When we flew back to Washington to deal with squatters, theft, estate issues and the like, she made sure that we were informed of all Washington state laws pertaining to whatever issue we had to deal with. My family and I had very finite time and Attorney Cross Bean was there to answer every question and need with professionalism and respect. I was truly honored to have had her in my employ and would recommend her with the highest of recommendations.

So today I finalized my estate planning. I've been meaning to do this for years, but always put it on the back-burner because it was difficult to understand exactly what I needed to do, even with all of those self-help websites. It was so much easier than I'd thought it would be, once I enlisted professional help. I cannot speak highly enough of The Crowe Law Office for all of their help. Easy to understand advice, along great personal service. Now I have peace of mind when the inevitable happens. If you're thinking about estate planning, I highly recommend Dan and Molly. I couldn't be happier with my decision.

Dan is nice and did help a bit. But he ask for documents to be dropped off went there 3 different times during business hours door locked. 2 days before court His Paralegal calls me and informs me they wont be there and my response letter was not sent I would have to do that. I missed a day of work to scramble to get it there before it was late. The Paralegal told me I could get my file and then when I went to get it was so rude. I'm sure to you my case was insignificant but to me and my family it's not. Will not recommend you to anyone. I felt really insulted by Molly.

Daniel was so knowledgeable at our first consultation that we didn't even need to hire him! He outlined all of our rights and responsibilities and didn't try to jack-up the price of service on us. We are living on a budget and this is the kind of service that makes our lives better! Thank you Crowe!

What a Probate Lawyer Can Do for You

A probate lawyer assists with the legal process of administering a deceased person’s estate. This often involves guiding executors (if a will exists) or beneficiaries (if no will exists) through the probate process to settle the estate according to the deceased’s wishes or applicable laws. Probate lawyers can help validate the will, distribute assets, resolve disputes among heirs, handle outstanding debts or taxes, and ensure the estate is legally and efficiently administered.

Whether you’re an executor of an estate or an heir facing probate proceedings, a probate lawyer can help you navigate the often-complex legal process to ensure the estate is settled correctly.

When Should I Hire a Probate Lawyer?

You should consider hiring a probate lawyer when you are responsible for managing the estate of a deceased individual, especially in the following situations:

  • The estate has substantial assets: If the estate includes significant assets like real estate, investments, or business interests, legal assistance is often necessary to handle the distribution properly.
  • The will is being contested: If there are disputes among heirs regarding the validity of the will or the division of assets, a probate lawyer can help resolve the conflict.
  • The estate includes complex or unclear provisions: If the will contains complicated instructions or there are no clear beneficiaries, a lawyer can ensure that the estate is administered according to legal requirements.
  • There is no will (intestate estate): When a person dies without a will, the estate is subject to intestacy laws, which determine how assets are distributed. A probate lawyer can help navigate this process.
  • Debt or tax issues exist: If the estate owes significant debts or is subject to estate taxes, a probate lawyer can help ensure debts are paid appropriately and taxes are minimized.
  • Probate disputes: If family members or other parties are disputing the distribution of assets or challenging the executor's actions, legal representation is crucial to defending your rights and ensuring the estate is handled properly.

Hiring a probate lawyer early in the process can help avoid costly mistakes and ensure the estate is settled efficiently.

What Does a Probate Lawyer Do?

A probate lawyer provides a wide range of legal services to help manage and settle an estate. Their tasks can include:

  • Validating the will: Filing the will with the probate court and ensuring its legal validity.
  • Guiding executors or administrators: Advising the person responsible for managing the estate on their duties, including inventorying assets, notifying creditors, and paying debts.
  • Filing necessary paperwork: Preparing and submitting the legal documents required to initiate and complete the probate process.
  • Resolving disputes: Mediating or litigating disputes among heirs or between beneficiaries and executors, including challenges to the will or disagreements over asset distribution.
  • Handling debt and tax matters: Ensuring that outstanding debts, taxes, and estate taxes are properly calculated and paid from the estate’s assets.
  • Distributing assets: Ensuring that assets are distributed to the beneficiaries according to the will or intestacy laws, and that all legal requirements are fulfilled.
  • Closing the estate: Completing the final steps of the probate process, including filing a final accounting with the court and formally closing the estate.

How Are Probate Lawyers Paid?

Probate lawyers typically charge for their services based on the complexity of the estate and the nature of the legal work involved. Common payment structures include:

  • Hourly rate: Most probate lawyers charge by the hour, with rates depending on the lawyer’s experience and the complexity of the estate. Hourly rates can range from $150 to $500 or more.
  • Flat fee: For simple estates or straightforward probate tasks, some lawyers may charge a flat fee that covers all of the necessary legal work.
  • Percentage of the estate: In some states, probate lawyers are allowed to charge a percentage of the estate's value as their fee. This percentage typically ranges from 2% to 5%, depending on the size of the estate and state regulations.
  • Retainer fee: Some lawyers may require an upfront retainer fee, which is billed against as the probate process progresses.

It’s important to clarify the fee structure during your initial consultation to understand how you will be charged and avoid unexpected costs.

How Much Does a Probate Lawyer Cost?

The cost of hiring a probate lawyer depends on several factors, including the complexity of the estate, the type of legal issues involved, and the lawyer’s fee structure. General cost estimates include:

  • Simple estates: For estates with straightforward assets and no disputes, probate legal fees can range from $2,500 to $10,000, depending on the lawyer's fees and the state's probate laws.
  • Complex estates: For larger or more complicated estates with multiple properties, business interests, or disputes, probate costs can exceed $10,000 and may reach $20,000 or more.
  • Hourly rates: If charged by the hour, expect rates between $150 and $500, depending on the lawyer’s expertise and geographic location.
  • Percentage fees: In some cases, a probate lawyer may charge 2% to 5% of the estate’s value, particularly for larger estates or those involving complex legal matters.

Always ask for a clear estimate of fees during your initial consultation to understand the total cost of probate representation.

Top Questions to Ask a Probate Lawyer

Before hiring a probate lawyer, it’s essential to ask the right questions to ensure you’re hiring someone qualified to handle your estate needs. Key questions include:

  1. What experience do you have with probate cases like mine?
Ensure the lawyer has experience with estates of similar complexity, especially if disputes or high-value assets are involved.
  2. How do you charge for your services?
Ask whether the lawyer charges an hourly rate, a flat fee, or a percentage of the estate, and request a cost estimate.
  3. What is the likely timeline for my probate case?
While it’s hard to predict exactly, an experienced lawyer can give you a general idea of how long the probate process may take based on the specifics of your estate.
  4. What steps will you take to manage and distribute the estate?
Ask about the lawyer’s approach to handling debts, taxes, and asset distribution.
  5. Will you be handling my case personally?
In larger firms, junior attorneys or paralegals may handle some aspects of your case, so it’s important to know who will be working on your probate case.
  6. What are potential challenges we may face?
A good lawyer will be able to anticipate possible issues, such as will contests or creditor claims, and explain how they would handle them.

How to Check the Credibility of a Probate Lawyer

To ensure you’re hiring a reputable probate lawyer, follow these steps to check their credentials and experience:

  • Verify their state bar status: Check with your state’s bar association to confirm the lawyer is licensed to practice and has no history of disciplinary action.
  • Look for probate experience: Review the lawyer’s website or professional profile to ensure they specialize in probate law and have experience handling estates of similar complexity.
  • Read client reviews and testimonials: Look for online reviews on platforms like Avvo or Martindale-Hubbell to see what past clients have said about the lawyer’s probate experience.
  • Ask for references: A credible lawyer should be able to provide references from past clients who can vouch for their professionalism and expertise in handling probate matters.
  • Look for membership in professional organizations: Membership in organizations like the American Academy of Estate Planning Attorneys (AAEPA) or the National Academy of Elder Law Attorneys (NAELA) can indicate a lawyer's commitment to estate and probate law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a probate lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • A copy of the will or trust (if applicable): Bring any estate planning documents left by the deceased, including wills, trusts, or powers of attorney.
  • List of assets and debts: Prepare a detailed list of the deceased’s assets (e.g., real estate, bank accounts, investments) and outstanding debts (e.g., loans, mortgages, credit cards).
  • Death certificate: Bring a certified copy of the deceased person’s death certificate.
  • Contact information for heirs and beneficiaries: Have a list of all individuals or entities named in the will or who are entitled to inherit under intestacy laws.
  • Questions about the probate process: Write down any questions you have about the process, costs, and potential issues you might face.
  • Relevant financial records: If available, bring any relevant financial documents, such as bank statements, property deeds, and tax returns.

By coming prepared, you can ensure a productive consultation and allow the lawyer to provide the best advice for your situation.
