Communication is poor with this office:  1. They are ready to sign up. Right after signing you up, they will tell you that you might not get favorable judgement and comp will be too less. 2. They communicate only by text messages. Do not reply back by emails. 3. They use gmail. In the beginning, my emails went to their spam box. I had to sort the problem out.  4. F.B. Brown’s voicemail is always full and gets disconnected. Sometimes he responds back by text though saying he will get back with answers. But never gets back and never gives straight answers to questions asked. His father hearing representative speaks and speaks but fails to listen to questions or answer them. 5. They cannot setup clients with good doctors. The doctors they set me up messed my medical records and other paper work and were only trying to hook me up on Pain meds and forcing me to go to work though I have spinal damage. They told me they have seen many cases like me. However, they do not explain the condition as it is, because they are extremely busy. When I asked Browns, I am informed my case is denied, it is not possible to change doctors. Even Browns told me to find some job soon by hiding my injury with prospective employer because I might not get favorable judgement and money I will get will be too less. 6. F.R. Brown is expecting/or has a baby now. He is tied up. It’s been more than one month. After few text msgs, missed calls & emails, I receive their response that they will look into my case and reply. Since Feb 2016, he did not reply to my emails. 7. Now they are defining what their job is and what their job is not. Wish they did that before signing me up. Now I do not receive even their WC related advice. I am being forced to accept their terms and move on. 8. Now it appears to me that they are seeking revenge on me (their own client) I am scared that they’ll slip my case juggling too many balls(cases) at once. I am disabled and jobless and incomeless. I got proof all my communication with them and thinking of filing a complaint against them at CalBar Association.

Mr. Ortega has not been helping me with my case. My case settled more than a decade ago but in the last 4 years I have tried to get help from him on the services awarded to me by the Court and he has been of no assistance to me. I have called him and left messages on his voice mail (more than 100 messages by now) and they have unanswered. Its pretty obvious he doesn't care and lacks the professional ethics of a lawyer.

Unfortunately I do not recommend hiring Mr. Samarghachian. I hired him for a Workers Compensation case in 2015 when I received a concussion and neck injury at work. In our first meeting Mr. Samarghachian promised many things including finding a doctor in Dallas where I had to move to live with my parents due to the injury’s affect on my ability to work. I suppose he thought that I wouldn’t remember this meeting since at the time I was pretty stricken with brain fog from the concussion (I had to take a break halfway and have some water as I couldn’t handle a normal conversation at that time) and denied he made such a promise. Finally I dropped him as my attorney in 2016 later after years of not getting a hold of him or his assistant (who was rude on the phone for no reason as I was perfectly polite), promises to move my case forward that never happened, a phone call in which he seemed to basically not remember anything about my case, and probably more that I’ve forgotten. It seemed that, thinking my case probably wouldn’t make him much money, he stringed me along instead of officially dropping me as a client. Additionally, he basically told me that he had done everything he could for me case (which I know to be false due to my current lawyer’s efforts). If I hadn’t been dealing with debilitating brain fog, migraines, neck injury and learning the ropes of WC cases on my own, I might have saved myself some time and grief and dropped him sooner. Do yourself a favor and hire Steve Kaykov instead. He is younger and less experienced than Mr. Samarghachian but he and his assistants have worked tirelessly on my behalf, always prompt to answer, explain the process and address my concerns. I only wish I had hired him, and fired Mr. Samarghachian, sooner.

This was the worst ever experience. I found a good one after I let this one go. He did more damage to my case then good. He failed to file the 132A after I hired him to take care of my case which caused me to lose those benefits because my other attorney told me he failed to file it in a statute of limitations time. He failed to call and return calls. Dealing with his rude secretary over the phone to get anything handled was nothing but a headache. Getting on the phone having to get my own doctors and such approved when it was his job to do. Then getting a 100 thousand dollar lean the day before christmas and having to dispute it. I felt this was a hot mess of an attorney.

While being represented, I had a work comp surgery that resulted in an injury to another area of my body secondary to the traction that needed to be placed to perform the surgery. I immediately contacted this lawyer, he was aware of injury immediately. He never added injury to my w/c case. Injry occured in feb 2012, he would not add to my w/c case. He allowed me to see AME in Oct 2012, without any mention of this injury that caused while i had been under general anesthesia. My employer and w/c ins refused to treat new injury that they caused( the burden of proof apparently was mine/ attorney) I had to go through my private insurance to get treatment. I have spent $$$$$ out of pocket. I ended up with compartment syndrome in my foot where the traction was placed wrong, had surgery and still now 2+ years later have disability and physical impairment to foot. Tomm would not answer emails for over a year, nor over 40 messages left at his office. He was aware I wanted to file negligence against MD that caused damage, and still no response. My statute of limitations had expired, now 3 years later and a new w/c attorney, the damage and care to foot is now being addressed thru the w/c system. This attorney has provided legal negligence. Dont go to him

AS for a workman's comp lawyer, they are disinterested in my case. Trying to get answers to questions was usually answered with "this takes time" and more so "I DON`T KNOW". I was asked to represent myself by Mr. Bolas at a hearing to the plaintiffs attorney and NOT have the Judge have it on record. Why do I have an attorney then??? Don`t ask the Secretary any questions what so ever, the negative attitude is omnipresent and overwhelming. On the initial consultation with Mr. Bolas, the secretary barges into his office and tells HIM, in the USUAL NASTY way that he has to stop because she wants to start the paper work. This happened a few times and the consultation was abruptly halted due to HER DEMANDS! And he is oblivious to the disturbing behavior. When I spent my time getting answers to questions they could not, or would not answer, and I questioned them on why things are ignored Miss ATTITUDE said I guess your not happy with the SERVICE you are getting. If you count I DON`T Know, as service, yes I wanted a professional that does KNOW the answers, and will DO what it takes to protect the client and that never happened. How dare anyone question them. So they Quit. Thank god. You will be ignored and be on your own if you dare retain THEM. NOT WORTH A DAM. ZERO STARS IS THE TRUE RATING BUT I AM FORCE TO GIVE VERY GENEROUS 1 STAR.

Let me tell you about this girl. And yes, I said girl. She does not deserve the title of woman. I went in for a worker's comp hearing, and she had the nerve to ask me, after having gone through a situation with an abusive ex-boyfriend, why I did not have a boyfriend. Rude as all hell. I don't know what she was hoping to accomplish, but she does not deserve any support or funding.

I have been trying to get on Social Security Disability for sometime and I have waited for over a week to 10 days to have an phone interview with Sharon Kelly and I have been very stressed over my situation and I was trying to explain to her what was going on. She and I were only on the phone for less then a minute and she told me that I talked to much and just Hung up on Me.. That was Wrong.!!! I don't care how much education you might have. There is such thing called Good Manners and companion. Because of her arrogance and narcissist attitude I Would Not Recommend her as an attorney. I don't care how good she thinks she is. If she wanted me to slow down in my conversation she said OK, slow down and take a breath and let me talk.. Instead she said that I talked to much and just Hung Up On Me... Less then on minute of a conversation with her. Sharon Kelly Just Don't be a hateful, inconsiderate person and just Don't Hang Up ON A Person.. You Should Not Waist Your Time with This Law Office.. There are other and Better Attorney's then Sharon Kelly.. Just to let you Know so you Don't get hung up..

Marcia Price "through me under the bus", in case back in 2002! As result of her ineffectiveness of counsel, I spent 33 months in county and prison! I found evidence during my trial, that should have impeached my ex-wife's testimony, just to find out, the judge(Lawrence Jones), would not allow it in court! She failed(I found out later), to do an "offer of proof", for the record, making the judge explain why he was not allowing that relevant evidence into trial, for the appeal process. This get's even worse. Not only what the Judge did was illegal, the prosecuting D.A. knew of this evidence(side bar), as well. Lisa Soundergard is now running for DA, here in Fresno, Ca. I have proof of what took place, in my transcripts. No attorney would take my case, unless I paid them $30,000 or more to fight this again. Do not trust this lady with your life.

I interview with john's staff. dropped off my paperwork. I had one question that was pertinent and time was a factor and let them know...about a week went by so, I just assumed no response. Out of the blue I get a call saying he won't be able to contact me for two weeks. I say thats too late, it becomes Monday with out a breath. That was a little offsetting. I tried to mention I just had 1 question...but she kept getting irritated and kept saying how he had pushed me in front of others and could deal with my case later. I tried to mention it was just one question...but she wasn't listening. After thinking on it, I didn't want to jump the line in front of others and really felt like there was more stress than necessary. I called back and got some one else and mentioned to forget about it. That I was uneasy with a couple things and its ok, i will figure it out. Monday I receive a letter saying they will not be handling my case due to my request. I call and mention this is a miscommunication. I just meant nevermind about my question. Same woman I had that conversation with and she remembered and apologized. I did too. She said she would mention it to them, they would get back to me. I waited a week and then called because this is when I was supposed to call before the question came up. I get the 2nd woman, she says they still aren't taking my case for reasons mentioned in the letter....that I requested it. WHAT THE F? heard good things but they may be too good for you. They were way too good for me

I was not a client. I worked with her. Good people don't belittle people. They don't act with smug superiority. She was unkind and rude. She cost me my job - I was a single mom making a modest living and had no college education. She nitpicked every thing I did and treated me as if I was stupid. It was humiliating and demoralizing. It has been over 25 years but I will never forget the way she made me feel.

I am blown away by how bad my experience was with this law firm. This review could go one for pages with my concerns related to the profound lack of professionalism that Mr. Lindheim demonstrated during my workers' comp case but I will spare you. Lack of return phone calls, terrible advice and an apparent lack of interest in my case pervaded the years of my interactions with Lindheim and his staff. I cannot recommend enough that you either do not use Lindheim, or if you do, to drop him the instant you feel that he is being disrespectful, unresponsive or ineffective.

We hired Craig Streed and paid the bill in full. During our meetings with him prior to paying the full balance Mr Streed continually assured us that we qualified for chapter 7 no problem. once the balance was paid, things changed almost immediately. He informed us after running the “means test” we made to much money. Even though nothing had changed since our previous meetings with him. We was at all times fully aware of our income/debt ratio. He strung us along suggesting once my hours were reduced down the road we would surely qualify. Months later with my reduced hours we still didn’t qualify! At that time he suggested once my unemployment ran out we would surely qualify. Well once again we did not qualify. We would never have paid the 1800 dollars to this man had he not told us with 100% confidence we would qualify. Once we paid up, and of course there are no refunds... we were told sorry, you don’t qualify! He was also extremely hard to reach and took days and sometimes weeks to respond to calls and e mails. Our experience with him was awful and I would NEVER recommend him to anyone, extremely dissatisfied

I actually got more acomplished before I went to Mr. Diaz. My case actually got worse after hiring him because once you've entered into the work comp system with an atty you can mo longer contact anybody nor can they contact you they have to go through your attorney. This does not go well if your attorney is always unavailable and his assistant does everything and there were many errors after all they are not the one with the degree. Did not return phone calls or emails. Nothing moves fast in work comp but an occasional update would have been nice. There are Alot of people involved in a workers comp case. You need a atty who is hands on and treats your case with the compassion and dignity you deserve. I stumbled on him i should have done more research that is why i wanted to write this review. To save someone else this experience. So i would recomend you keep searching try to find someone who can recomend an atty who is respectful and hands on.

I hired Cheryl Simbulan Beach 2018 fir a workers comp case . Big mistake I would have been better off hiring a lawyer off a bulletin board on the side of the freeway. I have left here emails left her messages, I have spoke to Valda, Keenan, Erika, some man that answers the phone and says call back in 10 minutes everytine who does that . What kind of office did I hire please don’t make the same mistake I made go with a real lawyer the only thing she did fir me was file the court papers . I must admit she got paid very good fir that because that’s all she did . Also was brought to my attention that the mediation judge I believe us my adjusters boss how does that work out ? She was my worthless public defender on the outrageous criminal charges against me, and she did absolutely nothing for me but repeatedly lie to me, or ignore my repeated request to talk to me, ignored all the information and details, and witteses I had to prove my innocence. She instead sold me out for her buddy the D. A., and repeatedly pressured me into accepting a horrible plea offer that railroaded me into a prison and completely destroyed my life in every way possible, all over a crime that never even happend at all. She could not care less about the truth, or defending her client's, or about justice at all. She only cares about being lazy, decitful, and committed Wrongful Misconduct in my case. She absolutely Should NOT have any Law License at all, and should do time in a prison so she can feel what so many other clients she betrayed had to endure. She is inept, incompetent, decitful, lazy, and worthless.

What a Workers’ Compensation Lawyer Can Do for You

A workers’ compensation lawyer specializes in helping employees who are injured or become ill as a result of their job to receive the benefits they are entitled to under workers' compensation laws. These lawyers represent injured workers in claims for medical benefits, wage replacement, and other compensation related to workplace injuries or illnesses. They also help when claims are denied, benefits are delayed, or disputes arise with the employer or the insurance company.

Whether you've been injured on the job, developed an occupational illness, or are dealing with a denied workers' compensation claim, a workers’ compensation lawyer can help you navigate the claims process and ensure you receive the full benefits you deserve.

When Should I Hire a Workers' Compensation Lawyer?

You should consider hiring a workers' compensation lawyer in several situations, especially when complications arise during the claims process or when your rights as an injured worker are being challenged. Some common reasons to hire a workers' compensation lawyer include:

  • Claim denial: If your workers' compensation claim has been denied, a lawyer can help you appeal the decision and represent you in hearings or litigation.
  • Inadequate benefits: If the insurance company offers you a settlement that doesn’t cover your medical expenses, lost wages, or other damages, a lawyer can negotiate on your behalf for a fair amount.
  • Delay in receiving benefits: If your benefits are being delayed, a lawyer can help expedite the process to ensure you receive timely compensation.
  • Permanent disability: If your injury leads to permanent disability (partial or total), a lawyer can help you navigate the more complex process of securing long-term benefits.
  • Retaliation by employer: If your employer retaliates against you for filing a workers' compensation claim (e.g., by firing or demoting you), a lawyer can protect your rights and pursue legal action.
  • Third-party liability: If a third party (e.g., a contractor or equipment manufacturer) was responsible for your injury, a lawyer can help you pursue additional compensation through a personal injury lawsuit.
  • Pre-existing conditions: If your employer or the insurance company claims that your injury is related to a pre-existing condition, a lawyer can help you present evidence showing that the injury was work-related.

Hiring a lawyer early in the process can prevent delays, avoid mistakes, and ensure you receive all the benefits you’re entitled to under workers' compensation law.

What Does a Workers' Compensation Lawyer Do?

A workers' compensation lawyer provides a range of legal services to injured workers, ensuring that they receive the benefits they deserve. Their tasks often include:

  • Filing claims: Helping injured workers prepare and file their workers' compensation claims to ensure accuracy and timeliness.
  • Appealing denied claims: Representing workers whose claims have been denied and guiding them through the appeals process, including hearings and court appearances.
  • Negotiating settlements: Negotiating with insurance companies to secure fair compensation for medical expenses, lost wages, and other damages.
  • Handling disputes: Resolving disputes between the injured worker, the employer, and the insurance company regarding the amount of compensation or the nature of the injury.
  • Coordinating medical evidence: Gathering and presenting medical records, expert testimony, and other evidence to support the workers' compensation claim.
  • Advocating for benefits: Ensuring that injured workers receive all the benefits they’re entitled to, including temporary or permanent disability benefits, vocational rehabilitation, and medical treatment.
  • Filing third-party lawsuits: In cases where a third party is responsible for the injury, a workers' compensation lawyer may also pursue a personal injury lawsuit to recover additional damages.

How Are Workers’ Compensation Lawyers Paid?

Workers' compensation lawyers typically charge a contingency fee, meaning they only get paid if they successfully recover benefits for you. This fee is usually a percentage of the benefits awarded, and the specific percentage is often regulated by state law. Here's how it generally works:

  • Contingency fee: The lawyer's fee is typically between 15% and 25% of the total benefits awarded to you. You don’t have to pay any upfront legal fees, and the lawyer’s fee comes out of the settlement or benefit award.
  • No fee if no recovery: If the lawyer doesn’t recover any benefits for you, you generally don’t have to pay for their services.
  • State regulations on fees: Many states cap the percentage that workers' compensation lawyers can charge, and some states require the fee to be approved by the workers' compensation board or judge.

Be sure to discuss the fee structure with your lawyer during the initial consultation to understand how much you will owe if your case is successful.

How Much Does a Workers' Compensation Lawyer Cost?

The cost of hiring a workers' compensation lawyer typically depends on the contingency fee arrangement, meaning the lawyer’s fee will be a percentage of the benefits you receive. General cost estimates include:

  • Contingency fees: Most workers' compensation lawyers charge between 15% and 25% of the total settlement or benefits awarded. For example, if you receive $50,000 in benefits, the lawyer’s fee would range from $7,500 to $12,500.
  • State regulations: Some states limit the percentage that workers' compensation lawyers can charge. In these cases, the fee is usually capped, often at 20% to 25%, depending on state law.
  • Additional costs: Some lawyers may charge for out-of-pocket expenses, such as filing fees, medical records retrieval, and expert witness testimony, though these costs are typically deducted from the settlement after the case is won.

You should always ask for a clear explanation of fees and potential additional costs during your consultation so you understand the financial arrangement.

Top Questions to Ask a Workers' Compensation Lawyer

Before hiring a workers' compensation lawyer, it’s important to ask the right questions to ensure they are the best fit for your case. Key questions to ask include:

  1. What experience do you have with workers' compensation cases?
Ensure the lawyer has experience handling cases similar to yours, especially if your injury is severe or the case involves disputes.
  2. How do you charge for your services?
Clarify whether the lawyer charges a contingency fee and whether there are any additional costs you need to be aware of.
  3. What is the likelihood of success in my case?
Ask for an honest assessment of your case, including the potential challenges and outcomes.
  4. Have you handled cases like mine before?
Find out if the lawyer has experience dealing with cases involving similar injuries or disputes, such as denied claims or permanent disability.
  5. How long will the process take?
While it’s difficult to predict an exact timeline, the lawyer should be able to provide a general estimate based on their experience with similar cases.
  6. Will you personally handle my case?
In larger firms, junior attorneys or paralegals may handle parts of your case. Make sure you know who will be working on your claim.

How to Check the Credibility of a Workers' Compensation Lawyer

To ensure you are hiring a reputable workers' compensation lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no disciplinary actions against them.
  • Look for workers' compensation experience: Review the lawyer’s website or professional profile to ensure they specialize in workers' compensation law and have successfully handled cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s expertise and service.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their experience in workers' compensation cases.
  • Check for professional affiliations: Membership in organizations like the Workers' Injury Law & Advocacy Group (WILG) or local bar association committees on workers' compensation can indicate the lawyer’s commitment to this area of law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a workers' compensation lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Accident report or incident documentation: Bring any documentation related to your workplace injury or illness, including accident reports or notifications to your employer.
  • Medical records: Provide copies of medical records, including treatment notes, doctor’s reports, and any information related to your injury or condition.
  • Employer correspondence: Bring any letters, emails, or forms related to your claim from your employer or the workers' compensation insurance company.
  • Wage and benefits information: Provide information on your wages, benefits, and any lost income due to the injury.
  • List of questions: Prepare questions about your case, the process, costs, and what to expect moving forward.
  • Timeline of events: Prepare a timeline of the incident, your injury, and any medical treatment or communication with your employer and the insurance company.

Being well-prepared for your consultation will allow the lawyer to assess your case more effectively and provide you with the best possible legal advice.
