I would recommend going by yourself before hiring this attorney, He does not communicate nor does he do what he tells you he is going to do. They do not return calls, and when you call they usually say they are with a new client. He has excuses for everyone except for his own lack of actions. He did not even file an appeal for permanent disability judgement that was based on a report over a year+ prior to getting surgeries approved , I had been out of the hospital for only 9 days from having Lumbar L4-L3 surgery and had cervical surgery on C6-C7 only 10 weeks prior to that. He did not help when the insurance company was denying medications and treatments, updating the claim or when there was a report that was not correct. He just blames Arnold Schwarzenegger for the corrupt system we currently have now . His staff is just as lackadaisical as he is. Please pray for this man, as his judgement day is going to be harsh.

Mr Irwin represnted me in a Workers Compensation case, againt my employer, the largest WC carrier in California. Mr. Irwin was upfront with me about everything and gave my case his best attention to detail and got me the best settlement possible. As a senior adjuster I had worked with many attornies in Riversie and San Bernardino County, so choosing Mr. Irwin was an easy choice-he is honest, trustworthy, and has the best and most responsive staff. Mr Irwin is a respectful man who does his job with the utmost concern for his client, not the insurance company who is trying to save a dime at every turn. I would highly recommend him to anyone who had a legitimate injury.

Terribly hard to communicate with. It's been 6 years and I have only talked with him maybe 5 times. His office rarely returns phone calls whether to him, his secretary or his aide. I get silence instead of action and feel like I have no lawyer.

Nick is an intelligent man. I loe his bedside personality. Unfortunately some of his associates take side with opposing counsel and do not give me a opportunity to give a followup to clarify what may have really happened. I feel boxed in and little to no legal help or defense. It is a struggle to get on their page. Since I have not really been written in. For instance I asked his office to contact my doctor to ake shure the doctor had the write authorization tho give me my pain medication. They said, "No give the doctor a call yourself."

I was a client of nick sheedy in a work comp case. His office did nothing to help me through this difficult process. He let the comp system bully me around and only had his profit margin in mind. His staff is unproffecional and unhelpful in every manor. I would have been better off going at this myself. They sent me to doctors that down played my injuries just so he could settle the case as soon as possible and move on to his next victim.

I've hired this law firm to represent me and my experience has been the worst ever. They never return your calls, until you threaten to call the bar on them, then they'll contact you. They're very disrespectful, unprofessional, incompetent, etc. And, they only get you pennies compared to other folks I've spoke with and had minor injuries but received way more money than I did. This lets me know my attorney is crap!! Please, please, please read these comments and stay away. You'll regret it. , thanks to Sparagna, Sparagna. Oh, not to mention they have a fast turn over with employees. That should tell you something. My attorney even had the nerves to call me one day yelling at me, "Why aren't you here in court!" My response, "Had someone communicated, informing me via letter, email, or phone call I would've definitely been there." She even went as far as lying saying they sent a letter and called me. Never had a problem previously, but all of a sudden? Lies, Lies, Lies! Stay away from this firm.

When Diana Sparagna recieved my case she seemed to understand everything that was going on with me -physically and emotionally, as a result of an awful job. She did not review the case properly, she did not pay attention to details, I had to remind her about the important/details of the case. She never returned my phone call, the deposition was a nightmare. I did not feel suppoted by my attorney, she said nothing, there was never a briefing about or for the case. She did not come to the settlement meeting her husband (never met him) showed up, and our communication was awkwad at best. I did not get the settlement I deserved. Horrible Experience. I would never recommend anyone.

so far, ive gotten excuses and a rude staff about how they will not release info about my mother even though i have power of attorney. First impression is all bad. Its obvious he makes excuses not to talk with you. the response I got when i called twice was, he got your message and will call you when he calls you. So far this has been extremely unprofessional and now have to drive 2.5 hrs to join my mother as i do not trust she is in good hands. I would advise a more empathetic attorney with better reviews. I have a business and would never run mine in such manner.

Mr. Borenstein took over the case thankfully. But it didn't turn out well. Even though my left foot, ankle and leg were intentionally ran into and over with an 2,200 lb power lift. And crushed to the point that the foot, ankle and leg swell a lot even after 5 years. 5,520 was taken out of the Settlement amount even though I never took any Disability relating to the injury. I caught staph infect. in a personal matter not Worker's Compensation related. Well Mr. Borenstein's purpose, the exact reason he was hired . was to catch such Underhanded tactics from Tobin and Lucks LLP. HE DIDN'T. So I basically received nothing. Zero money. So, I'm closing out this other case currently and they're also trying to Close out the "Future Medical" on the Foot ankle case and I realize the mistake Mr. Borenstein made so I call him. He was borderline rude with me. Friggin unbelievable! Saying "your coming back to me after five years! I can't do anything." Well all I can do is see if I can file a State Bar Complaint. I have no choice. In these very tuff times I hired him for the particulars and he muffed it! Period! Now we're out minimum $5,500.00

I had hired him for a workman’s comp case. I am completely disgusted with the service he provided. I never spoke to him about anything and it was always relayed through a paralegal that never listened to my concerns or would even contact me with updates. They would make business decisions that would benefit their firm but not me. Wouldn’t even discuss anything. I feel as if they really don’t give a hoot if you are a First Responder or not. Read the reviews online and make your own decision , but I wish I never hired him.

If you look at the website you will see that their law firm specializes in handling Public Employee Cases, mainly Law Enforcement and Fire Fighters. With this being said, I must say that I am very happy with the handling of my case. Mr. Hampton told me upfront that it would take at least a year to handle and most likely longer since the STATE COMPENSATION INSURANCE FUND will likely deny my claim (which they did) and that we may have to litigate it in court. It has taken 2 1/2 yrs., 3 doctors and a deposition, which was delayed for 4 hours due to the State Attorney being late, (I guess my time wasn't important to the other side, even though they sent me a letter stating if I was late my case would be denied). This week I received a letter from State Fund assuming responsibility for my injury and a six figure settlement.

He was recommended for a Workers Compensation case for us. Initially, in 2013, was okay, but 3 years later basically feel like he caters to Fireman and Police W/C cases. Namely contact has been with Susan, not Thomas Hampton. Phones calls are not returned for 3/4 days, if at all. I'm sure if our case was against the City, he would be great. But our case is not, so as far as a recommendation, due your research on this attorney

I prefer not to give any star to lawyer Robert Wyman who is laid back, not actively and proactively to fight for my medical treatment from worker compensation, the assistant asked me to apply the medical treatment through my insurance if any needed treatment gets rejected by worker compensation insurance. That sounded ridiculous, my health insurance won't cover any injury related to work, so I ended up without needed treatment offered for months but suffering pains daily basis. Secondly, before deposition, Robert didn't prep me well, only called for 45 minutes on the date of deposition, and his instructions was so off from the real deposition, 2 hours deposition online, Robert didn't support me at all, I was interrogated fully by the WC lawyer. If you look for a responsible, professional, reliable and diligent lawyer, please stay away from Mr. Robert Wyman, his office is on Geary Street, SF

I was injured at my CDCR job in January of 2020. I was ordered by my boss to do work not in my job description after I had been injured. I could not afford to take time off on Workers Comp. I support a family of five. In May, my employer forced me to go on workers comp because due to my injury I could not perform the duties which were listed at N/A in my job description. My co-workers all told me to contact Ferrone and Ferrone because they are the best for state employees. I quickly looked up their website, and asked them for representation. I was assigned Mr. Scott. He had his clerical contact me, and state that they were working on my case. Over the course of several months, I contacted his office several times. In October, I was wrongfully terminated due to my injury. I called him immediately. I HAD A FAMILY TO SUPPORT! My employer told me I no longer had health benefits and the salary of 9000.00+ was now zero. I frantically called Mr. Scott! After weeks!!! For the first time he called me back and said, "You have no case, you should just retire." I would be receiving no benefits and $1,000.00 a month to support my family, he said there was nothing else to do. Luckily, Mr. Scott left Ferrone and Ferrone and attorney John Ferrone answered my call for help! I now have my job back, I am supporting my family again, not losing my home, and Mr. Ferrone is assisting me in all the areas starting back in January where things went wrong. Mr. Scott misled me, wasted my time for months and did not care that my huge state employer was going to ruin my entire life and family’s support. I would have lost everything if it were up to him. Stick with Ferrone and Ferrone for work issues.

I’m not typically one to leave reviews but I feel it is necessary to warn anyone who is considering Spencer Gong as their lawyer. I have been trying to contact him and his office about my case for over 3 months now, left multiple voicemails but no one ever returns my call sand now their machine is too full; it’s gotten to the point where I’ve personally tried going there and now they’ve locked the office door and won’t let anyone inside. I understand that lawyers are busy but to not even be able to make an appointment and get ignored for over 3 months is just ridiculous. I can’t hire another lawyer since my case is “too old to take on,” Im living in constant pain and they’re not even fighting for me anymore… I’m honestly ready to close my case, which Is impossible to even do! I know there’s more I want to say but I’m too frustrated and hurt to even put it in words. Just stay away.

If you can choose a different lawyer or attorney I recommend you go elsewhere. No type of communication and really doesn’t help you with your case. I feel like they have been trying to pressure me into signing, the first time I went into the office the first thing Spencer told me was “you are not going to get rich over this” I never said I was and never planned too I was just looking for a “good” lawyer to help me with my case. I am now living with constant back pain and this office doesn’t seem to care not once did they call me to check up on me or ask me if I had any questions I was the one that would call and no one would answer. I also called and was able to talk to a lady I don’t remember her name but she told me “ you don’t need to be calling us if we need anything we will call you” I just wanted to check the status. This office doesn’t really fight for you and honestly I feel like they are more on the insurance side then on the injured workers. I don’t recommend them if you can go elsewhere just do that.

I used to work at a big company for over 17 years.. got injured and need an attorney... what I did was asked some of my fellow peers to recommend a attorney which they did... most of them at the company used this 1 workman's comp injury attorney so I called the attorney and explain my case.... and in about 5 quick seconds I was told "I didn't have much of a case and there was nothing there that he could help me with"... so what I decided i'd do was to go on workman's comp lawyer site and explain some of my case and send it out to several attorneys and what I got back was "screening services" if you don't know what a "screening service" is... those are the employees that work for the attorney that get the case basics on these sites...then give the person in need of services a call and have them explain the details of the case... then what they do is tell you "we'll give this to the attorney and will call you to let you know if you have a case" so several of these attorneys "screening services that actually called me back... ALL basically said the same thing "you have nothing there... there's not much of a case?( can you believe this)... and then I got a call from ONE attorney... I REPEAT ONE actual attorney Lyle Foz... he took the time out of his busy client schedule to listen to me go over the case.. I told him detail by detail as I did the others... he stated to me that he believed there was something there and he with my permission would like to take my case on.... I said "you know you're the only one that actually called me back personally"...I give permission to take my case and I never regretted it... what I got was a "genius of an attorney" not only does he work for the client (common person) but he also works for the defendants(big companies) so he has the expertise in both areas and avenues of what happens in day-to-day work comp case on BOTH SIDES.... I was extremely blessed and fortunate to have him on my side.... not only did he practically take apart the defense... he even got a lot of big obstacles moved out of the way so my case was settled And over in 1yr & 8mths... whereas when little people take on big companies.. cases can drag out for over 5 years... he was right on time(thorough) very personable and extremely extremely knowledgeable... so if I were you.... I would definitely PAY HEED to this review and give Mr. Foz a call... you'll WON'T ever regret it!!

He has stepped in so many times on my behalf to get the care I need, but, I had to be active WITH him. Just like the doctors today, you must be fully committed along with them, you are not their only client! How did I get past the "gatekeepers"? Persistence! I was represented by this idiot for a workers comp.back injury..as the previous review said its nearly impossible to actually talk with him...he carried my case for 7 years, I met him 3 times in that span , the initial meeting, the deposition,& at a very informal meeting between him & my former employers lawyers to decide of the case would be accepted as a valid claim...lets keep In mind I am seriously injured, only being relieved by medication, sitting in a folding chair for 6 hours before he finally came out and said they don't think your injury is serious enough..coming to this conclusion by reading 4 different orthopedic reviews all starting I had a 10mm disc herniation at L-5 S-1..of course in the Dr report it said 1cm...they said that was not substantial...this is why I call him inept...1cm or 10mm is just below 1/2 inch.after I have him a very fast and clear math lesson he ran back up & represented this and a room of lawyers were dumbfounded that all their education combined they could not figure this out yet a simple high school grad working retail showed them up..needless to say the next words were good news they are accepting your claim. Keep in mind to get to this point took 8 months after injury. I knew I was in for a long ride. Little did I know it would be a long as it was. 18 doctors, 7 orthopedic specialists in 2 years all agreed what was said 2 months in after first MRI, surgery is needed, yet it took them 2 years to the day of accident to perform surgery...failed surgery, UN-repairable nerve damage. 46% disabled..on top of my issues I CDs not get a hold of him, I finally sent a letter to him demanding attention or I would terminate him as its my right when not being represented properly..as soon as he seen his 15% going out the window he started sending communication to me. I was never given anything but limited W/C pay unlike everything I had the right to, such as a position catered to my limitations and restrictions, no vocational training, almost like they once again forgot it wad a legit claim. By this time I was frustrated, depressed, and at times furious. The deal I accepted was way under what I would have got with an actual lawyer, but I needed to move on with my life. Now the company I worked for, its a retail home improvement giant,I was the best at what I did,7 years of employment & the highest marks in every review. He had a chance to make a name, take down a company for millions, we came no where near that..as a matter of fact to receive the award I did I had to agree to never work there again, which I believe violates W/C rights..but I was done fighting with both my lawyer and their lawyers. I still sit unemployed because of this..can't get state disability, or ssd because I had been out of work so long...needless to say thank good I have family otherwise I would be on the streets with no income..life is hard & these programs are in place to protect you & lawyers are there to fight for you when you can't...I was duped, put on the sideline for 7 years, lost my livelihood, my health had taken several hits, my pride, & essentiallymylife was taken from me because thus man is an inept, unreliable, impersonal man who dies not care about his clients...he robbed me of my life, don't let him do this to you..how he has a rating over 1 is just astonishing.

Richard and Mona are horrible at communication. They will not let you know when something has been updated with your case. You will need to stay on them constantly to get things done, and to get updates on what is happening. I am kicking myself for not doing more research before choosing representation. Avoid at all costs!

Something is really wrong with my case!! We started a claim against big company, I was hurt at work permanently and we reached a very small settlement in the amount of 20,000 for 5 years of time. One day he called and sd hay the insurance company called and wants to settle for $20,000.00 and you will receive 17,000.00 tax free and in one weeks time i was thinking wow this as a blessing and i said ok because he recommended this is a good deal even though i knew of others in the same company that were hurt the same way as I did and received 80,000 each, so we were thinking this is low because i have a permanently , but he said to hurry up and take the deal because they might take the offer back and if we went to court they just might not give me any money at all. so i agreed not really knowing how this attorney was because in the 5 years we never really talked with him but maybe 2 times at the beginning and on the phone. Now we make a app to sign the papers and then he was talking fast and stated all the money is $17,000 less $1840.00 and said this very quickly like there was this notice to us about $1840.00 less even though your said just a week ago that the money was suppose to be 1700,00 tax free where is this $1840.00 coming from? he looked stunned like he didn't even know what he was just taking about then he stated we had gotten advances from the insurance company and I had to remember getting this amount and from this insurance company name ? then i said no i never got any checks in the amount of 1840.00 4 years ago at christmas time. I would remember that because i was on workman's comp and we were broke so at christmas I would have remembered that! then he said it could take a few days to have the insurance company to check there files and come back with canceled checks. so we waited and sure enough the insurance company didn't have any canceled checks and he said that they would settle right (1840.00 less) the same deal as before or we would have to wait again for 4 months to see if they can check again to see if they can come up with canceled checks and if we wait the judge was for sure going to give us less and possible nothing at all. sounds crazy but when your there and someone is telling you $20,000 or wait no nothing at all. you start to think this isn't right but Id better go along with this because what if he's right. So i agreed after I didn't want to but he insisted again stating you might not get a penny! and I'm going to do something very special for you I'm going to go and tell the insurance company right now to split the difference (900)a 900.00 less I'm even going to through in a hundred dollars of my money.? so he came back and said ok i got them to settle for 16,160.00 . ok he told me 16,200.00 but it dosent matter its only 40.00 and he took a hundred out of his own settlement wow he's such a good guy, NOT at all because after we got the settlement papers that he was holding the whole time and never let me look at ????? we noticed the $1840,00 was stated as paying me $1840.00 worth of workman's comp benefits not insurance company advances like he was trying to rejog my memory for. so i called him and said wait one minute your the lawyer and u knew the whole time that the money in question was not from the insurance company and we settled for 900.00 less because we were waiting on the insurance company to come back with canceled checks in there name not workman's comp? he was stunned and retracted all his previous statements and so i said do you remember you said the whole time he was waiting for the insurance company to show us proof that the money came from there company? and he said well the workman's comp is not company ?? and that i didn't understand the whole deal and if i was unhappy with the settlement???? are you serious have you been listening to me at all?

Due to this organization not doing their job, my family and I went to a D.A. and now the attorney who I complained about is no longer on the case. Returning phone calls is not their top priority. It can be flustrating at times. I do not live in fresno. I wanted to talk one on one and get the name of the person who was working my case. I found his staff to be courteous and help full. After talking to my case manager, I always got and answer for my question, even though I still had to call the office. Some comp. case's take a very long time to settle. They are not just cut and dried. There are many legal issues to resolve. I found this law firm does not take any short cuts and they work to make sure you receive every thing you are entitled to. I did not meet Mr. Mong'e until the day of my hearing. I was very impresses with his professionalism. He will explain what will happen when he takes you before the hearing Judge. My case was settled that day. It is hard to be patient when you don't understand the legal process but this Law Office will represent you'r interests in the best possible way. My case took over two years.

I have been ongoing with my case since 2011. I am so disappointed with this firm. I have to be the one to always call them. And they say I will call you back and they never do. There is never any resolution to anything. They never follow up unless I call them to see if they contacted the adjuster or anyone else. I have never been through a worker's comp case, but I am sure that things should not be handled as they are. And it seems to me that all they care about is there money. And not fighting my case. I just wish this would be over soon.

I became a client in 1997. My case is still ongoing. Need I say more? No return phone calls unless I send a certified letter. My comp carrier has deep pockets that we bailed out a few years ago. They have stopped providing my medications and when I call Monge's office I am told it's my doctors fault. No, it's my attorneys fault for not making them do what they are required to do.

The worst most unprofessional office ever. if only I had read all these negative reviews on William Greens office, i would of never ever hired them. They never communicate, they never call you back, they always end up hanging up on you and never return emails until you threaten to take them to The State Bar. They lie continuously to you. One of the worst employees is Noemi who calls herself the manager. She is absolutely so unprofessional, dishonest and does not give a s... about you or her work environment. i do not see how she can be called a manager when she does NOTHING for this law practice but destroy it. I ended up firing them and am so glad i did. This place is such a nightmare to deal with. I ended up working out my work comp case without them on my own. I must say what a pleasure it was dealing with the defendants insurance attorneys. They were so very professional. They called me when they said they would. They emailed me when they said they would. They answered all my questions in a very professional manner and were just a pleasure to deal with. If anyone has a work comp case, RUN from this law firm.

I had a case with Mr Green for many years. I like him as a person and i trusted him. But after 14 years i became very sceptical of all the things that happened. The biggest problem is communication with most of his clients. The problem i am having now is i left the country, and the covid is keeping me from getting to really push the firm to settle my case. I only talk to a legal assistant, and that is only by email, when he decides to answer my emails. It has been so long that no other attorney wants to handle the case. So i am basically stuck with them. Well, i have one attorney that might help me. Anyway, The legal assistant always has another reason to keep the case going. I am almost convinced that they want to keep it going. At first the legal assistant told me the rating and how much we could get if i just wait longer. I waited and now he is saying the settlement is much much less. I spend a big part of my life going to MRIs, exrays, doctor visits, evaluations, re-evaluations, depositions, etc. Now they still wont settle the case, and they keep me holding on to nothing. I am retired now and drawing social security and pension from my job. But i cant get them to settle the case. I guess i will have to get the other attorney to intervene and help with the case and pay an extra fee for that. Or i will have to complain to the board. I am very very disappointed in that group of people. I dont think anyone knows where the office is. Bill goes out to get clients and then you talk to people in some office somewhere. The mail goes to a post office. I thought Bill was a friend, but now i am wondering about all of them.

This has got to be the worst office, my husband had him as a lawyer for 4 months. His wife-Paralegal yelled at my husband when he called and asked for a milleage form and some questions about his case.My husband would call and leave messages with no response. He has injuries that require a Dr because he is in pain and he sent him to a chiropractor. We switched lawyers now this office wants$10,000 for supposedly working on my husband's case for 4 months which I'm not sure what he did besides sending him to a chiropractor. And he has the oddasity to not releasing my husband's case file. Now he can't even go to the Dr either because of what this lawyer is doing.. STAY AWAY FROM THIS OFFICE YOU WILL REGRET IT!

If I could give a rate to this place it would be a 0. The law attorney, Esequiel Solorio, has been working on my mother's case for 4 years and still has not solved her case. He has failed to send her to the doctors within the first 2 years up until last year; now she has gotten worse from her injuries. He doesn't want to advance her case, based on my observations. It seems like he just wants my mother to give up and settle with the 58k for her permanent disability on 2 injuries knowing she has 3 injuries! It's upsetting, because as an attorney, you should do everything in your power to fight your client's case. Also, her assistant, Cecilia is not attentive. NOT RECOMMENDABLE.

Hugo has been my attorney since 2009,and he has been wonderful to me .I was recommended by a friend to go see him and since then I have recommended two other people to go see him. In 2011 I was told I had pancreatic cancer so I called him because I was worried about my family and he was very sympathetic and understanding.A couple days later I received a letter from him telling me that he was sorry for my recent diagnosis. And he would do what he could to help me and my family. That letter is what got me through a very scary time in my life, and made me feel he was looking out for me. I later was told that a mistake had been made and after many tests that were done, I did'by have cancer. So I thank him everyday in my prayers for not only being a great attorney ,but a great human being.

No lo recomiendo para nada, mi caso fue accidente de trabajo, pero así como yo también tenemos derechos y podemos reportarlos al bar de abogados. Yo lo reportare para que no se aproveche de otras personas. No se merece ninguna estrella.

I work in the workers compensation department of a large organization which uses Mr. Lebovitz's law firm. Of all the lawyers we hire, Mr. Lebovitz has been the worse. He is unorganized and doesn't return our calls. He gets into unnecessary (and expensive) disputes with the injured workers and their lawyers. The pursues "issues" and "theories" that no other lawyer would think are relevant. In the end, his "theories" don't result in anything productive -- but they cost us money in legal fees as he pursues them. We avoid using Sam when we can. At one time, Sam may have been a decent lawyer. But, I don't think he is anymore. Maybe he has a very heavy case load which prevents him from giving the time to deal with our needs.

The employee Aaron i spoke with hung up on me when asking how we’d go about sending receipts and placed me on hold about 20 times in our hour long bs conversation. Kenneth Fram does not have any disciplinary actions taken against him on record because, The State Law Board refuses to take them. Instead, they tell you to sue him for negligence. And goodluck with finding an attorney to sue another attorney. Kenneth Fram took my entire settlement and lied about it. And I would have never known about it, had I not heard the defense attorney speak about it. And The State Law Board, allows attorneys to get away with these types of acts, with no consequences. Leaving injured workers permanently disabled, unable to seek future employment and impoverished. There is a special place down below for Kenneth Fram. Because, I know I am not the only person he has done this to.

Won’t fight for necessary medical treatments. Haven’t received a single payment and I have permanent injuries. 9, 10, 12 years is way to long and I was not forewarned that this would go on for so long. Upon initial contact over and decade to ago, Warren Green successfully sold himself as a knowledgeable, hard-working, fiduciary with extensive Workmen’s Compensation experience. After over a decade of “ grappling “ with the Workmen’s Compensation system it became clear that Warren green expended very minimal time working on the case, never scheduled a single hearing with an administrative Workmen’s Compensation Judge or expanded efforts to bring the case to trial. BEWARE that he does not provide clients with an email address, business voicemail, or a cell for text or voice communication. He clearly has established his practice of minimizing any paper trail beyond the minimum to keep the case open. He clearly was not “ fighting “ to address necessary medical care and/or a settlement. When you ask him a straightforward question ( which you can typically google with some effort ) he will tell you that he does not deal in reality. Minimal (rude) support staff, no apparent paralegal support at all; patiently waits for the case to settle at any percent ( with absolute minimal effort to organize or advocate ) counting on his percentage of ANY settlement. If you do retain him, it will be virtually impossible to obtain alternate councel. BEWARE!!

What a Workers’ Compensation Lawyer Can Do for You

A workers’ compensation lawyer specializes in helping employees who are injured or become ill as a result of their job to receive the benefits they are entitled to under workers' compensation laws. These lawyers represent injured workers in claims for medical benefits, wage replacement, and other compensation related to workplace injuries or illnesses. They also help when claims are denied, benefits are delayed, or disputes arise with the employer or the insurance company.

Whether you've been injured on the job, developed an occupational illness, or are dealing with a denied workers' compensation claim, a workers’ compensation lawyer can help you navigate the claims process and ensure you receive the full benefits you deserve.

When Should I Hire a Workers' Compensation Lawyer?

You should consider hiring a workers' compensation lawyer in several situations, especially when complications arise during the claims process or when your rights as an injured worker are being challenged. Some common reasons to hire a workers' compensation lawyer include:

  • Claim denial: If your workers' compensation claim has been denied, a lawyer can help you appeal the decision and represent you in hearings or litigation.
  • Inadequate benefits: If the insurance company offers you a settlement that doesn’t cover your medical expenses, lost wages, or other damages, a lawyer can negotiate on your behalf for a fair amount.
  • Delay in receiving benefits: If your benefits are being delayed, a lawyer can help expedite the process to ensure you receive timely compensation.
  • Permanent disability: If your injury leads to permanent disability (partial or total), a lawyer can help you navigate the more complex process of securing long-term benefits.
  • Retaliation by employer: If your employer retaliates against you for filing a workers' compensation claim (e.g., by firing or demoting you), a lawyer can protect your rights and pursue legal action.
  • Third-party liability: If a third party (e.g., a contractor or equipment manufacturer) was responsible for your injury, a lawyer can help you pursue additional compensation through a personal injury lawsuit.
  • Pre-existing conditions: If your employer or the insurance company claims that your injury is related to a pre-existing condition, a lawyer can help you present evidence showing that the injury was work-related.

Hiring a lawyer early in the process can prevent delays, avoid mistakes, and ensure you receive all the benefits you’re entitled to under workers' compensation law.

What Does a Workers' Compensation Lawyer Do?

A workers' compensation lawyer provides a range of legal services to injured workers, ensuring that they receive the benefits they deserve. Their tasks often include:

  • Filing claims: Helping injured workers prepare and file their workers' compensation claims to ensure accuracy and timeliness.
  • Appealing denied claims: Representing workers whose claims have been denied and guiding them through the appeals process, including hearings and court appearances.
  • Negotiating settlements: Negotiating with insurance companies to secure fair compensation for medical expenses, lost wages, and other damages.
  • Handling disputes: Resolving disputes between the injured worker, the employer, and the insurance company regarding the amount of compensation or the nature of the injury.
  • Coordinating medical evidence: Gathering and presenting medical records, expert testimony, and other evidence to support the workers' compensation claim.
  • Advocating for benefits: Ensuring that injured workers receive all the benefits they’re entitled to, including temporary or permanent disability benefits, vocational rehabilitation, and medical treatment.
  • Filing third-party lawsuits: In cases where a third party is responsible for the injury, a workers' compensation lawyer may also pursue a personal injury lawsuit to recover additional damages.

How Are Workers’ Compensation Lawyers Paid?

Workers' compensation lawyers typically charge a contingency fee, meaning they only get paid if they successfully recover benefits for you. This fee is usually a percentage of the benefits awarded, and the specific percentage is often regulated by state law. Here's how it generally works:

  • Contingency fee: The lawyer's fee is typically between 15% and 25% of the total benefits awarded to you. You don’t have to pay any upfront legal fees, and the lawyer’s fee comes out of the settlement or benefit award.
  • No fee if no recovery: If the lawyer doesn’t recover any benefits for you, you generally don’t have to pay for their services.
  • State regulations on fees: Many states cap the percentage that workers' compensation lawyers can charge, and some states require the fee to be approved by the workers' compensation board or judge.

Be sure to discuss the fee structure with your lawyer during the initial consultation to understand how much you will owe if your case is successful.

How Much Does a Workers' Compensation Lawyer Cost?

The cost of hiring a workers' compensation lawyer typically depends on the contingency fee arrangement, meaning the lawyer’s fee will be a percentage of the benefits you receive. General cost estimates include:

  • Contingency fees: Most workers' compensation lawyers charge between 15% and 25% of the total settlement or benefits awarded. For example, if you receive $50,000 in benefits, the lawyer’s fee would range from $7,500 to $12,500.
  • State regulations: Some states limit the percentage that workers' compensation lawyers can charge. In these cases, the fee is usually capped, often at 20% to 25%, depending on state law.
  • Additional costs: Some lawyers may charge for out-of-pocket expenses, such as filing fees, medical records retrieval, and expert witness testimony, though these costs are typically deducted from the settlement after the case is won.

You should always ask for a clear explanation of fees and potential additional costs during your consultation so you understand the financial arrangement.

Top Questions to Ask a Workers' Compensation Lawyer

Before hiring a workers' compensation lawyer, it’s important to ask the right questions to ensure they are the best fit for your case. Key questions to ask include:

  1. What experience do you have with workers' compensation cases?
Ensure the lawyer has experience handling cases similar to yours, especially if your injury is severe or the case involves disputes.
  2. How do you charge for your services?
Clarify whether the lawyer charges a contingency fee and whether there are any additional costs you need to be aware of.
  3. What is the likelihood of success in my case?
Ask for an honest assessment of your case, including the potential challenges and outcomes.
  4. Have you handled cases like mine before?
Find out if the lawyer has experience dealing with cases involving similar injuries or disputes, such as denied claims or permanent disability.
  5. How long will the process take?
While it’s difficult to predict an exact timeline, the lawyer should be able to provide a general estimate based on their experience with similar cases.
  6. Will you personally handle my case?
In larger firms, junior attorneys or paralegals may handle parts of your case. Make sure you know who will be working on your claim.

How to Check the Credibility of a Workers' Compensation Lawyer

To ensure you are hiring a reputable workers' compensation lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no disciplinary actions against them.
  • Look for workers' compensation experience: Review the lawyer’s website or professional profile to ensure they specialize in workers' compensation law and have successfully handled cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s expertise and service.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their experience in workers' compensation cases.
  • Check for professional affiliations: Membership in organizations like the Workers' Injury Law & Advocacy Group (WILG) or local bar association committees on workers' compensation can indicate the lawyer’s commitment to this area of law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a workers' compensation lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Accident report or incident documentation: Bring any documentation related to your workplace injury or illness, including accident reports or notifications to your employer.
