I was injured in a bike accident. The driver was sitting in his car and opened his car door on me as I rode by. Ended up at the ER with 6 internal and 6 external stitches in my neck, an inch away from my carotid artery, a sore wrist which a MRI revealed to be a slight tendon tear and abrasions on my knee and hand, plus a sore shoulder. The driver's GEICO insurance tried to refute my claim saying I was 50% at fault for not looking to see if a driver was in the car. The police report said he was in violation since I had the right of way. I initially contacted a larger law firm I saw advertised on TV. They referred me to Braid.
Braid was great. He told me these things might take a while, but to be patient. GEICO initially offered to only pay my medical expenses, then a little later expenses plus $7K. Braid advised me to wait because he was sure he could negotiate more.
Eventually he negotiated a significant settlement, much more than I ever expected. The whole process took 7 months. I highly recommend him.

During the course of a complicated $2M+ development project in the Town of Los Gatos, I retained the services of attorney Rick Gullen from the law offices of Rossi, Hamerslough, Reischl & Chuck in response to neighboring property owner’s lawsuits objecting to the project, as well as a breach of contract. Additionally, despite the project being permitted, there was increasing obstruction by City administration in response to these lawsuits that required Rick and his firm to intervene. The scope and breadth of the litigation required the involvement of California Fish and Wildlife, US Army Corp of Engineers, California Water Board, Air Quality Management District, County of Santa Clara, Town of Los Gatos Town Attorney, as well as surveyors, engineers, arborists, and hydrologists.
In addition to his years of personal, in-depth real estate law knowledge and litigation experience, and a large firm behind him specializing in complicated real estate matters, Rick brought to the table personal connections with experts ranging from former city Planners, structural and geotechnical engineers, aerial photography firms, surveyors, specialized insurance attorneys, property title experts, traffic engineers, etc.
The litigations spanned issues including easements, access right of ways, public vs private roadway right of ways, lot line disputes stemming from titles and maps from the 1800’s, and he also successfully won an arbitration award for liquidated damages, arguing against a complex claim of unmarketable title due to appurtenant easements and junior vs senior deeds of trust.

On a quiet Sunday afternoon about six months ago, I was served with a civil complaint contesting the ownership of one of my residential rental properties in San Jose. I was concurrently noticed of an “ex parte” hearing scheduled for 8:30 am the following Tuesday morning at which time the allegedly aggrieved Plaintiff would seek a court order to immediately place my property into receivership and begin collecting all of the rents etc. I literally had only hours to formally rebuke this craven, contumelious assault and to affirm my ownership position in this property!
I contacted RHRC early Monday morning and found the firm’s initial response professional and sympathetic to the absolute urgency of my plight. Rick Gullen quickly agreed to re-arrange his calendar and meet with me that afternoon to review the complaint and formulate an appropriate response. By the start of our meeting, there were less than eighteen hours before the “ex parte” hearing scheduled for the next morning! Rick, his assistant, and I worked diligently for the remainder of that afternoon and evening to prepare our formal response. We were ultimately successful in this endeavor and the Judge denied all elements of the receivership motion. In the ensuing weeks and months, the complaint response and a counter suit were filed and the discovery process was initiated. Recently, this case was resolved through mediation with an executed settlement agreement very much to my benefit.
As a successful entrepreneur and retired tech executive, I have had considerable experience dealing with dozens of attorneys during the past several decades. I have retained or otherwise engaged attorneys on three continents who specialized in litigation, corporate law, contract law, employment law, family law, patent law, intellectual property law, and international law. All of these attorneys were competent in their respective fields – some were even exceptional. Never however, had I prevailed upon any of my counsel to respond to an issue with such immediacy as I did with Rick. He willingly rose to the challenge as my advocate and successfully countered the opposition at every turn.
For the duration of this case, Rick consistently demonstrated his broad knowledge of the law and his experience in resolving real estate ownership conflicts. His recommendations regarding the strategies and tactics most likely to successfully engage the opposition were very insightful. Rick’s sage advice on the legal options available not only to me as the Defendant, but equally important, the various options likely to be pursued by the Plaintiff, were particularly significant in my management of this case. His pensive, amicable demeanor combined with his tenacity and dedication to defending his client and prevailing in the case, were indeed exemplary.
Should the need ever arise in the future, I would not hesitate to call on Rick for assistance. I am certain however, that he would very much appreciate having more than eighteen hours notice to prepare a formal response and appear in Court on my behalf! I can unequivocally recommend Rick Gullen as an advocate who always represents his clients’ best interests and as a consummate professional in the practice of real estate law.

Jessica was the calm, smart, and knowlegable friend who protected me and my son when I was scrared, depressed, and angry at end of my relationship with his mother. My son's mother threatened that our son would live with her, and I would only be allowed to see him when she saw fit. I was devastated and demoralized at the idea of not being able to see my son. I was a shambles when I sat down for my first appointment with Jessica. I'd never worked with a lawyer before: was it going to be all business, or could I share my fears, grief? Jessica made space for me to reveal to her the wreck that I was. It was vital to me to show her how important my son was to me, how scared I was by the threats our son's mother had made. She let me know she'd dealt with other fathers as scared as I was, that she understood the fear the legal system can inspire when a parent is already in fight-or-flight mode because of the end of a relationship. Then she walked me step-by-step through how the process goes, never impatient at having to re-explain the details to me. It was also important to me that I remain a “good guy”. I didn't want to do any character assasination to my son's mother, I didn't want to be adversarial in court. Jessica agreed with me, and together we crafted all communications with the opposing counsel, and the court. We won, but even if I hadn't I wouldn't regret having hired Jessica. After my experience with her, I don't believe there is anyone who could have done a better job.

I was ensnared in a corupt child protective services juvenile matter (DCFS) and my 2 children which started in Dec 2007. although it was dragged out in local juvenile court over the next 2 years in a manner which was done as a punitive means by the temp judge- He helped ensure my children weren't taken away thru that time. I knew my civil rights and those of my children's were violated from day 1- I am blessed that he responded to my massive blanketing of law firms, and that he is an expert in the field of suing CPS DCF for violations of rights. He made sure my child was never in the care of the unethical people the devil sent. He made sure she was set free from corrupt practices from judges and social services. He is following the land of the laws, he is honoring the Constitution of the United States. Mr. Powell is honoring the Bill Of Rights, puts a stop to violation of citizens 42 U.S.C 1983. Robert represented my ex-wife and was definitely one of the best lawyers I have encountered. My attorney was VERY expensive and I was truly disappointed. She was not able to stand across from Robert in the court room. I had noticed his knowledge in the law and his real life experience combined made one of the best arguments.
Years later I remarried and my current was just finishing her divorce and custody case. Her lawyer at the time was very passive. We hired Robert and let me say what an honor to have him on my side! Aside from what he can do in the court room he is VERY compassionate with his clients, always available and will give you all the facts so that you can make informed decisions about the next steps.

When called on it, she was aggressive and failed to take accountability even after acknowledging to my brother and I she was busy handling trial matters. Awful bedside manners and rude. We fired Patricia Boyse and had to immediately hire a new attorney, incurring substantial legal fees for the new attorney to come up to speed before the scheduled mediation. Horrible experience.

In first consultation, Richard took time to understand our situation and willing to answer our concerns and questions. I knew we found the right person. Instead of glory promises, he told us the reality possible outcomes. My partner and I dropped in to Mr. Wingerden's office this week while seeking counsel for my partner's criminal case. Long story short the SCC sheriff unlawfully arrested my partner (who is a retired criminal) & falsified the police report - quite poorly as a matter of fact (I give him an "F" for effort...) The public defender neither followed up with us nor provided the discovery we on several occasions requested, so 2 days before court we were extremely desperate after leaving the Public Pretender's office as (again) he was nowhere to be found. We dropped by Richard's office where we just so happened to catch him. He wasn't working that day but had stopped by the office briefly. I informed him that we had legal coverage through ARAG offered by my employer, and was hoping he could assist us considering he is a ARAG network attorney. Unfortunately, Richard doesn't handle criminal cases via ARAG anymore (only Family & Estate) but he sat down with us for an hour or so and did a free consultation. He listened patiently and even took notes as my partner recalled the events and facts surrounding his case, and as we voiced our concerns/frustrations. Richard was very easy to talk to and has a personality that makes you feel like you're talking to a friend. I really wanted to sign him on to help us fight our case despite the fact ARAG would not cover it. I explained that I would be getting a large tax return any day now, and would spend it all on him and pay the rest out of pocket. Other attorneys (like the one I hired years ago for a DUI case) would tell me to sign on the dotted line and not think twice about it. Not Richard - he said that he didn't feel that is was right to let us hire him since our financial situation is already a challenge, and he didn't want to take all our money. His compassion extended even further when he told us that despite this, we could call him should we have any questions or need advice at any point in the future for this case or anything else. He did give us some solid advice, which I then did utilize when the Public Pretender called our name 5 minutes before court. I reiterated what Richard had advised, and when my partner was called in front of the judge that day the PD requested a motion that we be presented with the officer's body cam footage. The prosecutor objected, and although the PD could barely fumble a plausible explanation as to why we needed the body cam footage (because you know...who needs all the evidence in a felony matter anyways, right??? Cops NEVER lie!) the judge ultimately granted the motion to get us that footage. Without telling the PD the points Richard advised, he definitely would not have successfully filed this motion and perhaps wouldn't have even tried. If I ever require legal counsel for Family or Estate litigation I will 100% without a doubt give Richard Wingerden a call. THANK YOU RICHARD, don't stop being A ROCKSTAR with a BIG HEART.
