I absolutely do not recommend Juan Mendoza or their staff. My case was dropped with no explanation as to why it was. I talked to three different lawyers and I got a totally different answers than from him. They will just take your money. If my husband had no chance to get papers and he knew all along why give false hopes and just take over 6 thousand dollars from us. Also, when they needed to contact us for whatever it was that they needed for my husbands process they never contacted me, they went to my husband and I called to ask for more information they would tell me that they had already talked to him. Furthermore, when I had questions about legal matters he would never be available to talk over the phone and would make me come to him and would never take payments with card, they always needed to be cash. Kind of sketchy huh? If I had the possibility to give ZERO stars I absolutely would.

In April of 2022, I lost two sons in a car accident. July of 2022 after being harassed since April, 3 days after two of my son's died April 16th my four and two years old, dcf decided to begin to harass me. Immediately I start contacting mr cartelli, before the boys were taken in July I had informed him by hysterical emails documenting everything going on before even retaining him, I retained him a few days after their removal. I have listened to each word he's suggested and I am trusting him to keep his word so far he has. He is very caring, a very good person to retain as an attorney because he doesn't do this for the money he does this mostly because he wants to help and he cares. He does email back, he does call back. He's very welcoming to surprise drop ins, he always finds time to talk with me. Unlike a big law firm he's one person, against an entire court room. Trust him, what he says. If you retain him in the end youll be happy.

Mr Cartelli will no fight for you. He didn't care about my case, didn't answer my calls, and didn't discuss with me what i really need and finally didn't respect my desire, favor the other part. He only get the divorce over with. I do not recommend him at all. He even sent proposals to the judge that I strictly disagreed with.

I shelled out nearly $20,000 for his law firm for a crime that I was earnestly innocent and they basically led me to believe that they genuinely cared and I would be a priority. Once I handed them over the check, they didn't care about me anymore and I was mistreated by being ignored. Phone calls and emails were not responded to. I had no power to do anything about it because technically he is within his right to ignore me and not care about his clients. When you go in for a consultation, you see a brilliant fighter who will zealously represent you passionately and with fervor & diligence. Once the money is handed over to him, it is like Cinderella at midnight when she turns from a princess to an ordinary person. Basically, the lawyer you see during the consultation is NOT the same man he will act once he has gotten what he has wanted from you (your money). He will then suddenly then show his true colors once the motivation to I also found it EXTREMELY manipulative how during the consultation he emphasized that he sometimes turns down clients, and once you decide to hire him, he has the final say and there's a chance he will turn you away. In hindsight, this should have been a red flag because of how it induces you to consider yourself lucky if you are able to secure his legal representation. The last thing I want to emphasize is that "board certified" means NOTHING significantly valuable in the grand scheme of things. I over-estimated the importance of board certification but upon further research, all it means is that an attorney jumped through a few extra hoops so that they can put a shiny title next to their name or on their business card. Another instance of manipulation was how strongly I felt coaxed into signing a plea deal. During the initial consultation, I felt like he wanted to take my case to trial because he believed in my innocence. After hiring him, and as months passed, he emphasized that if I lost at trial that I could potentially be sent to prison because my charge was for a 2nd degree felony. I specifically remember him or his co-partner telling me that it's a bad idea to put my fate into the hands of a jury because the jury could potentially have unreasonable people who decide to take the word of law enforcement and simply vote to convict based on the fact very little evidence existed one way or another. I was made to feel that taking the case to trial proved I was being foolish and taking an extreme unnecessary risk of being sent to prison. In the interest of fairness, I will now briefly list a few positives about Kepler Funk. First, he's very intelligent. Second, he's super professional and hard-working during the initial consultation. Lastly, he has mostly 5-star reviews which I didn't expect. I guess if you're guilty and he gets you a good plea deal, then hats off to him. My experience with him was very negative and I feel like I owe my fellow Floridians a dire warning about him that he becomes a different person after he receives your money. The lawyer you see at the initial consultation IS NOT the same person you will represent you during your case. His diligence and professionalism and fervor all evaporate and you'll be left with an entitled, unmotivated lawyer who has zero incentive to do beyond the bare minimum job for you. In summary, this man is a mediocre lawyer, at best.

Let me first start off by saying that the justice system for people of color is a joke. I contacted Attorney Kelly Collier for representation by a referral of Zona Long Bailbond in Bartow. Being that my family had never had to seek bail or a defense attorney we weren't familiar with either company. We selected the two above mentioned companies. Not one of best decisions. I should have been alarmed when I was advised by the bondsman that they were legally unable to provide any attorney info but just so happen to have Attorney Colliers contact information visible for me to use. Once the initial meeting with Mr. Collier took place he was paid in full. He advised that he would be getting with the state to discuss if charges would even be filed against his newly hired client. We met Mr. Collier on 4/24/23 he seemed as if he was truly going to be able to assist in the matter. At time of initial meeting Mr. Collier was made aware that the potential plaintiff want to sign a waiver of prosecution but due to personal reason was unable to go to courthouse. I asked as the attorney for defendant would he be able to assist with get the waiver completed, his response was less that helpful. He could care less with assisting with clearing his clients name. From that point forward he was just another body at every appointment and seemed to never know what was going on. He was late to every hearing never recognized his client when he finally showed up. Just tacky and very unbecoming. He allowed the courts to continue to drag out proceedings instead speaking up on his clients behalf. The case was drug on for 7 months and Mr. Collier did absolutely nothing. He rarely answered the phone or responded to emails. On the morning of the final hearing 11/08/23 Mr. Collier was yet again late and walked into the courtroom and could not identify his client. As I sat in the hall he walks out and I addressed him. There is no victim & no actual proof of a crime committed so we are still uncertain how the state has a case. He acted as if he was dumbfounded as to this news. Yet he has the audacity to tell me the state wants to offer his client 1 year of probation. Funny thing is he never notified his client prior to this hearing. He assumed that we would accept this under duress. I instantly said no and it’s time for him to do his job. At this time he proceed to tell me that he is working two courtrooms and would be back. I had to the remind him that he has been paid in full & this defendant is also just as important even if he can’t remember his name or face. Time comes as his client stands before the judge the charges are instantly dropped. But of course had we accepted that one year of probation he would be another victim of the unjust justice system. We paid Attorney Collier for representation and almost got railroaded. To make matters even worse he wants to charge $500 to assist with record expungement. I would NOT recommend this attorney to anyone. Did not feel that he valued the importance of ensuring that my family was vindicated.

This man came and made all sorts of promises to me the morning of my trial, convinced me to switch to him. Then, after receiving payment, did absolutely nothing for 9 months. Despite having provided him numerous things for my defense, he literally did no preparing at all - he only came to discuss the case the sunday afternoon before trial! I had explained to him exactly what data was needed, and how to obtain that data, to exonerate me and he did not do this! This data would prove I could hot have done what I was charged with. I had also provided case law of an identical case that would show Florida had no jurisdiction. But because he failed to even read the case law, which clearly stated the court ruled in what would have been my favor, when the state misrepresented that case to court Mr. Wagner did not object and did not argue because he DID NOT EVEN READ THE CASE! Not only this, but I had hired him for a civil matter as well, and after 9 months, as I am sitting at the defendant table at trial, he STARTS to write a motion for that matter - and it was complete garbage! I literally had to rewrite it myself and not only fix basic spelling and grammatical errors, which were prevalent, but CORRECT HIM ON MATTERS OF LAW! This guy is about worthless - if you hire him, he will take your money, ignore you, judge you as guilty so as to feel ok about his poor work ethic, and try to get you a plea - which eliminates 99% of appeals! This is a big problem because when he blows his motion arguments from lack of preparation, he tells you "oh, don't worry - you can appeal this issue!" But you can't. So no, do not hire this man, or Steve Henderson, or Dan Ciener... Diamond and Funk are the only attorneys worth a penny in Brevard County. You would be better to hire someone from Orlando or elsewhere.

I had had a referral for Rachel Gorenflo, she had a full schedule, but her husband was highly recommended, so I paid Clif 10,000 to represent me in advance, I found Clif to be knowledgable, but his staff seemed to want to suck up all of my retainer with stuff that was already documented/discovered. Instead of helping me with my case, his staff seemed to only want to charge me with discovering things that were already discovered. The money quickly ran out this way and even though I helped with my own documentation, which he laughed about (to my face).. The document I prepared was never reviewed by the court. Instead of helping me with my case, his staff seemed to only want to charge me with discovering things that were already discovered. I would give a -5 star review and worse, the most inept firm I’ve ever dealt with, lost me my house or any reasonable compensation, in spite of the strong case and mounds of documentation I had to back my claims and the complete lack of anything substantial to support the other party’s claim. I did all the leg work, wrote all the proposals, yet was billed as though they did. Even if I didn’t have as good of a claim as I knew I did, there was one tiny, pathetic (and I mean pathetic, especially since I had all the documentation and the opposing party had none) argument made, lost paperwork, missed deadlines, extremely unprofessionally scattered, zero support throughout the process, ultimately bullied me to take a ridiculous settlement out of pure laziness or conspiring with the opposing team, honestly if it wasn’t incompetence then it was corruption, nothing else could explain how truly bad his ineptness was. This firm received more $ than I did in the end. Would only recommend to whomever you want to loose.

Terry is an unbelievable attorney and his years of practicing family law show in the way he maintains his law practice. That 5K turns into 50K in a heartbeat and you have nothing to show except for boxes of files ( 15 in my case ) showing hearings postphoned / 6 hrs of bs mediation etc... Not the case with Terry . Not prepared, canceled numerous meetings, no objections to a witness being led , no counter offer on states offer. Thank God we went elsewhere from Musca law it took a new law firm 2 days to get a plea deal to keep our innocent son from going to jail . We had been with Musca 1 1/2 yrs. I have been using Lee Hollander for any legal issues for almost 10 years, a total of 3 cases. The first case, he got thrown out the day I went to 24-Hour Court for a VOP. The second case was a habitual felony case and he got me probation, and even after a violation, I was out of jail at my first court date, with just a year of extra probation, that later he terminated for me anyway. The third case was for my family member, and he had her felony dropped to a misdemeanor and all she had to do was 10 classes, once a week. He's honest, I would go so far as to say blunt; some people may not be used to that. He does NOT sugarcoat things, but who wants a bull-****ter? He is excellent at what he does, he's been on both sides, and he loves it.

He will get up in the middle of your meeting to show you the door and doesn't return phone calls as promised. I would guess I'm not the first client he has lost money on because of their lack of tact and professionalism. I gave them a 2 because I got my full refund, otherwise it would be a 1 (0 if it was available). UPDATE: had no expectations other than what was said would be done, be done. If your wife/secratary says you will call me back by the end of the day, I think anyone would expect that would be the case or that at least be given a good estimated time frame of which I was rudely denied. Pretty fundamental business concept. And a client calling the next day after not recieving a phone call as expected, should be extremely understandable and acceptable, but I was met with irritation, defensiveness and snide behavior from your staff/wife. I do find it interesting that you find it important enough to argue about this on a public forum and make false and inaccurate comments but returning clients calls seems to be at the bottom of your list. Priority is everything and yours is a puzzlement. Being direct is not rude. Just honest. Wish you luck.

Gave retainer for custody trial. Told him repeatedly that I would not settle but wanted to fight for custody. He kept telling judge a settlement could be made who then sent us to mediation 2x. When I wanted my retainer back he made up pages of "work" he had done. Cost me 5K and months of my time.

Garrett helped develop an Estate Package for my mother and we were both very satisfied with the results. He took the time to determine exactly what she would and then went right into the necessary procedure to get us the documents.

I am very happy I found Mr. Briggs when I did. He worked with me and was truly compassionate to my situation. He took the time to understand every detail and then worked through each problem. It was amazing to see him work. Garrett Briggs exceeded my expectations and I would proudly recommend him to anyone.

What an Appeals Lawyer Can Do for You

An appeals lawyer specializes in representing clients in appellate courts, challenging or defending lower court decisions. If you believe that a legal error was made during your trial or that the court’s decision was unjust, an appeals lawyer can help you appeal the ruling to a higher court. They work to identify mistakes made during the trial, such as improper application of law, exclusion of key evidence, or jury misconduct. On the other hand, if you're defending a favorable judgment, an appeals lawyer can help protect the decision from being overturned.

Appeals lawyers don’t retry the case but instead focus on legal arguments and procedural issues to convince the appellate court to either overturn, modify, or uphold the lower court’s decision.

When Should I Hire an Appeals Lawyer?

Hiring an appeals lawyer is necessary when you are involved in a legal appeal, either as the appellant (the party appealing the case) or the appellee (the party defending the lower court’s ruling). Common situations in which you should hire an appeals lawyer include:

  • Appealing a conviction or ruling: If you’ve been convicted in a criminal case or lost a civil case and believe the decision was based on legal errors or improper procedures, an appeals lawyer can review the case and file an appeal on your behalf.
  • Challenging a sentence: In criminal cases, if you feel that the sentence is excessively harsh or not in line with legal standards, an appeals lawyer can work to reduce or modify the sentence.
  • Defending a lower court ruling: If the opposing party has filed an appeal to overturn a favorable ruling, an appeals lawyer can help defend the judgment and argue that the lower court’s decision should be upheld.
  • Complex legal issues: If your case involves complicated legal issues or interpretations of the law, an appeals lawyer can provide the necessary expertise to argue those points effectively before an appellate court.
  • Reviewing trial errors: Appeals lawyers can examine whether mistakes such as jury misconduct, improper exclusion or admission of evidence, or incorrect jury instructions occurred during the trial.

You should hire an appeals lawyer as soon as you decide to appeal or are informed that the other party is appealing the case, as appellate procedures are time-sensitive.

What Does an Appeals Lawyer Do?

An appeals lawyer provides specialized legal services to challenge or defend a lower court decision. Their role focuses on legal arguments, reviewing the trial record, and persuading the appellate court to either reverse or uphold the ruling. They can:

  • Review the trial record: Appeals lawyers meticulously review transcripts, evidence, and rulings from the original trial to identify any legal errors or procedural mistakes that could be grounds for appeal.
  • Prepare and file briefs: Appeals lawyers write legal briefs that present persuasive arguments to the appellate court. These briefs focus on the legal errors made during the trial and how they affected the outcome.
  • Present oral arguments: In many appeals, lawyers present oral arguments before a panel of judges, explaining why the lower court’s decision should be reversed or upheld based on legal principles.
  • Monitor case law developments: Appeals lawyers stay updated on changes in the law and precedents set by higher courts, which can be crucial in shaping the arguments they present during the appeal.
  • Provide legal advice on the likelihood of success: Appeals lawyers can offer a realistic assessment of your chances of winning the appeal based on the legal errors and evidence from the trial.

How Are Appeals Lawyers Paid?

Appeals lawyers typically charge for their services based on the complexity of the appeal and the amount of work required to prepare briefs and present arguments. Common payment structures include:

  • Hourly rate: Many appeals lawyers charge by the hour due to the significant amount of research, writing, and preparation involved in appeals. Hourly rates can range from $200 to $600 or more, depending on the lawyer’s experience and the case’s complexity.
  • Flat fee: For some straightforward appeals, a lawyer may charge a flat fee that covers all the work necessary to complete the appeal.
  • Retainer fee: In complex or high-stakes appeals, a lawyer may require a retainer, an upfront payment that covers the initial stages of the appeal. The lawyer then bills against this retainer for ongoing work.

It's important to discuss fees and costs upfront with your lawyer during the initial consultation to ensure you understand the financial commitment involved.

How Much Does an Appeals Lawyer Cost?

The cost of hiring an appeals lawyer varies depending on factors such as the complexity of the case, the lawyer’s experience, and the amount of work involved. General cost estimates include:

  • Straightforward appeals: For simpler appeals, such as those involving minor legal errors, fees can range from $5,000 to $15,000, depending on the scope of work.
  • Complex appeals: Appeals that involve complicated legal issues, multiple grounds for appeal, or high-stakes outcomes can cost anywhere from $20,000 to $100,000 or more, especially if the case requires extensive legal research, brief writing, and oral arguments.
  • Hourly rates: Many appeals lawyers charge hourly rates ranging from $200 to $600 per hour, with higher rates often associated with more experienced attorneys or particularly challenging cases.

Before proceeding with your appeal, it’s crucial to ask for a clear estimate of the costs involved so you can budget appropriately.

Top Questions to Ask an Appeals Lawyer

Before hiring an appeals lawyer, it’s essential to ask questions to ensure they are well-suited for your case and that you understand the appeals process. Important questions include:

  1. What experience do you have with appeals?
Ensure the lawyer has substantial experience handling appellate cases, particularly in the area of law relevant to your case (e.g., criminal, civil, family, etc.).
  2. How do you charge for appeals?
Ask whether the lawyer charges an hourly rate, a flat fee, or a retainer, and request an estimate of the total costs for handling your appeal.
  3. What is the likelihood of success for my appeal?
A good appeals lawyer should provide an honest assessment of your case’s strengths and weaknesses and the chances of winning the appeal.
  4. How long will the appeal process take?
Ask for an estimate of how long the appeal process might take, from filing the initial briefs to a final decision by the appellate court.
  5. Will you personally handle my appeal?
In larger law firms, junior attorneys or legal assistants may handle some of the research or drafting. Clarify who will be responsible for preparing and arguing your case.
  6. What is your approach to handling appeals?
Some lawyers may be more inclined to focus on procedural issues, while others emphasize broader legal arguments. Make sure the lawyer’s approach aligns with your goals.

How to Check the Credibility of an Appeals Lawyer

To ensure that you’re hiring a reputable appeals lawyer, take the following steps to verify their credentials and experience:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for appellate experience: Review the lawyer’s website or profile to ensure they specialize in appellate law and have successfully handled appeals similar to yours.
  • Check client reviews and testimonials: Look for client feedback on platforms like Avvo, Martindale-Hubbell, or Google to get insight into the lawyer’s track record and client satisfaction.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their expertise and success in handling appeals.
  • Look for recognition in appellate law: Membership in organizations like the American Academy of Appellate Lawyers (AAAL) or awards and recognition in appellate law can indicate a lawyer’s expertise in this specialized area.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with an appeals lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Trial transcripts and court records: The lawyer will need a complete record of the original trial, including transcripts, motions, exhibits, and the final judgment or order.
  • Legal briefs from the trial: If any briefs or motions were filed during the trial, bring copies so the appeals lawyer can review the legal arguments that were presented.
  • Written decision or verdict: Bring the court’s written ruling, verdict, or decision so the lawyer can identify any potential errors or issues to raise on appeal.
  • Questions about the appeal process: Write down any questions you have about the appeal’s timeline, costs, and potential outcomes.
  • List of potential legal errors: If you believe specific mistakes were made during the trial (e.g., improper evidence, legal misinterpretations), provide a list of those issues.

Being well-prepared for your consultation allows the lawyer to assess your case more effectively and provide the best guidance on how to proceed with your appeal.
