Mr. Fenstermaker went above and beyond the call of duty in my appeal. When he uncovered withholding of exculpatory evidence (among other things), he could have pretended he never saw it like most lawyers. He told me about it, and went ahead to file the appropriate motions, which cost him many more hours than stipulated in the retainer. Needless to say, I lost my appeal due to the hideous corruption in Westchester County and the rubber stamping Court of Appeals. He's an absolute professional, and will work harder for you than anyone else I know. Unfortunately for me, just the polar opposite of my trial attorney.

I recently leased a car and got scammed by a dealership in Long island New York. Upon coming home i reviewed my paper work and noticed that it had been switched and the price was almost 10k of what i had agreed upon. i contacted them immediately and was told that although i was right that it was to late to make any corrections and i would just have to deal with. The scammers eventually stopped taking my calls. I knew i would have to retain a lawyer to be able to recoup any of my money. I reached out to a number of so called super lawyers and was most never even returned my calls and the ones that did all said the same thing. That Although i indeed got scammed my case was not worth there time. i was extremely upset frustrated beginning to think these scammers would get away with it. I refused to give up and continued my search and eventually came across David Kasell. Not only did David evaluate my case for free but agreed to take it on. Knowing my situation David agreed to work with me on his fees and we came to a very reasonable agreement. I submitted all my evidence and David assured me he would make things right. He kept in touch and was happy to answer any questions or concerns i had. To make a long story short not only did David get me a settlement check but he did so even faster than i expected. Apparently the dealership knew he meant business and wanted no parts of going to a trail. If it wasn't for David i would still be out thousands and the scamming dealership would likely have got away with ripping me off. I hope no one ever finds themselves in a similar situation but if you do the good news is David is only a phone call away. Cant say enough about how good and professional this man is, if only all lawyers were like him the world would be a better place. Id like to say Thanks David your efforts saved this hard working man being out thousands and unnecessary hardship. If it wasn't for you its likely these scammers/frauds would have got away with it. I hired David Kasell to represent me on a lemon law case with a difficult manufacturer, after I had completed the arbitration process and it was found in my favor. I purchased a car from the dealership online. The car looked great in the pictures and the salesman said there was no issues with the car. When the car was delivered 14 days later and was able to look at it in person there was damage to the car / problems not identified by the car dealer to me. The estimated damage to repair was 15k. The dealership would not answer my calls and put me on hold until it hung up on me. Also, I did not receive title to the car so I couldn't register the car in my state. After 30 days of this going on I called Kasell law firm to get this taken care of. David took them to Federal court and was able to get me out of the car loan and have the car picked up by the dealership. If it wasn't for David Kasell I would have been stuck with the car and the repairs. He stayed on top of my case and provided updates. He is a very honest person and does what he says. I appreciate everything he did for me and highly recommend him if you are in a bad situation.

In my early years I heard many disturbing stories of how people lost a major part of their inheritance to City, State and Federal tax, after their parents died without having lawful protection from the tax system, and the thought of seeking a protection crossed my mind many times. But I kept postponed it to next week, next month, or next year, and year after year until I became much older and one morning I woke up with a terrible thought of how foolish it would have been If anything happened to me and left my family without protection losing half of what really belongs to them.

I had a consultation with Richard Shapiro in which he explained, nit why he thought, but why I was wrong about how I chose to leave my estate to my beneficiaries.
Lawyers overall I’ve found as most of us have to be extremely dishonest greedy and not looking out for their client but their wallet.
When with the years of trust, estate and probate experience, to the point that on occasions I wrote our errata’s to pending petitions, guided me as to what I know is best for my beneficiaries, Mr Shapiro disagreed however was unable to provide a valid argument as to why his thought on how I should distribute my estate was wrong and even made the ludacris assumption I should put monies for adults in their 40s 50s and 60s into a trust that would not be immediately distributed at the time of my death.
My decision is to have my beneficiaries be saved from dealing with greedy corrupt lawyers, power crazed trustees and executors and very wisely instead leave monies to beneficiaries of accounts which they would then immediately without lawyers or other corrupt interference , get their money.
Okay, so Mr Shapiro said you’re not protected legally then and a wife could then somehow get that money .
Instead his brilliant idea appears to be to treat adults like under age children and have them subject to trustees , trustee fees and the power crazed people giving them money like an allowance.
I’m apparently unable to make the decision it appears he thinks to allow my beneficiaries, all who are adults, to have use and enjoy the money I leave them without being subject in their 40s and 50s and 60s to being lorded over by a trustee..of course which gets a nice fee, plus a trust company also taking more money in fees.
Be wise and find someone ..speak to several lawyers when planning your estate and remember your decisions will affect your beneficiaries. They can be subject to years of litigation to even get their portion If the trustee fails their fiduciary duties and without spending months or years and endless amounts of lawyer fees. Theres nothing they can do about it.
I think Richard was not concerned about me, my beneficiaries, what’s best for us and the money and assets but it seems to me in my humble opinion he’s more interested in making the estate pay the most possible , and continue making it pay year after years in a trust for successful adults, including 2 attorneys, one pediatric surgeon, as well as other mature adults, who do not need babysitters and to have to go to strangers to get their money in dribbles from a stranger.
Honestly it’s so disheartening time after time to see how corrupt people are when money is involved. Do your research, leaving bank or brokerage accounts to beneficiaries is easiest quickest and the way to avoid any greedy or disturbed lawyers or executors or trustees to harm your loved ones.
