I cannot speak more highly of the counsel that Brian Dowling gave us while defending our worker's compensation case. We knew early on that we got the right person to guide us through this trying time because he could easily explain the law in non-technical language and, more importantly, could quickly offer several strategies to our defense. Brian's prompt response to all our seemingly endless inquiries calmed our nerves and his tenacious personality uncovered all avenues for our defense. Brian has many years of proven expertise and experience as a Board Certified Worker's Compensation Attorney, which he clearly demonstrated as he successfully defended our case. Thank You so much, Brian!

First I must say that if you need a workers comp attorney, Jeffrey Friedman is the best you’ll ever find. I thought my case would be difficult being that I was injured in the state of Florida, then hired a prior attorney who later said that they could not do anything else for me. My worker’s comp checks stopped and left me unable to pay any bills and I remained injured. Due to losing everything, I had to move back to my birth state of Hawaii. I later found Attorney Jeffrey Friedman, a Florida Worker’s Comp Attorney, on Avvo, a site where you can find an attorney. He was able to take my case due to I got hurt on my job in Florida. He made it so simple for me to communicate via email, phone call or text. He and his staff was always available and not put on hold. He has exceptional experiences on Worker’s Compensation Claims. He’s has lots of experience & knowledge on both sides. As a worker’s comp insurance adjustor, then later serving injured employees with their lost wages and medical care. Since hiring Jeffrey Friedman, my stressors have decreased a lot. He not only was advocating for me as an injured employee, but he was truthful, caring, has great morals & values and will fight for you until your case settles. His assistant was also wonderful. He fought for what was right! He made sure that I received my medical care in a timely manner and my lost wages were retroactive 3 months after hiring him and it continued monthly until I settled my case. He got me more than I could ever dreamed of. Thank you so much for representing me and I am so totally blessed and grateful to you. Mahalo & much Aloha’s!

Mr. Friedman handled my workers compensation cases during the past five years. He represented me against Publix and always had my best interest at heart. He was there to handle things for me when I was incapable to make sense of everything. He went over and above to help me after my husband died in matters unrelated to my workers comp case, and I trust Mr. Friedman beyond measure. He dealt with Social Security, and all the red tape. I now receive disability pmts each month and he is currently is appealing my date of disability. You will not find anyone who sincerely is invested personally in their client. His professionalism and ethics are A-1! I will not hesitate to recommend Mr. Freidman to any individual who would benefit from the level of service Mr. Friedman and his paralegal Laurel provide to their clients.

I had an issue that involved a work-related injury that was not being taken care of properly. This was very disturbing as I needed to get my health checked but I also needed a job and to be treated fairly. I needed to seek out a lawyer and I did a little search on the internet and found Barbaslaw.com and the first lawyer I was referred to was Atty. Hovsepian, which was heaven sent. He was very professional right at the start and all the way through the whole ordeal. I had never been through any court proceeding before; therefore, I was naturally very nervous. However, Atty. Hovsepian and his staff treated me with respect, courteous, dignity, and always made me feel like a person instead of just another client of his. He always took the time to explain things to me, sometimes more than once, to make sure I understood all things going on. With the help of God and of course Atty. Hovsepian my case was resolved. It is because of Atty. Hovsepian that I started to feel like a human again and I could move on from this whole tribulation. I would highly recommend Atty. Hovsepian to anyone that is seeking any legal advice in any work or any discrimination areas. He is very knowledgeable of the laws and will carefully study your case and will tell you truthfully his professional opinion and guidance, but will always listen to your decisions.

I retained Steve Hovsepian to represent me in a "breach of employment contract". As with all legal issues, the process is often complicated and at times difficult for the plaintiff to understand. From the very first day we met, to the day the case was settled, his concern was always that I understood what was taking place. While Steve is a highly credentialed and seasoned attorney, his persona is one that exemplifies the very best qualities of a true professional. He is very humble and extremely empathetic. He is also one of the best communicators I have ever had the pleasure to work with, and that includes a large number of CEO's, CFO's, COO's etc. He is a partner in the firm of Barbas Nunez Sanders Butler & Hovsepian. Both as a lay consumer and as CEO of my company, I would endorse Steve and his fine firm for anyone that required the very "best of the best" , and wanted true peace of mind that their interests would be protected throughout every step of the legal process.

Over the past twenty-five years, Mr. Cohen has assisted me with two family law issues, a personal injury case, and a workers’ compensation inquiry. As counselor for the Orlando Police Benevolent Association I also had the opportunity to interact with Mr. Cohen professionally when he represented law enforcement officers with administrative and criminal issues. In personal and professional matters, I always found Mr. Cohen truly concerned with doing whatever was in his client’s best interest. His office staff has always been professional and assisted me with any issue brought to their attention. First thing first, I would like to thank my lawyer, Mr,Davis for his fine work on my case. As many of you probably already know, suing a insurance company is not as easy as u think, many insurance companies are prepared to give u the run around and or stall you out for as long as possible, which liberty mutual tried to do in my case, and I’ve had a couple lawyers in my time and none of them were as professional as Mr. Davis. He was persistent in his efforts to get my claim damages took care of along with my medical claim, which I would say was a tedious process to say the least. Hire Mr. Davis for criminal or personal injury cases, I can guarantee this him and his firm will give you a 110% percent effort to solving your case in a timely matter.

Very much the professional, Attorney Cruz, put me at ease the moment I walked into his office. As most people feel when they turn to an attorney to perform a task that we cannot do ourselves, I was completely defeated and had no idea of the types of documentation needed. Step by step, he led me through a rather difficult task and gave me the confidence I needed to complete all of the paperwork. He stayed "connected" and in less than 3 weeks the entire process was completed. In spite of the complete professional approach, I know he is a compassionate individual who intended to provide me with peace of mind. He listens!

Jeff and his staff are kind and knowledgeable. There is a strong appreciation and understanding from the staff at Jeffrey Bordulis' office as to how important and sensitive my case is. From day one I have felt appreciation and concern not just with my case, but also my well being. Jeff and his staff have performed with complete honesty and integrity about my case, and if ever I did not understand something or had a concern Jeff personally worked with me on it. It is rare to have a lawyer that truly believes in your case, but also genuinely loves what he does. I am so thankful that someone recommended Jeff to me. First let us thank Matthew for the work and professionalism he provided to us through our case. Additionally we came to experience Matthew in a personal way, he is passionate, professional and persistent. There was never a time in our case that he did not respond to our calls and emails with efficiency and timely updates. Matthew was very thorough and simplistic in how he walk us through the terminology and nuisances of our case. He did not provide us with a false hope, but constantly assured us he was working to meet our needs and in the benefit of our reuest. If he thought that a strategy was not wise he would suggest another means to accomplish our goal. Not only is Matthew an attorney but a true person at heart with character, ethics and morality. If you are looking for a exuberant, informed and passionate attorney, Matthew is the person you want on your side. Thank you again Matthew for your counsel and may your practice succeed in every way.

My lawyer, Dale Albright, was a wonderful attorney. When I made my first call to the office, they were all very helpful and willing to assist in my case. My first consultation they came to my house, which was great. Throughout the entire process, Dale, was always there to help and answer any questions. His response time was usually within 24 hours. I was even given personal contact information should I have needed to contact him after hours. I hope that I do not have to go through another case like this, but he would be whom I'd have to represent me. I would refer him to anyone who needs legal assistance as well.

I was originaly with ms. rodgruise partner, Tanya Mayes. When ms. mayes was called to duty in our military, she gladly step into her shoes and took my case. She was remarkable and so good. I had a tuff case to reunify with my child and she worked magic with the courts, my son and myself. she kept me focused and gave moral support. everyone but the judge was against this union and it all came out a win situation with my son who now resides with me in my home full time and no longer with the court system. I lived out of state, so getting back and forth to florida was hard for me, but through her help, and courts, we made prior arrangements so my attendence went as ordered. She has a para-legal named Patty who is a wonder in the office and keeps her looking good and her case load needing nothing except her voice in court. Together they make a fantastic team. I have loved having her work for me in my best interest and always had only the best for my defense needed. Always prepared for court and ready to go for the win. I reccomend Ms. Rodrigues for all your needs and services. She will get the job done

What a Workers’ Compensation Lawyer Can Do for You

A workers’ compensation lawyer specializes in helping employees who are injured or become ill as a result of their job to receive the benefits they are entitled to under workers' compensation laws. These lawyers represent injured workers in claims for medical benefits, wage replacement, and other compensation related to workplace injuries or illnesses. They also help when claims are denied, benefits are delayed, or disputes arise with the employer or the insurance company.

Whether you've been injured on the job, developed an occupational illness, or are dealing with a denied workers' compensation claim, a workers’ compensation lawyer can help you navigate the claims process and ensure you receive the full benefits you deserve.

When Should I Hire a Workers' Compensation Lawyer?

You should consider hiring a workers' compensation lawyer in several situations, especially when complications arise during the claims process or when your rights as an injured worker are being challenged. Some common reasons to hire a workers' compensation lawyer include:

  • Claim denial: If your workers' compensation claim has been denied, a lawyer can help you appeal the decision and represent you in hearings or litigation.
  • Inadequate benefits: If the insurance company offers you a settlement that doesn’t cover your medical expenses, lost wages, or other damages, a lawyer can negotiate on your behalf for a fair amount.
  • Delay in receiving benefits: If your benefits are being delayed, a lawyer can help expedite the process to ensure you receive timely compensation.
  • Permanent disability: If your injury leads to permanent disability (partial or total), a lawyer can help you navigate the more complex process of securing long-term benefits.
  • Retaliation by employer: If your employer retaliates against you for filing a workers' compensation claim (e.g., by firing or demoting you), a lawyer can protect your rights and pursue legal action.
  • Third-party liability: If a third party (e.g., a contractor or equipment manufacturer) was responsible for your injury, a lawyer can help you pursue additional compensation through a personal injury lawsuit.
  • Pre-existing conditions: If your employer or the insurance company claims that your injury is related to a pre-existing condition, a lawyer can help you present evidence showing that the injury was work-related.

Hiring a lawyer early in the process can prevent delays, avoid mistakes, and ensure you receive all the benefits you’re entitled to under workers' compensation law.

What Does a Workers' Compensation Lawyer Do?

A workers' compensation lawyer provides a range of legal services to injured workers, ensuring that they receive the benefits they deserve. Their tasks often include:

  • Filing claims: Helping injured workers prepare and file their workers' compensation claims to ensure accuracy and timeliness.
  • Appealing denied claims: Representing workers whose claims have been denied and guiding them through the appeals process, including hearings and court appearances.
  • Negotiating settlements: Negotiating with insurance companies to secure fair compensation for medical expenses, lost wages, and other damages.
  • Handling disputes: Resolving disputes between the injured worker, the employer, and the insurance company regarding the amount of compensation or the nature of the injury.
  • Coordinating medical evidence: Gathering and presenting medical records, expert testimony, and other evidence to support the workers' compensation claim.
  • Advocating for benefits: Ensuring that injured workers receive all the benefits they’re entitled to, including temporary or permanent disability benefits, vocational rehabilitation, and medical treatment.
  • Filing third-party lawsuits: In cases where a third party is responsible for the injury, a workers' compensation lawyer may also pursue a personal injury lawsuit to recover additional damages.

How Are Workers’ Compensation Lawyers Paid?

Workers' compensation lawyers typically charge a contingency fee, meaning they only get paid if they successfully recover benefits for you. This fee is usually a percentage of the benefits awarded, and the specific percentage is often regulated by state law. Here's how it generally works:

  • Contingency fee: The lawyer's fee is typically between 15% and 25% of the total benefits awarded to you. You don’t have to pay any upfront legal fees, and the lawyer’s fee comes out of the settlement or benefit award.
  • No fee if no recovery: If the lawyer doesn’t recover any benefits for you, you generally don’t have to pay for their services.
  • State regulations on fees: Many states cap the percentage that workers' compensation lawyers can charge, and some states require the fee to be approved by the workers' compensation board or judge.

Be sure to discuss the fee structure with your lawyer during the initial consultation to understand how much you will owe if your case is successful.

How Much Does a Workers' Compensation Lawyer Cost?

The cost of hiring a workers' compensation lawyer typically depends on the contingency fee arrangement, meaning the lawyer’s fee will be a percentage of the benefits you receive. General cost estimates include:

  • Contingency fees: Most workers' compensation lawyers charge between 15% and 25% of the total settlement or benefits awarded. For example, if you receive $50,000 in benefits, the lawyer’s fee would range from $7,500 to $12,500.
  • State regulations: Some states limit the percentage that workers' compensation lawyers can charge. In these cases, the fee is usually capped, often at 20% to 25%, depending on state law.
  • Additional costs: Some lawyers may charge for out-of-pocket expenses, such as filing fees, medical records retrieval, and expert witness testimony, though these costs are typically deducted from the settlement after the case is won.

You should always ask for a clear explanation of fees and potential additional costs during your consultation so you understand the financial arrangement.

Top Questions to Ask a Workers' Compensation Lawyer

Before hiring a workers' compensation lawyer, it’s important to ask the right questions to ensure they are the best fit for your case. Key questions to ask include:

  1. What experience do you have with workers' compensation cases?
Ensure the lawyer has experience handling cases similar to yours, especially if your injury is severe or the case involves disputes.
  2. How do you charge for your services?
Clarify whether the lawyer charges a contingency fee and whether there are any additional costs you need to be aware of.
  3. What is the likelihood of success in my case?
Ask for an honest assessment of your case, including the potential challenges and outcomes.
  4. Have you handled cases like mine before?
Find out if the lawyer has experience dealing with cases involving similar injuries or disputes, such as denied claims or permanent disability.
  5. How long will the process take?
While it’s difficult to predict an exact timeline, the lawyer should be able to provide a general estimate based on their experience with similar cases.
  6. Will you personally handle my case?
In larger firms, junior attorneys or paralegals may handle parts of your case. Make sure you know who will be working on your claim.

How to Check the Credibility of a Workers' Compensation Lawyer

To ensure you are hiring a reputable workers' compensation lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no disciplinary actions against them.
  • Look for workers' compensation experience: Review the lawyer’s website or professional profile to ensure they specialize in workers' compensation law and have successfully handled cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s expertise and service.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their experience in workers' compensation cases.
  • Check for professional affiliations: Membership in organizations like the Workers' Injury Law & Advocacy Group (WILG) or local bar association committees on workers' compensation can indicate the lawyer’s commitment to this area of law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a workers' compensation lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Accident report or incident documentation: Bring any documentation related to your workplace injury or illness, including accident reports or notifications to your employer.
  • Medical records: Provide copies of medical records, including treatment notes, doctor’s reports, and any information related to your injury or condition.
  • Employer correspondence: Bring any letters, emails, or forms related to your claim from your employer or the workers' compensation insurance company.
  • Wage and benefits information: Provide information on your wages, benefits, and any lost income due to the injury.
  • List of questions: Prepare questions about your case, the process, costs, and what to expect moving forward.
  • Timeline of events: Prepare a timeline of the incident, your injury, and any medical treatment or communication with your employer and the insurance company.

Being well-prepared for your consultation will allow the lawyer to assess your case more effectively and provide you with the best possible legal advice.
