I was put in touch with Monte Willis by a family member who noticed I was trying to sort through and handle everything that comes along with dealing with insurance companies. I was hit by a car that had run a stop sign while I was on my bike, and Monte was fantastic in helping me any way he could in this case that ended up being open for well over a year. He stepped in and took over everything, and I was especially struck by his ability to read each situation and recognizing when I needed a little extra guidance and information when making the crucial decisions. He paid closed attention to each concern I expressed, never making me feel belittled or uninformed. He went the extra mile, and I would not hesitate to recommend him to anyone who is in need of a personal injury attorney.

After my accident I did not know to do. I was a busy college student who could not afford to spend hours on the phone talking with the insurance company. Monte Willis stepped in and took over talking with them for me. He also answered any questions I had about what was going on with my claim. He helped me understand what was happening, explained the steps and the process. He asked how I was doing at the beginning of every conversation. He showed genuine concern about my health and getting me back to where I was before the accident. If I ever need another lawyer again, I am going to go to Mr. Willis.

I was in a hit and run accident. My insurance company is known for paying out very little and most times having to be sued instead of settling. I did not have "PIP" but did have uninsured motorist. I was informed by the insurance company when I signed up that I really did not need PIP because I had medical included in my coverage. Turned out after my accident it really was not much due to the fact that I have permanent damage and will be on medication for the rest of my life and require more treatments. Mike Jacobs fought for me. My payout was the "MAXIMUM" amount of coverage I had for my medical and in addition a payout of almost $14,000.00 to fix my automobile "without totaling my car". This was all settled out of court. I'm so grateful Mike took my case. He was always so respectful and a pleasure to work with. I highly recommend him.

Recently my wife and I had occcasion to need an auto accident lawyer. We are very picky about who does legal work for us and how it is done. Mike has not disapppointed us. He and his team have been efficient, timely, and helpful. And even though ours is not the biggest case in the world, Mike has taken the time to explain things and to apply his strategic thinking and skill to our case. Highly recommended !!!

Drew Lombardi was my attorney for a personal injury case after an accident. Until I started working with him, I was lost in the car and health insurance systems and wasn’t sure how to move forward. Fortunately, Drew provided the support I needed with exceptional communication skills. He kept me updated on my case’s progress, welcomed any and all questions, and was sure to keep my goals in mind while conducting the work. I truly felt like he took the time and consideration to fight for me, and I was grateful to be able to rely on his good nature, professionalism, and expertise to help me through my case.

B. Fulton assisted in one of the most traumatic times a family can go through. Brad went above and beyond for our family and son. We consider his expertise and attention to detail the core definition of dedicated counsel. 15 yrs later we are still getting advice and would always be our #1 recommendation. Thank you Brad Fulton for going above your call of duty in our time of need and being more of a family friend than legal counsel.

I know Eric handles a lot of “big” cases. He represented me in boating DUI, which was a “big” case to me. I had refused the breath test – which is a $2,000,00 fine. He beat that. The DUI charge itself he was able to get reduced to a non-criminal traffic ticket. He is a competitive person and gave my case the same attention as he does the higher profile cases.

I have know C. Anthony for almost 30 years. I was in professional school when he was in Law School. I have always been impressed with Tony's honesty and integrity. He has been my attorney for 25+ years and I have had outstanding service and attention. Tony has the rare gift of humor that dovetails well with a highly professional presentation. I would highly recommend him to anyone who is looking for an honest, caring, spirited, "real" family man. He has unique experience in several aspects of the law and has represented me in the health professions admirably. I view Mr. Davis as one of my closest and respected friends as well as my attorney. 5 stars...a true "10".

Patricia Anderson represented our family through our darkest years. A few years ago our son, expecting his first child, was killed by an impaired untrained driver who had not been drug tested at the collision. Ms. Anderson supported us every step of the way, kept in contact as needed and reassured us all along the path. We felt safe in both her hands and her partners. She is also an extremely bright and smart lawyer. She thinks problems through in s calm and organized way before making decision. She is also just plain nice: she is a good person with great values. The harm to our family can never be fixed but she assured the future security of our granddaughter and daughter-in-law. I highly recommend Ms. Anderson.

I engaged Mr. Kraft as my attorney in 2014 after another car collided into me at a high speed on the freeway. My car was wrecked, I sustained several injuries and I didn't know where to go to get help. After discussing the incident with Mr. Kraft, what needed to be done became much more clear. He handled all correspondence with the at fault party's insurance & made the process very straightforward. Working with Mr. Kraft gave me peace of mind that I was going to be made whole after all was said and done. I now have the care that I need to get by and he was able to negotiate a settlement that I am very pleased with. I would not hesitate to recommend Mr. Kraft to anybody who sustains serious injury and needs to make a claim. I am forever grateful for the successful results that he provided.

I have been involved in a few different situations that required the help of an attorney over the last 10 years. It can be a very stressful and scary experience. Working with Ms. Tallon Reynolds was the best experience I have had to date. She constantly kept me informed regarding my suite and gave me more than enough time to gather info she needed from me. She explained things so I could fully understand them and was ALWAYS available for a conversation to calm my nerves. Ms. Tallon Reynolds was thorough and very professional. She got the results my family and I needed and made it the best experience it could be! I would highly reccomend her to all and in the unfortunate situation I find myself needing representation in the future, I would call on her without question!

“The only thing necessary for the triumph of evil is for good men to do nothing.” Edmund Burke As I put pen to paper I realize I have no words to do justice to the battle waged on my behalf by Rick and his dedicated team of justice fighters. I am simply not capable of putting into words the gratitude and respect I have for them as professionals, people and warriors. Warriors must rise to the top to defend those incapable of defending themselves. Not all battles are fought on the battle field. Some are fought in the court of law before a judge and jury, fought with the sword of truth and the rule of law. As we all know there is good and evil in the world. Evil comes in all shapes, colors and sizes and often disguises itself as good. As long as we go forward with the truth and there are honorable warriors to fight on our behalf, as you and your team have proven to be, the truth will prevail no matter how powerful and deceptive the opponent may be. The team of men and women led by Rick Friedman are dedicated to doing the right thing. Why? Because that’s what men and women of honor do. As Rick and his team prosecuted the truth on our behalf, the financial resources afforded my wife and I by the jury’s verdict has allowed us to better focus on adapting and living with the struggles of long term care associated with my traumatic brain injury. I want to thank Rick for taking the time to remove his attorney hat and speak to me as a friend about how to best move forward in rebuilding my life with a brain injury. Rick said “That if I only focus on what I can no longer do I would become a bitter and miserable human being. Instead figure out and focus on what you can still do and you will have the ability to live a fulfilling life.” As I continue to figure out and focus on what I can do to contribute I feel it’s important to anyone with a brain injury to hear this as I truly believe I would not be here today had I not taken and implemented Rick’s advice. Thank you again for all you and your team have done for my wife and I. God bless you all, Brad

Alex Ackel represented me in a personal injury case after I was seriously injured in a car accident. I found his practice through the recommendation of a friend, and they did not lead me astray. When I started the process I had no prior experience with personal injury law. Therefore, I appreciated that Alex set clear expectations about how the process would work and kept me informed throughout. His office staff were responsive and professional. Alex negotiated tirelessly on my behalf with both car insurance companies. I obviously wish I had not been hurt in the first place, but the experience working with Alex couldn't have gone more smoothly.

What a Wrongful Death Lawyer Can Do for You

A wrongful death lawyer specializes in representing families who have lost a loved one due to the negligent, reckless, or intentional actions of another person or entity. These lawyers help families seek compensation for the emotional and financial losses associated with the untimely death of a loved one, including medical bills, funeral expenses, lost income, loss of companionship, and pain and suffering. Wrongful death claims can arise from various situations, including car accidents, medical malpractice, workplace accidents, and criminal actions.

If you have lost a family member due to someone else’s wrongful actions, a wrongful death lawyer can help you navigate the legal process and pursue justice on behalf of your loved one.

When Should I Hire a Wrongful Death Lawyer?

You should consider hiring a wrongful death lawyer if a loved one has died as a result of someone else’s negligence, recklessness, or intentional harm. Some common reasons to hire a wrongful death lawyer include:

  • Car accidents: If a loved one was killed in a car, truck, or motorcycle accident caused by another driver’s negligence (e.g., reckless driving, DUI, or distracted driving), a lawyer can help you file a wrongful death claim.
  • Medical malpractice: If a loved one died due to medical negligence, such as a misdiagnosis, surgical error, or medication mistake, a wrongful death lawyer can help you pursue compensation from the healthcare provider.
  • Workplace accidents: If your loved one died in a workplace accident or due to unsafe working conditions, you may be entitled to compensation from the employer or third parties responsible for the unsafe conditions.
  • Defective products: If a defective product caused your loved one’s death, a lawyer can help you file a wrongful death claim against the manufacturer or distributor of the product.
  • Criminal actions: If your loved one was the victim of a criminal act, such as homicide or assault, a wrongful death lawyer can help you pursue a civil claim for damages, even if a criminal case is also ongoing.
  • Nursing home negligence: If an elderly loved one died due to neglect or abuse in a nursing home, a lawyer can help you hold the facility accountable for their wrongful actions.

Hiring a wrongful death lawyer soon after the incident ensures that important evidence is preserved and that you can meet any legal deadlines for filing a claim.

What Does a Wrongful Death Lawyer Do?

A wrongful death lawyer provides a wide range of services to help families navigate the legal complexities of a wrongful death claim and seek compensation for their losses. Their responsibilities often include:

  • Investigating the death: Conducting a thorough investigation of the circumstances leading to your loved one’s death, gathering evidence such as medical records, accident reports, and witness statements.
  • Establishing liability: Identifying who is legally responsible for your loved one’s death, whether it’s an individual, company, or government entity, and building a case showing how their negligence or wrongful actions caused the death.
  • Calculating damages: Helping you determine the full extent of your financial and emotional losses, including funeral expenses, medical bills, lost income, loss of companionship, and pain and suffering.
  • Filing a wrongful death claim: Preparing and filing the necessary legal documents to initiate a wrongful death lawsuit within the statute of limitations in your state.
  • Negotiating settlements: Working with the responsible party’s insurance company or legal team to negotiate a fair settlement for your losses.
  • Representing you in court: If a settlement cannot be reached, representing you in court by presenting evidence and making legal arguments to support your case.
  • Handling legal deadlines: Ensuring that all legal filings are completed within the deadlines set by your state’s statute of limitations for wrongful death cases.

How Are Wrongful Death Lawyers Paid?

Wrongful death lawyers typically work on a contingency fee basis, meaning they only get paid if they win or settle the case. Here’s how it generally works:

  • Contingency fee: The lawyer’s fee is usually a percentage of the total settlement or damages awarded, typically ranging from 25% to 40%. You won’t have to pay any upfront fees, and the lawyer only gets paid if they successfully recover compensation for you.
  • No fee if no recovery: If the lawyer does not win or settle your case, you generally won’t owe them any legal fees.
  • Case expenses: In addition to the contingency fee, you may also be responsible for reimbursing the lawyer for case-related expenses, such as court costs, expert witness fees, and investigation costs. These expenses are typically deducted from the settlement or award.

It’s essential to discuss the fee structure with your lawyer during the initial consultation to ensure you understand how much you will owe if your case is successful.

How Much Does a Wrongful Death Lawyer Cost?

The cost of hiring a wrongful death lawyer is usually based on a contingency fee structure, meaning you only pay if the lawyer recovers compensation for you. General cost estimates include:

  • Contingency fee percentage: Most wrongful death lawyers charge between 25% and 40% of the total settlement or court award. For example, if you receive a $500,000 settlement and the lawyer’s fee is 33%, the lawyer would receive $165,000, and you would keep the remaining $335,000.
  • Case expenses: In addition to the lawyer’s fee, expenses such as court costs, expert witness fees, and investigation costs may be deducted from the settlement or award. These expenses can range from $5,000 to $50,000 or more, depending on the complexity of the case.

Make sure to ask your lawyer for a clear explanation of their fees and case-related expenses before proceeding with your wrongful death claim.

Top Questions to Ask a Wrongful Death Lawyer

Before hiring a wrongful death lawyer, it’s important to ask the right questions to ensure they have the experience and resources to handle your case. Key questions to ask include:

  1. What experience do you have with wrongful death cases?
Ensure the lawyer has successfully handled cases similar to yours, whether it’s medical malpractice, car accidents, or workplace deaths.
  2. How do you charge for your services?
Clarify the lawyer’s contingency fee percentage and any additional costs, such as case expenses, that you may be responsible for.
  3. What is the likelihood of success in my case?
Ask the lawyer for an honest assessment of your case and any potential challenges that could affect the outcome.
  4. How long will the process take?
Wrongful death cases can take time to resolve, so ask how long the lawyer expects the process to last, from filing the claim to reaching a settlement or going to trial.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be managing your case and representing you in court.
  6. What types of damages can I recover?
Ask the lawyer to explain the types of compensation you may be entitled to, such as medical bills, funeral expenses, loss of income, and emotional suffering.

How to Check the Credibility of a Wrongful Death Lawyer

To ensure you are hiring a reputable wrongful death lawyer, take the following steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for wrongful death experience: Review the lawyer’s website or professional profile to ensure they specialize in wrongful death cases and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A reputable lawyer should be able to provide references from past clients who have worked with them on wrongful death cases.
  • Check for certifications or memberships: Membership in organizations like the American Association for Justice (AAJ) or local bar associations can indicate the lawyer’s dedication to wrongful death and personal injury law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a wrongful death lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Death certificate: Bring a copy of your loved one’s death certificate, as this is a key document in wrongful death cases.
  • Medical records: If applicable, bring your loved one’s medical records, autopsy reports, or any documentation of their medical care leading up to their death.
  • Accident or incident reports: If the wrongful death resulted from an accident, bring any police reports, accident reports, or workplace incident reports.
  • Financial records: Provide documentation of your loved one’s income, benefits, and financial contributions to the family to help calculate economic damages.
  • Correspondence: Bring any communication you’ve had with the responsible party, their insurance company, or legal representatives.
  • List of questions: Prepare a list of questions for the lawyer about the legal process, potential outcomes, and fees.
  • Timeline of events: Be ready to provide a clear timeline of the events leading up to and following your loved one’s death.

By preparing thoroughly for your consultation, you can help the lawyer assess your case more effectively and provide the best possible legal advice.
