If you're reading this, you are looking for a attorney. Such an endeavor is very stressful and you're likely in an extremely emotional state of mind. First, let me point out that even though lawyers take a oath, most are very crooked and just out for money. Once the money runs dry, their services do too. You are in need of someone that is honest and has your best interest at heart, willing to see things through to the end, not just throw in the towel when things get complicated. You are in need of someone that is knowledgeable, understanding, and dedicated. I can tell you that Emily Brooks meets these things, and they are very, very hard to find in today's society. I hired Emily in 2015 with a real estate issue where the other side had millions of dollars to spend on attorneys and corruption, and I have an extremely limited income. I had first used Northwest Justice Project (NWJ), but when they found out how complicated the case was due to the unethical conduct of the other side, they suggested I hire an attorney with more resources that can devote more time and energy to the case. Emily was fresh out of school and just opened her own office. Even considering how inexperienced she was, she regularly went up against attorneys with 30+ years of experience and had an impressive track record. As a matter of fact, she had to deal with over 4 of them all having over 30+ years experience in real estate law for our case alone! The other side kept filing frivolous motions, appeals, and any other delaying tactics throughout the entire 4-year battle (starting with NWJ), despite strong verbiage from judges on how fruitless such actions would be. Emily fought tirelessly and stayed focused on our case, always saying this was about justice and making things right. Because of our income, we only could afford to have Emily write us some letters initially, but when she saw the injustice, she fought the entire case at trial with minimal further financing from us. A lot of the work was also done by her paralegal, Jonathan, who also was despised at the unethical behavior of the other side, and took a considerable amount of time out of his own personal life to help fight this case. In the end, Emily won our case! Actually, she won on three separate occasions on three different angles the other side kept trying to pursue before the other side took things to an appeals court. Unfortunately, we did not retain Emily for the appeals case because we were not sure what to expect, but our appeals attorney (who also had 30+ years of experience) was able to keep the case from trial purely because of the excellent documentation and work Emily had done. Let me also point out that the appeals attorney didn't seem nearly as efficient or knowledgeable as Emily. We are so thankful for Emily for all she did for us and highly recommend her to anyone needing an attorney.

My wife and I rented a house in Ellensburg WA. for a year. Prior to leaving we made sure the house was spotless and looked better then when we arrived. After moving we found out the landlord, who was use to renting to college kids, tried to keep our deposit stating the house was not properly cleaned and had reported damage that we did not do. We really didn't care about the money so much but hated the idea of this person taking advantage of people who couldn't do anything about it. After a quick call to Gonzaga University's law department, I was referred to Emily Brooks from Brooks Plumb Law Firm. Within no time, and after sending off a well crafted letter to the landlord, she got us a 100% refund and compensation to pay legal fees. We were out nothing and the landlord learned an important lesson. Emily showed why she is in the profession she is in. We highly recommend her and very much thank her for the support she provided to our family.

Greg was extremely knowledgeable in bankruptcy law. Anytime I had a question he called me back the same day, even if it was a question he probably got a100 times. He is honest, polite, and friendly. Yes, I did use the word honest something you normally don't hear in the same sentence with attorney/lawyer. :)

As first time going through bankruptcy we were not sure what to expect from the process much less who to trust. Greg explained each step and all fees involved before we even hired him. During the process he was always quick answer our calls and kept us informed all along the way. Never made us feel bad just always there to answer our questions. He even sent us all the necessary info needed for what to do after the bankruptcy was finished. From the beginning he was ethical trustworthy and very competent. I would recommend him to anyone needing legal help!

Mr. Young was recommended to me by my partner as an advisor in a contract dispute I was filing. He was able to convey my thoughts in a cohesive, articulate manner and match them to Florida law. He focused my argument and edited out the nonessential material resulting in a much stronger platform. I hope to never need another civil attorney, but if I do, he will be the first one I call.

If you need an assertive, honest, and experienced attorney that will be as invested in your case as you are, look no further. I can say without a doubt that Drake Shunneson is the best attorney I have ever had the pleasure of working with and his service is second to none. In the courtroom he is confident, well prepared, and well versed in the case he is presenting to the Court. He is a well respected and well liked member of the McHenry and Lake County legal communities. We retained him for two separate cases and have no doubts when it comes to placing our trust in him to act with the best interest of our family in mind. I initially retained Mr. Shunneson to register a parenting plan in Illinois (my career moves me around a lot). This simple case quickly became very complex and high conflict because of an uncooperative respondent. When my case became exceptionally complicated, Drake accepted the challenge head on. He was flexible in his practice and not afraid to step out of his comfort zone to see our case through. Drake respects the fact that every case is unique and wants what is best for his clients. It is evident with the amount of time he devotes to his clients and their cases. (Just keep in mind that what is best and what you want may not always be the same thing, but he has a way of helping you understand why it is the best thing). Mr. Shunneson handled our cases with ease. He was very communicative throughout the process and we were always well informed of our options along the way. He was always very attentive and we never felt as though we were just another client to bill. For all of these reasons and many that are not listed, we will continue to retain Mr. Shunneson and this firm for all of our legal needs.

Our Son had two Title IX Complaints filed against him with the University of Maryland from another Student. As a Family we disagreed with the Complaint. We hired Ron and he assisted our family and represented us in the proceedings against him by the UMD Conduct Offices. The Charges filed were of a serious nature and could have lead to an expulsion from the College and would negatively effect his academic and professional career for his future. Ron planned and prepared a defense for us, prepared and filed several documents, and represented our Son in each of the investigations and hearings. His knowledge and additional interpretation of the Student Code of Conduct assisted us in having all of the charges dropped and it was determined there were no violations. We had felt our Son was treated unfairly in the investigation. Ron's diligence and pursuit of this matter along with his interpretation of the Student Conduct Rules resulted in a favorable outcome on our behalf. I would recommend Ron for any Legal Matters involved with the University of Maryland and other Legal issues needed to be resolved. His Expertise and Experience in Legal Matters provides an edge. My Family is forever grateful for his Services.

Mr. Depastina help me out so much! I couldn't be happier... I went through a hardship several years ago and was behind on my mortgage thousands and thousands of dollars I reached out for help from the bank and other lawyers and was turned down from the bank and about 3 different lawyers saying there was nothing that could be done to help me...I thought I was never going to get out of this nightmare. After 3 years of being depressed and not knowing weather I was going to keep the house I was referred to talk to Anthony. He gave me a lot of guidance and was very knowledgeable and knew exactly how to handle the situation. The long short of it I was approved for the modification program and all the late fees were waved and the principle balance was reduced I saved about $150,000 dollars and my mortgage went from $1800 a month to $1048. I cant thank Anthony Depastina enough I couldn't have done it without him. If anyone is in a similar situation or knows anyone that is please call Anthony you will not be disappointed!!!

OK, so I just bought a house in Homestead and during the closing the lawyers were talking about my "new" taxes. Yeah, that's cool, they aren't too crazy, but anyway, they were saying that this guy was hired by the city and he's crushin' all of these slime balls who haven't paid their taxes in like over 20 years!! They were joking that if I didn't pay some taxes that were owed that this "Sherriff Cowboy" would show up and make sure Yonkers got paid. So one of the lawyers went on the computer and did a search and he said that this guy has gotten MILLIONS $$$$$ of dollas from a whole bunch of people who haven't like EVER paid their taxes - in like over 20 years straight. So I say GO GET EM' Mr. C. I want our COPS to get paid and FIREMEN to come to my house if I need help and TEACHERS to keep teaching my kids . . . and so I don't have to pay ANY MORE MONEY cause of these slumlords not paying their taxes!!!

Our lawyer advised us that in the eyes of the law we had a weak case since we did not have written documents (it was a verbal agreement) We strongly expressed that although we realized the weakness in the case, we knew what the truth was and felt we wanted to go forward. Once the decision was made to proceed legally, she handled everything professionally and on a timely basis. Any and all of questions or concerns were addressed, even if it was something we didn't want to hear. We always knew where we stood, what was next and other options if things didn't go as we had hoped. To me, her belief in the case and making things right for my Dad meant the world to me. We were able to agree on a very nice settlement due to our lawyer knowing how to handle the case legally with the appropriate court motions and tactful conversations with the opposing lawyer. We avoided a long drawn out court battle because our attorney made it be known that we were not going away easily. It worked! Very pleased with the outcome of our case given the odds were stacked against us in the eyes of the law.

I don’t even know where to start. What I can say is hands down the most down to earth, caring person I’ve ever met in the field. He is straight to the point and even though he is busy he will always find a way. Mr. Von Roenn gets the job done and he is always about the client! I came to him about two issues that I had and even though the second issue he directed me to another person that got the job done ! If you need someone that is caring and will always be there when you need him I recommend him! Thanks Mr. Von Roenn for everything !

We had occasion to seek Attorney Peter Lawrence's opinion concerning our unfortunate need to declare bankruptcy and then seeking a Deed in Lieu for our home from a major bank—a bank that sought to confuse, delay and bully us. Although we were in a financial situation we would have never anticipated, Peter was kind, understanding and compassionate when explaining our options. We found him to be patient with us even when he had to re-explain aspects of the legal process we were confused about, especially with the Deed in Lieu negotiation. It seemed the bank's tactic was to send conflicting communications and it seemed that one department of the bank did not communicate with other parts, often time conflicting with previous communications and statements. Peter was able to put us at ease with his knowledge of the process and his assurance that there would a satisfactory outcome. His calm demeanor, his understanding of our embarrassment being in these difficult situation and his ability to not “talk over us”, but explain in language we could understand, made resolving our problems more endurable. We would not hesitate to refer friends and family to Attorney Lawrence!

I am writing to express my sincere gratitude to John Wilkins, Melody and Arlene and commend them for their extraordinary customer service! Thank you, thank you, thank you! I was very fortunate to meet the Coltrane & Wilkins team during my home buying process and they were very kind, helpful, patient and knowledgeable. I probably felt like a pen-pal to them at times with my emails and curious questions - and I was always treated like their #1 customer! During the closing, John Wilkins was very cordial, thorough and guided me through the process seamlessly - even giving me pointers to make future transactions smooth {like my county tax rate and utility paperwork}. I am truly grateful. Experiencing exceptional customer service is like seeing a rainbow - it rarely happens so it's extra amazing when it does! This firm deserves to be recognized for providing outstanding customer service. Thanks again to John and his team for making this such a smooth, easy and best-of-all: very happy and extremely stress-free process!!! You have a Coltrane & Wilkins cheerleader for life and I highly recommend you! ~ E & EG

What a Foreclosure Lawyer Can Do for You

A foreclosure lawyer specializes in helping homeowners navigate the legal complexities of foreclosure, working to protect their rights and potentially save their homes. Foreclosure lawyers assist homeowners facing foreclosure by negotiating with lenders, filing legal defenses, and representing them in court. They also help with loan modifications, short sales, and other alternatives to foreclosure. Whether you’re behind on mortgage payments or already in foreclosure proceedings, a lawyer can help you explore your legal options and work toward a solution.

If you’re at risk of losing your home, a foreclosure lawyer can provide guidance on how to stop or delay the foreclosure process and protect your financial future.

When Should I Hire a Foreclosure Lawyer?

You should consider hiring a foreclosure lawyer in several situations where you are facing financial difficulties with your mortgage. Common reasons to hire a lawyer include:

  • Facing foreclosure proceedings: If your lender has initiated foreclosure proceedings, a lawyer can help you file a legal defense and explore options for stopping or delaying the process.
  • Loan modification: If you want to modify the terms of your mortgage to make payments more manageable, a lawyer can help you negotiate with your lender and ensure that the modification complies with legal standards.
  • Challenging the foreclosure: If you believe your lender has violated foreclosure laws or the terms of your mortgage agreement, a lawyer can help you challenge the foreclosure in court.
  • Stopping a foreclosure sale: If your home is about to be sold at a foreclosure auction, a lawyer may be able to file for a temporary restraining order or injunction to halt the sale.
  • Short sale or deed in lieu of foreclosure: If you cannot afford to keep your home but want to avoid foreclosure, a lawyer can assist with arranging a short sale or a deed in lieu of foreclosure, where you voluntarily transfer ownership of the home to the lender to avoid foreclosure.
  • Filing for bankruptcy: If you’re unable to manage your mortgage debt and other financial obligations, a lawyer can advise whether filing for bankruptcy might stop foreclosure and help you restructure your debts.

Hiring a lawyer as soon as possible - especially when foreclosure is imminent - can provide you with more legal options to save your home or limit financial damages.

What Does a Foreclosure Lawyer Do?

A foreclosure lawyer provides a variety of legal services to homeowners facing foreclosure, working to protect their rights and help them avoid losing their homes. Their responsibilities often include:

  • Negotiating with lenders: A lawyer can negotiate with your lender to modify your mortgage or create a repayment plan, helping you avoid foreclosure by securing more favorable terms.
  • Filing a legal defense: If your lender is improperly foreclosing or has made errors in the foreclosure process, a lawyer can file a legal defense, challenging the foreclosure in court. Defenses may include violations of foreclosure laws, predatory lending practices, or failure to follow the terms of the mortgage.
  • Representing you in court: A lawyer can represent you in foreclosure proceedings, whether you are defending against the foreclosure, seeking more time to negotiate with the lender, or filing for bankruptcy.
  • Stopping or delaying foreclosure sales: If your home is scheduled for a foreclosure auction, a lawyer can help file a motion to stop or delay the sale, giving you time to explore other options.
  • Advising on bankruptcy: A foreclosure lawyer can assess whether filing for Chapter 7 or Chapter 13 bankruptcy would be beneficial, as bankruptcy can temporarily stop foreclosure and give you time to reorganize your finances.
  • Arranging short sales or deeds in lieu of foreclosure: A lawyer can help facilitate a short sale (selling the property for less than the mortgage balance) or a deed in lieu of foreclosure (transferring the property to the lender), which may allow you to avoid the foreclosure process.

How Are Foreclosure Lawyers Paid?

Foreclosure lawyers typically charge for their services based on the complexity of the case and the legal work involved. Common payment structures include:

  • Hourly rate: Many foreclosure lawyers charge by the hour, with rates typically ranging from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific legal services, such as negotiating a loan modification or filing a bankruptcy petition, some lawyers offer a flat fee. Flat fees can range from $1,500 to $5,000, depending on the scope of the work.
  • Retainer: In more complex foreclosure cases, especially those involving ongoing negotiations with lenders or court appearances, a lawyer may require a retainer. This is an upfront payment that is billed against as the lawyer works on your case.
  • Contingency fee (rare): In some rare cases, particularly when suing a lender for wrongful foreclosure, a lawyer may work on a contingency fee basis. This means they only get paid if they win the case or settle on your behalf.

It’s important to discuss fees and payment arrangements with your lawyer upfront, especially if you are facing financial difficulties.

How Much Does a Foreclosure Lawyer Cost?

The cost of hiring a foreclosure lawyer depends on the complexity of the case, the lawyer’s experience, and the amount of time required to resolve the issue. General cost estimates include:

  • Hourly rates: Foreclosure lawyers typically charge between $150 and $500 per hour. For example, a simple case with 10 hours of legal work at $300 per hour would cost $3,000.
  • Flat fees: For straightforward services such as filing for bankruptcy or negotiating a loan modification, flat fees typically range from $1,500 to $5,000, depending on the complexity of the work.
  • Retainers: In more complex or ongoing foreclosure cases, a lawyer may require a retainer ranging from $2,500 to $10,000, depending on the length of the case and the lawyer’s experience.

In addition to legal fees, you may also need to cover additional costs, such as court filing fees or expenses related to property appraisals.

Top Questions to Ask a Foreclosure Lawyer

Before hiring a foreclosure lawyer, it’s important to ask key questions to ensure they have the necessary experience and approach to help you. Key questions to ask include:

  1. What experience do you have with foreclosure cases?
Ensure the lawyer has experience handling foreclosure cases similar to yours and has successfully helped homeowners avoid foreclosure or negotiate better terms.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or requires a retainer, and ask for a detailed estimate of the total cost of their services.
  3. What are my options for stopping foreclosure?
Ask the lawyer to explain the different legal strategies available for stopping or delaying foreclosure, such as loan modifications, filing a legal defense, or bankruptcy.
  4. What is the likelihood of success in my case?
Ask the lawyer for an honest assessment of your case and the chances of successfully avoiding or delaying foreclosure.
  5. How long will the process take?
Foreclosure cases can vary in duration, so ask the lawyer how long they expect the process to take and what factors might affect the timeline.
  6. Will I need to go to court?
Ask whether your case is likely to settle out of court or if a trial may be necessary. If a trial is possible, ask what steps the lawyer will take to prepare.
  7. What steps can I take to protect my home?
Ask the lawyer for advice on steps you can take to protect your home, such as making partial payments, negotiating with your lender, or exploring foreclosure alternatives.

How to Check the Credibility of a Foreclosure Lawyer

To ensure you are hiring a reputable foreclosure lawyer, take the following steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice law and has no disciplinary actions against them.
  • Look for foreclosure experience: Review the lawyer’s website or professional profile to ensure they specialize in foreclosure law and have successfully handled cases similar to yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about their experience with the lawyer.
  • Ask for references: A reputable lawyer should be able to provide references from past clients who have worked with them on foreclosure matters.
  • Check for certifications or memberships: Look for lawyers who are members of organizations like the National Association of Consumer Advocates (NACA) or who have specialized certifications in real estate or foreclosure law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a foreclosure lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Mortgage documents: Bring a copy of your mortgage agreement, payment history, and any correspondence you’ve received from your lender, including foreclosure notices or demand letters.
  • Financial information: Provide information about your income, expenses, and debts, as this will help the lawyer assess your financial situation and determine the best legal strategy for your case.
  • Previous communications with your lender: If you’ve already tried to negotiate with your lender, bring any emails, letters, or records of phone calls that document these communications.
  • Court documents (if applicable): If foreclosure proceedings have already begun, bring any court documents related to the case.
  • Questions about your legal options: Prepare a list of questions about the foreclosure process, your options for avoiding foreclosure, and how the lawyer plans to help you.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and provide the best possible legal advice for protecting your home from foreclosure.
